OF THE
BOARD OF COUNTY COMMISSIONERS
OTTER TAIL COUNTY MINNESOTA
Pursuant to adjournment, the Board of County Commissioners of
Otter Tail County met Tuesday, June 8th, 1971, 9:30 A.M., all members present.
Motion was made by Hubert Nordgren, seconded by George Walter and
unanimously carried, to allow the additional tracts of land lying between two
township roads in Government Lot 4, Section 34 -133 -39, be split out as sur-
vey lots, 200' in width.
Motion was made by Andy Leitch, seconded by Hubert Nordgren and
unanimously carried, authorizing Knutson Heating to install a Lennox Cool Air
Circulating system in the Treasurer's office, as proposed.
Motion was made by Andy Leitch, seconded by George Walter and
unanimously carried, to not open the previously advertised for crusher bids
and to re-advertise with right to raise bid orally providing a sealed bid is
submitted. Bids to be opened at 9:00 A.M., July 7th.
The Board, having previously advertised for bids to be received
for grading and aggregate surfacing, S.A.P. 56-621-12 (71), C.P. 71:21, proceeded
to open bids which were found to be as follows:

Upon motion made by Richard Dillon, seconded by Andy Leitch and
unanimously carried, the County Auditor was authorized to advertise for bids to
be received until 11:00 A.M. o'clock, July 12th, for grading and bituminous sur-
facing 0.407 mile of Fergus Falls Township road, C.P. 71:0lFF, located from CSAH
#27 and East into Woodland Heights, approximately 0.5 mile North of Fergus Falls.
Upon motion made by Hubert Nordgren, seconded by George Walter and
unanimously carried, the County Auditor was authorized to advertise for bids to be
received, until ll:00 A.M. o'clock, July 12th, 1971, for the following:

and unanimously carried, the following resolution was adopted:
RESOLVED by the Board of County Commissioners, Otter Tail County
Minnesota, that
WHEREAS on July 14, 1970, the County Board entered into contract
with Michaelson Bros., Inc., Madison, Minnesota, for Grading and Aggregate Sur-
facing on C. P. 70: 135, in the amount of $92,261.29, and
WHEREAS same has been completed to the satisfaction of .the County
Board, with an increase of $5,126.01, due to a sink hole at approximately Station
210, increasing the common excavation and sodding,
NOW THEREFORE, the County Auditor is hereby authorized and directed
to issue a warrant in the amount of $9,891.73 to the Michaelson Bros., Inc.,
Madison, Minnesota as final payment for this work.

A petition s_igned by various freeholders of Pine Lake and Corliss Town-
ships requesting the County Board to declare a roadway between Pine Lake and Cor-
liss Townships impassable was read and upon motion made by George Walter, seconded
by Hubert Nordgren and unanimously carried, a hearing was ordered to be held at
9:30 A.M., July 12th, at which time persons may appear and present testimony relative
to the matters set forth in the complaint now on file with the County Auditor.
Motion was made by Hubert Nordgren, seconded by George Walter and unani-
mously carried, to approve funds for Viking Basin not to exceed $1,750 per year for
a three year period.

WEDNESDAY'S SESSION
Pursuant to adjournment, theBoard of County Commissioners of
Otter Tail County Minnesota met at 9: 30 A.M., Wednesday, June 9th, 1971,-all mem-
bers being present.
Motion was made by Hulfe,i';t~Nordgren, seconded by Andy :Leitch and
unanimously carried, authorizing Eastern Township $300.00 Special Aid. for t.1he
reconstruction of a road commencing at C.H. #69.
Motion was made by Andy Leitch, seconded by Hubert Nordgren and
unanimously carried, to re-appoint Marvin Klicker as Veterans Servic'e -Officer
for a two year period commencing July 1st, 1971.
Upon motion made by George Walter, seconded by Hubert Nordgren and
unanimously carried, the following amendments to the Otter Tail County Personnel
Policies were adopted:
AMENDMENTS
TO
OTTER TAIL COUNTY PERSONNEL POLICIES
Articles III, XII and XVI were amended June 9, 1971, by action of the Board
of County Commissioners of Otter Tail County Minnesota. The amended paragraphs
now read as follows:
III.
HOURS OF WORK
Court house hours are from 8:00 A.M. to 5:00 P.M., Monday through Friday.
One hour shall be provided for noon lunch for court house employees. A maximum
of eight (8) hours shall constitute a day's work, and a maximum of forty (40)
hours shall constitute a week's work. The regular work hours for the County
Highway Maintenance employees shall be as follows: 8:00 A.M. to 12:00 A.M.;
12:00 A.M. to 12:30 P.M. Lunch Hour; 12:30 P.M. to 4:30 P.M.
In all departments which maintain facilities on a 24 hour a day basis, the
department head shall establish work schedules for its employees on a basis of
8 hours per day -5 days per week.
The workweek shall be Monday throµgh Friday for all other employees. All
time worked in excess of eight hours per day or forty hours per week shall be
rated as overtime and compensated at time and one-half rates. An employee shall
not be required to take time off during the regular assignediworkweek to avoid
payment of overtime.
In the event of an emergency or special situation which may arise, the depart-
ment head may authorize employees to work hours different from the above or regular
work schedule hours.

