BOARD OF COUNTY COMMISSIONERS
OTTER TAIL COUNTY MINNESOTA
Pursuant to adjournment, the Board of County Commissioners of Otter
Tail County met at 9: 30 A. M. , Tuesday, ~ugust 7th~ 197 3, all members present.
A representative of the F.H.A. appeared before the board and explained
their role and the County Board's role in processing disaster area crop losses.
Motion· was made by George Walter, seconded by John Snowberg and
unanimously carried, to retain-Wendell P. Huber on county payroll until September
1st, including vacation time, to assist with e_ngineering at Phelps Mill and dam.
Motion was made by John Snowberg, seconded by Richard Dillon and
unanimously carried, to approve the following applications for reduction of assessed
valuation:

Motion was made by John Snowberg, seconded by Richard Dillon and unani-
mously carried, authorizing Commissioner Walter and Highway Engineer Berend to nego-
tiate for garage building property in Newton Township area.
A delegation from the M.P.C.A. appeared before the Board and discussed
the County's progress on establishing sanitary land fill sites and completion of plan.
Motion was made by Andy Leitch, seconded by George Walter and unani-
mously carried, to allow Harold H. Boese a utility permit under County Road #110,
expense to be born by applicant.
Upon motion made by Richard Dillon~ seconded by Hub Nordgren and unani-
mously c~rried, the County Auditor was authorized to advertise for bids to be received
/~il------!~:00 A.M., September 11, 1973, for 60 tons of calcium chloride in 80 lb. bags
11 and 120 ,i~ns of rock salt, in bags, for sanding.

Upon motion made by George Walter, seconded by Richard Dillon and
unanimously carried, the following resolution·was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail
County Minnesota, that
WHEREAS on February 13, ·1973 the County Board accepted the bid
of Allied Blacktop· Company, Minneapolis, Minnesota for County Wide Sand Sealing
for the amount of $140,066.90, same having been completed to the satisfaction
of the Board at a total cost of $141,178.82, an increase of $1,111.92 due to
normal Variation,
NOW, THEREFORE, BE IT HEREBY RESOLVED the County Auditor is
authorized to issue a warrant in the amount of $15,118.61.payable to Allied
Blacktop Company, Minneapolis, Minnesota as final payment for this work.

Upon:motion made by Hub Nordgren, seconded by John Snowberg and
unanimously carried, the following resolution·was adopted:
RESOLVED by the Board of·county Commissioners of.Otter Tail County
Minnesota, that
WHEREAS the United States of America was involved in a war in
Southeast Asia for the past nine years and
WHEREAS many of our Otter Tail County men were called or enlisted
in the service of.their country during this period~ and
WHEREAS the citizens of the State of Minnesota have seen fit to
pay a bonus to these veterans,
NOW, THEREFORE, BEIT HEREBY RESOLVED, that the week of August
15th through August 21st, 19 73 be proclaimed as "Honor the Vietnam Veteran Week
in Otter Tail County", and
BE IT FURTHER RESOLVED that these days 1in August be set aside by
the County Veterans Service Office for the purpose of taldng applications· .for
said Vietnam: Bonus.

Be it resolved-that the Commissioner.of Highways be and.he hereby is
authorized and requested to take such steps and perform such acts on
behalf of the County of· Otter Tail as may.be necessary tohave the
construction and improvement of the roads hereinafter described pro-
.perly approved by' the Federal Highway Administrator as a Federal-Aid
Secondary project eligible for the expenditure of federal funds there-
on and eligible for present construction and the letting of a contract
therefor.

Pursuant to adjournment, the Boardaf County Commissioners of Otter
Tail County met at 9:30 A.M., Wednesday, August 8th, 1973, all members present.
Motion was made by Hub Nordgren, seconded by Andy Leitch and unani-
mously carried, to purchase a used air conditioner at a cost of $95.00, plus cost.
of cleaning and installi_ng, from Hintgen-Karst Electric, Fergus Falls, ~nnesota.
Motion was made by Andy Leitch, seconded by George Walter and unani-
mously carried, to approve the plat.of Rundle Add'n, Scambler Township.
Motion was made by Andy Leitch, seconded by John Snowberg and unani-
mously carried, to approve the plat of Pischke & Taylor, ls.t Add •n, Leaf Mountain
Township.
Motion was made by George Walter, seconded by John Snowberg and unani-
mously carried, to concur with the decision of the Otter Tail County Planning Advi-
sory Commission· on the denial of the preliminary plat of Tonseth He.ights, Friberg
Township.
Motion was made by Richard Dillon, seconded . by Hub Nordgren and
unanimously carried, to proceed with necessary notices to inform employees of
personnel.policy to be adopted January 1, 1974 relative to National Guard Camp.

unanimously carried, to acknowle_dge, with thanks, the anonymous gift of $1,219.96
to be used at Phelps Mill.
Motion was made by George Walter, seconded by Richard Dillon and
unanimously carried, to approve the transfer of additional land for Melvin Gr~iff
and Roger L. Hoenegschmidt from Robert Martodam in Government Lot 2, Section 14 -
136 -40, said tracts to adjoin parcels now owned by grantees.

unanimously carried, to approve a·county Court appointment of Terry Jacobson as a
3rd Probation.Officer for Otter Tail County.

