BOARD OF COUNTY COMMISSIONERS
OTTER TAIL COUNTY MINNESOTA
·. '. Pursuant to adjournment, the Boa1"9·of County Commissioners of
Otter Tail Cowtty met at 9:30 A.M., Tuesday, August 7, 1979 with all members
present.
Motion was made by Andy L~itch, seconded by Hub Nordgren and
carried, to pay the balance due the Ci~y of Fergus Falls appr.opriated for
the sanitary landfill, subject to taking of pesticide cans as prescribed by
the Minnesoa Polution Control Agency.
Motion was made by Hub Nordgren, seconded by Bert Hovland and
carried, to give preliminary approval to Werner Knapp and James Klimek for an
on-sale liquor license in Parkers Prairie Township, provided however, all
requirements of the State of Minnesota are met and the primary business be
food.
The Board, having previously advertised for bids to be received
for construction of concrete arch culverts and corrugated steel culverts in
Compton Township, S.A.P. 56-599-23, Corliss Township, S.A.P. 56-599-08 and
Tumuli Township, S.A.P. 56-599-16, proceeded to open bids which were fOWtd to
be as follows:

After consideration, motion was made by Hub Nordgren, seconded
by Andy Leitch and carried, to award the contract for S.A.P. 56-599-23 to
Landwehr Heavy Moving, Inc., St. Cloud, Minnesota in the amount of $41,220~00
it being the lowest bid. There were no bids received for S.A.P. 56-599-08 and
S.A.P. 56-599-16.
' Upon motion made by Andy Leitch, seconded by Sydney Nelson and
carried, the county engineer was authorized to advertise for bids to be received
until 10:00 A.M., Tuesday, September 4, 1979 for the following:

S.A.P. 56-599-08, Bridge Replacement with two 13'-3" Sp_an C.S. Str. Pl.

Motion was made by Bert Hovland, seconded by Andy Leitch and
carried, to allow Ray Pfeifle to split Lot 6, Block 2, Crystal-Lida Beaches,
increasing Lot S, Block 2 by 12'.
Motion was made by Hub.Nordgren, seconded by Andy Leitch and
carried, to approve a burning permit to the Noftood Specialty Company, for the
purpose of burning woodwaste in Parkers Prairie Township.
Motion was made by Andy Leitch, seco~ded by Bert Hovland and
carried, to approve . an increas'e in the 'county Recorder Is budget in the amount
of approximately $1,900.00 for the repair of book binders, tabs, etc ••
Motion was made by An4y Leitch, seconded by Bert Hovland and

carried, to give an unfavorable review of Project #1073, Title, Otter Tail-Wadena
CAC Conduct and Administration request for funds.through the West Central REgional
Development Commission, because it is a duplication of services.
Motion was made by Bert Hovland, seconded by Sydney Nelson and
carried, to place in nomination for public health position of the Min-Dak Board of
Directors, the following:

Arnold Ellingson, Sanitarian, Fergus Falls Health ·Department
Roy Anderson, Director, Lake.land Mental Health Center

Upon motion made by Andy Leitch, seconded by Bert Hovland and
carried, the following resolution was adopted:
RESOLVED by the Board of County Commissioners of Ott.er Tail
County, that
WHEREAS, in accordance with a Procedural Agreement between the
Minnesota Department of Natural Resources and the U.S. Fish and Wildlife
Service, dated May 23, 1962, certification by the County Board of Connnissioners
for acquisition of lands by the U. s. Fish and Wildlife Service is requested,
and
WHEREAS, representatives of the U. s. Fish and Wildlife Service
met with the Board of Commissioners on August 7th and informed said Commissioners
that a waterfowl easement had-been secured from,Byron Stock on the SW¼ of
Section 11 and the N½NW'/4 of Section 14 -131 -44, and
WHEREAS said , Bo-ard · examined i_n~o. the request by the U. 5. Fish
and Wildlife Service,
NOW, THEREFORE, BE IT RESOLVED s~id Board does hereby approve
the aforementioned request for easement acquisition by the u. s. Fish and
Wildlife Service.

Upon motion made by Andy Leitch, seconded by Hub Nordgren and
carried, the following resolution was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail
County Minnesota, that
WHEREAS, in accordance with a Procedural Agreement between the

Ruth Lee Fabian, et_al, on the W½ NE¼ of Section 36, except a 4 chain by Schain
tract in the NW1/4NE¼ of Township 132 -Range 42,
NOW, TIIEREFORE, BE IT RESOLVED, said Board of Commissioners
does hereby approve the above request for easement acquisition by the u. s. Fish
and Wildlife Service.

Upon motion made by Andy Leitch, seconded by Hub Nordgren and
carried, the followi_ng resolution was adopted: .
RESOLVED by the Board of County Commissioners of Otter Tail
County that,
WHEREAS, Laws of 1979, Chapter 287, grants authority to all
Counties to provide a vote of the majority of its:, electors residing outside
of municipalites that have adopted the state building code prior to January
1, 1977, and
WHEREAS it is.the desire of the Board of County Commissioners
of Otter Tail County to allow-the.voters of Otter·Ta.il County to determine
if the state building code shall be adopted . in Otter TaiJ County·,
NOW, IBEREFORE,. BE·_ IT HEREBY ~SOLVED, a referendum shall be
held in Otter Tail County in ¢ompliance with Section 2 of Chapter 287 of the
Laws of 1979,
BE IT FURTIIER RESOLVED, the date set for said referendum shall
be the 2nd of October in all precincts of Otter Tail County except the eight
precincts of the City of Fergus Falls.

