BOARD OF COUNTY COMMISSIONERS
OTTER TAIL COUNTY MINNESOTA
Pursuant uto adjournment, the Board of County Commissioners of
Otter Tail County Minnesota met at 9:30 A.M., Tuesday, February 6, 1979, all mem-
bers present.
Representatives from East Otter Tail County offices appeared before
the Board relative to proposing combining all East Otter Tail County offices into
one location, either by renting existing space, purchasing an existing building,
or constructing a new building. No action taken.
A petition was presented to the Board by users of County Road #142,
praying for upgrading and resurfacing of said road and also calling for take-over
by the County of the township road into which #142 goes. Upon motion made by Sydney
Nelson, seconded by Hub Nordgren and carried, the petition was accepted, the County
Engineer was requested to check it over and the County Auditor was authorized to
file same.
Upon motion made by Andy Leitch, seconded by John Snowberg and
carried, the following applications for reduction of assessed valuation :were approved:

Upon motion made by Sydney Nelson, seconded by Andy Leitch and
carried, to approve forgiveness of penalty on payment of the 1978 tax on Plate
#263, Corliss Township, where a tax was changed after having been paid, the owner
not having been notified of the change.
The scheduled hearing was held on the long ·range road construction
plan as set forth by the County Engineer. After considerable discussion, upon
motion made by John Snowberg, seconded by Bert Hovland and carried, the following
resolution \~as_ ~dopted:

RESOLUTION
WHEREAS, Otter Tail County, to comply with the State of Minne-
sota Action Plan, did hold a public meeting on February 6, 1979, to
consider a long range bridge and highway construction plan, and
WHEREAS, the adoption ~f. a futllre bridge and highway construc-
tion plan in accordan~e with the Minnesota Action Plan is required.
NOW, THEREFORE, 'r'T IS RESOLVED'., 'that t~.h~ -"Otter Tail County,
1979 Annually Revised Bridge and Highway Construction Plan, dated.
February 6, 1979", as prepared by the County Highway Engineer, is
the 1979 long range Bridge· and High\Jay Construction Plan for Otter
Tail County.
BE IT FURTHER RESOLVED, that the proposed construction date
on any project can be changed to accommodate the available funding
and construction requirements.

Upon motion made by Andy Leitch, seconded by Bert Hovlarid and
carried, the following resolution was adopted:
RESOLVED by the Board of County Couunissioners of Otter Tail
County Minnesota, that
WHEREAS application has been made by Roger W. Halvorson, as
representative of the Estates of Arthur Eisen-and Ida Halvorson, to repurchase
the SE¼ of Section :::6 -132 -42, said property having forfeited to the State
·of Minnesota for non-payment of.taxes on October 27, 1978, and
WHEREAS the sum of $1,896.99 has been submitted with said appli-
cation, being the aggregate of all delinquent taxes and assessments with penalties,
costs and interest,
NOW, THEREFORE, BE IT RESOLVED the Board of County Commissioners
of Otter Tail County does hereby approve the application for repurchase, said
repurchase to be to the best public interest and relieve undue hardship.

