HomeMy WebLinkAboutBoard of Commissioners - Minutes - 11/06/1973MINUTES OF THE ADJOUR:\!ED MEETING OF THE BOARD OF COUNTY CQMMISSIONERS OTTER TAIL COUNTY MINNESOTA Pursuant to adjournment, the Board of County Commissioners of Otter Tail County Minne.sota met at 9: 30 A.M., Tuesday, November 6, 1973, all members present. Motion was made by Richard Dillon, seconded by George lfal ter and - unanimously carried, to approve the minutes of the previous meetings. A delegation from the Fergus Falls Chamber of Commerce appeared before the Board requesting consideration be made relative to establishing a conciliation court. Judges Polkinghorn & Boe appeared and explained their posi- tion. The County Board requested the Judges explore methods of starting a con- ciliation court. Motion was made by John Snowberg, seconded by Richard Dillon and unanimously carried, to appropriate a sum of $200.00 for a D.W.I. clinic fund and $25.00 be designated registration fee. Upon motion made by Richard Dillon, seconded by Hub Nordgren and unanimously carried, the following applications for reduction of assessed valuation were approved: Morris Lucas Oliver Orpen Virginia Dodds George & Ardis Brandvig Shell Oil Co. Norman Boehne Lida Township Wrong measurement on cabin Lida Township 65' lot assessed as 100' Dunn Township Lot overvalued Dunn Township Cottage incomplete Fergus Falls Township Land value changed Parkers Prairie Village Foregiveness of penalty Motion was made by Richard Dillon, seconded by George Walter and unanimously carried, to delete bid items #24, #25 & #26 from the radio equipment bid and readvertise for same. Upon motion made by Andy Leitch, seconded by George Walter and unanimously carried, the followi_ng resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that WHEREAS the County Board, on February 13, 1973 accepted the bid of Mark Sand & Gravel Company, Fergu_s Falls, Minnesota in the amount of $99,483.50 for Aggregate Base and Plant Mixed Bituminous Surfacing on County Highway #112, and WHEREAS the above contract has now been completed to the satis- faction of the County Board at a total cost of $102,147.19, an increase of $2,663.69 due to the need for additional -bituminous material for mixture and additional wearing_ course mixture, NOW, THEREFORE, the County Auditor is hereby authorized and directed to issue a warrant in the amount of $13,827 ,04 payable to Mark Sand & Gravel Company, Fergus Falls, Minnesota, as final payment for this work, said warrant to be issued out of the Federal Revenue Sharing Fund. Clerk T Upon motion made by George Walter, seconded by John Snowbe_rg and unanimously carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that WHEREAS the County Boa,rd, on February 13, 1973 accepted the bid of Mark Sand & Gravel Company, Fergus Falls, Minnesota in the amount of $125,527.00 for Aggregate Base and Road Mix Bituminous Surfacing on County Highway #137, and WHEREAS the above contract has now been completed to the satis- faction of the Cow1ty Board at a total cost of $1?7,239.89, an increase of $i,712.89 due to normal variation, NOW THEREFORE, the County Auditor is hereby authorized and directed to issue a warrant in the amount of $92,365.61 payable to Mark Sand & Gravel Company, Fergus Falls, Minnesota, as final payment for this work, said warrant to be issued out of the Federal Revenue Sharing Fund, ATTEST: Dated at Fergus Falls, Minnesota this 6th day of November, 1973. ~ Clerk ~ DJ__ Ch~ The matter of the petition of State of Minnesota, by Ray Lappegaard, · its Commissioner of Highways, for the right to make minor alterations or changes in ~ounty Ditch No. 38 and County Ditch No. 38--Branch 3 in Otter Tail County, .came up for final action. Upon motion made by George Walter, seconded by John Snowberg:::and unanimously carried, the following order was issued, to-wit: The above entitled matter came on for hearing before the County Board of Otter Tail Coun:ty, in the County Commissioners' Room in the Court House in Fergus Falls, Minnesota, on the 6th day of November, 1973, at 2:00 o'clock P.M. The petitioner appeared by Bernard Revering. The petitioner ,:.presented evidence in support of its petition for permission to make minor alterations or changes in Otter Tail qounty Ditch No. 38 and County Ditch No. 38--Branch 3, all. as shown in the plan sheets attached to the petition. It was made to appear that the minor alterations or changes in said Otter Tail County Ditch No. 38-and_County Ditch No. 38--Br;inch 3, petitioned for by the Pt:titioner, would be advant.ageous or desirable in the maintenance and con- st ruction of Trunk H.ighway No. 10. It was further made to appear that said minor alterations or changes in said County Ditch No. 38 and County Ditch No. 38--Branch 3 would in no way impair the efficiency or functioning of the drainage system. The County Board having heard the evidence adduced by the petitioner in support of its petition for permission to make minor alterations or changes in Otter Tail County Ditch No. 38 and County Ditch No,. 