BOARD OF COUNTY COMMISSIONERS.
OTTER TAIL COUNTY MINNESOTA
Pursuant to adjournment, the Board of County Commissioners of
Otter Tail County met at 9: 30 A .M. , Tuesday, August 9, 1977, all members present.
Upon motion made by Sydney Nelson, seconded by John Snowberg and
unanimously carried, the following applicatiats for license to sell non-intoxicating
malt liquor were approved:

Upon motion made ·by Bert Hov·land, seconded by John Snowberg and ·
unanimously carried, . the County Engineer was authorized to advertise for bids to
be received until 9:30 A.M., September 6, 1977, for snow removal equipment.
Motion was made by John Snowberg, seconded by Hub Nordgren and
unanimously carried, to confirm the sale of the county owned property in Fergus
Falls Township known as the ''Haugen Property", to Don Beltrand of Fergus Falls,
for the sum of $59,000.00, and the Chairman of the Board and the County Auditor
were authorized to execute a deed to Mr. Beltrand.
The Board, having previously.advertised for bids to be received
for highway striping, proceeded to open bids which were found to be as follows:

Upon motion made by Hub Nordgren, seconded by John Snowberg and
unanimously carried, awarding of the contract was postponed until Wednesday,
August 10th.
Motion was made by Bert Hovland, seconded by John Snowberg and
unanimously carried, to furnish lists of new car sales to automobile dealers
as a service, at 20¢ per name.
The matter of bids for hospitalization insurance for county employees
was brought up for. final action and upon motion made by John Snowberg, seconded by
Sydney Nelson and unanimously carried, the bid of Blue Cross-Blue Shield of Minnesota
at a premium of $26.29 single coverage and $65.41 family coverage, subject to removal
of the restriction on death or inuury resulting from assault, felony or misdemeanor
and self inflicted injury.
Motion was made by John Snowberg, seconded by Andy Leitch, authorizing
the County Engineer to obtain quotations for the purchase of an electronic measuring
lDlit, Sydney Nelson, Hub Nordgren and Bert Hovland voting "no", motion failed.
Motion was made by Andy Leitch, seconded by Sydney Nelson and unani-
mously carried, to grant permission to Arnold Schroeder to utilize the road ditch
and two approaches on CSAH 182 at Dalton as a holding dike to contain possible petro-
leum spills from storage tanks located next to the road, provided that Mr. Schroeder
is entirelr responsible for installing, monitoring and maintaining flow control
gates on the culverts in the approaches. These gates must be such that flow through
the culverts will only be restricted in the event of a petroleum spill, and in the
event of such spill, Mr. Schroeder will be held entirely responsible for all clean
up activities and will be held liable for any, or all, damages whatsoever. Also,
providing that this solution for a spillage-container is and continues to be accep-
table to the Minnesota P.C.A.
Motion was made by Hub Nordgren, seconded by Sydney Nelson and 1D1ani-
mously carried, to establish a policy of granting the cost of living increase to
be effective after the six month probationary period.
Motion was made by Andy Leitch, seconded by Hub Nordgren and unani-
mously carried, to deny the recommendation of'the personnel committeefor a salary
increase for Delores Baker on the basis no classification changes or 911.ary increases
in the middle of \the year.
Upon motion made by Hub Nordgren, seconded by John Snowberg and
·unanimously carried, the following resolutbn was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail
County Minnesota, that
WHEREAS application has been made by Bernadine Kamphake, owner
of record of the following described property:
SE¼ NW¼ of Section 26 -131 -37
for the repurchase of said .property having forfeited to the State of Minnesota
·on September 20, 1973 for non=payment of the 1967 tax and subsequent years, and
WHEREAS applicant has pai~ the aggregat.e of all delinquent taxes,
' ' . -penalties, costs and interest in the amount of $181.35,
NOW., THEREFORE, ·the County .Board does hereby approve said appli-

cation and that permission to repurchase be' granted in the best public interest
and relieve undue hardship.

Be it resolved that the Minneso.ta. Commissioner of Trans-
portation be and h~ hereby i~ authorized an~ req~este~ to t~ke
such steps ,and perform such acts on behalf of the County of Ot~er
·Tail as may be necessary to have the construction and improvement
of the ro~ds hereinafter described piopetly ·~pproved by the
Federal Highway Administrator as a Federal-Aid secondary project
eligible for the expenditure of federal funds thereon and eligible
for present construction arid the lettihg of cont~acts therefor.
Approximately 16.2 miles, of.County State Aid Highway N~. 1
from 0.5 mile Northeast of Fergus Falls to County State Aid
Highway No. 83,.l.mile West of Otter Tail .Lake, including

WHEREAS, -it has. been deemed to .be in the best interest of
Otter Tail County to add the extra seasonal requirements.· for
base and bituminous surfacing and sand seal work to existing
County corii:racts, when and where it is practical-to do so.
NOW THEREFORE, BE IT.RESOLVED, that the. County Highway
Engineer is hereby designated and authorized to perform all the
actions necessary on behalf of Otter Tail County to accomplish
this extra work.
BE _IT FURTHER RESOLVED, that this procedure may be utilized
for all previous County Board approved projects, whether Board
approval is written or verbal, and also on any future project
approved by the County Board.
BE IT FURTHER RESOLVED, that this practice shall be in
effect until changed by action of the County Board.

