OF THE BOARD OF COUNTY COMMISSIONERS

Pursuant to adjournment, the Board of Co1mty Commissioners of
Otter Tail ColDlty Minnesota met at 9:30 A.M., Thursday, September 7, 1978, all
; ·members present.
Upon motion made by John Snowberg, seconded by Sydney Nelson and
carried, the following applications for reduction in assessed valuation were
approved:

Marvin Swan
Leaf Lake Township
Lida Township
Property overvalued
Assessed as having a basement
and has none
Motion was made by Andy Leitch, seconded by John Snowberg and carried,
to approve special aid to Nidaros Township in the amount of $1,200.00 for major
drainage structure.

mously carried, to sell the county shop located in the City of Underwood to the
Township of Sverdrup for $10,000, one-third down, balance in two years, possession
when county vacates property.
Motion was made by Hub Nordgren, seconded by Andy Leitch and unani-
mously carried, to approve special aid in the amount of $215.86 to Eastern·Township.

to approve transfer of property, by metes and bounds descriptions, on property between
a road tobe vacated and a new road built~ in Girar~ Township, subject to approval by
the Otter Tail County Planning ADvisory Commission.

R E S O L U T I O N
WHEREAS, the County of Otter Tail has .obtained th~ Commissioner's
approval of the plans for. the· following County State-Aid Highway Projects:
S.A.P. No. 56-627-05 CSAH No. 27, located 5.5 miles North of CSAH
No. 10 to CSAH No·. 24, 3 iniles East of Erhard. Consisting of Aggre-
gate Base, Bituminous ~urfacing and Aggregate Shouldering.· · ·
s.-A.P. 56-652-02 CTB CSAH No. Old !>2,. located.from·csAH No. 10,.
Northwest· of· Carlisle~ to· CSAH No. 24 in Rothsay. Consis.ting of
Grading, Bituminous Surfacing and Aggregate Shoul~ering, and
WHEREAS, said County·is prepared to proceed.with the construction of
said projects by providing local funds to supplement the available funds in.
the Regular Account of its County State-Aid ~ighway Funds, and
WHEREAS, repayment of the· funds so advanced by.the· County is desired
in accordance with the provisions of Minnesota Statutes 162.08, Subdivisions
5-and 7.
NOW THEREFORE, BE IT RESOLVED: That the.Commissioner of.Transportation
be and is hereby requested to approve this basis for financing said construc-
tion projects and to authorize repayments from the.-subsequent accruals to the
Regular Account of the· County State-Aid Highway F~nd for·said County, within
the limitations provided by law and at the· times and in the· amounts as herein
indicated: (Not to·exceed a period of 5 years.)
On or after Feb~ 1, 1979 -$350,000.00. from.1979 Allotment.

Upon motion made by Andy Leitch, seconded by John Snowberg and
unanimously carried, the following resolution was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail
County Minnesota, that
WHEREAS on July 19, 1977, the County Board accepted the bid for
grading and aggregate surfacing on C.P. 77:119 from Lincoln Construction, Lynd,
Minnesota, in the amount of $105.485.95, and
WHEREAS the above contract has now beencompleted to the satis-
faction of the County Board at a total cost of $106,104.07, an overrun of
$618.12 due to normal variation and liquidated damages deducted in the amount
of $1,200.00,
NOW, fflEREFORE, BE IT RESOLVED, the County Auditor is hereby

authorized and directed to issue a warrant in the amount of $18,766.02 payable
to Lincoln Construction, Lynd, Minnesota as final payment for this work.

WHEREAS application has been made by Gordon Dykhoff to·repurchase
from the State of Minnesota the following described-property:
Sub Lots 1, 6, 7, 8 & 9 of SW~ of Section 33 -135 -36
said property having forfeited for taxes on the 28th of December, 1977 for non-
payment of the 1971 tax, and
WHEREAS the :iabove applicant, being owner of record, has paid
the sum of $,161.47, being the aggregate of all delinquent taxes, assessments,
penalties, costs and interest,
NOW, TifEREFORE, BE IT. RESOLVED'· the Board of County Commissioners

carried, the following resolution was adopted: ·
RESOLVED by the Board of County Commissioners of Otter Tail
County Minnesota that
WHEREAS, in acoordance with a Procedural Agreement between the
Minnesota Department of Natural Resources and the U.S. Fish and Wildlife Service,
•.• dated May 23, 1962, certification by the Comity Board of Commissioners for acqui-
sition of lands by the U.S. Fish. and Wildlife Service is requested, and
WHEREAS, representatives of the U.S. Fish and Wildlife Service
have met with the Board of Commissioners on September 7, 1978, and informed said
Board that a purchase agreement had been secured from Allan D. Backstrom on the
~ SW¼ of Section 16 and the E½ SE¼NE¼, and the NE¼ NE¼ SE¼ of Section 17, all
in 135 -43, and
WHEREAS the above request has been given consideration by said
Board,
NOW, THEREFORE, BE IT RESOLVED, approval for said acquisition by
the U.S. Fish and Wildlife Service on the above described land, be and is hereby
granted.

