Motion was made by Hub Nordgren, seconded by Andy Leitch and carried, preliminary to approve the/plat of Otter Tail Lake View Heights, revised 9/11/79, to be located in Section 29 -134 -39. Motion was made by Hub Nordgren, seconded by Andy Leitch and carried, to approve a preliminary plat of Indian Camp, to be located in Section 7 -134 -39, subject to approval by federal flood plain requirements. Motion was made by Andy Leitch, seconded by Hub Nordgren and carried, to approve change·. order G-:-3 on the Anderson Bros. contract for construction of the government services building in the City of Fergus Falls, with an increase of $1,018.63. Motion was made by John Snowberg, seconded by Sydney Nelson and carried, to approve the forgiveness of penalty on the payment of a delinquent 1977 tax by Gregory & Maurice A. Ness, granted because of an error in assessment. Motion was made by Hub Nordgren, seconded by Andy Leitch and carried, to refund John Walker an overpayment due to statement erroneously submitted by the auditor's office, in the amount of $51.60 on Lot 14, Block 2, Echo Ranch Riviera, 2nd Add'n belonging to another party. There being no further business, the Chairman adjourned the meeting until 9:30 a.m., Tuesday, December 4, 1979. The motion was seconded by Sydney Nelson but did not carry, with John Snowberg, Andy Leitch and Bert Hovland voting "no". Motion was made by Andy Leitch to accept the low bids of Sterling Excavating, Fergus Falls, MN in the amount of $34,590.00 on S.A.P. 56-599-36 and $34,300.00 on S.A.P. 56-599-34; and the low bids of Landwehr Heavy Moving, Inc., St. Cloud ,MN of $43,158.00 on S.A.P. 56-599-35 and $30,379.00 on S.A.P. 56-599-37, less a $500.00 discount. The motion was seconded by JohnSnowberg and carried with Sydney Nelson and Hub Nordgren voting "no". Douglas K. Wise, Community Development Director for the City of Fergus Falls, appeared before the Board relative to proposed construction of a soft- ball complex at DeLagoon Park. Motion was made by John Snowberg, seconded by Bert Hovland and carried, to approve said construction and the County Auditor was authorized to send a letter to the State Planning 1gency in affirmation. Motion was made by John Snowberg, seconded by Hub Nordgren and carried, to approve the 1980 dues to the Association of Minnesota Counties inthe amount of $5,610.00 and authorized payment of same. · Motion was made· by Bert Hovland, seconded by Andy Leitch and carried, to appropriate the sum of $400.00 to the Minnesota Red River Valley Development Ass'n for the year 1980. Motion was made by Bert Hovland, seconded by Andy Leitch and carried, to allow Eddie Velo permission to purchase and replace a tile on Ditch #56, Trondhjem Township and charge same to said ditch. Upon motion made by Andy Leitch, _seconded by Hub Nordgren and carried, . . . the County Auditor wasauthorized to advertise for bids 'for half section maps, to be received until 1:00 p.m., W~dnesday,,J~n~ary 9, 1980:· Upon motion made J:Sy 'John.Snowberg, seconded by Bert Hovland and car- ried, the following resolution was adopted: RESOLVED by the Board of County Commissioners ,of Otter Tail County Minnesota, that WHEREAS the County has previously designated Friberg Avenue within the City of Fergus Falls as a Courity s.tate Aid Highway, and WHEREAS the City of Fergus Falls desires, in 1980, to award a contract for relocation and construction of that part of Friberg Avenue lying between Cecil Avenue and Cherry Avenue, and WHEREAS it is deemed to the best interest of all parties that the duties and responsibility of both the City of Fergus Falls and the County should be clearly defined, NOW, THEREFORE, BE IT RESOLVED the.County Board authorizes the Chairman of the Board and the County Auditor execute agreements on behalf of Otter Tail County, BE IT FURTHER RESOLVED, the City of Fergus Falls will furnish all engineering, supervision and other administrative expense incidental to this con- struction and the County will pay out of funds provided for that purpose all costs of grading, base and bimunious work for the full width of the street, exclusive of curb and gutter; the City of Fergus Falls will pay all construction costs for right- of-way, curb