RESOLUTION
BE IT RESOLVED, that work on the previously approved
one (1) mile road project of base and bituminous surfacing
for Effington Township, located in Section 32 and costing
approximately $25,000.00, shall _be added to the 1978 Otter
Tail County Base and Bituminous Surfacing Contract.and
that 1977 County assistance policies shall be used~

Upon motion made by Bert Hovland, seconded by Hub Nordgren and
unanimously carried, the following resolution was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail
County Minnesota, that the following described project is hereby approved
by Otter Tail County and the County Highway Engineer shall take such action
needed to have the work completed.
BE IT FURTHER RESOLVED, that the work may be included in
future County contracts, added to existing County contracts or by any
other method deemed to be the most advantageous to the County:

Upon motion made by Hub Nordgren, seconded by Bert Hovland and
wtanimously carried, the following resolution was adopted:
RESOLUTION
WHEREAS, the Minnesota Department of Transportation, Highway
Division, has reconstructed Trunk Highway No. 10 in the City of
Bluffton, and
WHEREAS, the reconstruction did require the realignment of
County State Aid Highway No. 77, and
WHEREAS, the reconstructed portion of CSAH No •. 77 is designed
to meet rural State Aid Standards, and
WHEREAS, the recons·tructed portion is eligible for State Aid
Designation.
NOW THEREFORE, BE IT RESOLVED, that the following described
segment of highway be designated as County State Aid Highway No. 77:
Beginning at a point on CSAH #77 which is approximately 265.0
feet North and 750.0 feet East of the center of Section 30-
135-36; thence in a northwesterly direction to the South
right of way line of the eastbound lane of new T.H. #10;
beginning again on the northerly right of way line of the
westbound lane of new T.H. #10; thence in a northwesterly
direction to the intersection of Second Street and Main
Street in Bluffton; thence westerly along Second Street to
the intersection of Second Street and Center Street and
there terminate, length 0.48 mile.
BE IT FURTHER RESOLVED, that the old portion of CSAH No. 77
cut off by the relocation be turned over to City of Bluffton juris-
diction and control, as provided by law.

'RESOLVED by the Board of County Commissioners of OtterTail County
Minnesota, that
WHEREAS levy limitations for Otter Tail County are greatly affec-
ting the County's ability to function, and
WHEREAS. continued limitations as presently.set up will necessarily
curtail vital services, and
WHEREAS Chapter 423, Laws of 1977, Article S, Section 6, allows
the Board of County CoDDllissioners to increase the levy limitation of their
county by ten percent (10%), and
WHEREAS it is the feeling of this County Board it would be to
the best interest of the people of Otter Tail County to insure public service
at present level,
NOW, THEREFORE, the County Boar4 does hereby set a hearing on the
establishment of an increase of $248.650.21 over and above the present levy limi-
tation, and

WHEREAS on·the 18th of September, 1968, the following described
property forfeited to the State of Minnesota for non-payment of taxes:

RESOLVED by the Board of County Commissioners of Otter Tail
County Minnesota, that
WHEREAS Minnesota Statutes 361.26 provides that the Commissioner
of Natural Resources may, if he determines it to be in the ?est public interest,
establish regulatbm,-relating to the use of watercraft on the waters of this State,
and
WHEREAS area residents and public opinion are in favor of the,
prohibition of water skiing\\On Portage Lake, located part in Ottertai 1 City, part
in Sections 23 and 24 of Otter Tail Township and part in Section 18 of Leaf Lake
Township, all in Otter Tail Co\Dlty,
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners
in and for the Co\Dlty of Otter Tail, State of Minnesota, that the Commissioner of
Natural Resources be and he hereby is respectfully requested to take such steps
as are required by ,statute to establish regulations relating to the prohibition of
water skiing on Portage Lake, Sections 23 and 24, Otter Tail Township, Section 18,
Leaf Lake Township, and Ottertail City.

ORDINANCE RELATING TO PROHIBITION OF ALCOHOLIC BEVERAGES AT PHELPS MILL PARK
The Comity Board of Otter Tail Comity Ordains:
SUBDIVISION 1. The use, sale, consumption or possession of alcoholic
beverages, including 3.2 beer, within the confines·of Phelps Mill Park, Otter
TaU Comity, Minnesota, is hereby prohibited.
SUBDIVIS~ON 2. All violations of this ordinance shall be pmiishable as
a misdemeanor.
SUBDIVISION 3. Effective date. This ordinance shall be in full force and
effect upon due passage and upon publication in the·Fergus Falls Journal at
. !·
least once separately, or as part of the publication of the official minute~ of·
the proceedings of the Board of Commissioners of Otter Tail County of the meeting
at which the ordinance was enacted.

unanimously carried, the following resoluti>n was adopted:
RESOLVED by the Board.of County Commissioners of Otter Tail
County Minnesota that·
WHEREAS the City of. Perham.Minnesota has passe~ a resolution
calling for maximum punishment for habitual juvenile and adult offenders, and
WHEREAS the City Council of the City of Perham has requested
full cooperation from the County Board,
NOW, THEREFORE, BE IT HEREBY RESOLVED, the"Board of County
Commissioners of Otter Tail County does hereby pledge its support and coopera-
tion in a. joint effort to do everything to_ see that habitual offenders are
punished to the maximum extent possible.

RESOLUTION
WHEREAS, Nidaros Township has made application to the Minne-
sota Department of Natural Resources for-a construction permit to
place a culvert on Vining Creek, and
WHEREAS, Otter Tail County does acknowledge that approximately
4.5 acres of low lying land would be flooded during the 1OO-year storm.
BE IT RESOLVED, that Otter Tail County does support this design
provided that the Township does obtain consent from the affected land
owner.
