HomeMy WebLinkAboutBoard of Commissioners - Minutes - 10/09/1973MINUTES OF THE ADJOU~~ED MEETING OF THE BOARD OF COUNTY COMMISSIONERS OTTER TAIL COUNTY MINNESOTA Pursuant to adjournment, the Board of County Commissioners of Otter Tail County Minnesota met at 9:30 A.M., Tuesday, October 9th, 1973, all members present. Upon motion made by Richard Dillon~ seconded by Geo17ge Walter and carried, the minutes of the September meeting were approved. The Board, having previously advertised for bids to be received for the purchase of one 1974 police car, 4 dr. sedan with trade-in of one 1972 'Dodge, proceeded to open bids which were found to be as follows: Bid Price Trade-In Net Price Fergus Dodge, Ifi'c. $4,850.00 $1,766.40 $3,083.60 Minnesota Motor Co. 4,959.40 1,688.00 3,271.40 The Board, having previously advertised for bids to be received for the purchase of one 1974 4-Dr. Standard Sedan with trade-in of one 1971 Dodge Polara, proceeded to open bids which were found to be as follows: Fergus Dodge, Inc. Minnesota Motor Co. Bi.d Price $4,300.00 4,344.40 Trade-In $1,305.00 1,145.00 Net Price $2,995.00 3,199.40 The Board, having previously advertised for bids to be received for the purchase of one 1973 or 1974 walk-in van, proceeded to open bids which were found to be as follows: Minnesota Motor Company International Harvester $5,023.65 5,780.00 After consideration, motion was made by Geo.rge Walter, seconded by John Snowberg and carried, Hub Nordgren voting "no", to accept the bids of Fergus Dodge, INc., for'$3,083.60 and $2,995.00 and Minnesota Motor Company for $5,023.65, being the lowest bids. ;--~~\ . \ ,,,....---,) The following resolution was introduced by Andy Leitch who moved for its adoption: RESOLVED by the Board of County Commissioners of Otter Tail I County Minnesota, ·that WHEREAS the Underwood· Village Sanitary Landfill meets the minimum requirements of the Otter Tail County Solid Waste Ordinance,· and WHEREAS vegetable fiber material constitutes more than fifty per- cent (50%) of solid waste bulk material, WHEREAS vegetable fiber material is delineated in the Solid Waste Ordinance heretofore mentioned above, WHEREAS combustion is the most efficient method to achieve volume reduction objectives, WHEREAS land availability for world food production· purposes is rapidly deminishi.ng to the presures of an expanding urbanized society, WHEREAS the nation· faces an energy crisis and the Governor of Minnesota is considering mandatory petroleum rationing, and WHEREAS the covering of vegetable fiber waste by heavy earth moving equipment would consume vast volumes of diesel fuel, WHEREAS diesel fuel is vitally needed for· world food production purposes, and WHEREAS the Otter Tail County Board of Commissioners would like to cooperate with the Governor's program to conserve diesel fuel, NOW, THEREFORE, be it hereby resolved by the Board of County Commissioners of Otter Tail County, Minnesota, that a burni_ng permit be issued to the Underwood Vill_age Sanitary Landfill. Motion was seconded by Hub Nor_dgren. Yes votes -5 No votes -O Dated at Fergus Falls, Minnesota this 9th day of October, 1973. ~ ATTES~ Clerk The followi_ng. resolution was introduced by Richard Dillon who moved for .its adoptbn: RESOLVED by the Board of.County Commissioners of Otter Tail County Minnesota, that WHEREAS the Saint Paul Winter Carnival Association~ Inc., Saint Paul, Minnesota, has made a request to Otter Tail County for permission to run _ the route of the 1974 Saint Paul Winter Carnival International "500" Snowmobile Race through Otter Tail County, and WHEREAS all machines will be run in the roadside ditches at all times except where obstacles require shoulder travel, at the consent of the County Sheriff, and WHEREAS all highway crossings will be manned by persons assisting in the traffic control of the race, NOW THEREFORE BE IT HEREBY RESOLVED the County Board of Otter Tail County does hereby approve the request of the Saint Paul Winter Carnival Association, INc., Saint Paul, Minnesota, to route the 1974 Saint Paul Winter Carnival International 11 500 11 Snowmobile Race through Otter Tail County, Motion· was seconded by Hub Nordgren. Clerk Upon motion made by George Walter, seconded by John Snowberg and unanimously carried, the following resolution was adopted: RESOLVED by theBoard of County Commissioners of Otter Tail County Minnesota, that WHEREAS on March 14, 1973, the bid for one 1973 Chevrolet Truck was awarded to the Vaughn