OF THE
BOARD OF COUNTY COMMISSIONERS
OTTER TAIL COUNTY MINNESOTA
Pursuant to adjournment, the Board of County Commissioners of
Otter Tail County Minnesota met at 1:00 P.M., Tuesday, April 25, 1978, all members
present.
Motion was made by Hub Nordgren, seconded by John Snowberg and
unanimously carried, to appoint Robert Reinbold and Frank Johnson to represent_
the county on the Joint County-City Airport Board in the City of He·nning.
The Board, having previously advertised ·for bids to be received
for bituminous material, proce_eded -to open bids which '.were found to be as follows:

After consideration, motion: was made by' John Snowberg, seconded by
Hub Nordgren and carried; to accept the bid of Koch Refining Company, Saint Paul,
Minnesota, in the amount of $.3900 for S.C. and $.3900 for M.C., it being the lowest
bid.
Motion was made by Bert Hovland, seconded by John Snowberg and
· carried, to reroute a road ditch on County #1 in Aurdal Township and pay damages.
Motion was made by John Snowberg, seconded by Andy Leitch and
carried, to approve the bond for Dennis Berend, County Engineer, in the amount of
$50,000.00.
The Board, having previously advertised for bids for seasonal
culvert supplies,. proceeded to open bids which were found to be as follows:

After consideration, motion was made by John s·nowberg, seconded by
. Hub Nordgre_n and carried,' to accept the bids of Northern Culvert Operations, -
Shakopee, Minnesota in the amount of $12,255.14 for steel culv_erts and Elk River
Concrete Products, Minneapolis, Minnesota, in the amount of $20,609.46, -being the
lowest bids.
·Motion was made by Bert Hovland, seconded by Sydney Nelson and
unanimously carried, to approve an application of West Central Speedway, Inc.,·
for license to sell noR-intoxicating malt liq-uor, in Aurdal township, as passed
by the Board of Aurdal Township, suqj<ect to approval by the County Sheriff.

carried, the following applications for license to sell non-intoxicating malt

Upon moti.on made by Hub Nordgren, senonded by Sydney Nelson and
unanimously carried·, the following resolution was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail···
County Minnesota, that
WHEREAS the County wish.es to ~ssist low-moderate income families
to help them better their living and· working conditions.
WHEREAS, City and County have determined that it is desireable
and in the interest of its citizens that the City and County file jointly for
Community Development Block.Grant funds to benefit the same,

NOW, THEREFORE, BE IT RESOLVED the Board of County Commissioners
of Otter Tail County Minnesota.supports the.participation in the joint City-
~ . .
County Cooperative Community Development Block Grant agreement and authorizes
the Chairman of its Board and County Auditor to sign the joint cooperative agree-
ment on behalf of the County.

Motion was made by Hub Nordgren, seconded by Andy Leitch and
carried, to approve the application of Melvin E. Freye for license to sell non-
intoxicating )Jlalt liquor at the Leaf Lakes Grocery in Leaf Lake Township, subject
to approval by the County Sheriff.
Motion was made by Sydney Nelson, seconded by Hub Nordgren and
carried, to establish a per diem of $10.00 for the members of the Board of Adjust-
ment plus other necessary expenses in attending meetings.
The matter of group life insurance came up before the Board for
final action and upon motion made by Andy Leitch, seconded by Sydney Nelson and
carried, the life insurance contract was awarded to Minnesota Mutual Life Insurance
Company, Saint Paul at a rate of $.41 per $1,000, accepted because it contained
no maximum termination age, coverage to become effective June 1, 1978.
Motion was made by Andy Leitch, seconded by John Snowberg and unani-
mously carried, to approve the preliminary plat of Stich & Wagner, to be located in
Section 19 -131 -39.
Motion was made by Andy Leitch, seconded by John Snowberg and carried,
to approve a preliminary plat of Country Manor Estates, to be located in Section 13
of Buse Township, subject to stipulations requested by the Otter Tail County Planning
Advisory Commission.
Motion was made by Sydney Nelson, seconded by Hub Nordgren and
carried, to approve an applfcation of Vern Rinkel for special use permit to land-
scape lot for walkout basement on Marion Lake in Rush Lake Township.
Upon motion made by J.ohn Snowberg, seconded by Hub Nordgren and
carried, the following applications for sewage disposal installers license were

Motion was made by Sydney Nelson, seconded by Hub Nordgren and

Motion was made by Andy Leitch, seconded by Hub Nordgren and carried,
to approve a special use permit for Wailace Johnson, to construct a driveway in Dane
Prairie Township.
Upon motion made by Hub Nordgren, seconded by Sydney Neis on and
carried·, ·•the County Engineer was authorized to advertis~ for bids to be received
until 1:00 P.M., Tuesday, May 23rd, for the following:

Motion was made by Sydney Nelson, seconded by Andy Leitch and unani-
mously carried, to insureT,ce an acceptable detour for future county bridge replace-
ment work, Otter Tail County will provide assistance to Otto Township in the amount
of 50% of the local share.

