OTTER TAIL COUNTY MINNESOTA
. . Pursuant to adjournment, the Board of County Commissioners of
Otter Tail County Minnesota met at 1:00 P.~L, Tuesday, August 23, 1977, John.
Snowberg absent.
Motion was made by Hub Nordgren, seconded by Andy Leitch, to
purchase two compact cars for use by the assessor's office. Upon roll call vote,
Bert Hovland and Sydney Nelson voted no, Andy Leitch and Hub Nordgren voted yes,
motion failed.
The Board·, having previously advertised for bids to be received' for . '
two pickups and two tan~em· axle trucks for use by the highway.department, proceeded
to open bids which were found to be as follows:·

After consideration, motion was made-by Bert Hovland, seconded by Hub
Nordgren and unanimously carried, to accept the bid of Minnesota Motor Company, Fergus
' ' Falls, Minnesota, in the amount of $7,828.87 for two Chevy Luy pickups, it b_eing the
only bid. Motion .. ~as made by Bert Hovland, seconded by. Hub Nordgren and unanimously
carried, to acceptthe bid of Super G~M.C.Truck Sales, Fergus Falls, Minnesota, in the
. .
amount of $50,757.78 for-the two·tandem axle ·trucks, it being the lowest bid.
Motion was made by Bert Hovtand, seconded by Sydney Nelson and carried,
to approve the), agreements for the Otter Tail Trail Association #1 and the Pelican Trail
Association·snowmobile trail assistance program grants-in-aid with.the stipulation
there is to be no financial responsibility on the part of the county.
Upon motion made by Hub Nordgren, seconded by Sydney Nelson and .
carried, the County Auditor was authorized to advertise for bids to be received
until 1:30 P.M., September 20th, 1977; for one privately owned PABX telephone
system, for use in the Court House.
Motion was made by Bert Hovland, seconded by Sydney Nelson and
carried, .to ·.recommend•}A.:,Hub~rt;,Nordgren to the Environmental Quality Board as a
person to serve on the pptential Critical Area Nominatinn Conunittee.
Motion was made by Sydney Nelson, seconded by Hub NordgreQ and
carried, to approve the application of Cyril L. Dombeck for on sale liquor license
for Dombeck Enterprises, Inc., at Liiinks &i:J,.~es-,~Supper qub, Perham, Minnesota.
Upon motion made by Andy Leitch, seconded by Sydney Nelson and
carried, the following applications for permit to sell non-intoxicating malt liquor
were approved:

