HomeMy WebLinkAboutBoard of Commissioners - Minutes - 08/21/1979MINUTES OF nIB ADJOURNED MEETING OF THE BOARD OF COUNTY COMMISSIONERS OITER TAIL COUNTY MINNESafA Pursuant to adjournment, the Board of County Commissioners of Otter Tail County Minnesota met at 1:00 P.M., Tuesday, August 21, 1979, all members present. The County Sheriff, having previously been authorized by the Board to obtain proposals for a new vehicle, appeared before the Board ::iwith one proposal obtained from Minnesota Mot~r Company for a 1979 Chevrolet Malibu police cruiser, demonstrator, at a cost of $6,300.00, no other proposals received as no units:; available. Upon motion made by Hub Nordgren, seconded by Bert Hovland and carried, the proposal,:. of Minnesota Motor Company, Fergus Falls, Minnesota, in the amount of $6,300.00 was approved, and payment of same authorized upon delivery. Proposals were received by the County Sheriff for replacement of carpet on stair case and hallway from sheriff's office to the county court rooms. Motion was made by Andy Leitch, seeonded by John Snowberg and carried, to accept the proposal of Town & Country Interior, Fergus Falls, i~ the amount of $410.00 being the lowest proposal received. Motion was made by Andy Leitch, seconded by Bert Hovland and carried, to enforce garbage haulers lice~s:e regulations . in Otter Tail County. . ' . , ' . . ~ . . Motion was made by Sydn~y Nelson, seconded by Andy Leitch and carried, 1st Add'n to approve the plat of Cousin~ ParkJ to be located in Section 7 -136 -38. Motion was made by Bert Hovland, seconded by John Snowberg and carried, to approve the plats of Woodland Heights, 2nd and 3rd Add'n, to be lo- cated in Section 26 -133 -43. Upon motion made by Andy Leitch, seconded by Hub Nordgren and carried, the following applications for sewage ,disposal installers license were approved: Roger Bommersbach Kenneth A. Svare Roger's Plbg., Inc. Hankinson, North Dakota Audubon, Minnesota Upon motion made by Andy Leitch, seconded by Hub Nordgren and carried, an application of Erwin Brutlag for gradi~g and construction of driveway on Lot 11 of First ADdition to Ed's Sunrise Beach, Tumuli Township, was approved. Motion was made by Sydney Nelson, seconded by Bert Hovland and carried, to refer _the application of Ole Lather for special use permit to construct approx. 800' of road in G.L. 2, Section 13, Rush Lake Township, back to the Otter Tail County Planning Advisory Conunission. Motion was made by Bert Hovland, seconded by Andy Leitch and carried, to deny application of J.C. Schulz, for special use permit to clean debris from Lots 1, 2 & 3, Summer Haven Beach, Scambler To~ship, upon recommendation of the Otter Tail County Planning Advisory Commission. Motion was made by Sydney Nelson, seconded by Andy Leitch and carried, to approve a registered land survey in Sections 4 & 9 -136 -41. Motion was made by Bert Hovland, seconded by John Snowberg and carried, to approve a preliminary plat of Betty Johnson Add'n, to be located in Sections 20 and 21 -137 -42. Motion was made by Bert Hovland, seaonded by John Snowberg and carried, to approve an application of Robert W. Johnson for special use permit to construct 2,000 feet of road to serve proposed subdivision in Section 20 - 137 -42. Upon motion-made by-Sydney Nelson, seconded by Hub Nordgren and . . ' carried, a preliminary. plat of Wallace Add.'n,. located in Section 9 -.136 -38., was approved. Motion was made by Andy Leitch, secondedby John Snowberg and; carried, to approve a metes and bounds descriptio~ parcel split by Ole Draxten, in Section 22 -132 -42, provided, however no other splits have been_made. Motion was made by Andy Leitch, seconded by Hub Nordgren and carried, to approve a metes and bounds description of a parcel 65,000 spare feet., for Harry Bengtson, in G.L. 2, Section 14 -131 -40. Motion was made by Hub Nordgren, seconded by Andy Leitch and carried, to grant the City of Deer Creek permission to put brush in their landfill. Upon motion made by Andy Lei~ch, seconded by Bert Hovland and carried, accepted all proposals received for depositories by the County as follows: Security State Bank · Fergus Falls, Minnesota Western Minnesota Savings & Loan Ass•n, Fergus F~lls, Minnesota Security State Bank First National Bank Northwestern National Bank , ' Deer Creek, Minnesota Fergus Falls, Minnesota Fergus Falls, Minnesota Upon motion made by Andy Leitch, seconded by Bert Hovland and carried, an application of Erwin H. Post for permit to sell non-intoxicating malt liquor at Parkway Inn, Leaf Mountain Township. Motion was made by Bert Hovland, seconded by Hub