WHEREAS, the State of Minnesota did on October 18, 1978, quit claim
to the County of Otter Tail certain property as a turnback of a part of .Trunk High-
way No. 36, renumbered 210, and
WHEREAS, the County of Otter Tail makes no claim to said roadway and
desires to relinquish any interest the County has in and to said abandoned right of
way to the abutting owners thereof, and
WHEREAS, John Mark, now deceased, was the owner of the land surrounding
the property hereinafter described,
NOW, THEREFORE, BE IT RESOLVED:
That the Chairman of the Board of County Commissioners of the County
of Otter Tail, and the County Auditor'of said County are hereby authorized and direc-
ted to Quit Claim to Elizabeth LaPlante and Donald Ashworth, representatives of the
estate of John Mark, deceased, the following described premises situated in the County
of Otte trail, and State of Minnesota, to-wit:
That part of Tracts A and B described below:
Tract A. That part of the SE¼ of Section 2 -132 -43, Otter
Tail County, Minnesota, lying West and South of State
Trunk Highway No. 36 as located and established prior
to May 22, 1930;
Tract B. Lots 35 and 36, State Subdivision of the W½ of Section
2 -132 -43, according to the plat thereof now on
file and of record in the office of the County Recorder
in and for Otter Tail County Minnesota
which lies within a distance of 50 feet on each side of Line 1 described
below, Northerly of Line 2 described below, and Easterly of Line 3
described below:
Line 1. From a point on the E line of the SE¼ SW¼ of said Section 2, dis-
tant 190' Southerly of the NE corner thereof, run Westerly at an
angle of 89°14 '00" from said East line (measured from North to
West) for 1389 feet to the point of beginning of Line 1 to be
described; thence run Easterly along the above described course
for 1289.4 feet; thence deflect to the left on a 2000 1 00" curve
(delta angle 16028'00") for 823.3 feet and there terminating;
Line 2. From the point of termination of Line 4 described below, run North-
westerly at right angles to said Line 4 to a point on a line run
parallel with and distant 75' Northwesterly of said Line 4, which
is the point of beginning of Line 2 to be described; thence run
Northeasterly on said 75' parallel line for 150'; thence run North-
westerly at right angles to said Line 4 to a point on a line run
parallel with and distant 110 feet Northwesterly of said Line 4;
thence run Northeasterly on said 110' parallel line.for 400' and
there terminating;
Line 3. Beginning at a point on the Nortlerly line of Tract B hereinbefore
described, distant 25' Easterly of the Northwest corner thereof;
thence run Southeasterly to the point of intersection of Line 5
described below with a line run parallel with and distant 100'
Easterly of Line 6 described below;
Line 4. From a point on the North and South Quarter line of said Section 2,
distant 1060.11' North of the South Quarter corner thereof, run
v Northeasterly at an ~le of 72036' 15" (measured from North to East)
for 353.72' to the point of beginning of Line 4 to be described;
thence run Socthwesterly on the last described course for 600 feet
and there terminating;
Line 5. Beginning at a point on the Southerly boundary line of the first de-
scribed strip, distant 100' Easterly of its intersection with the
Easterly boundary of the public road (as located and established on
May 22, 1930) running along the Westerly line of said Tract B;
thence run Southwesterly to a point on said Rlsterly boundary of said v'/
public road, distant 100 feet Southerly of said intersection and
there terminating;
Line 6. Beginning at a point on the South line of said Section 2, distant
1309 feet EAst of the Southwest corner thereof; thence run Northerly
at an angle of 90040 '00" from said South section line (measured from
West to North) for 1200 feet and there teminating;
together with that part of Tract B hereinbefore described adjoining and South-
erly of the first above described strip, which lies Easterly of Line 3 des-
cribed above and Northwesterly of Line 5 described above;
c/ also together with that part of Tracts A and B hereinbefore described adjoin~ng
and Northerly of. the first above described strip, which lies Northwesterly of
Rine 2 described above and Southerly of a line run parallel with and distant
60' Northerly of the following described line: Beginning at a point on Line 1
described above, distant 1289,4' Easterly of its point of beginning; thence
run Easterly on said Line 1 for 400' and there terminating;
also together with that part of Tract B hereinbefore described adjoining and
Northerly of the first above described strip, which lies Easterly of Line 3
described above and Southwesterly of the following described line: Beginning
at the point of beginning of said Line 3; thence run Southeasterly to a point
distant 142.0' Southerly and 222.6' Easterly of the Northwest corner of said
Tract Band there terminating.
The foregoing resolution was duly offered by Commissioner Snowberg,
seconded by Commissioner Leitch, at the adjourned meeting of the County Board held
in the Court House of the Otter Tail County, Minnesota, on the 6th day of February,
' ... 1979. Upon roll being taken, the Chairman declared the Resolution duly adopted.

Upon motion made by John Snowberg, seconded by Andy Leitch and
unanimously carried, the following resolution was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail County
Minnesota, that
WHEREAS, Minnesota· St~tute·s 6 .48 describes the duties of the State
Auditor insofar as examination o:f: county's records, accounts, etc., with the pro-
vision that the State Auditor shall make a thorough examination of said county
records once each year if funds and personnel permit, and
WHEREAS, Minnesota Statutes 6.56 states that the county shall be
liable to the state for the total cost and expenses of such examination, including
the salaries paid to the examiners while actually engaged in making such examina-
tion, and
WHEREAS the cost of said examinations has increased at a much
greater amount than the 6% limitation placed upon county governments for general
tax levies, and
WHEREAS the State of Minnesota has full control of the amount of
time and costs to be charged against an individual county audit, with the county
having absolutely no control or input thereof,
NOW, THEREFORE, BE IT RESOLVED that the Otter Tail County Board
of Commissioners hereby requests the Minnesota State Legislature to amend the
Minnesota Statutes to relieve the burden of the examination cost from the counties
and to place the cost onto the State of Minnesota, as is done for other services
by the State of Minnesota.