Upon motion made by John Snowberg, seconded by Bert Hovland and
carried, the following resolution was adopted:
RESOLUTION
WHEREAS, Maine Township has expressed the desire .to replace
the deficient Township bridge adjacent to Phelps Mill County Park and,
WHEREAS, the replacement of this ~ridge should be compatible
with the existing park· facility, and
WHEREAS,'. it ha.s beeµ deteI:IDined by a, group of representatives.
from Maine.Township,:Otter Tail County and Phelps Mill County Park
that a covered timber truss bridge is compatible with the existing
park facility.
NOW THEREFORE BE IT RESOLVED, that the Phelps Mill County Park
Board does support the proposal for.a covered timber truss bridge
replacement adjacent to the Phelps ;MUL · ..

Upon motion made,by Hub Nordgren, seconded by Andy Leitch and
carried, the following resolution was adopted:
RESOLUTION
WHEREAS, the County of Otter Tail has applied to the Commis-
sioner of Transportation for a grant from the Minnesota State Trans-
portation Fund for the reconstruction of Township Bridge No. 95066
over the South Bluff Creek, and;
WHEREAS,_ the application for the grant has been reviewed by
the West Central Regional Development Commissioner, and;
WHEREAS, the amount of the grant has been determined to be
$40,370.00 by reason pf the lowe~t responsible bid.
NOW, THEREFORE, BE IT RESOLVED, -that the County of Otter Tail
does hereby affirm that any cost of the bridge in exce·ss of the grant
will be appropriated from funds available to the County of Otter Tail,
and that any grant monies appropri,ated for the bridge but not required,
ba_sed on the final estimate~ shall be returned to the Minnesota State
Transportation Fund.

-WEDNESDAY'S SESSION -
Pursuant to adjournment The Board of County Commissioners of Otter
Tail County met at 9:30 A.M., Wednesday, August 8th, 1979, all members present.
Larry Iversen, representative of the Blue-Cross -Blue· Shield
appeared before the board with an expiation of the group coverage and increased
rates to take effect as of September 1, 1979.
Norman Johnson appeared before the Board with a proposal for the
preservation of ditch maps and profiles for the county. No action taken.
Motion was made by Bert Hovland, seconded by Sydney Nelson and
carried, to appoint John Snowberg, Andy Leitch and Hub Nordgren as Otter Tail
County's representatives on the Joint Otter Tail -Grant County Ditch #3
Committee.

Motion was made by Hub Nordgren, seconded by Andy Leitch and
carried, with John Snowberg voting "no", to table action on the Northeast Otter
Tail County Sanitary Landfill until new regtiations are received from the M.P.C.A.
Upon motion made by Bert Hovland, seconded· by Andy Leitch and
carried, the County Auditor was authorized to publish notice of hearing for
the proposed use of Federal Revenue Sharing Funds in the amount of $648,860
for entitlement period 11, said hearing to be at 1:00 P.M., Friday, September
7, 1979.
Motion was made by Bert Hovland, seconded by Andy Leitch and
carried, to approve the plat ·_of ~o,stad, Deyelopm~Jlt~ located in Section 32 -134 -41.
Motion was made by Sydney_Nelson, seconded by John Snowberg and
carried, to approve the plat of Meadow Wood Estates,.located in Section 6 -136-40.
Motion was made by Bert Hovland, seconded by John Snowberg and
carried, to deny approval of the plat of Poss Beach, located in Section 31-137-42,
because of inconsistency with the preliminary plat and requirements of the shore-
land management ordinance.

Motion.; was made by John Snowberg, seconded by Andy Leitch and
carried, to deny the preliminary plats of Pine Wood Estates and Evergreen Hills
to be located in Scambler Township, for economic and environmental reasons.
Motion was made by Bert Hovland,. seconded by Sydney Nelson and
carried, to approve a preliminary plat of River Hills, to be located-in Section
29 -134 -42, and.also the application for special use permit to construct
approximately one mile of road to :serve ~ai'd P,lat-~
Motion was made by B_ert _Hovland, seconded by John Snowberg and
carried, to approve an applicatio11 of Oakvi~w C~nst~ction, . Inc.,. for special
use permit to construct a road to serve .a proposed Oakview Heights Subdivision,
subject to conditional requirements.
Motion was made by Bert Hovland, seconded by Hub Nordgren and
carried, to approve a preliminary plat of River-N-Woods Estates, 2nd Add'n, to
be located in Section 9 -133 -43, subject to conditional requirements.
Motion was made by Bert Hovland, seconded by Andy Leitch and
carried, to authorize Malcolm Lee and Larry Krohn of the Land & Resource Man~ge-
ment office to attend a meeting of the National Sanitation Fundation to be held
at Ann Arbor, Michigan October 29, 30 and 31st.
Upon motion made by Andy·Leitch, seconded by H~b· Nordgren and
carried, _the application of Erwin Post for license to sell non-intoxicating malt
liquor at the Parkway Inn in Leaf Mountain Township was approvm, subject to approval
by the County Sheriff.
Upon motion made by Hub Nordgren, seconded by Bert Hovland and
carried, the meeting was adjourned·until 1:00 P.M., Tuesday, August 21, 1979.