38--Branch 3, all as shown in plan sheets marked Exhibit "A-38", and made a part thereof, hereby makes its Order consenting to and granting permission to said petitioner to make the miri6r alter- ations or changes in Otter Tail County Ditch No. 38 and County Ditch No. 38--Branch 3, all as shown in exhibit marked "A-38" and made a part thereof. The Board further orders that the petitioner, State of Minnesota, by Ray Lappegaard, Commissioner of Highways, pay to the County of Otter Tail the sum of $46.87 for publication fees and $is.so for filing fees, incurred by said County in this matter. IT IS FURTI-IER ORDERED that damages, if any, for any additional lands necessary for said changes or alterations shall be paid by the petitioner herein. It was further made to appear that said minor alterations or cha_nges in said County Ditch No. 41 would in no way iinpair the efficiency or functioning of the drainage system. The Board, having previously advertised for bids to be received for steel posts proceeded to open bids which were found to be as follows: Paper, Calmenson & Co. M-R Sign Company, Inc. The Board, having previously advertised for bids to be received . ) for a two way radio system for the Otter Tail County Highway Department, proceeded to open bids which were found to be as follows: RCA Corporation Des Plaines, Illinois General Electri~ Minneapolis, Minnesota $26,306.35, excluding Items #14 & #15 $31,107.00 complete The bids were turned over to the County Engineer for review and study. Upon motion made by George Walter, seconded by John Snowberg and unanimously carried, the followi_ng resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that WHEREAS Dorothy K. Krueger has made application to repurchase the followi_ng described property: E 400' of S 250' of SE¼ NE¼ of Section 15 "'." Township 135 -Range 39 said property havi_ng forfeited to the State of Minnesota for non-payment of 1967 taxes and havi_ng paid the sum of $83 .65 being the aggregate amount of all delinquent taxes and assessments with penalties, costs and interest, NOW, THEREFORE the County Board does hereby approve said application· 'to be. to the best public interest 3.nd relieve undue hardship. ATTEST: Clerk Upon motion made by George Walter, seconded by Richard Dillon and unanimously carried, the following resolution was ·adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that WHEREAS Howard Lund has made· application to repurchase the following described property: Lots 12 and 13, Block 2 Blowers First Add'n to the Village of New YOrk Mills said property having forfeited to tl1e State of Minnesota for non-payment of the 1966 tax, and having paid the sum of $279.77 being the aggregate amount of all delinquent taxes and assessments with penalties, costs and interest, · NOW, THEREFORE, the County Board does hereby approve said application to be to the best public interest and relieve undue hardship. ATTEST~ Clerk Larry Streif of the Otter Tail County Soil Conservation District appeared before the Board and explained highway ditch erosion problems at various locations in the county. The County Board instructed Streif to proceed with study. Motion was made by George Walter, seconded by Hub Nordgren and carried, to rescind the motion awarding the bid of the county highway department building in New York Mills to Anderson Bros., Fergus Falls, Minnesota, because of errors in bidding. Motion was made by Geo::rge Walter, seconded by Hub Nordgren and carried, to award the contract for building the highway department building in New York Mills to Olinger_ Construction Co., Brainerd, Minnesota, in the amount of $149,500.00, it being the lowest bid. Motion was made by Hub Nordgren, seconded by Richard Dillon and unanimously carried, ,;to authorize the County Board Chairman to s_ign slope ease- ments -on the SW¼ SW¼ and Part of NW¼ SW¼, Section 1 Buse Township, lying south of Trunk H_igh,fay 1/-210. Motion was made by Hub Nordgren, seconded by George Walter and· unanimously carried, to reject the State Highway Department's offer of $22,800.00 fot the county h_ighway buildi_ng and five acres of land at New York Mills. Motion was made by Hub Nordgren, seconded by John Snowberg and carried, to approve the bonds of David Oelslager, Ervin Siems and John Skramstad, employees in the County Assessor's office, each in the amount of $1,000 with Integrity Mutual Insurance Company. Motion was made by Andy Leitch, seconded by Richard Dillon and unanimously carried, to withdraw application for the Rabbit River Watershed as requested by the sponsors. WEDNESDAY'S SESSION Pursuant to adjournment, the Board of County Commissioners