OTTER TAIL COUNTY BOARD OF COMMISSIONERS

Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, December 21, 1999 at
9:31 a.m. at the Otter Tail County Courthouse with Commissioners Sydney Nelson, Chair;
Virginia Partmann, Malcolm Lee, and Roger Froemming present.
Approval of Agenda
Motion by Lee, second by Froemming, and unanimously carried to approve the County Board
agenda of December 21, 1999 with the following additions:
Rick West at 9:40 a.m. -Request for Final Payment
Steve Andrews at 10:20 a.m. -Request for Forgiveness of Penalty
Bill Kalar -Final Plat
Approval of Minutes
Motion by Partmann, second by Lee, and unanimously carried to approve the County Board
minutes of December 14, 1999 as mailed.
Agriculture Update
Extension Educator, Bill Saumer, reported that the application deadline for an Extension Educator
in Fergus Falls is January 15, 2000. Mr. Saumer discussed the current challenges in the milk
industry and the move towards larger dairy farms throughout the United States. Minnesota's
average dairy farms are about 60 head, whereas in Idaho, the average dairy farm is 200 head.
Commissioner Partmann stressed a need to look to the future relative to the changing farm
economy in Otter Tail County to allow for organized planning or restructuring of land uses.
Discussion continued. Mr. Saumer reported that Collin Peterson will be in Fergus Falls to hear
from farmers regarding the farm bill. There will be several upcoming dairy meetings and a feedlot
meeting is scheduled for January 6th•
Request for Forgiveness of Penalty -LTD Partnership
Joyce Anderson, Office Manager at Profit LTD Partnership, requested forgiveness of penalty, in
the amount of $3,207.12. She stated that the tax payment had been sent out of the corporate
office on October 8, 1999, one week before the tax deadline. Treasurer, Steve Andrews, stated
that the check was not received in his office. Another check has been issued including the penalty,
however; the original check has not been found. Discussion followed regarding county policy.
Commissioners suggested that Profit LTD Partnership check with the Fargo post office.
Motion by Partmann, second by Lee, and carried with Nelson opposed, to deny the request of
Profit LTD Partnership for forgiveness of penalty, in the amount of $3,207.12, unless the original
check is received with a postmark on or before October 15, 1999. In the latter case, the penalty
paid would be refunded to Profit LTD Partnership.

Request for Forgiveness of Penalty -Days Inn
Treasurer, Steve Andrews, requested forgiveness of penalty and interest from November 30, 1999 0
to July 1, 2000 on behalf of the owners of the Days Inn.
Motion by Lee, second by Froemming, and unanimously carried to deny the forgiveness request of
the Days Inn as the request is contrary to county policy.
Request for Forgiveness of Penalty -Kenneth & Nancy Pearce
Treasurer, Steve Andrews, requested forgiveness of penalty, in the amount of $5.00, for Kenneth
& Nancy Pearce. An address was not updated in the county system on one of the parcels
purchased.
Motion by Lee, second by Froemming, and unanimously carried to forgive the penalty assessed to
Kenneth & Nancy Pearce, in the amount of $5.00, as the penalty was assessed because of a
county error.
Request for Final Payment -Countywide Traffic Marking
Motion by Lee, second by Partmann, and unanimously carried to approve final payment, in the
amount of $46,442.93, payable to Traffic Marking Service, Inc. for C.P. 99:TM, countywide traffic
marking.
Reappointments -Board of Adjustment
Motion by Partmann, second by Lee, and unanimously carried to approve the following
reappointments to the Otter Tail County Board of Adjustment for a one-year term: r'\

Payment Approval
Motion by Lee, second by Partmann, and unanimously carried to authorize payment from the
General Revenue Fund to the Minnesota Department of Corrections, in the amount of $207.80, for
the Camp Ripley Program.
Sale of Gravel Pit
Motion by Lee, second by Froemming, and unanimously carried to authorize the sale of the
following described gravel pit with the bid opening to be scheduled on January 25, 2000:
Beginning at a point two hundred thirty (230) feet north of the southwest corner of the Southeast
Quarter of the Southeast Quarter (SE¼SE¼) of Section (15) in Township One Hundred Thirty-
seven (137) North, of Range Forty-three (43) West, thence due east two hundred (200) feet,
thence due north one hundred (100) feet, thence due west two hundred (200) feet, and thence due
south one hundred (100) feet to the point of beginning and also a tract of land beginning at the
southwest corner of the Southeast Quarter of the Southeast Quarter (SE¼SE¼) of Section Fifteen
(15) in Township One Hundred Thirty-seven (137) North, of Range Forty-three (43) West, thence
Two Hundred Thirty (230) feet due north, thence thirty-three (33) feet due east, thence two
hundred thirty (230) feet south, thence thirty-three (33) feet west to point of beginning. Q

