MINUTES OF THE KDJ0URNED MEETING
OF THE
BOARD OF COUNTY COMMISSIONERS
OTTER TAIL COUNTY MINNESOTA
I
Pursuant to adjournment, the Board of County Commissioners of
Otter Tail County Minnesota met at 9:30 A.M., Tuesday, March 7, 1978, all members
present.
Bob Barker of the Hesb¥:,,.-Barker Insurance Agency, Fergus Falls,
appeared before the Board with a proposal for workmen's compensation insurance
at a net estimated annual cost of $45,385.00. Since the county's current carrier
has notified the county of their discontinuance as of March 1st, with an extension
requested until April 1st by the local agent, motion was made by John Snowberg,
seconded by Andy Leitch and carried, to accept the proposal for workmen's compensa-
tion from the Hesby-Barker Agency, Fergus Falls, Minnesota at a net estimated annual
cost of $45,385.00.
N6ble Hatling of the Fergus Falls Rifle and Pistol Club appeared be-
fore the Board relative to the need for a rifle range. No action taken.
Glen Melby, Under-Sheriff appeared before the Board and presented
the Sheriff's Department's Annual Report for 1977.
Representatives of the West Otter Tail County Soil & Water Conser-
vation District appeared before the Board relative to the possibility of erecting
a tree storage building. No action taken.
Motion was made by Hub Nordgren, seconded by Sydney Nelson and
unanimously carried, to approve payment to Road & Bridge Fund for services ex-
pended for sanitary landfill engineering as follows:

Upon motion made by Andy Leitch, seconded by Hub Nordgren and carried,
the County Engineer was authorized to advertise for bids to be received until 10:00
A.M., Thursday, April 13th, 1978, for roadside mowing.
Motion was made by Sydney Nelson, seconded by John Snowberg and carried,

Motion was made by Bert Hovland, seconded by Andy Leitch and unani-
mously carried, to approve the application of Gary Spies for on sale liquor license
at Mable Murphy's in Fergus Falls Township.
Motion was made by John Snowberg, seconded by Hub Nordgren and carried,
Syd Nelson and Andy Leitch abstaining, to approve payment in the amount of.$424.64,
balance due on the log cabin purchased by the Phelps Mill Park Committee from Ted

to make application to the City of Fergus ·Fall,s for a ~onditional use pennit for the
erection of a building to be· located on Lots 13, 14, 15 and 16, Block 42, Original
Plat of the City of Fergus Falls.

Upon motion made by Hub Nordgren, seconded by Andy Leitch and
unanimously carried, the following resolution was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail
County Minnesota, that
WHEREAS legislation has been introduced under H.F. 2245 which
would eliminate the right of sheriffs to appeal their budgets to the district
court on the ground that county boards acted arbitrarily and capriciously in
setting their salaries or budgets, and
WHEREAS said Board favors such legislation,
NOW, THEREFORE BE IT HEREBY RESOLVED, the Board of County
Commissioners of Otter Tail County ur~es-passageof H.F. 2245 (S.F. 2175) and
urges all Otter Tail County representatives vote in favor thereof.

Upon motion made by Andy Leitch; seconded by Hub Nordgren and
unanimously carried, the following resolution was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail
County Minnesota, that
WHEREAS the M.P.C.A. has developed current Feedlot Regulations,
and
WHEREAS it w~s the M.P.C.A. 's desire to administer and enforce
feedlot regulations out of their St. Paul Headquarters, and
WHEREAS the M.P.C.A. has on several occasions requested that
Otter Tail Cowtty·administer and enforce M.P.C.A. feedlot regulations which
Otter Tail Cowtty Board of Commissioners has declined, and
WHEREAS proposed S.F. 2164 and H.F. 2320 would force counties
to administer and enforce feedlot regulations,
NOW, THEREFORE BE IT RESOLVED that Otter Tail Cowtty Board of
Commissioners opposes both S.F. 2164 and H.F. 2320 because t~e regulations are
unrealistic, burdensome and. would require expenditures of Otter Tail County
taxpayers' dollars for regulations which are not needed and undesirable.

