HomeMy WebLinkAboutBoard of Commissioners - Minutes - 03/22/1977MINUTES OF THE ADjOURNED MEETING OF THE BOARD OF COUNTY COMMISSIONERS OTTER TAIL COUNTY MINNESOTA ' Pursuant to-adjournment, the Board of County Commissioners of Otter Tail County Minnesota met at 1:00 P.M., Tuesday, March 22nd, 1977, all members present. Upon motion made by Hub Nordgren, seconded by Sydney Nelson and unanimously carried, Bert Hovland and K. W. Hanson were authorized to attend the A.M.C. Delegate Assembly II to be held April 3rd and 4th. Upon motion made by John Snowberg, seconded by Sydney Nelson and unanimously carried, the County Audi to:r 1\las authorized to advertise for bids to be received until 2-:30 P.M.,Tuesday, April 19, 1977, for approximately 50,000 gallons SC and 200,000 gallons MC to be delivered at any point in Otter Tai 1 County by transport truck, equipped \•lith pump for unloading. UPon motion made by Bert Hovland, seconded by Sydney Nelson and unanimously ca:r:ried, the County Audi tor was authorized to advertise for bids to be received until 2:45 P.M., Tuesday, April 19, 1977 for seasonal culvert supplies. Upon motion made by John Snowberg, seconded by Bert Hovland and unani- mously carried, the County Audito:r.M-a'~ authorized to reimburse the Road & Bridge Fund by the following amounts from the County Building Fund for certain repair work: Remodelling of downstairs room in Engineer's office Replace door panels, County Garage -#3 1 Replace Door, County Garage #17 Replace roof, County·Garage #18 Landscape lot -County Garage #20 $ 623.98 360 .43 956.61 ~ 1,429.79 7,339.54 $10,710.35 Motion was made by Bert Hovland, seconded by John Snowberg and unani- mously carried, to proceed with drawing up an agreement with the Moorhead State University Department of Sociology and Anthropology relative to salvaging archae- ology at Otter Tail Lake along CSAH #1. Upon motion made by Sydney Nelson, seconded by John Snowberg and unani- mously carried, Don Tweet was granted permission to convey up to five lots, 150' in width but at least four acres in size, property located in Government Lot 4, Section 15, Edna Township. I Upon motion made by John Snowberg, seconded by Andy Leitch and unani- mously carried, the County Auditor was authorized to advertise a hearing to be held at 1:30 P.M., Tuesday, April 19th, for the purpose of redistricting the county. Motion was made by Bert Hovland, seconded by Hub Nordgren and unani- mously carried, to approve the Crystal Lida Sewer District considering the possibility of excluding the portion known as Inlet Beach and the metes and bounds area between Inlet Beach and Crystal Lida Beaches belonging to Earl Davis and Dallas Davis, with the provision this area would qualify for individual sewer disposal systems. Motion was made by Bert Hovland, seconded by Sydney ·.Nelsoi:i and unani- mously carried, authorizing the County Auditor to advertise· for bids to be received until 9: 30 A.M., May 10th, for the follmving grading and aggregate surfacing: S.A.P. 56-627-04 Length 5.446 miles, located from 5.3 miles north of CSAH#lO to CSAH 1/-24. S.A.P. 56-641-03 Length 4.266 miles, located from T.H. #108 to 4.3 miles north S.A.P. 56-679-01 Length 3.339 miles, located from the south county line to T.H. 235 C.P. 77:136 Length 7.992 miles, located from a point 1 mile north of CSAH #6· on T.H. #29 to a point 3 miles north of CSAH #6 on T.H. #29. Also, from CSAH #42 to a point .74 mile north. The following resolution was introduced by Andy Leitch who moved for its adoption: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that WHEREAS the Minnesota State Legislature has established the mechanics for reviewing state agency regulations, and WHEREAS Subdivision 2 of the Preamble to the Minnesota Pollution Control Agency on Solid Waste Regulations states, "In adopting standards, the pollution control agency shall give due reco·gnition to the fact that elements of control which may be reasonable and proper·;'.tn1..:.dens~!Y populated areas of the state may be unreasonable and improp~r in sparsely populated or remote areas of the state," and WHEREAS the Minnesota Poll~tion Control Agency has one (1) set of solid waste standards for. all areas of ~he state and the variance procedure . . for and deviation from this set o·f standards are' c:umbersome, inefficient and not in the best interest of achieving the solid waste management objectives of the solid waste laws, NOW, THEREFORE, BE IT HEREBY RESOLVED, that theLegislative Review Board interpret whether the Subdivision 2, mentioned above, requires two (2) sets of standards or one set of standards for solid waste disposal regulations. The above motion was seconded by Hub Nordgren and upon a unanimous vote was declared adopted, this 22nd day of March, 1977. ATTEST: ~ ~~Clerk Upon motion made by Bert Hovland, seconded by Sydney Nelson and unanimously carried, the following resolution was adopted: RESOLVED by the Bard of· County Commissioners -of Otter Tail County Minnesota, that The stipulation agreement dated September 28,. 1976 between the Minnesota Pollution Control Agency and the City of Pelican Rapids compares favorably with the Otter Tail County Minnesota Solid Waste Plan and is hereby approved. ([' . -~ ATTEST~~ -Clerk I Commissioner Bert Hovland introduced the following resolution and moved its adoption: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that WHEREAS: A. Nine of ten parcels owned by pers_ons objecting to the proposed improvements could be exUuded from the proposed sewer district by shortening the southeasterly leg of the proposed sewer district to exclude Lots 1 through 12 of Inlet Beach and exclude two metes and bounds parcels owned by Earl and Dallas Davis which are located between Inlet Beach and Crystal-Lida Beaches; B. Said portion of Inlet Beach has such a low elevation that the lots may not be in compliance with existing sewer laws and ordinances; C. A determination of feasibility and necessity will be made with respect to Crystal-Lida Sewer District either including or excluding said portion of Inlet Beach and said metes and bounds parcels. NOW, THEREFORE, BE IT RESOLVED by the County Board of the County of Otter Tail, Minnesota, as follows: 1. The County Land and Resource Administrator is ;hereby ordered to proceed to determine which of the following described parcels are presently in com- pliance with existing laws and ordinances relating to sewage disposal: Lots 1 through 12 of Inlet Beach and two metes and bounds parcels mmed by Earl and Dallas Davis which are located betwean Inlet Beach and Crystal- Lida Beaches. 2. ht the determination of the area to be covered by the proposed Crystal-Lida Sewer District be taken under advisement until said determination is made by the County Land and Resource Administrator, and that further action thereon be accordingly be deferred until the regular meeting of April 19, 1977. 3. That at the time the order is issued to Houston Engineering, Inc., to make a detailed survey and to prepare all necessary plans and specifications for the proposed improvements, said order be c-onditioned upon the petitioners filing an additional bond with the County to cover the costs of same; and that said bond to- gether with the previously filed bond shall total $15,000.00. 4. That further action by the County Board of the County of Otter Tail, Minnesota, with respect to said proposed Crystal-Lida Sewer District Improve- ments be taken under advisement and that further action thereon be accordingly de- ferred until the regular April 19, 1977 meeting of the County Board. The motion for the adoption of the foregoing resolution was duly seconded by Commissioner John Snowberg, and upon a vote being taken thereon, the following voted in favor thereof: Sydney G. Nelson, Bert Hovland, Andy Leitch, A. Hub Nordgren and John Snowberg and the following voted against the same: none Whereupon said resolution was declared duly passed and adopted at Fergus Falls, Minnesota this 22nd day of March, 1977.