NACO Membership
Motion by Lee, second by Froemming, and unanimously carried to authorize membership in the
National Association of Counties (NACO) for a two-year trial period. The membership for year
2000 will be paid by the Association of Minnesota Counties with the second year's membership
dues to be paid by Otter Tail County. Membership is approximately $900 per year.
Request for Forgiveness of Penalty -Robert & Fern Young
Motion by Froemming, second by Partmann, and unanimously carried to deny a forgiveness of
penalty request from Robert & Fern Young based on county policy (the penalty was not a result of
a county error).
Water Plan Committee
Land & Resource Director, Bill Kalar, provided the minutes from a recent Water Plan Committee
meeting held December 3, 1999. Discussion followed regarding the Soil & Water Conservation
District soil survey.
Land Surveyors Certificate of Correction to Plat
Otter Tail County Resolution No. 99 -66
Upon a motion by Lee, second by Partmann and unanimously carried, the Otter Tail County Board
of Commissioners adopts the following resolution:
Name of Plat: Shady Nook Resort
A part of Government Lots 2, 7 and 8, Section 15, a Replat of Lot 7, Block One, West
Shady Nook Beach, Township 134 North, Range 41 West, 5th P.M., Maine Township,
Otter Tail County, Minnesota
Pursuant to the provisions of Section 505.174 and 505.176 of State Statutes of Minnesota, the
undersigned, A Registered Land Surveyor in and for the State of Minnesota, declares as follows:
1. That I am a Professional Land Surveyor licensed in the State of Minnesota with registration
number 17004.
2. That I prepared the plat known as Shady Nook Resort, said plat filed for record on the 22nd day
of December, 1999, and duly recorded as Document No. 857275 in the Office of the County
Recorder in and for Otter Tail County, Minnesota.
3. That said plat contains a drafting error in the following particulars:
The phrase "ADD 1000.00 FEET TO CONVERT TO N.G.V.D. located in the lower left hand
corner of the said plat under the heading of "BASE BENCH MARK" is erroneous, the correct
phrase should be "ADD 1300.00 FEET TO CONVERT TO N.G.V.D.
4. That this Affidavit shall serve notice that said phrase is hereby revised, amended, and
corrected, as noted above, to reflect the true data concerning the conversion to N.G.V.D.

of Commissioners adopts the following resolution:

Principal Meridian, Maine Township, Otter Tail County, Minnesota
Pursuant to the provisions of Section 505.174 and 505.176 of State Statutes of Minnesota, the

Final Plat· Shady Nook Resort
Motion by Lee, second by Partmann, and unanimously carried to approve the final plat of
"Shady Nook Resort" owned by Glen & Yvonne Rogness on Pickeral Lake (Sec. 15, Twp. 134,
R. 41, Maine Township).
Approval of Agreement with Lakes Country Service Cooperative
Motion by Partmann, second by Lee, and unanimously carried to authorize the Chair's signature to
execute a Joint Powers Agreement for Group Employee Benefits and Other Financial and Risk
Management Services between Otter Tail County and the Lakes Country Service Cooperative for
calendar year 2000.
Closed to the Public
At 11 :08 a.m., Chairman Nelson declared the meeting of the Otter Tail County Board of
Commissioners closed to the public for the purpose of evaluating the performance of Human
Services Director, John Dinsmore, pursuant to M.S. §471.705 Subd. 1d(d). A summary of
performance conclusions will be provided at the next regular board meeting. At 11 :55 a.m., upon
conclusion of Mr. Dinsmore's performance evaluation, the meeting continued in closed session for
the purpose of discussing labor negotiation strategies with the county's six collective bargaining
units. All seated commissioners were present along with the County Coordinator, County Attorney,
Human Services Director, and Recording Secretary.
Adjournment
At 12:15 p.m., upon conclusion of the labor negotiation strategy closed session, Chairman Nelson
declared the meeting of the Otter Tail County Board of Commissioners adjourned until Tuesday,
December 28, 1999.