and gutter, sewer, storm sewer, catch basins, or other public utilities. The width of the street built under this agreement shall be fifty (50) feet. The City of Fergus Falls will install water mains, sewer mains and all house connections for both water and sewer to a point back of the curb line before grading shall be done. ATTEST: 0 Clerk Motion was made by John Snowberg, seconded by Andy Leitch and ca~ried, to place all delinquent 1979 personal property apd mobile home taxes into ju_dgment, and the followingreport of the County Board of the County of Otter Tail, State of Min- nesota, of uncollected personal property taxes for the year 1979 is presented: Fergus Falls, Minnesota, December 18, 1979 BE IT KNOWN, That the County Board of Otter Tail County Minnesota did meet in session on the 18th day of December, 1979, that at said session the County Treasurer of said County delivered to said Board the list of uncollected personal property taxes for the year 1979, together with his certificate thereon as required by law; and that at said session the said Board did duly consider said list of uncollected taxes, and did cancel suchtaxea as they are satisfied cannot be collected. Minnesota, in ·the·amount of $9,505.44, and WHEREAS the above contract has-'now beeri completed to the satis- faction of the County Board at a total cost of $9,244.55 a decrease of $260.89 due to deduction of 1.46 miles of mo~ing on CSAH #62 and $140.00 for liquidated damages, NOW, THEREFORE, BE IT RESOLVED the County Auditor is hereby authorized and directed to issue a warrant in the amount of $798.46 payable to Thomas Benson, Henning, MN as final payment for this work. Motion was made by John Snowberg, seconded by Andy Leitch and carried, to inter into a contract with Xerox Corp. for a new duplicating machine for the office of the Clerk of District Court, at a co.st of $119 .17 per month. Motion was made by John Snowberg, seconded by Andy Leitch and carried, authorizing the Chairman of the Board to sign a purchase agreement with Domtar Ind., Inc., Sifto Salt Division for the purchase of salt at $34.58 per ton delivered, for use by the highway department .. Motion was made by Andy Leitch to sell cutting edges to political subdivisions as a community service. The motion died for lack of a second. ',, WEDNESDAY's SESSION Pursuant to adjournment· the Board of County Commissioners of Otter Tail County Minnesota met at 9:30 a.m., Wednesday, December 5, 1979, all members present. Representatives of the Sheriff's A.ssociation appeared before the Board with requests for 1980. After considerable discussion, motion was made by John Snowberg, seconded by Hub Nordgren and carried, withdrawing the previous offer of an 8% increase in salaries for the year 1980. Motion was made by Andy Leitch, seconded by, John Snowberg and carried, authorizing the Chairman of the Board to execute agreements on behalf of Otter Tail County for application of grant funds for the purchase of additional land for Phelps Mill Park. Motion was made by Andy Leitch, seconded by Hub Nordgren and carried, to approve payment of $150.00 to Erwin C. Amundson, Alexandria~ MN for appraisal of property negotiated for purchase at Phelps Mill Park. Representatives of the highway department AFL-CIO union appeared be- for the Board with proposals for the year 1980. The Board submitted a counter pro- posal for consideration by the union. No formal action taken. Representatives from the City of Fergus Falls appeared before the Board relative to a proposed by-pass of State Highway #210. No action taken. Upon motion made by John Snowberg, seconded by Andy Leitch and carried, with Hub Nordgren voting "no", the following resolutions pertaining to bridge replacements were adopted: RESOLUTION WHEREAS,-the County of Otter Tail has applied to the Commissioner of Transportation for a grant from the Minnesota State Transportation Fund for the reconstruction of Township Bridge No. 95196 over Oak Creek, and; WHEREAS, .the application_ for_ the grant has been reviewed by the West Central Regional Development Commission, and; WHEREAS, the .amount of the grant has been determined to be $27,085.26 by reason of the lowest responsible bid.