Nordgren and carried, authorizing the County Auditor to advertise for bids to be received until 2: 30 P .M., Tuesday, September 18th, 1979, for property owned by the County of Otter Tail located in Carlisle Township, being part of Lots S & 6, All of Lot 7 and the West 25' of Lot 8, Block 3, Carlisle Townsite. Motion was made by Andy Leitch, seconded by John Snowberg and carried, to refund a duplicate payment of the first half of the 1979 tax on Parcel 71-001-99-0318, being the N 46' of Lots 4, S & 6, Block 9, Cutler's Third Add'n to the City of Fergus Falls. Motion was made by Andy Leitch, seconded by Hub Nordgren and carried, to schedule an ?,informational meeting to be held at the American Legion Hall in Underwood, September 17th at 8:00 P.M., relative to County Ditch #37. Upon motion made by Sydney Nelson, seconded by Hub Nordgren and carried, the County Engineer was authorized to advertise for bids to be received until 1:00 p.m., Tuesday, September 18, 1979, for the replacement of Bridge No. L0941 in Butler Township. Upon motion made by Bert Hovland, seconded by John Snowberg and carried, the following resolution was adopted: RESOLVED by the Board of County Conunissioners of Otter Tail County Minnesota, that WHEREAS in accordance with a Procedural Agreement between the Minnesota Department of Natural Resources and the U. ·s. Fish and Wildlife Service, dated May 23, 1962, certification by the County Board of Commissioners for acquisition of lands by the u. s. Fish and Wildlife Service is requested, and WHEREAS representatives of the U. S. Fish and Wildlife Service met with the County Board on August 21st and informed said Board that a water- fowl easement had been secured from Mr. and Mrs. James Rorvig on the E½NW1/4NW1/4 and the W½NE¼NW¼ of Section 32 -135 -44, and from Mr. and Mrs. Vernon.J. Wigdahl on the N½NW¼ of Section 4 -134 -44, NOW, THEREFORE, BE IT RESOLVED the County Board does hereby approve said waterfowl easement acquisition by the u. s. Fish and Wildlife Service. Dated at Fergus, Falls, Minnesota_~lµ.s 21st day of August, 1979. ·_,:I, ATTEST: W:,; 11) J?ip~L,,i)tferk Upon motion ma4e by Andy Leitch., seconded by John Snowberg and carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that The County Board of Otter Tail does hereby authorize the submission of an application for a Land Use Planning Grant as per M.S. 4.27-4.31 and further authorized the-execution of a grant agreement should the application be approved. The chairman of the Otter_Tail County Board of Commissioners is hereby authorized to execute the grant agreement on behalf of Otter Tail County, BE IT FURTIIER RESOLVED, the County Board agrees to contribute the local share of $3,000.00 as stated in-the grant application. WHEREAS, flood waters have c;auE\ed. damage to Bridge No. 10941 in Butler Township, and WHEREA!:;;' the Township· has ,request~d, the replacement of this structure as soon as possible, and WHEREAS, it has been determined to be in the public interest to replace this structure before another potential spring flood, and WHEREAS, the ptoject_has been approved and the funds are available for replacement. · NOW THEREFORE BE IT RESOLVED, that a state of emergency does exist and the bridge will be replaced during the 1979 con- struction season. BE IT FURTHER RESOLVED, that the County Highway Engineer is instructed to assist the Township and take,suc.h action as needed to have. this accomplished. SEAL Upon motion made by Sydney Nelson. seconded by Bert Hovland and carried, with Hub Nordgren voting 11no1:1, the ·following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that \ WHEREAS pursuant to Minn. ;Stat. 400.05, authority is given to the Board of County Conuniss~oners to' el?tablish. and determine. boundaries of solid waste management service areas in the county, and WHEREAS the required hearing for establishment of a solid waste management area in the northeast portion of Otter Tail County, said hearing having been held on August 2nd, 1979, pursuant to prescribed notice, NOW, THEREFORE BE IT RESOLVED, a solid waste management area shall be established containing in whole the following townships and cities: Blowers Township Bluffton-Township Butler Township Candor Township Corliss_Township Dead Lake Township Dora Township Edna Township Gorman Township Hobart Township Homestead Township Newton Township Otto Township Paddock Township Perham Township Pine Lake Township Rush Lake Township Star Lake Township City of Bluffton City of Dent City of New York Mills City of Perham City of Vergas Dated at Fergus Falls, Minnesota this 21st day of August, 1979.