Upon motion made by Hub Nordgren, seconded by Bert Hovland and
carried, the following resolution was adopted:.
RESOLVED by the Board.of County Commissioners of Otter Tail
County Minnesota, that
WHEREAS a traffic problem· e·xists in the present route of Highway
#210 through the City of Fergus ·Falls; and
WHEREAS the City of Fergus Falls has adopted a street and traffic
plan and in said plan has developed a Highway #210 by-pass, and
WHEREAS a Highway #210 By-Pass will help conserve energy resources
through the efficient movement of people and goods; assist in maintaining an exis-
ting highway within its capacity to carry traffic, thus effecting.a greater degree
of personal safety and lower rate of damage to property and allow a smooth flow of
traffic. which will permit the improvement of the social, economic and environmental
well-being of the people in the area,
NOW, THEREFORE, BE IT RESOLVED, the Board of County Commissioners of
Otter Tail County support the City of Fergus Falls in its plans to develop1.:' a by-
pass and encourage the City Council in its present endeavor to expedite the planning.
of such development in conjunction with MNDOT; and direct our representatives to con-
sult with the City Engineer and the MNDOT District Engineer on the steps to be taken
to expedite this urgently needed improvement to the state highway system;
BE lT FURTHER RESOLVED that the proper governmental units designate
a corridor for such a by-pass at a.he earliest possible time so that City Planning
and the plans of local business and individuals may coordinate with such a corridor
at an effective saving to all concerned.

Alva Krekula, East Otter Tail County Agricultural Inspector,
appeared before the Board and presented his report for the year 1978. Motion was
made by Hub Nordgren, seconded by Sydney Nelson and carried, to approve the report
as presented.
A scheduled hearing was held on the proposed dog and cat ordinance
at which time various individuals were heard, no action taken.
Motion was made by Hub Nordgren, seconded by John Snowberg and
carried, to enter into agreement with the Minnesota Counties Research Foundation
for the purpose of providing professional· consul ting services for Indirect Cost
Allocation Plan Update for the year 1979, and the Chainnan of the Board was au-
thorized to sign sad:d agreement on behalf .c,f Otter-Tail County.

. ' carried,, to grant a leave of absence, without pay, to Gertrude Gray, to attend
a fwieral in California.
Motion was made by Bert Hovland,seconded by Hub Nordgren and
carried, to appoint Dennis Berend, John Snowberg and Andy Leitch to serve on a
committee, along with representatives of the City of Fergus.Falls, for the pur-
pose of establishing a by-pass for Highway #210, south of the City of Fergus
Falls.
The Chairman adjourned the meeting until 9:30 A.M.; Wednesday,.
February 7, 1979.
-WEDNESDAY'S SESSION -
Pursuant to adjournment, the Board of Comty Commissioners of
Otter Tail County Minnesota met at 9: 30 A.M., Wednesday, February 7th, 1979, all
members present.
Gordon Bjoralt, West Otter Tail County Agricultural Inspector,
appeared before the Board and presented his renort for the year 1978. Unon motion
made by Andy Leitch, seconded by John Snowberg ·and carried, the report was accepted.
The Board, having previously advertised for bids to be received for
half section maps proceeded to open bids which were found to be as follows:
Kermit T. Bjorgum, Fergus Falls, Minnesota $ 6,800.00
Robert B. Oslund & Associates, Inc., Fergus Falls, Minnesota 10,800.00
After consideration, motion was made by Andy Leitch, seconded by
Hub Nordgren and carried, to accept the bid of Kermit T. Bjorgum, Fergus Falls,
Minnesota in the amount of $6.800.00, it being the lowest bid.
Motion was made by John Snowberg, seconded by Andy Leitch and
carried, to accept the statement of receipts and disbursements for the year ended
December 31, 1978, as presented by the cdunty·audit~r.

Motion was made by Bert Hovland; seconded by Sydney Nelson and
carried, Andy Leitch voting "no," to forgive the penalty on a late payment of ·
the 1978 tax on Plate #116AB, Buse Township.
The County Sheriff appeared before the Board and presented his
report for the year 1978.
Motion was made by Andy Leitch, seconded by John Snowberg and
carried, to appropriate out the County Revenue Fund the sum of $1,000 for the
Ottertail Country Tourism Ass'n, and the sum of $1,000 to Viking-Land-USA, for
the year 1979.
Upon motion made by Andy Leitch, seconded by Bert Hovland and
carried, the following resolutbn was adopted:
. -RESOLVED by the Board of County Commissioners of Otter Tail
County Minnesota, that
WHER~AS Minn. Stat. 394.30 has been amended to read a County
Commissioner need not be a member of the county planning commission;··and
WHEREAS it is the opinion of this Board, the planning commission
could best serve the people of Otter Tail County without one of the members of
the county board sitting on the commission,
NOW,·THEREFORE, BE IT RESOLVED that an.Otter Tail County
Commissioner does not have to be a member of the Otter Tail County Planning
Advisory Commission.