WHEREAS, in accordance with a Procedural Agreement between the

A petition signed by various residents of Buse Township praying
for approval of purchase by the U. s. Fish·& Wildlife Service of the Eddie
Peterson property· in Buse Township was read. Upon motion made by Andy Leitch,
seconded by Sydney Nelson and carried, said petition was accepted and the·county
Audi tor was authori.zed to file same.
A petition calling for restrictions on the use of Pelican Lake
was read to the Board. UPon motion made by Bert Hovland, seconded by Hub Nordgren
and carried, the petition was accepted and the County Auditor was authorized to
file same, and the Cotmty Attorney was requested to check on the situation.
Motion was made by Bert Hovland, seconded by Sydney Nelson and carried,
to approve an application by, Kalmer· Hanson for reduction of ~ssessed valuation in
the City of Rothsay.
Motion was made by John Snowberg, seconded by Andy Leitch and carried,

Lake Water Sur(ace Use Ordinance.
Motion was made by Sydney Nelson, seconded by Hub Nordgren and carried,
to approve the plat of Shenandoah Ridge, locate4 in Section 23 -136 -41.
Motion was made by Sydney Nelson, seconded by John Snowberg and
carried, to app~ve the plat of Chuc}('s North Shore. View, Second Adcltion, located ' .
in Section 35 -136 4L
Motion was made by Hub Nordgren, seconded by_Andy Leitch and carried,
to approve a special use permit for Kenneth Van Tassel, to expand resort by adding
four cabins to existing resort, located onOtter Tail Lake, Otter Tail Township.
Motion was made by Bert Hovland, seconded by Hub Nordgren and carried,
to approve a special use permit for Harry Dallmann, to cut and fill area on Long Lake
in Elizabeth Township.
Motion was made by Bert Hovland, seconded by Sydney Nelson and carried,
~o approve a special use perinit for ijoward A.~Greterman to roll back front of lot,
on Pelican Lake,· Scambler Township.
Upon motion made by Sydney Nelson, seconded by John Snowberg and
carried, the special use permit for Dorothy Bylander of ByJander's Resort in Dora
Township was approved for three addi tinnal mobile home sites •
Motion was made by Sydney Nelson, seconded by John Snowberg and
carried, to approve an application of George McCullough for special use permit to
fill a low area on West McDonald Lake in Edna Township.
Moti_on was made by Bert Hovland, seconded by· Hub Nordgren and carried,
to approve an application of Calvin Preston for special use· permit to move road on
Preston's Lakeview Beach, Jewett Lake, Elizabeth Township.
Motion was made by Andy Leitch, seconded by Hub Nordgren and carried,
to approve a special use permit for Joseph Koep to expand bait business at Spitzer
Lake in Leaf Mountain Township.
Motion was made by Bert Hovland, seconded by John Snowberg and wtani-
mously carried~ to affirm the decision of the Otter Tail ColD1ty Planning Advisory
Comission in the denial of a special use permit for Dale W. Light to construct
year around dwelling with well and sewage system using excess dirt to slope towards
lake, on Heilberger Lake in Friberg Township.
Motion was made by Bert Hovland, seconded-by Andy Leitch and carried,
to approve a preliminary plat of Winger's Orchar1:}l,1for two lots, to be located in
Sections .33 & 34'-133 -43.
Motion was made by Bert Hovland, seconded by Hub Nordgren and carried,
to approve a preliminary plat of Rostad's Development to be located in Section 32 -
134 -41, on condi.tion that problem of easements be resolved for all people concerned
in a legal form.

to approve a preliminary plat of Adams Point, to be located in Section 7 -135 -39.
Upon motion made by Bert Hovland, seconded by Andy Lei_tch and carried,
a sewage disposal system cleaners license was.approved for Marvin Pederson, Route #1,,
Erhard, and a sewage disposal installers,license was approved for.Waldo Johnson of
Johnson Excavating, Detroit Lakes, Minnesota.
The Board, having previously published notice of hearing on
General Revenue Sharing ftmds as contained in the proposed budget for the year
1979, considered the budget as proposed.

All interested persons were heard but no action taken.
Motion was made by Hub Nordgren, seconde4 by Andy Leitch and carried,
to raise the out-of~county board of prisoners fee to $14.00 per day.
Motion was made by John Snowberg, seconded by Andy Leitch and
carried, to charge the various villages a·sum of 1/2 of the county rate for boarding
of prisoners.
Th.ere being no further business, the Chairman adjoumed the meeting
until 1:00.P.M., Tuesday, September 19, 1978.
