HomeMy WebLinkAboutBoard of Commissioners - Minutes - 11/16/1999MINUTES OF THE OTTER TAIL COUNTY BOARD OF COMMISSIONERS Otter Tail County Courthouse Commissioners' Room, Floor 1-B Tuesday, November 16, 1999 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, November 16, 1999 at 9:32 a.m. at the Otter Tail County Courthouse with Commissioners Sydney Nelson, Chair; Virginia Portmann, Malcolm Lee, and Roger Froemming present. Commissioner Andy Lindquist was absent. Approval of Agenda Motion by Portmann, second by Lee, and unanimously carried to approve the County Board agenda of November 16, 1999 with the following additions: John Dinsmore request for Personnel Committee meeting. Clarification of Minutes -November 2, 1999 Motion by Lee, second by Portmann, and unanimously carried to clarify the County Board minutes of November 2, 1999 (Pages 3, heading Conditional Use Permit -Darrel and Marlene Gast as follows: add titles Findings of Fact to Deny and Finds of Fact to Grant. and the paragraph; O:therefore, shall read: 0 Findings of Fact to Deny 1. The proposal would have adverse effects to adjacent properties, in the form of water runoff and flooding. 2. There would be adverse environmental effects as a result of a drain structure channeling water directly into the lake, bypassing natural filtration. 3. The grading and filling involves extensive alterations to the natural topography of the lot, and is not necessary to put the property to permitted uses. Findings of Fact to Grant 1. The proposed grading and filling is based upon an engineering plan by Pat Reisnour of Interstate Engineering, which appears to adequately control the potential for adverse effects to adjacent property. 2. The engineering plan makes adequate provisions to protect the environment from direct runoff into the lake. 3. The engineered proposal more adequately deals with water problems than the existing conditions on the lot. Otter Tail County Board of Commissioners November 16, 1999 Page 2 4. 5. The owner of the lot remains legally responsible for any surface runoff onto his neighbor's property. The proposed grading and filling is reasonable in order to allow the property owner to use the property in conformance with the provisions of the Shoreland Management Ordinance. Conditions: ► The granting of the conditional use permit is conditioned upon the owner following the engineering plan. ► The conditional use permit is conditioned upon the engineer supervising the grading and filling project. Add to the motion "of fact to approve"; therefore, the motion shall read: 0 Motion by Partmann, second by Lee, to approve the CUP request of Darrell & Marlene Gast on Otter Tail Lake (Sec. 14, Twp. 134, R. 40W, Amor Township, Lake No. 56-242) with conditions as recommended by the Planning Commission and the above Findings of Fact to Grant. Chair Nelson called for a vote: Voting: In Favor -Lee & Partmann Opposed -Froemming & Nelson Motion failed. Also clarify (Page 5, heading Resignation of Otter Tail County Water Planning Committee Member as follows: change the sentence "Mr. Cruff will serve from the Vergas area, and the motion; Q therefore, shall read: . "Motion by Froemming, second by Partmann, and unanimously carried to approve the recommendation to replace Kermit Larson's position on the Otter Tail County Water Planning Committee with Gary Cruff. Mr. Cruff will represent the Otter Tail County Coalition of Lakeshore Association (COLA)." Approval of Minutes Motion by Lee, second by Froemming, and unanimously carried to approve the County Board minutes of November 9, 1999 as mailed. Traffic Study -City of Perham Highway Engineer, Rick West, reported that the City of Perham and the County of Otter Tail are proposing to undertake a traffic study in three phases: 1) Traffic signals, 2) Local traffic patterns, and 3) Task force meetings. The cost will be split half with City of Perham and half with County of Otter Tail. SRF Consulting Group will be performing this work for Larson, Peterson, and Associates. Motion by Partmann, second by Lee, and unanimously carried to approve Phase 1 of the traffic study, 1) Traffic signals, with costs shared half between Otter Tail County and half of the cost with City of Perham. Phase 2 and Phase 3 will be presented for approval at a later date. Application for Cleaning County Road Ditch -CSAH No. 2 and CSAH No. 7 Rick West reported that an application for cleaning county road ditches was received from Brian O Langseth and Mike Brause. Application was for cleaning out silt and high spots on CSAH No. 2 and CSAH No. 7 in the NW¼ of Sec. 8, Twp. 131 N, R. 44 W, Western Township. Otter Tail County Board of Commissioners November 16, 1999 Page 3 r'\Motion by Lee, second by Froemming, and unanimously carried to approve a 0.4 ft. max. depth .....,clean-out on CSAH No. 2 and to deny clean-out on CSAH No. 7 as per the County Engineer's recommendation. Five Year Highway Improvement Plan Public Meetings Rick West reported on the Five Year Highway Improvement Plan. There will be meetings held in Fergus Falls and in New York Mills that will be open to the public. Written notices will be sent to all the townships. These meetings will be informational. Bid Award -Sign Truck Body After previously advertising for bids, the Highway Engineer opened the following bids at 1 :00 p.m. on November 10, 1999 for Sign Truck Body: Crysteel Truck Equipment Fridley, MN J-Craft Kimball, MN $69,437.00 $64,350.00 Motion by Partmann, second by Lee, and unanimously carried to award the bid for Sign Truck Body to J-Craft of Kimball, MN, as the low bidder in the amount of $64,350.00. 