HomeMy WebLinkAboutBoard of Commissioners - Minutes - 11/02/19990 0 0 MINUTES OF THE OTTER TAIL COUNTY BOARD OF COMMISSIONERS Otter Tail County Courthouse Commissioners' Room, Floor 1-8 Tuesday, November 2, 1999 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, November 2, 1999 at 9:30 a.m. at the Otter Tail County Courthouse with Commissioners Sydney Nelson, Chair; Virginia Partmann, Vice-Chair; Malcolm Lee, and Roger Froemming present. Commissioner Andy Lindquist was absent. Approval of Agenda Motion by Froemming, second by Partmann, and unanimously carried to approve the County Board agenda of November 2, 1999 with the following additions: Approval of Change Order on Tax Forfeited Sites Certify the Revised Tax Levy Appointment -Water Planning Committee Approval of Minutes Motion by Lee, second by Partmann, and unanimously carried to approve the County Board minutes of November 2, 1999 as presented. Additionally, this motion included a correction to the Human Services minutes of October 26, 1999, (Page 4, Heading, "Kandiyohi Resolution in Support of Legislative Action") which should read that the Kandiyohi resolution be referred to the Human Services policy committee of the Association of Minnesota Counties. Approval of Change Order on Tax Forfeited Sites Motion by Partmann, second by Lee, and unanimously carried to authorize the County Auditor's signature on the Change Order Number one with Zervas Industrial Petroleum Co. Inc. The change order extends the completion date from November 5, 1999 to December 22, 1999. Payment Approval -Otter Tail/Wilkin Joint Ditch Number 2 Motion by Partmann, second by Froemming, and unanimously carried to approve payment to the Wilkin County Treasurer, in the amount of $1,824.52, for costs incurred during the maintenance of Otter Tail/Wilkin Joint Ditch Number 2 as follows: Wilkin Co. Highway Department Borup Ag Total County Share 65.77 1,758.75 1,824.52 This represents 33.5% (Otter Tail Share) of the total expenditure. Total 196.32 5,250.00 5,446.32 Approval of Revised Proposed Net Levy Motion by Nelson, second by Partmann, and unanimously carried to approve the following revised proposed net levy: Otter Tail County Board of Commissioners November 2, 1999 Page 2 Payable 2000 Proposed Net Levy as Certified September 14, 1999 - Schedule N Change - Levy Limit Adjustment Due to Schedule N Change - Removal of Schedule M - Addition to Schedule H - Revised Payable 2000 Proposed Net Levy-November 2, 1999 - 13,327,943 ( 1,509,869) 1,494,869 (10,904,837) 10,917,164 (27,644) 41,864 13,339,490 Bond of $10,000 Received for County Drainage Ditch No. 25 Wayne Stein, Auditor, reported that a bond in the amount of $10,000 has been received for County Drainage Ditch No. 25. Copies of this letter will be referred to David Hauser, County Attorney, and Tiny Holm, AG/Ditch Inspector. Prairie-To-Lakes Ducks Unlimited The Prairie-To-Lakes Ducks Unlimited has submitted an application for authorization for exemption from lawful gambling license for an event scheduled for December 9, 1999 at the HiWay Park Ballroom. No action was taken. 0 Request for Approval -Property Transfer Motion by Lee, second by Froemming, and unanimously carried to approve property transfer to Q Otter Tail County from the City of Henning. The property is an area of approximately 20 acres located south of the MNDot Station. Rick West, Highway Engineer, will bring this issue back to the board when contract and/or easement approvals are required. Approval to Pay Bills Motion by Lee, second by Froemming, and unanimously carried to approve bills per Attachment A of these minutes which include the following lodging payments: Best Western Kelly Inn GIS Employees Brian Armstrong and Sherran Leabo Cragun's Lodge and Conference Center Solid Waste Director, Mike Hanan Sheraton Inn Midway Sheriff Gary Nelson (reimbursable by MCCC) Red River Water Basin International Coalition Motion by Froemming, second by Partmann, and unanimously carried to approve membership for Otter Tail County in the International Coalition for Land/Water Stewardship in the Red River Water Basin provided there is no cost to the county. Correspondence Acknowledged Chair Syd Nelson read a letter regarding Assistant Veterans Service Officer, Mr. Tom Figliuzzi, commending him for his time and consideration and caring manner. The Board requested that this letter be put in Tom's personnel file. 0 0 0 Otter Tail County Board of Commissioners November 2, 1999 Page 3 Request for Approval of Final Plats Final Plat -"Bistodeau's First Addition to Woodland Park": Motion by Froemming, second by Lee, and unanimously carried to approve the final plat of "Bistodeau's First Addition to Woodland Park" on E. Battle Lake (Sec. 25, T. 133, R. 39, Girard Township). Final Plat-"Towers Cove": Motion by Nelson, second by Lee, and unanimously carried to approve the final plat of "Towers Cove" on Big Pine Lake (Sec. 15, T. 136, R. 38 Pine Lake Township). Planning Commission Recommendation Conditional Use Permit -Darrel and Marlene Gast: This CUP was tabled from the October 26, 1999 Board of Commissioners meeting to allow the County Attorney and Land & Resource Director to document Findings of Fact relative to this request. It was noted that the record was closed at the end of the October 26th meeting on this matter and no further testimony would be accepted today. The County Attorney read the findings as follows: Findings of Fact ► The proposal would have adverse effects to adjacent properties, in the form of water runoff and flooding. ► There would be adverse environmental effects as a result of a drain structure channeling water directly into the lake, bypassing natural filtration. ► The grading and filling involves extensive alterations to the natural topography of the lot, and is not necessary to put the property to permitted uses. ► The proposed grading and filling is based upon an engineering plan by Pat Reisnour of Interstate Engineering, which appears to adequately control the potential for adverse effects to adjacent property. ► The engineering plan makes adequate provisions to protect the environment from direct runoff into the lake. ► The engineered proposal more adequately deals with water problems than the existing conditions on the lot. ► The owner of the lot remains legally responsible for any surface runoff onto his neighbor's property. ► The proposed grading and filling is reasonable in order to allow the property owner to use the property in conformance with the provisions of the Shoreland Management Ordinance. Conditions: ► The granting of the conditional use permit is conditioned upon the owner following the engineering plan. Otter Tail County Board of Commissioners November 2, 1999 Page 4 ► The conditional use permit is conditioned upon the engineer supervising the grading and filling project. Motion by Partmann, second by Lee, to approve the CUP request of Darrell & Marlene Gast on Otter Tail Lake (Sec. 14, Twp. 134, R. 40W, Amor Township, Lake No. 56-242) with conditions as recommended by the Planning Commission and the above findings. Chair Nelson called for a vote: Voting: In Favor -Lee & Partmann Opposed -Froemming & Nelson Motion failed. Resignation of Otter Tail County Water Planning Committee Member Motion by Froemming, second by Partmann, and unanimously carried to approve the recommendation to replace Kermit Larson's position on the Otter Tail County Water Planning Committee with Gary Cruff. Mr. Cruff will serve from the Vergas area. Closed to the Public At 10:37 a.m., Chairman Nelson declared the Otter Tail County Board of Commissioners meeting closed to the public for purposes of discussing Labor Negotiation Strategies. Commissioners Syd Nelson, Virginia Partmann, Malcolm Lee, and Roger Froemming were present along with the County Attorney, County Coordinator, and Recording Secretary. Adjournment 0 At 11 :12 a.m., upon conclusion of the closed session, Chairman Nelson declared the meeting of the Otter Tail County Board of Commissioners adjourned until the next scheduled meeting on Q Tuesday, November 9, 1999.
