Pursuant to adjournment, the Board of County Commissioners
Otter Tail County Minnesota met at 1:00 p.m., Tuesday, September 18, 1979,
members present.

The Board, having previously .advertised for bids to be received ·
for concrete arch culverts, S.A.P. 56-599-26~ proceeded to open bids which were
found to be as follows:
Landwehr Heavy Moving, Inc., St. Cloud, MN
Raedniecki & Jensen Const. Co., Inc., Oklee, MN
Ackling Construct'on Co., Perham, MN
Riley Bros., Morris, MN

After considerat'pn, motion was made by Sydney Nelson, · seconded by
John Snowberg·and carried,·to accept the bid of Landwehr Heavy Moving, Inc, Saint
Qoud, Minnesota, in the amount of $57,739.00, it beingthe lowest bid.
Motion was made by Hub Nor_dgren, seconded by Bert Hovland and car-
ried, to approve the application of E. L. Colman, for sp~cial use permit to construct
public road for residential development in Section 7 of Otter Tail Township, subject
to conditional requirements.
Motion was made by Sydney Nelson, seconded by John Snowberg and
carried, to approve the application of Hartman Properties & Donald D. Busker for
special use permit to construct road for ·proposed subdivision, subject to condi-
tional requirements.
Motion was made ·.I!Y -Andy: Lei tc~, .seconded by Hub Nordgren and carried,
to approve an application of Walter Schmidt for special use permit to ~perate a com-
bination body shop & marine business, repairing of boats, motors andcars on Shady Bay
Resort in Sverdrup Township.
Motion was made by -Bert Hovland, seconded by John Snowberg and carried,
to approve a preliminary plat of Oak View Heights, to be located in Section 29 -133 -
42.
Motion was made. by Hub' Nor_dgren, seconded by Andy Leitch and
carried, to approve the preliminary plat of Greenwood. Resort, located in Sec-
tion 29 -134 -39.
Motion was made by Bert Hovland, seconded by John Snwoberg and car-
ried, to approve a preliminary plat of Preston's West Acres, to be located in
Section 14 -134 -43.
Motion was made by Sydney Nelson, seconded by Andy Leitch and car-
ried, to approve a preliminary plat of. Oak Ridge E_s_tates, 1st Add' n, to be located
in Section 10 -137 -40.
Motion was made by John Snowbe!g, se·corided by Bert Hovland and car-
ried, Andy· Leitch voti_ng "no", to table action on the preliminary plat of Nebraska
Beach, 1st Add'n, Hobart Township, for inspection by Commissioner Nelson.
Motion was made by Sydney Nelson, s'ecbnded by Bert Hovland and car-
ried, to approve a preliminary plat of Art's North Shore, 2nd Add'n, to be located
on Marian Lake in Section 5 -135 -39.
The Board, having previously advertised for bids to be received for
the sale of certain property owned by the County of Otter Tail located in Block 3
of the Townsite of Carlisle, proceeded to open bids which we.re found to be as fol-
lows:
Roger Grunewald, CArlisle, MN $30.00
After consideration, motion was made by Bert Hovland, seconded by
John Snowberg and carried, to accept the bid of Roger Grunewald, Carlisle, MN in
the.amount of $30.00, it bei_ng the only bid.
The matter ofthe bids onthe construction of the Crystal-Lida Sanitary
Sewer system was bro_ught up for final action. Upon the re~ommendation of the engineer
motion was made by Bert Hovland, seconded by John Snowbe!g and carried, to reject all
b_ids received.
Motion was made by Andy Lei~ch, seconded by John Snowberg and carried,
to retain the firm of Houston Engineering, Fargo, North Dakota as consultants in con-
nection with CountyDitch #37.

Upon motion made by.Sydney Nelson, seconded by Hub .Nordgrenand
carried, the followi_ng resolution was adopted:

RESOLUTlON
WHEREAS, the County of Otter Tail has applied to the Commis-
sioner of Transporta_tion for a grant from the Minnesota State Trans-
portation Fund for the reconstruction.of Township Bridge No. 95168
over the. Red Eye R,iver, and; ·
WHEREAS, the application for the grant has been reviewed by
the West Central Regional Development Commission, and;
WHEREAS, the amount of the grant has been determined to be
$54i824t0Q by reason of the lowest responsible bid.

NOW·, THEREFORE, BE IT-RESOLVED, that the County of Otter Tail
does hereby affirm that any cost.of the bridge in excess· of the grant·
wili be appropriated from funds·available to the County of Otter Tail,
an4 that any grant monies appropriated for the bridge but not required,
based on the final estimate, shall be returned to the Minnesota State
Transportation.Fund.