0 Approval of Release of Easement Motion by Lee, second by Partmann, and unanimously carried to authorize the Chair's and Vice- Chair's signatures to execute a Release of Highway Easement on the Thomas A. Burton and ,O I Margaret M. O'Neill property legally described as follows: "All that part of the Southeast ¼ of the Southeast ¼ and the Northeast ¼ of the Southeast ¼ of Section 22, Township 137, Range 43, Otter Tail County, Minnesota, which lies easterly of the easterly right-of-way line of County State Aid Highway No. 9. Except that part which lies within the dedicated public road as dedicated in the plat of Pike Beach, according to the recorded plat thereof." Closed to the Public At 9:55 a.m., Chairman Nelson declared the Otter Tail County Board of Commissioners meeting closed to the public for the purpose of evaluating the performance of Highway Engineer, Rick West, pursuant to M.S. §471.705 Subd. 1d(d). Commissioners Sydney Nelson, Virginia Partmann, Malcolm Lee, and Roger Froemming were present. A summary of performance conclusions will be provided at the next regular board meeting. At 10:35 a.m., upon conclusion of the closed session, Chairman Nelson declared the County Board meeting reconvened. Premise Permit Otter Tail County Resolution No. 99-59 Upon a motion by Froemming, second by Lee, and unanimously carried, the Otter Tail County Board of Commissioners adopts the following resolution: WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of licenses and permits for the conduct of lawful gambling lies with the Minnesota Gambling Control Board; and, Otter Tail County Board of Commissioners November 16, 1999 Page 4 WHEREAS, the Dent Lions Club, Dent, MN, has made an application to the Gambling Control Board for a premise permit to conduct lawful gambling at Ye Olde School House Bar, in Friberg Township of Otter Tail County; and, WHEREAS, Minnesota Statute 349.213 provides that the Gambling Control Board may not issue a premise permit unless they receive a resolution from the Otter Tail County Board of Commissioners approving the permits; and, WHEREAS, the Otter Tail County Board of Commissioners is aware of no reason to oppose the conduct of lawful gambling by the Dent Lions Club, Dent, MN, at Ye Olde School House Bar, in Friberg Township of Otter Tail County. NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners hereby approves the conduct of lawful gambling by the Dent Lions Club, Dent, MN, at Ye Olde School House Bar, in Friberg Township of Otter Tail County, provided the applicant meets all the necessary criteria for the licenses and permits as required by the Gambling Control Board. IT IS FURTHER RESOLVED, that notice of this application and approval shall be provided to the Township of Friberg by sending them a copy of this resolution. Adopted this 15th day of November, 1999. He was re- appointed on May 25, 1999 to a four-year term effective July 1, 1999. The Otter Tail Water Management District Board has found a replacement to fill the remaining portion of Mr. Thorson's term. The Otter Tail Water Management District Board has nominated John Mehl, of Battle Lake, 0 MN, and requests that the Otter Tail County Board of Commissioners appoint Mr. Mehl to fill the unexpired term of Mr. Thorson. Motion by Lee, second by Partmann, and unanimously carried to appoint John Mehl of Battle Lake, MN, to the Otter Tail Water Management District Board to fill the unexpired term of Don Thorson. Vehicle Purchase -Sheriff's Department Chief Deputy, Mark Morris, reported that the deadline is December 1, 1999 to order vehicles under the state contract through Falls Automotive, Inc. for patrol cars. Chief Deputy Morris stated that this would be coming out of the FY 2000 budget. Budgeted amount for vehicles is $150,000. Cost for new vehicles through Falls Automotive, Inc. is as follows: 2 -2000 Dodge Durango 4x4 SUV 1 -2000 Dodge Intrepid 4 dr Intermediate Sedan 2 -Restoration of 1997 Ford Crown Victorias Total Price Delivery would be in 60 to 90 days. $54,133.98 (tax included) $17,497.95 (tax included) $32,000 (approximately) $103,631.93 Motion by Lee, second by Froemming, and unanimously carried for approval to purchase vehicles through Falls Automotive, Inc., in the amount of $103,631.93, upon approval of the County Auditor and County Coordinator, for availability of funding. Thomas & James Sylte: Motion by Lee, second by Portmann, and unanimously carried to approve the Preliminary Plat of "Sylte Estates" consisting of nine single family residential lots with two blocks, with conditions as recommended by the Planning Commission. A Conditional Use Application for the construction of 3,880' of road per specification in the Shoreland Management Ordinance has also been approved. The property is described as Pt of Gov. Lots 1 & 4 & the E ½ of NE¼, Sec. 16 of Tordenskjold Township; Long Lake (56-428), RD. Conditional Use Permit-Brad & Michelle Dean/Natalie & Gary Sheldon: Motion by Partmann, second by Lee, and unanimously carried to approve a Conditional Use Permit to obtain a Permit for retail sales of Antiques & Crafts from this house and accompanying buildings with conditions as recommended by the Planning Commission and with the condition that the items for sale be confined to the buildings. Items to be sold will include furniture, clothing, jewelry, toys, household items & crafts and will be sold primarily during the summer months. No. LM103). Conditional Use Permit-Steven D. Lenthe: Motion by Lee, second by Portmann, and unanimously carried to deny the request for a Conditional Use Permit to modify CUP #5659 as recommended by the Planning Commission. CUP #5659 required the removal and restoration of the vacated township road (T-609) and dedicated street (South Street). The new CUP would modify CUP #5659 such that it would retain a total of 250 feet of the vacated township road in its present condition. (It was noted that in its existing state, the tarred surface is a safety hazard.)