Upon motipn made by Bert Hovland, seconded by Sydney Nelson and
carried, the County Auditor was authorized to advertise for bids to be received
unt1l 1:30 P.M., Wednesday, October 12th, 1977, for the construction of a new
highway department building, to be located in Section 20 of Aurdal Township.
Upon motion made by. Bert Hovland, seconded by Sydney Nelson and
carried, the County Auditor was authorized to advertise for bids to be received
until 2:00 P.M., Tuesday, September 20, 1977, for construction of concrete cul-
verts and township road over the Pelican R~ver,· under project S.A.P. 56-599-02.
Motion was made by Andy Leitch, seconded by Bert Hovland and unani-
mously carried, to approve an application for special use permit for the construction
of. an access road to a survey plat in Section-16 -133 -41, by Irving Sem, subject
to approval by Sverdrup Township Board.
Motion was made by Sydney Nelson, seconded by Hub Nordgren and unani-
. mously carried, to approve the application of Jack Cavanaugh for special use permit
to construction a road to serve a new subdivision, located in Section 7 of Pine Lake.
Township, subject to township requirements.
Motion was made by Bert Hovland, seconded.by Hub Nordgren and unani-
mously carried, to· approve the preliminary plat of K & B Properties, located in
Section 24 -133 -43.
Motion was made by Sydney Nelson, seconded by Andy Leitch and unani-
preltminary mously carried, to approve the/plat of Ridgeview Estates, 2nd Add'n, to be located
in Section 7 -136 -38.
Motion was made by Sydney Nelson, seconded by Bert Hovland and.unani-
mously carried, to appi'pve the preliminary plat of Freedom Flyers Estates, located
in Sections 29'and 32 of Hobart Township.
Motion was made by Hub Nordgren, seconded by Bert Hovland and unani-
mously carried, to approve the preliminary plat of Oak Grove Estates, located in
Section 16 -134 -36.
Motion .was made by Bert Hovland, seconded by Andy Leitch and unani-
mously carried; to approve an abatement of a county ditch assessment on State
property located in Section 21 -133 -43.
Motion was made by Hub .. Nordgren, seconded by Bert Hovland and unani-
mously carried, to set the 1978 budget hearing for 1:00 P.M., Tuesday, September
20, 1977, and the County Auditor was authorized to publish necessary notices.
Motion was made by Sydney, Nelson, seconded by Bert Hovland and
carried, to foregive interest, penalties.and costs arid accept a·net tax payment
on a parcel in G.L. 2, Section 2 -135 ;.,.40:,:on a 1971 delinquent tax, where a
certification of no delinquent taxes,was made,upon transfer of a deed in the
County Auditor's office -in 1976.
Motion was made by Bert Hovland, seconded by Hub Nordgren and unani~
mously carried, to doclDnent unused vacation. time for Sylvia Bergerud_ prior to her
I appointment as County Auditor, to be 6 days unused 19~6 vacation, .plus 16½ days
1977 vacation time, to be compensated at clerk's salary, or to be used at the
discretion of Mrs. Bergerud.

RESOLVED by the Board of CoW1ty Commissioners of Otter Tail
County Minnesota~ that
WHEREAS· ori J\Ule 7, 1977; the County Board accepted the bid for
sand sealing various county roads from Allied Blacktop Company, Minneapolis·,-
Minnesota in the amount of $138,887.85, and
WHEREAS the above contact h~s now been completed to the satis-
faction·of the County Board at a total cost of $150,255.02, an increase of
$11,367.17 due to more additive and aggregate being needed,
NOW, THEREFORE, the CountyAuditor is-hereby authorized and
directed ~o issue a warrant in the amount of $15,025 .~o ,· payable to Allied

Upon motion made by Hub Nordgren:, ·seconded by Bert Hovland and
wianimously carried, the following resolution was adopted:
RESOLUTION .
WHEREAS, the Otter Tail County Board of Commissioners did
receive a petition of. property owners from Otter Tail Township
requesting, among other.things,·an ext~nsion_ of a speed zone, and
WHEREAS, Otter Tail Township has also supported and re-
quested a change in the.speed zones, and
WHEREAS, ·the c01:itinued and ,extensive development along the
shore of Otter Tail Lak~ has made a review of the existing speed
zones desirable,
NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County
Board of Commissioners does hereby request that the Minnesota
Commissioner of Transportation review and take the action required
to revise the speed zones, as necessary, for the safe use by the
public on the County.State Aid Highways serving the.West and North
sides of Otter Tail Lake.

RESOLUTION.
WHEREAS, the Otter Tail County Board of Cormnissioners wish
to go on record to support the existing level of State Highway
Maintenance in the Pelican Rapids Area.
NOW,· THEREFORE, BE.LT RESQLVED,·that the Otter Tail County
Board of Cormnissioners does request that the·: State of Minnesota
continue to base highway maintenance equipment and personnel in
the Pelican Rapids Area to maintain the level of transportation
services in theconnnunity~

unanimously carried, the following resolution was adopted:
RESOLUTION
WHEREAS, the County Board ·of Otter Tail County has adopted
a resolution on August 23, 1977, to relocate County State Aid Highway
No. 51 within, and adjacent to, the corporate limits of the City of
Perham, and
WHEREAS, it has been determined by the County that, in the
future, the old alignm~nt will.primarily serve local traffic needs.