met at 9:30 A.M., Wednesday, November 7th, 1973, all member present. Motion was made by Hub Nordgren, seconded by George Walter and unanimously carried, to allow special aid in the amount of $300.00 to Eastern Township. The Board, having·previously. advertised for bids for two auto- mobiles for use by the East and West Otter Tail County Extension Service offices, proceeded to open bids which were found to be as follows: F~rgus Dodge, Inc. Minnesota Motor Co. Fergus Falls, Minnesota Fergus _Falls, Minnesota Price per auto $3,415.00 3,449.34 After reviewing, motion was made by Hub Nordgren, seconded by John Snowberg and unanimously carried, to accept the bid of one Dodge Monaco from Fergus Dodge, Inc., Fergus Falls, Minnesota, in the amount of $3,~llS.OO .. , - for use by the West Otter Tail County Extension Service, it being the lowest bid. The East Otter Tail County _Agent requested they not obtain a car at this time. Motion was made by Richard Dillon, seconded by Hub Nordgren and carried, authorizing, Rob't Oslund to proceed with ordering aerial photos necessary for Otter Tail County. After reviewing_ the two-way radio system bids as presented to the Board on November 6th, motion was made by John Snowbe_rg, seconded by George Walter and unanimously carried, to accept the bid of General Electric in the amount of $31,107.00, it being the only complete bid. Motion was made by John Snowberg, seconded j:Jy George Walter and carried, Hub Nor_dgren and Andy Leitch voting "no", to participate in the con-. struction of the Main,· Street Bridge in the City of Fergus Falls, in the amount of 1/2 of the cost of the bridge, but not to exceed $55,000.00. Motion was ni.adc by Geofge Walter, seconded by Hub Nor_dgren and unanimously carried, to approve the final plat of "San Souci". Motion was made by Richard Dillon, seconded by John Snowberg and unanimously carried, to approve the survey for Mike Anderson in Government Lot 3, Section 10 -137 -42~ Motion was made by John Snowberg, seconded by Andy Leitch and unanimously carried, to grant the City of Fergus Falls a County Sanitary Land Fi 11 Permit . Motion was made by Hub Nordgren, seconded by Richard Oil lon and unanimously carried, to approve a sewage disposal systems cleaners license for Joe Jai:sak, Vini_ng, Minneeota. Upon motion made by Richard Dillon, seconded by George Walter and unanimously carried, the followi_ng applications for special use permit were approved: Clarence Miller Maine _Township Paul Wegner Maplewood Township Cut bank along shoreline (conditional requirements) Slope bank, subject to conditional fequirements Motion was made by Richard Dillon, seconded by John Snowberg and unanimously carried, to approve the application of Lowell Bulson for reduction in the assessed valuation of a mobile home located in Amor Township. As authorized by Sec; · Hl6. 4 71, Subd. 5 & 6. Minnesota Statutes• motion was made by Richard Dillon, seconded by Hub Nordgren and unanimously carried, authorizi_ng and instructing the County Auditor to make the following assessinents to be collected with taxes payable in 1974 on the followi_ng ditches and in the following amounts, to-wit: Ditch #42 Ditch #56 Di;tch #3 Ditch #59 Ditch #45 $300.00 500.00 124.34 250.00 300.00 The following resolution was introduced by Andy Leitch who moved for its adoption: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that WHEREAS Otter Tail County is a member of Region Four, · WHEREAS one of the prime reaons for Regional Programs is to act as . liaison between Federal. State and local uni ts of government, WHEREAS a problem exists in state required solid waste laws, WHEREAS State solid waste laws were designed for densely populated areas such as Hennepin and Ramsey County, WHEREAS current state solid waste laws are unrealistic, unworkable and economically unfeasible in rural areas, NOW, HEREBY BE IT RESOLVED, that the Otter Tail County Board of Commissioners•; request Region Four to explore the possibility of more lenient solid waste laws to serve the sparsely populated areas of the state, such as Region Four. Clerk Upon motion made by Hub Nordgren, seconded by Richard Dillon and l . tuta.nimously carried, the following resolution was adopted: I I RESOLVED by the Board of County Commissioners of Otter Tail i Cqunty Minnesota, that WHEREAS in June of 1972 the Otter Tail County Boa.rd passed a I Final Solid Waste Management Plan, and I WHEREAS an addendum to this plan was requested together with I ailisting of designated proposed land fill sites, by the M.P.C.A., NOW, THEREFORE, be it resolved the County Board does hereby adopt said Final Solid Waste Management Plan together with addendum to said i Pl~an and authorizes the Shoreland Management Administrator to furnish a listing of designated proposed land fill sites to the Minnesota Pollution Control i .