unanimously carried, the following resolution was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail
County Minnesota, that
WHEREAS legislation has .been introduced under HF 2079 and SF
1663, whereby authority i~ould be given to the County Boards for setting of
salaries for probation officers,
.'-.NOW, THEREFORE, BE IT HEREBY RESOLVED, said County Board
of Otter Tail County does favor said legislation and urges the representative~
of Otter Tail County to vote in favor thereof.

unanimously carried, the County Engineer was authorized to call for bids to be
received until 11:00 o'clock A.M., April 13, 1978, for the following
(1) CONSTRUCT CONCRETE ARCH CULVERTS
S .A. P. 56-598-02, Bridge Replacement with three 154"' Span
R.C. P-A Culverts over the Pelican River
(2) CONSTRUCT CONCRETE BOX CULVERTS
S.A.P. 56-608-05, Bridge Replacement with one 12' x 8' concrete box
culvert over stream. Also includes 12,000 c.y. of
earthwork and 880 c.y. of aggregate surfacing

There being no further business, the Chairman adjourned the
meeting until 9:30 A.M., Wednesday, March 8, 1978.

Pursuant to adjournment, the Board of County Commissioners of
Otter Tail County Minnesota met at 9:30 A.M., Wednesday, March 8, 1978, all
members present.
Upon motion made by Hub Nordgren, seconded by Sydney Nelson and
carried, the following applications for license to sell non-intoxicating malt
liquor were approved:

Motion was made by Andy Leitch, seconded by John Snowberg and
· carried, to enter into agreement with Computer Concepts and Services, Inc., for
a one year term and the Chairman was authorized to execute agreements on behalf
of Otter Tail County.
Motion was made by Andy Leitch, seconded by Hub Nordgren and carried,
to drop a mandatory yearly review on a special use permit for Gilbert Garza, with
the stipulation no expansion is made in building facilities.

Motion was made by Bert Hovland, seconded by Hub Nordgren and unani-
mously carried, to approve a preliminary plat of Suncrest Terrace, located in Section
24, Fergus Falls Township, contingent upon access to township road •.
Upon motion made by Sydney Nelson, seconded by John Snowberg and
unanimously carried, the following resolution was adopted:
RESOLUTION
WHEREAS, the State of Minnesota, through the Minnesota Depart-
ment of Transportation, has provided available funds to replace defi--.
cient bridges, and
WHEREAS, Otter Tail County, on February 6, 1978 at a Public
Meeting, did approve a long range Bridge and Highway Construction
Plan, and
WHEREAS, the replacement of existing Bridge No. L0898 was listed
as a top priority work item for 1978 construction, and
WHEREAS, Bridge No. L0898 is now on record as being deficient
by the Minnesota Department of Transportation and, therefore, eligible
for State assistance.
NOW THEREFORE, BE IT RESOLVED, that Otter Tail County does declare
this structure to be deficient and does approve plans for its replace-
ment.
BE IT FURTHER RESOLVED, that Otter Tail County does request
State financial assistance in the replacement of this structure.

Upon motion made by Andy Leitch, seconded by John Snowberg and
unanimously carried, the following resolution was adopted:
RESOLUTION
BE IT RESOLVED, that the County of Otter Tail, State of
Minnesota, through its Board of County Commissioners, make appli-
cation through the Division of Emergency Services to the Executive
Council for financial assistance for Snow Removal_ provisions of
Minnesota State Statute 9.061.
Reason for Request
The blizzards of early November, 1977, created extremely
large snow removal expenditures which will af_fect normal County
Highway Department programs for years to come, unless some finan-
cial assistance is. obtained.

A preliminary plat of Walden Hills, located in Sections 19 and 20
of Leaf MoW1tain Township was presented to the Board for approval. Upon motion
made by Andy Leitch, seconded by Bert Hovland and carried, action was table until
March 21st at which time the town board members will be requested to appear to
present their opinion on said plat.
Motion was made by Andy Leitch, seconded by John Snowberg and unani-
mously carried, to deny approval of a preliminary plat of Stich & Wagner Develop-
ment, Section 19 -131 -39.
Motion was made by Hub Nordgren, seconded by Sydney Nelson and carried,
to table action on an application of Steven Heifort, for special use pennit to change
use of resort.

Excavate and cut area, 7 feet deep
Upon motion made by Hub Nordgren, seconded by John Snowberg and
carried, the meeting was adjourned until 1:00 P.M., Tuesday, March 21st, 1978.