NOW, THEREFORE, BE IT RESOLVED, that the old portion of
County State Aid Highway No. 51, cut off by the relocation described
as follows:
Beginning at the intersection of Third Avenue S.W. and Main
Street in the City of Perham, thence in a northerly direc-
tion 2,666.4 feet to a point 828.5 feet North of thesouth-
east corner of Section 10-Tl36N-R39W, length 0.51 mile,
be turned over to the City of· Perham 1 s .. jurisdiction and control, as
provided by law.

unanimously carried, the following resolution was adopted:
RESOLUTION FOR ALTERING COUNTY. STATE AID HIGHWAYS
WHEREAS, preparatory action has been completed for the alter-
ing of the County State Aid Highway System in Otter Tail County, and
WHE~AS, such alteration will require that new highway desig-
nations be made and that revocations of portions of old highway de-
signations also be made, and
WHEREAS, it appears to the County Board of the County of Otter
Tail that the roads hereinafter described should be designated, or
revoked, as County State Aid Highways under the provisions of Minne-
sota Laws of 1967, Chapter 162.
NOW, THEREFORE, BE IT RESOLVED, by the. County Board of the
County of Otter Tail, that the road described as follows, to~wit:
Beginning at a point 1,523.0 feet East of the South Quarter
corner of Section 31-Tl34N~R40W, thence in a northeasterly
direction 7,899.7 feet to a point 533.5 feet North of the

unanimously carried, the following resolution was adopted:

WHEREAS, reconstruction of Trunk Highway No. 10 in the City
of Bluffton has made additional revisions of the County State Aid
Highway System in Otter Tail County desirable, and
WHEREAS, such alteration will require that new highway desig-
nations be made and that revocations of portions of old highway de-
signations also be made, and
WHEREAS, it appears to the County Board of the County of Otter
Tail that the roads hereinafter described should be designated, or
revoked, as County State Aid Highways under the provisions of Minne-
sota Laws of 1967, Chapter 162.
NOW, THEREFORE, BE IT RESOLVED, by the County Board of the
County of Otter Tail, that the road described as follows, to-wit:
Beginning in the City of Bluffton at the junction of Prospect
Street and the northerly right of way line of the westbound
lane of new Trunk Highway No. 10; thence North 1,115 feet
on Prospect Street to a point 330 feet North of Fourth Street,
which is the junction with existing County State Aid Highway
No. 19, length 0.21 mile,
be, and hereby is, established, located and designated as County
State Aid Highway No. 19, subject to the approval of the Commissioner
of Transportation of the State of Minnesota.
BE IT FURTHER RESOLVED, that the portion of road described
as follows, to-wit:
Beginning in t,he City of Bluffton at the junction of Center
Street and old Trunk Highway No. 10; thence North 1,320 feet
on Center Street to a point 330 feet North of Fourth Street,
thence West 366 feet to Prospect Street and there terminating,
length 0.32 mile,
be, and hereby is, revoked as County State·Aid Highway No. 19, subject
to the approval of the Commissioner of Transportation of the State of
Minnesota.
BE IT FURTHER RESOLVED, that the road described as follows,
to-wit:
Beginning in the City of Bluffton at the junction of Second
Street and Center Street; thence on Second Street 366 feet
to Prospect Street and there terminating, length 0.07 mile,
be, and hereby is, established, located and designated as County State
Aid Highway No. 77, subject to the approval of the Commissioner of
Transportation of the State of Minnesota.
BE IT FURTHER RESOLVED, that the County Auditor is hereby
authorized and directed to forward two certified copies of this
resolution to the Connnissioner of Transportation for his considera-
tion, and that upon his approval of the new designations of said
roads, or portions thereof, that the same be constructed, improved
and maintained as County State Aid Highways of the County of
Otter Tail.
BE IT FURTHER RESOLVED, that the old portion of CSAH No. 19
cut off by the relocation be turned over to the City of Bluffton's
jurisdiction and control, as provided by law.