Chevrolet Company, New York.Mills, Minnesota, and WHEREAS same has been delivered to the satisfaction of the County Board, NOW THEREFORE, be it hereby resolved, the County Auditor is authorized and directed to issue a warrant in the amount of $8,850.86, payable to Vaughn Chevrolet Company, New York Mil ls, Minnesota, bei_ng the ful 1 amount of the bid. Motion was made by John· Snowbe.rg, seconded by Richard Dillon and unanimously carried, to accept the low bid of General Electric in the amount of $104.942.00, fundable contract. This bid to be let and purchase agreement signed after authorization of funding has been receiyed. Motion was made by Richard Dillon~ seconded by George Walter and carried, i . to approve the bid of $1,438.00 of General Electric for video monitor, unfundable equipment, to be incorporated with the above console. Gerald Frederick of the Highway Department and Safety Director of Otter Tail County, reported to County Board on meetings held and concerns of O.S.H.A. explaining the reporting and compliances necessary to meet requirements. Upon motion made by John Snowberg, seconded by Richard Dillon and unanimously carried, the County Auditor was authorized to call for bids for gal-· vanized steel posts for right-of-way markers and signs, bids to be received until 11:00 A.M., Tuesd~y, November 6th, 1973. Motion was made by John Snowbe,rg, seconded by George Walter and unani- mously carried, authorizing the County Auditor to pay Est. #I on the Phelps Mill ·project in the amount of $6,495.41. A discussion was helcl on resort signs along county roads. The H.igh- way e.ngineer \~as instructed to get quotations on price per slat plus posts, etc. Motion· was made by George \falter, seconded by Richard Dillon and unanimously carried, to adjourn until 9:30 A.M., Wednesday, October 10th, 1973. -WEDNESDAY'S SESS,lON - Pursuant to adjournment, the Board of County Commissioners of Otter Tail County met at 9:30 A.M., Wednesday, October_ 10th, 1973, all members present. Upon moton made by Hub Nordgren, seconded by John Snow.berg and unanimously carried, the following applications for homestead classification and/or reduction of assessed valuation were approved: Arnold E. Sibert Alvin H. Finn William Rademacher Oak Valley Township,-- Oak Valley Township Tordenskjold Township Valuation changed at equalization meeting Valuation changed at equalization meeting Double assessment A delegation of interested persons appeared before the Board relative to an app~ication for special use permit by Kel):y Drey on Wall Lake. Mr. Drey spoke on behalf of his development. Mr. Pemberton, attorney, represented the interested property owners on Wall Lake. Mr. Marv~-Mansfield, Chairman of Isaac Walton League, sppke on behalf of the Isaac Walton League requesting to go on·record in opposition of the concept because of overcrowding on Wall Lake. Motion was made by Richard Dillon~ seconded by John Snowberg and carried, Geo_rge Walter and Andy Leitch voting "no"~ to approve the concept of 16 units on Wall Lake subject to all necessary provisions as presented and approved by the Otter Tail_ County Planni_ng Advisory Commission~ Mr. Pemberton requested the County Auditor file a copy of the disapproval of-the special use permit. Motbn'was made by John Snowberg, seconded by Richard Dillon·and unanimously carried, to pay the balance due on'the electrical contracts on the joint county law enforcement b_uilding, except for the 10% retainage. RESOLVED by the Board ·of.County Commissioners of Otter Tail County Minnesota, that . . . WHEREAS, Provision is made in the Minnesota Statutes 1971 Section 18.231, Subdivision 1, the Board of County Commissioners when requested by the commissioner of agriculture, sha11· appoint a county agricultural inspector, who shall meet qualifications prescribed by the commissioner, and WHEREAS, John Wefald, Commissioner of Agriculture, has requested on September 12, 1973, such -·~ppointnient by the County Board of Otter Tail County, NOW, THEREFORE, BE IT RESOLVED that Alva Krekula, whose address is New York Mills, Minnesota and Telephone Number is 385 3004, be and he is hereby appointed East Otter Tail County Agricultural Inspector, for a period from January 1, 1974 to Decembe_r 31, 1974. BE IT FURTHER RESOLVED that Alva Krekula may attend the Annual County Agricultural Inspector's Short Course and other district conferences held during the year. BE IT FURTHER RESOLVED, that a copy of this Resolution shall be