HomeMy WebLinkAboutBoard of Commissioners - Minutes - 09/06/1977MINUTES OF TIIE ADJOURNED MEETING OF rnE BOARD OF COUNTY COMMISSIONERS OTTER TAIL COUNTY MINNESOTA Pursuant to adjournment, the Board of Cotmty Commissioners of Otter Tail County Minnesota met at 9:30 A.M., Tuesday, September 6, 1977, all members present. The Board, having previously advertised for bids for snow removal equipment proceeded to open bids which were found to be as follows: Little Falls Machine Co., Little FaDs, Minnesota $17,300.00 (less $350.00 trans.) Upon moti~n made by John Snowberg; seconded by Bert Hovland and unanimously carried, the b.id of Little Falls .Machine Co., Little Falls, Minnesota in the amount of $16,9~0.00 was accepted, it being the only bid. Clayton Rudolph appeared before the Board requesting a split on Lot 1, Kimber Beach. UPon motion made by Hub Nordgren, seconded by John Snowberg and carried, permission was.granted to split the lot, provided each split is of at least 100 feet of lakeshore. Motion was made by Andy Leitch, seconded by Hub Nordgren and carried, to deny recommendation of approval for Nutrition Project, Project No. 534, by the Otter Tail-Wadena CAC to West Central Regional Development Commission for grant funds as it appears to be a duplication of projects already commenced by t~e De- partment.of H\Dllan Services. The Board, having previously advertised for bids to be received for the NW¼ NE¼ of Section 32 -134 -40, .upon receiving no bids, determined upon motion made by Hub Nordgren, se<;on_ded by Bert Hovland and carried, not to make any more attempts at selling, at least for the present. Motion was made by John s:r:iowberg, that because of the present financial condition of the County, to remove all township road aid, except for major drainage structure, until such a time the financial condition changes. The motion was seconded by Andy Leitch but.,failed with Bert Hovland, Hub Nordgren and Sydney Nelson voting "no". / Upon motion made by Andy Leitch, seconded by Hub Nordgren and unanimously carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that WHEREAS the U. _ S. ~ish and WildHfe Service has made application to the Minnesota Land Exchange Board for the fee title acquisition of the SW¼ NE¼, NE¼ SW1/4 excepting those tracts respectiveiy described as ·being part of SE¼ NW¼ included within the following metes -and bounds description: Begin at NE corner of said SE¼ NW1/4, thence S along 1/4 section line to SE corner of said SE¼ NW¼, th. W along 1/4-section line -to a stake at road centerline, th. NWly along road center- line app~x. 2,000 feet t_o a stake, th. E ly approx. 310 feet to a stake, .th. NWly approx. 95 feet to a stake, thn N ly·ap.p.rox •. 500 feet.to a stake on the 1/16 line, thn. E along subdiv. line approx. 2,140 feet to P.O.B., all located in Section 11 - 132 -43, and WHeREAS, such acquisition under the Procedural AGreement between the United States Fish and Wildlife Service and the State of Minnesota requires approval by the. Board of County Commissioners in the County in which said land is located, NOW, THEREFORE, BE IT HEREBY RESOLVED, because of possible annexa- tion to the City of Fegus Falls of the above_ described lands,_ the . S. Fish and Wildlife. Service .has made application to the Minnesota Land Exchange Board for easement 9f the :fii.lowing described property: Lot S, Section 11; SW¼ NW1/4, SE¼ SW¼, S½ SE¼ of Section 13;. Adopted at Fergus Falls,, Minnesota this 6th day of September, 1977 • . ·~ i,ivr· Chairman~l ATTEST: ~.J b B7t!!£1 r/J_ · · ' · Clerk Upon motion made by Hub Nordgren, seconded by Bert Hovland and unanimously carried, the following resolution was adopted: RESOLUTION WHEREAS, the State of· M,i.rinesota is• in the process of establishing a network of designated 10 ton per axle truck routes, and WHEREAS, several.requests have been bro~ght to the attention of the Otter Tail County Board of Commissioners, NOW, THEREFORE, BE IT RESOLVED, that Otter Tail County does not approve or support 10 ton designations on any County administered highway located outside an incorporated City Limit, including CSAH #9, CSAH #24, CSAH #Old 52 and the rural portions of CSAH /tl9 and CSAH 1135. BE IT FURTHER RESOLVED, that Otter Tail County does support 10 ton route designations on certain