HomeMy WebLinkAboutBoard of Commissioners - Minutes - 01/02/1979II ,•'_ ' ' MINlITES OF nlE REGULAR MEETING OF THE BOARD OF COUNTY COMMISSIONERS OTTER TAIL COUNTY MINNESOTA Pursuant to Statute, the Board of County Commissioners of Otter Tail County Minnesota met at 9:30 A.M., Tuesday, January 2, 1979, Sydney Nelson, Bert Hovland, Andy Leitch, Hub Nordgren and John Snowberg present. The meeting was called to order by the ColDlty Auditor who stated ' the first item of business to be that of election of the Chairman and Vice ·Chair~ man for the year 1979. Motion was made by John Snowberg, seconded by Andy Leitch and carried, to elect Sydney Nelson Chairman. Motion was made by Andy Leitch, seconded by Sydney Nelson and carried, to elect John Snowberg as Vice Chairman. Motion was made by Andy Leitch, seconded by JOhn Snowberg and carried, authorizing the County Auditor to call for a hearing to be held at 1:30 P.M. Tuesday, February 6, 1979, for a proposed dog ordinance, Hub Nordgren voting "no". Upon motion made by Hub· Nordgren, seconded by Andy Leitch and carried, the Co\Dlty Auditor was authorized to advertise for bids to be received until 10:00 A.M., Wednesday, February 7th, 1979. for half-section maps for Aurdal and Sverdrup Townships. Upon motion made by Sydney Nelson, seconded by Andy Leitch and carried, the application of Donald H. Johnson for license to sell intoxicating liquor, and Sunday liquor license, at Links & Lakes in Perham Township was approved. .. Upon motion made by Andy Leitch, seconded by John Snowberg and carried, Syd Nelson voting "no", the following res_olution was adopted: RESOLVED by the Board.of County Commissioners of Otter Tail Coooty Minnesota, that The sum of ten cents (10¢) be paid out of the Revenue Food of the Coooty for every packet gopher and wood chuck killed in said county during the year 1978 in cases where the townships in which pocket-gophers and wood chucks are so killed shall provide for the payment of an additional boooty of ten cents (10¢) for each pocket-gopher and wood chuck so killed. RESOLVED FURTHER that payment of such boW1ty shall be made by the Coooty Auditor upon certificates executed by the Chairman of the Town Board of said townships setting forth that the pocket-gophers or wood chucks were duly presented to the Chairman of such Board and that the townships has issued and de- livered to each claimant a town order for twenty cents· (20¢) for each pocket- gopher or wood chuck so killed. ATTEST: c;z/...,La) J /fyrn~l<-', J Clerk Upon motion made by John Snowberg, seconded by Andy Leitch and carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that UNDER the provisions of Section 739 General Statutes of ~932, the sum of $400.00 be and the same hereby is appropriated out of the Revenue Ftu1d of the County to the Red River Valley Development Association, said amount so appropriated to be used in payment of premiums to exhibitors for the year 1979. I WEDNESDAY'S SESSION Pursuant to adjournment, the Board of County Commissioners of Otter Tail County met at 9:30 A.M., Wednesday, January 3, 1979, all members present. Motion was made by Andy Leitch, seconded by Bert Hovland and carried, with Sydney Nelson and Hub Nordgren votirig "no", to proceed with con- struction of a building for the Department of Social Services located at 503 & 505 South Court Street in the City of Fergus Falls. Motion was made by Andy Leitch, seconded by Bert Hovland and carried, to approve payment-i~ the\amount of $775.95 to Dorsey, Windhorst, Hanna-. . ,. ford, Whitney & Halladay, Minneapolis, Minnesota for legal services rendered as Bond Counsel in connection with the issuance of General Obligation Ditch Bonds, Joint Otter Tail-Wilkin County Ditch #2. Motion was made by Bert Hovland, seconded by John Snowberg and carried, to appoint the five commissioners, together with Roland Winterfeldt, Dennis Berend and Gene Davenport as delegates to the Association of Minnesota Counties. The Board, having previously advertised for bids to be received for the demolition of the two houses located at 503 & SOS South Court Street in the City of Fergus Falls, proceeded to open bids which were found to be as follows: Egge Construction, Pelican Rapids, Minnesota Tim Burris Const. Co., Fergus Falls, Minnesota demolition $8,500.00 demolition 7,680.00 Karen Peterson, Fergus Falls, Minn. purchase certain items 100.00 After consideration, motion was made by Andy Leitch, seconded by Bert Hovland and carried, to accept the bid of Egge Construction, Pelican Rapids, Minnesota in the amount of $8,500.00 for demo Ii tion, it being the lowest qualified bid. Hub Nordgren and Sydney Nelson voted "no". Upon motion made by Bert Hovland, seconded by John Snowberg and carried, the following resolution was adopted: RESOLVED by the Board of County Coilihiissioners of Otter Tail County Minnesota, that WHEREAS pursuant to Mn.S. 116A.10 the firm of Houston Engineering, Inc., Fargo, North Dakota has now filed their report on the Crystal-Lida Sanitary Sewer District, NOW, TIIEREFORE, BE IT RESOLVED, said report by hereby accepted, and the County Auditor directed to file same. Upon motion made by Bert Hovland, seconded by Hub Nordgren and carried, the following resofution was· adopt.ed:_· ~ · RESOLVED by· th_e Board· of County Commissioners of Otter Tail Cowity Minnesota, that WHEREAS pursuant ,to M.S., 116A the Engineer's report on the ·• Crystal-Lida Sanitary Sewer District has been accepted and filed; and WHEREAS viewers have been appointed to determine damages to all lands and properties affected by the proposed system, NOW, THEREFORE, BE