forwarded to the Commissioner of Agriculture, Room.648, State Office Building, Saint Paul, Minnesota. Motion was made by Andy Leitch, seconded by Richard Dillon and unanimously carried, to approve the preliminary plat of Sam Lykken' s on West Battle Lake, in Section 1 of Clitherall Township. Yes votes -5 No ·votes -0 Adopted at Fergus Falls, Minnesota. this 10th day of October, 1973. \ ATTEST:~ Clerk In Re Petition for Hearing on an Alleged Impassable Road in Trondhjem Township, Otter Tail County, Minnesota. The County Board_ofOtter Tail County was duly presented with a petition requesting a hearing on·an alleged impassable road in Trondhjem Town- ship between Sections 1 and 12. Pursuant to this petition~ notice was duly served on all parties required to receive notice by law and a hearing was duly set for the 10th day of J~ly, 1973 at 10:30 A.M. o'clock in the Commissioners's Room of the Otter Tail" County Courthouse. That at said time and date a hearing was duly held on this petition and all interested persons were permitted to give evidence and testimony concerning the allegations contained in the petition. The County Board is governed and required to decide this petition based on the provisions of Minnesota Statutes contained in Sections 163.16, which provides in part as follows: "Sub di vision 1. When a written complaint, signed by five or more free- holders of any town is presented to the county board stating that a des- cribed town road in or on the line of the town has not been opened and constructedor·is not.properly maintained, and because of such neglect is not reasonably passable, the tounty board by resolution, shall fix a time and place for· hearing the complaint. Subdivision 2. At the designated time and place the county board shall consider the complaint and hear and consider such testimony as may be offered by the officers of the town and the compla.inants relative·-to the matters set forth in the complaint ... The county board may drive over the road and make such further investigations as it deems necessary. Subdivision 3. If upon the hearing and investigation, the county board shall be of the opinion that the ·complaint is well founded, it shall be resolution direct the town hoard to do such work or to make such improve- ments as it shall deem.necessary to put the road in a passable condition." Based on said petition~ hearing, the testimony presented thereat, and on all of the files and records presented herein and on the investigation and personal view of the road by at least one of the members of.the county board, the county board hereby makes the followfog FINDINGS OF FACT 1. The petition for a hearing was duly s_igned and filed as re- quired by law for a hearing on the township road running between Sections 1 and 12 in Trondhjem Township. 2. That notices were duly given pursuant to the requirement of Minnesota law. 3. That pursuant to said petition and notice, a hearing was duly held in the Commissioners' Room of the Otter Tail County Courthous~ on July 10, 1973. 4. That the road under consideration was personally viewed by a mem- ber of the County Board of Commissioners and representatives of the Otte ~ail County Highway Department. 5. The road in question has not been opened or constructed within the terms or meani_ng of Minnesota. Statutes 163 .16. It is presently not being main- tained and that, because of the neglect to open, construct and maintain said road, it is at this time not reasonably passable. RESOLUTION Based on.the foregoing, it is hereby resolved that the town board of Trondhjem Township be and it is hereby directed that said town board forthwith commence the necessary construction, opening,: and maintaining of said road in order to make the same reasonably passable. Be it further resolved that if the town board within 30 days after the receipt of the notice of this resolution, fails or neglects to do the work or to make the road poasable, the county board will cause the· work to be done and the improvements made and the costs thereof shall be paid from the County Road and Bridge Fund and the same duly assessed against the taxes of the township and collected accordi_ng to the provisions of applicable la.w. Commissioner Dillon· moved the adoption of· the foregoi_ng Resolution which Resolution was seconded by Commissioner Walter and the followi_ng Commissioners voted in favor of the adoption of the Resolution: Commissioners Dillon, Walter, Nordgren, Snowbe_rg and Leitch.