County administeredhighways located within incorporated cities, with each municipal request for a 10 ton route being considered on an individual basis by the County, providing however that the City is served by a designated 10 ton route and the affected City passes a resolution to approve and support the 10 ton route designation, possibly including the municipal portions of CSAH #19 and CSAH 1135. Chairma, tter Tail County Board of Commissioners Upon motion made by Andy Leitch, seconded by John Snowberg and unani- mously carried, the following resolution was adopted: RESOLUTION REGULAR AID TO TOWNSHIPS WHEREAS, the County Board of Commissioners on April 10, 1973 did then agree by reaolution to aid Townships according to the amounts levied by the T?wnship for Road' and Bridge purposes, and WHEREAS, Minnesota St~te Law has placed an annual increase limitation on the amount of tax revenue that can be raised by Otter Tail County, and WHEREAS, in recent years the increased annual operating costs have far exceeded the limitation amount, and WHEREAS, Townships are not required to operate under this restriction, and WHEREAS, it has been determined by Otter Tail County that County assistance and services must be curtailed if the County is to continue to operate under this restriction. NOW, THEREFORE, BE IT RESOLVED, that beginning in the year 1978 payments of Township Aid shall be suspended by Otter Tail County and the resolution of April 10, 1973 is hereby rescinded. BE IT FURTHER RESOLVED, that this resolution remain in effect until such time as the Board determines that the levy limitation restrictions and/or overall financial conditions have changed to warrant an increase in the level of County assistance to Townships. BE IT FURTHER RESOLVED, that this resolution does not pro- hibit the County Board from taking future action deemed necessary regarding Township Aid. Adopted September 6 , 1977. ------'------------ Ch Board of Conunissioners Attest: (SEAL) Upon motion made by John Snowberg, seconded by Hub Nordgren and carried, Bert Hovland and Sydney Nelson voting "no", the following resolution was adopted: RESOLUTION SPECIAL AID TO OTHERS WHEREAS, Minnesota State Law has placed an annual increase limitation on the amount of tax revenue that can be raised by Otter Tail County, and WHEREAS, in recent years the increased annual operating costs have far exceeded the limitation amount, and. WHEREAS, Townships, and other agencies, are not required to operate under this restriction, and WHEREAS, it has been determined by Otter Tail County that County assis- tance and services must be curtailed if the County is to continue to operate under this restriction, and WHEREAS, the Otter Tail County Board has determined that any Township to qualify for County financial assistance for Bituminous Surfacing, Special Road Construction, Major Drainage Structure Construction, etc., must demon- strate a need for. financial assistance, and WHEREAS, the amount levied by a Township is a major indication of self help and probable need. NOW, THEREFORE, BE IT RESOLVED, that the mill levy shall be the primary criteria used by the County to determine a need for financial assistance to Townships. BE IT ALSO RESOLVED, that to be eligible any township requesting County financial assistance must levy a minimum mill rate of 8.00 mills for Road and Bridge purposes. BE IT ALSO RESOLVED, that beginning in the year 1978, the County will provide free engineering on eligible and approved work requested by Townships that levy an established minimum assistance mill rate, or more, as determined and established by the County, and all work performed by the County for others will be billed to the respective party in an amount sufficient to cover the costs of all the work provided, including the·appropriate labor additives and also including a 15% overhead charge on all the labor, equipment rental, materials and services furnished, with the understanding that County work will be of top priority. BE IT ALSO RESOLVED, that beginning the year '1978, the amount of County Aid on approved Township-County Bituminous Surfacing projects shall be limited to free engineering for the Townships that levy an established minimum assis- tance mill rate, or more, as determined and established