IT RESOLVED the tiine and place of hearing for the establishment of the Crystal-Lida Sanitary Sewer District and the review of the asse·ssment roll be set . for 1: 00 P .M., Tuesday, February 27, 1979, in the District Court Room inthe Court House in the City of Fergus Falls, Minnesota. ATTEST: Upon motion made by Bert Hovland, seconded by John Snowberg and carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that WHEREAS on November 8, 1977, the bid for grading and aggregate surfacing, under Proj. 77:01, was awarded to Leonard Hillstrom, Vergas, Minnesota in the amount of $15,807.24, and WHEREAS the above contract has now been completed to the satis- faction of the County Board at a total cost of $15,807.24, NOW, THEREFORE, BE IT RESOLVED, the County Auditor is hereby authorized and directed to~sue a warrant in the amount of $1,580.72 payable to Leonard Hillstrom, Vergas, Minnesota as final payment for this work. Upon motion made by Bert Hovland, seconded by Hub Nordgren and carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail CoWtty Minnesota, that WHEREAS on January 4, 1978, the bid-f?r grading and aggregate . surfacing tinder Proj. 78: 01 was awarded· to Stan Morrill, Inc., Fergus Falls, Minnesota it the amount of $17 ,368.0S, and WHEREAS the above contract has no.w be~n completed to the satis- faction of the County Board at a total cost of $17,275.05, a decrease of $93.00 due to normal variation, NOW, THEREFORE, BE IT RESOLVED, the County Auditor is hereby authorized and directed to issue a warrant in the amount of $2,354.31 payable to Stan Morrill, Inc., Fergus ·Falls, Minnesota as final payment for this work. Upon motion made by John Snowberg, seconded by Bert Hovland and carried, the following resolution was adopted: MINNESOTA DEPARTMENT OF TRANSPORTATION FEDERAL AID FORM NO. III BE IT RESOLVED, That pursuant to Section 161.36, Subdivision 1 through 6, Minnesota Statutes, 1978, the Commissioner of Transpor- tation be appointed as agent of the County of O.tter Tail to let as its agent, contracts for the construction of portions of County Highways and the chairman and the auditor are hereby authorized and directed for and on behalf of the County to execute and enter into a contract with the Commissioner of Transportation prescribing the terms and conditions of such contracts in the form as set forth·. and contained in "Minnesota Department of Transportation Agency Agreement Form No. 30773", a copy of which said form was before the Board,_as- suming on behalf of the County all of the obligations therein contained. Adopted this 3.rd day of 19_79. )(1 (SEAL) Upon motion made by Hub Nordgren, seconded by Andy Leitch and carried, the following resolution was adopted: RESOLUTION BY THE BOARD OF COUNTY COMMISSIONERS OTTER TAIL COUNTY', MINNESOTA BE IT RESOLVED, that the County Highway Engineer be author- ized to issue payrolls for the purpose of salary payments to all maintenance employees, engineering employees, construction employ~ ees, and for the rental of trucks and other equipment"'necessary for the maintenance of County State.Aid Highways not to exceed $800,000 and County Roads not to exceed $200,000 ,for the year 1979. Attest: (SEAL) Upon motion made by John Snowberg, seconded by Bert Hovland and carried, the following resolution was adopted: RESOLUTION BY THE BOARD OF COUNTY COMMISSIONERS OTTER TAIL COUNTY, MINNESOTA WHEREAS, changing road conditions created by temperature changes, rain, snow, traffic, etc., can result in the deteriora- tion and serious damage to roads and highways in Otter Tail County unless weight restrictions are imposed upon the vehicles permitted to operate thereon. NOW, THEREFORE, BE IT RESOLVED, that no person shall operate any vehicle or combination of vehicles upon any restricted county road or highway in the County of Otter Tail and State of Minnesota, generally described as follows: Otter Tail County State Aid Highways and Otter Tail County Roads, where the gross weight on any single axle, as defined in Minnesota Statutes 1945, Sec. 169.87, Sub-division 1, exceeds five tons (10,000 pounds) and the County Highway Engineer of said County is hereby directed and authorized to determine the need and to erect and main- tain appropriate signs plainly indicating the prohibitions and re- strictions at each end of that portion of any highway affected thereby, and these restrictions shall be effective and this prohibition effective upon the erection and maintenance of the appropriate signs. COUNTY OF ENTERED ETA 1056 OTTER TAIL BE IT RESOLVED, That pursuant to Section 161. 39, Subdivision 1· through 6, Minnesota Statutes, 1978, the County Engineer, for and on behalf of the County of Otter Tail, is hereby. authorized to request and obtain from the Minnesota·Department of Transportation, needed engineering and technical•· services for which payment will be made by the County upon receipt of verified claims from the Commissioner of Transportation. This authority is to remain effective until rescinded by either party. I I Upon motion made by Andy Leitch, seconded by John Snowberg and -carried, the following resolution was adopted:· RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that THE BATTLE LAKE REVIEW be and the same is hereby designated as the newspaper in which shall be printed the list of lands in .OtterTail County upon which taxes became delinquent on the first Monday .in January, 1979. Be it further provided that the publishers of said newspaper be required to furnish a surety bond in the sum of $2,000.00 for the faith~ ful performance of said publication.