Upon motion made by Hub Nordgren, seconded by Sydney Nelson and
carried, the following resolution was adopted:
RESOLVED by theBoard of County Commissioners of Otter Tail County
Minnesota, that
WHEREAS in accordance with a Procedural Agreement betwcm the
Minnesota Department of Natural Resources and the U. S. Fish and Wildlife Ser-
vice, dated May 23, 1962, certification by the County Board of Commissioners
for acquisition of lands by the U.S. Fish and Wildlife Service is requested, and
WHEREAS representatives of the U.S. Fish and Wildlife Service met
with the Board of Commissioners of Otter Tail County, State of Minnesota on
April 25, 1978 and informed the Commissioners that a waterfowl easement had been
secured from Mrs. Howard Uhren and Kenneth Uhren on Lots 2 and 3 and NE¼ frac.
SW¼, and NE¼, SE¼ of frac. NW¼, lot 4 and SE¼ SW¼ of Section 19, and the S½ SE¼
of Section 18, all in Folden Township, and the SE¼ SE¼ of Section 24, Nidaros
Township, and
WHEREAS the County Board of Commissioners considered the above
request for acquisition for waterfowl easement by the U.S. Fish and l'lildlife
Service,
NOW, THEREFORE, the Otter Tail County Board of Commissioners does
hereby approve acquisition by the U. S. Fish and Wildlife Service for waterfowl
easement purposes.

Motion was made by Andy Leitch and seconded by Hub Nordgren to
approve the acquisition by the U. S. Fish and Wildlife Service of the Moebius
property in Tumuli Township but if any more requests for puchase in the 3rd Com-
missioner District are over 30% tillable, they will be turned down. Bert Hovland,
John Snowberg .and Syd Nelson voted "no". The motion failed.
Upon motion made by John Snowberg, seconded by Sydney Nelson and
carried, Andy Leitch voting "no", the following resolution was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail _County
Minnesota, that
\~1EREAS in accordance with a Procedural Agreement between the
Minnesota Department of N~tural Resource,s· and the ·u. S. Fish and Wildlife Service,
dated May 23, 1962, certification by the County Board of Co~issioners for acqui-
sition of lands by the U.S. Fish and Wildlife Service is requested, and

25, 1978, and informed the Commissioners that a purchase agreement had been secured

of-way, Section 15, Tumuli Township, and
WHEREAS the County Board considered the above request for acquisi-
tion by the U. S. Fish and Wildlife Service,
. NOW THEREFORE, BE IT RESOLVED, said Board does hereby approve
acquisition by the U. S. Fish and Wildlife Service of the aforementioned property.

Upon motion made by Andy Leitch,· seconded by John Snowberg and
carried, the following resolution was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail
County Minnesota, that
WHEREAS application has been made by Orval! S. Dornholt for the
repurchase of the following described property:
Lot 5. Block 3. Nelson's Add 'n to the City of Fergus \falls.
said property having forfeited to the State of Minnesota for non-p1yrnent of
truces for the years 1968 through 1977. and
WHEREAS said applicant has paid the aggregate of all delinquent
taxes, assessments and penalties in the sum of Four hundred ninety-seven and
24/100 dollars.
NQW, THEREFORE, SAID Board does hereby grant permission to the
above applicant for repurchase to be in the best public interest and r,elieve
undue hardship.

Upon motion made by Andy Leitch, seconded by Hub Nordgren and
unanimously carried, the following resolution was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail
County Minnesota, that
WHEREAS orders setting forth salaries of probation officers are
issued by the court pursuant to Minnesota Statute 260.311 without the advance
courtesy of consulting with the present county board; and
WHEREAS the Board of County Commissioners is aware of the SO% re-
imbursement factor for c9mparable statewide salaries, which is provided for in
the law, and which in effect, indirectly allows the state to dictate local salaries,
and
WHEREAS the County Board recognizes the constitutional separation
of powers and that the judicial system is a separate branch of county government
co-equal with the executive branch of county government,· and
Wf:[EREAS the County Board is responsible for the total county budget,
including the local share of the county court budget; and
WHEREAS, under Minnesota Statute 260.311, Subd. 5 the state has not
given county boards the power to approve or .disapprove of court-ordered salary in-
creases for probation officers,
NOW, THEREFORE, BE. IT ~SOLVED by the Boa~d of Commissioners of
Otter Tail County Minnesota that the County Board of Commissioners objects to the
amount of the salary increases ·ordered· b·y the court,
BE lT FURTHER RESOLVED, that the County Board of Commissioners ob-; : ~ ' . ..
j ects to the provisions of Minnesota Statute 260. 311 which virtually requires
the salaries of coW1ty probation officers to be the same as state probation offi-
cers, in effect, allowing the state to dictate local salaries.
BE IT FURTHER RESOLVED that. the CoW1ty Board of Commissioners ob-
jects to the provisions of Minnesota Statute 260. 311 which allows the coW1ty
court to order the salary of county probation officers without the approval or
disapproval of the coWlty board of commissioners.
BE IT FURTHER RESOLVED, that each legislator representing Otter
Tail County be and hereby is urged to support legislation limiting the authority
of state agencies to dicta~e directly and indirectly local salaries and giving
cotmty boards veto power over salaries established pursuant to Minnesota Statute
260 .311.
BE IT FURTHER RESOLVED that a copy of this resolution be for-
warded to each legislator representing Otter Tail County.

unanimously carried, to grant the County Engineer authority to appoint group
leaders in the maintenance crews.
Upon motion made by Andy Leitch, seconded by Hub Nordgren and
carried, the meeting was adjourned until 9:30 A.M., Tuesday, May 9, 1978.