by the County. BE IT ALSO RESOLVED, that the cost sharing ratio on Major Drainage Structures will be 50% County and 50% for the other governmental sub units. BE IT ALSO RESOLVED, that Special Aid can be given by Board action to any Township for a specific Road and Bridge project in an amount up to $500.00, provided the Township is levying the,minimum assistance mill rate, or more, as determined and established by the County, and funds are. available. BE IT ALSO RESOLVED, that all financial assistance requests to the County, involving $100.00 or more, shall be accompanied by a certified written resolution, or a written work authorization from the requesting party, before any considera- tion or action shall be taken by the County, and the request application shall explain the nature of the request in sufficient detail, including an estimate of cost, so appropriate action can be 'taken. BE IT FURTHER RESOLVED, that this resolution supersedes all prior Board action regarding Special Aid to Others and shall remain in effect until such time as the Board determines that the levy limitation restrictions and/or over- all financial conditions have changed to warrant an increase in the level of County Assistance to others. _BE IT FURTHER RESOLVED, that this resolution does not prohibit the County Board from taking any future action deemed necessary regarding Special Aid, including, but not limited to, the further reduction or the elimination of County Aid to others . . There being no further business, the Chairman declared the meeting adjourned until 9: 30 A.M., Wednesday, September 7, 1977. I WEDNESDAY'S SESSION Pursuant to adjournment, the Board of County Commissioners of Otter Tail County Minnesota met at 9:30 A.M., Wednesday,S'ep.temberl:;J, 1977, all members present. Motion was made by Hub Nordgren, seconded by John Snowberg and carried, Syd Nelson voting "no", authorizing the County Auditor to advertise for bids to be received until 10:30 A.M., Tuesday, October 11, 1977, for two cars, to be used by the County Assessor's office. Motion was made by Hub Nordgren, seconded by John Snowberg and carried, Syd Nelson voting "no", authorizing the County Auditor to advertise for bids to be received· until 11:00 A.M., Tuesday, October 11th, for two cars to be used by .the County Sheriff's Department. Pursuant to published notice a hearing was held on a resolution of August 9, 1977, calling·for an increase of ten percent (10%) over the levy limitation for Otter Tail County. Upon motion made by Hub Nordgren, seconded by Bert Hovland and carried, to continue the hearing until 9:30 A.M., Monday, September 12th at which time a final decision will be made. I Motion was made by John Snowberg, seconded by Bert Hovland and carried, to approve the following resolution: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that WHEREAS the Board of County Commissioners accepted the bid of Minnesota Motor Company, Fergus Falls, Minnesota on August 23, 1977, in the amount of $7,828.87 for two 1977 Chevrolet LUV pickups, and WHEREAS the above pickups have now been delivered to the satis- faction of the Co\D'lty Board and the County Engineer, NOW, THEREFORE, the County Auditor is hereby authorized and directed to issue a warrant in the amount of $7,838.87 to Minnesota Motor Company, Fergus Falls, Minnesota, in full payment thereof. Upon motion made by Hub Nordgren, seconded by Bert Hovland and carried, Sydney Nelson and Andy Leitch voting "no", the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that WHEREAS the Subdivision of Otter Tail County Minnesota has sustained major losses as a result of a windstorm on August 26, 1977 WHEREAS a considerable amount of damage has occurred to farm buildings and crops, and WHEREAS extreme hardship has been inflicted on the disaster victims through inability to secure loans or credit to make necessary repairs and restora- tion; NOW, THEREFORE, be it resolved that the Board of Commissioners of Otter Tail County, for anion behalf of the citizens of Otter Tail County request that the Governor of the State of Minnesota petition the Region Director of the Federal Disaster Assistance Administration to request the Small Business Administra- tion to make emergency loans available under the provisions of Public Law 93-24.