Upon motion mad~ by John Snowbe_rg, seconded by Hub Nordgren and
carried, the followi_ng resolution was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail
.County Minnesota, that
WHEREAS,.Minn. Stat. 645.44_ grants authority to the Board of
Commissioners to· name the Friday directly. followi:ng Thank_sgivi_ng Day as a Holiday
in li~ of the Columbus Day Holiday, the second Monday in_. October,
NOW, THEREFORE, BE IT RESOLVED, the Friday following Thank_sgi ving
Day shall be established as·a Holiday inthe County of OtterTail and the Court
House and all County Offices shall remain closed for public business on said day,
and
BE IT FURTHER RESOLVED, the second Monday in October, previously
observed as Columbus Day shall no lo_nger be considered a Holiday and the Court
House and all County Offices shall remain open for public business on said day· •.

RESOLVED by the Board of County.Commissioners of Ot=ter Tail County
Minnesota, that
WHEREAS, in accordance with a Procedural Agreement between the Min-
nesota Department of Natural Resources and the U.S. Fish and-Wildlife Service,
dated May 23, 1962, certification by the County Board-of Commissioners for acqui-
sition of lands by the U.S. Fish and Wildlife Service is requested, and
WHEREAS, representatives of the U. •S. Fish and Wildlife Service
have met with the Board of Commissioners on September 18th and informed said Board
that a waterfowl easement had been secured from Mr. and Mrs. Russell M. Anderson
on the NW¼SE¼, NE¼SE¼ lying_westerly of I-94 r/w, NE¼SE¼ lying easterly of I-94
r/w, in Section 5 -134 -44, and from Mr. and Mrs. Arnold Satter onthe E½SW¼ of
Section 8 -135 -42,
NOW, THEREFORE BE IT RESOLVED, the County Board does herebr grant·
approval for waterfowl easement acquisition on the aforementioned properties.

Motion was made by Bert Hovland to have the Land & Resource Man_age-
ment office do the necessary work in completi_ng the land use study in connection
with a Land Use Plann~ng Grant. The motion was seconded by Sydney Nelson but failed
with Hub Nordgren, Andy Leitch and John Snowberg voting "no".
Motion was made by John Snowbe_rg, seconded by Hub Nordgren and car-
ried, with Sydney Nelson and Bert Hoyland voting "no", to have the West Central
Regional Development Conunission do the necessary work in completing the land use
study in connection with a Land Use Planning Grant recently applied for, and ap-
proved.
Upon motion made by John Snowberg, seconded by Bert Hovland and
carried, the bill of Otter Country Electric, Fergus Falls, Minnesota in the amount
of $646 .00 for wiri_ng ventilation inthe jail.
Motion was made by Andy Leitch, seconded by John Snowberg and car-
ried, to approve payment inthe amount of $1,665.99 to Glenn·w. Cording Associates,_
Inc., Minneapolis, Minnesota for architectural fees in connection with the govern~
. ment services buildi_ng. ·
Motion was made by Bert Hovland, seconded by John Snowbe_rg and car-
ried, to approve an application calling for the reduction of .assessed valuation on
the Louis Toelle property on Adams Beach, Amor Township, cott_age overvalued.
Pursuant to pub~ished notice, the ~oa~q-conducted a hearing on the

proposed bu_dget for all county offices for the· year 1980. No· action taken.

Motion was made by Andy Leitch, seconded by Hub Nordgren and carried,

There being no further business, the Chairman ·adjourned th.e meeting

and carried, the following resolution was adop~ed:
R,ESOLUTI_QN
WHEREAS, the tax levy limitation imposed by the State Legislature
on Otter Tail County has required a curtailment of County services, and ·
WHERE~, Townships are excluded from this levy limi_tation.
NOW THEREFORE BE IT RESOLVED, that Ott~r Tail County shall no longer
provide free engineering and related services to Townships and other sub-
units of government after January 1, 1980.
BE IT ALSO RESOLVED, that.Otter Tail County ma,y-perform engineering
and related services_ for s.ub-uni_t& of government provided time is available
and provi_ded · the County is paid for . the · services rendered, including the
cost of overhead cha,rges.
BE IT ALSO RESOLVED, that, unle.ss other arrangements are made·w:ith.
the County Board pri_or to perf arming the work, any bi_ll -i;-emai_ning unpaid
after one year shall be collected by the CQunty by retaining any due amount
from the taxes collected for ·the. gover-nmental sub-unit involved.