WHEREAS on July 9th, 1973 the County Board accepted the bid of
Worner Auto Sales, Fergus Falls, Minnesota for one Catalina Pontiac in the
amount of $3.890.00, same having been delivered to the satisfaction of the
Board,
NOW, THEREFORE the County Auditor is hereby authorized and
directed to issue a warrant · from the Federal Revenue Shari_ng Fund in the
amount of $3,890.00 payable to Worner's Auto Sales, Fergus Falls, Minnesota,
being the total purchase price.

WHEREAS on July 9th, 1973 the County Board accepted the bid of
Minnesota Motor Company, Fergus Falls, Minnesota for one Chevrolet Impala, in
the amount of $3,595.42, same having been delivered to the satisfaction of the
County Board,. 1
NOW, THEREFORE the County Auditor is hereby authorized and directed
to issue a warrant out of.the Federal Revenue Sharing Funds in the amount of
$3,595.42, issued to Minnesota Motor Company, Fergus Falls, Minnesota, being the
full purchase price.

FINDINGS BY COUNTY BOARD AND RESOLUTION
In Re Petitions for Hearing on an Alleged Impassable
Road in Pine Lake and Otto Townships, Otter Tail County, Minnesota.
The County Board of Otter Tail County was duly presented
with petitions requesting a hearing on an alleged impassable
road in Otto and Pine Lake Townships. Two petitions were filed,
one for that portion of the road in Otto Township and a·~eparate
petition for that portion of the road in Pine Lake Township.
The road inquestion runs in a north~south direction between
Sections 1 and 2 in Otto Township and beginning at the Northwest
corner of Section 36 and running between Sections 35 and 36 in
Pine Lake Township.
Pursuant to these petitions, notice was duly served onduapy---·---
parties required to receive service by law and a hearing _was iv
set for the 12th day of June, 1973, at 10:00 O'Clock A.M. in the
Commissioners' Room of the Otter Tail County Courthouse.
That at said time and date a hearing was duly held on these
petitions and all interested persons were permitted to give evidence
and testimony concerning the allegations contained in the petition.
The County Board is governed and required to decide these
petitions based on the provisions of Minnesota Statutes contained
in Sections 163.16, which provides in part as follows:
"Subdivision 1. When a written complaint, signed by
five or more freeholders of any town is presented to
the county board stating that a described town road
in or on the line of the town has not been opened and
constructed or is not properly maintained, and because
of such neglect is not reasonably passable, the county
board by resolution, shall fix a time and place for
hearing the complaint. ·
Subdivision 2. At the designated time and place the
county board shall consider the complaint and hear and
consider such testimony as may be offered by the officers
of the town and the complainants relative to the matters
set forth in the complaint ... The county board may
drive: over the road and make such further investigations
as it deems necessary.
Subdivision 3. If upon the hearing and investigation,
the county board shall be of the opinion that the
complaint is well founded, it shall by resolution direct
the town board to do such work or to make such improvements
as it shall deem necessary to put the road in a passable
condition."
Based on said petition, hearing, the testimony pr~sented
thereat, and on .all of the files and records presented herein
and on the investigation and personal view of the road by at
least one of the members of the county board, the county board
hereby makes the following
FINDINGS OF FACT
1. Petitions for a h~aring were duly signed and .filed as
required by law for a hearing on the township road runni?g in a
general north-south direction between Sections 1 and 2 of Otto
Township and between Sections 35 and 36 of Pine Lake Township ..
2. That notices were duly given pursuant to the require-
ments of Minnesota law.
3. That pursuant to said petitibns and notice, a hearing
was duly held in the Commissioners' Room of the Otter Tail County
Courthouse on June 12, 1973.
4. That the road under consideration was personally viewed
by a member of the County Board of Commissioners and representatives
of the Otter Tail County Highway Department.
5. Although the said township road is not constructed and
maintained according to the standards and specifications of other
township roads in Otter Tail County, the county board nevertheless
finds that the road.is reasonably passable for its present intended
use.
6. The road is presently used primarily by one landownerY
for access to and from his property~ At the present time this
property is not used as the family homestead of the landowner's
wife and family, but a homestead .is maintained by them elsewhere.
There is, however, reasonable access provided to this landowner
and all other landowners to their property.
7. The county board is further aware of the proposed
reconstruction of Highway No. 10 which is scheduled to be rebuilt
within the next one to two years and which will change the present
access roads, one of which is the road that is the subject of
this petition. When Highway 10 has been rebuilt there may be
a change in this area which would warrant the granting of a
petition, however, the granting of such petition is not ~arranted
at this time.
RESOLUTION_
Based on the foregoing~ it is hereby resolved that the
petitio~heretofore filed, w~ich are the subject matters :of the
hearing held on June 12, 1973, be and the same hereby are denied.
It is further resolved that the· petitioners or anf lan~-
owner affected by this decision, may reapply to this county board
by appropriate petitions to review this matter after the ,completion
of the reconstruction of Highway·1O.