During the months of Jme, July and August, 8:00 A.M. to4:30 P.M. will.be per
missible, providing persons so desiring takel/2 hour for hoon lunch and work on a
schedule satisfactory to the department head so that at all times eno_ugh personnel
is available between the hour of 4:30 and 5:00 to allow said office to function
ef ficient_ly.
XII.
GRIEVANCE PROCEDURE
Except as otherwise provided by law, any county employee having a grievance
shall report such to his supervisor or head of the office. If the grievance cannot
be satisfactorily settled, it may be carried to the Board covering that office,
but 0111y if requested in writing by the employee. If the Board so desires they may
refer such matter to the grievance committee consisting of two (2) persons and the
chairman of the Board. All parties interested shall be present at a hearing of the
grievance committee, and the recommendations of the grievance committee shall be
made to the·Board at its next regularly scheduled meeting. The decision of the
Board shall be final in any such case. Chairman of the Board to appoint one member
and the employee to appoint one member.

DISMISSAL
Except as otherwise provided by law, any employee may be dismissed from his
job by the elected or appointed official in charge of that office. Dismissals
-shall be made only for just cause. Just cause shall include but shall not be
limited to inability or failure to perform duties as assigned by the office holder,
dishonesty, lack of loyalty to the head of the office and/or county, abuse of
vacation or sich leave privileges, abuse of county owned equipment or involvement
in civil or criminal offenses.
Any employee who believes his dismissal is not justified may appeal in writing
his dismissal to the Board. The Board shall hear all interes·ted-parties.-~d may
reinstate the employee upon such terms and conditions as are just an~ proper.

RETIREMENT POLICY

The retirement policy as set by the County Board specifies the. retirement age
to be 65 effective January 1, 1972.
The retirement policy as set by the County Board specifies the retirement age
for full and part-time employees (as defined in Section 9, Paragrph Band C) to be
age 65 effective January 1, 1972, except that when part-time-employees are needed,
these are limited to 60 working days in any calendar year. This classification of
part-time employee may be in excess of 65 years of age.

Upon motion made by Commissioner Walter, seconded by Commissioner
Dillon and unanimously carried, the following resolution was adopted:
WHEREAS, it is provided in Minn. Statute 282.05 for the apportion-
ment of the proceeds from the sale of tax-forfeited lands;
WHEREAS, the County Auditor shall apportion the tax sale proceeds
to the taxing districts pursuant to Minn. Stat. 282.08;
WHEREAS, Minn. Stat. 282.08[4) (b) provides that the County Board
may set aside 20% of the proceeds remaining after the value of public improvements,
special assessments and bond issues levied on the property have been paid, for
acquisition and maintenance of county parks and recreational areas;
WHEREAS, Otter Tail County has parks and recreational areas which
would benefit by such an apportionment;
NOW THEREFORE, BE IT RESOLVED, that the County Auditor retain 20%
of the.·proceeds from the sale of tax forfeited land for acquisition and mainten-
ance of parks and recreational areas from the proceeds available after making
the necessary statutory disbursements, said proceeds to be disbursed according to
law.

unanimously carried, the following resolution was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail County
f. Minnesota, that
WHEREAS, Ruth E. Smith has made application to repurchase from the
State of Minnesota the following described property, which forfeited to the State
of Minnesota for non-payment of truces for the year 1964 and subseq~ent years:
Johnson's Add'n, Ex. W 152', all N 150' of Reserve
said applicant bei.ng successor in interest.
Now, therefore, be it hereby resolved by the Board of County
Commissioners of Otter Tail County, Minnesota, to grant said application, per-
mission to do so being to the best public interest and relieve undue hardship.

before the Board and presented their progress report on the Comprehensive Sewer
and Water Survey being conducted in Otter Tail County, ,requesting an extension of
time for completion. Motion was made by Richard Di llort, seconded by George Walter
and unanimously carried, to extend the date of completion of the study to September
15, 1971 with a final report at that time.
Motion was made by George Walter, seconded by Andy Leitch and unani-
mously carried, to accept the plat of Ja-Ma-Ka Beach, subject to road approval and
approval by the Planning Advisory Commission.