Upon motion made by Hub Nordgren, seconded by Andy Leitch and
unanimously carried, the following resolution was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail
County Minnesota, that
WHEREAS a resolution has been passed by the Town Board of the
Township of Nidaros requesting the Department of Natural Resources restore
the dam in the creek between East Battle Lake and West Battle Lake to main-
tain the water level in East Battle Lake, and also to install a dam in the
outlet in West Battle Lake to maintain its water level, and
WHEREAS it is the opinion of this County Board, granting such
a request would be to the best public interest,
NOW, THEREFORE BE IT HEREBY RESOLVED the Department of Natural
Resources make a study to determine the feasibility of restoration of the dam
in the creek between East Battle Lake and West Battle Lake to maintain the
water level in East Battle Lake, and also to install a dam in the outlet in
West/ Battle Lake to maintain its water level.

Upon motion made by Hub Nordgren, seconded by Andy Leitch and unani-
mously carried, the following resolution was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail County
Minnesota, that
WHEREAS, On July 1, 1977, the County Board accepted the bid of
Burroughs Corp. Fargo, North Dakota, for System 2 Data Processing System in the
amount of ,$55,528.00, plus shipping and handling of $675.74, and
WHEREAS the above contact has now been completed to the satisfac-
tion of the County Board, at a total cost of $55,528.00, plus shipping and handling
of $700.00, and increase of $24.26 due to normal variation,
NOW, THEREFORE, the County Auditor is hereby authorized and directed
to issue a warrant in the amount of $56,228.00 payable to Burroughs Corp. Fargo,
North Dakota, in full payment thereof.

. Otter Tail County act as a sponsoring unit of government .for
a project titled Otter Tail County AFLIS Terminali. to be conducted by the
Otter Tail County Sheriff's Department during the feriod from ·January 1, 1978
through December 31, 1978, and
BE IT FURTHER RESOLVED the Chairman of the Board is hereby
authorized to apply to the Governor's Commission on Crime Prevention and Con-
trol for funding of the project on behalf of Otter Tail County,

carried, the following resolution was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail
County Minnesota, that
WHEREAS during the audit of county business by the State
Auditors, it was recommended the County Attorney's Contingent Fund and the
Incidental Fund be closed out and all transactions run through the County
Revenue Fund,
NOW, THEREFORE, BE IT HEREBY RESOLVED, the County Auditor
is to take whatever steps are necessary and make the proper journal entries
to close out the County Attorney's Contingent Fund and the Incidental Fund
and nm all payments previously made out of the County Attorney's Contingent
Fund and the Incidental Fund through the County Revenue Fund.

Upon motion made by Bert Hovland, seconded by Hub Nordgren and
unanimously carried, the following resolution was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail
County Minnesota,
WHEREAS the Board of County Commissioners on February 14, 1968
passed a resolution granting permission to the Department of Interior, United-
Stafes Fish and Wildlife Service, .Bureau of Sports Fisheries and Wildlife for -.
the acquisition under the small wetlands program of 2?,,000 total acres, and
WHEREAS the present Countr Board deems_it in the best interests
' of the people of O~ter Tail Cowity t'o rescind said-resolution,
.. NOW, THEREFORE, BE, IT HEREBY RESOLVED, all lands purchased by
the United States Fish and Wildlife_ Service will require the approval by a
majority of the Board of County Commissioners in the county where the land to
be purchased is located •

Upon motion made by Hub Nordgren, seconded by Bert Hovland and
carried, the Chairman of the Board was authorized to sign an agreement on behalf
of Otter Tail County with the City of Fergus Falls for environmental health ser-·
vices under the Community.Health Service Plan.
There being no further business, the Chairman declared the
meeting adjourned until September 6, 1977, at 9:30 A.M.
