Approval of Agenda Motion by Lee, second by Lindquist and unanimously carried to approve the County Board agenda of October 19, 1999 with the following addition: Request for Payment Approval Approval of Minutes Motion by Lindquist, second by Froemming and unanimously carried to approve the County Board minutes of October 12, 1999 with the following spelling correction: The final plat on Page 4 of October 12, 1999 named as "Che-Rosa Beech First Addition" should read "Cha-Rosa Beach First Addition". Tobacco Administration Public Hearing The Public Hearing for a tobacco citation against the Lakeland General Store in Dunvilla and employee, Darlene Erickson, was convened at 9:35 a.m. Under oath, Business Manager, Robin Johnson, agreed with the fact that the sale of tobacco was made to an underage youth; however, he requested that the fines for this first time violation of the Otter Tail County Tobacco Ordinance be waived. He stated that Labor Day weekend is the busiest time for his business and questioned several portions of the county ordinance. Under oath, Public Health Director, Diane Thorson, reported that the State of Minnesota mandated counties to enact a tobacco ordinance if townships did not enact an ordinance and the first offense fee is also mandated by state law. Chairman Nelson closed the hearing at 10:00 a.m. Motion by Lee, second by Partmann and unanimously carried to deny the request from Lakeland General Store to waive the first offense fee under the Otter Tail County Tobacco Ordinance. The Assistant County Attorney will issue the Findings of Fact and Order for this public hearing and send notice to the appropriate individuals. Payment Approval Motion by Lindquist, second by Lee and unanimously carried to approve final payment to Unistrut Corporation in the amount of $28,865. This completes final payment for the Countywide Rural Addressing Project for sign posts and hardware at a total cost of $116,857. Bid Award After previously advertising for bids, Highway Engineer, Rick West, opened the following bid October 13, 1999 at the Otter Tail County Courthouse for an Herbicide Sprayer: Otter Tail County Board of Commissioners October 19, 1999 Page 2 Norstar Industries Auburn, WA $25,431.37 Motion by Partmann, second by Lee and unanimously carried to award the bid for an herbicide sprayer to Norstar Industries, Inc. in the amount of $25,431.37. Proposed Violence Prevention Policy Safety Director, Tim Hunt, reported that a task force of county officials has worked on a Violence Prevention Policy for Otter Tail County for the past two years. He provided a copy of the proposed Otter Tail County Operational Policies, Physical Security & Personal Safety dated October 1999 (Appendix 15 to Annex L to Otter Tail County Safety & Health Program). Mr. Hunt requested that board members review the policy and noted that he would return for approval at the next regular County Board meeting. Approval to Pay Bills Motion by Lindquist, second by Partmann and unanimously carried to approve bills per Attachment A of these minutes which include the following lodging payments: Days Inn Deputy, Alan Frank Ruttger's Bay Lake Lodge Detention Officer, Jack Dawkins Asst. Detention Facility Adm, Allan Keller Recess & Reconvene At 10:40 a.m., Chairman Nelson declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. The Chairman reconvened the meeting at 10:55 a.m. Nutrition Program Commissioner Partmann reported on a recent West Central Area Agency on Aging (WCAAA) meeting. The nutrition program administered through the agency is doing well. The provider has identified outcomes and goals and developed outreach and incentive programs. Planning Commission Recommendations Conditional Use Permit -Faith Haven Camp, Inc: Motion by Lindquist, second by Partmann and unanimously carried to approve a conditional use permit to add an addition to the west end of the old main lodge & gym on Eagle Lake (Sec. 10, Twp. 131, R. 40, Eagle Lake Township, Lake No. 56-253) as presented. Conditional Use Permit -Joanne J. Anderson: Motion by Lee, second by Lindquist and unanimously carried to deny a conditional use permit to construct a wooden beach front retaining wall on Bass Lake (Sec. 17, Twp. 132, R. 42, Dunn Township, Lake No. 56-770) as recommended by the Planning Commission. Conditional Use Permit -Thomas Otto: Motion by Nelson, second by Lee and unanimously carried to install a driveway access to a future lake home on Little Pine Lake (Sec. 2, Twp. 136N, R. 39W, Perham Township, Lake No. 56-142) with conditions as recommended by the Planning Commission. 0 0 Conditional Use Permit -Kenneth M. Davis: Motion by Lindquist, second by Partmann and unanimously carried to approve a conditional use 0 permit to install a driveway to allow access to a building site near South Turtle Lake (Sec. 36, Twp. 133, R. 41, Sverdrup Township, Lake No. 56-377) with conditions as recommended by the Planning Commission. 0 0 0 Conditional Use Permit-Otter Tail Power Company: Otter Tail County Board of Commissioners October 19, 1999 Page 3 Motion by Portmann, second by Froemming and unanimously carried to approve a conditional use permit to increase the size of a downstream embankment to improve factor of safety required by the Federal Energy Regulatory Commission (FERG) on Otter Tail River (Sec. 5, Twp. 132, R. 43, Buse Township, No. 56-ORD) as presented. Preliminary Plat -"Pheasant Ridge", Thomas & Nancy Russell: Motion by Lindquist, second by Portmann and unanimously carried to approve the Preliminary Plat of "Pheasant Ridge", Thomas & Nancy Russell, consisting of 7 residential lots with conditions as recommended by the Planning Commission. The property is described as Pt of SE1/4 of SE1/4 of Section 4 of Tordenskjold Township. Conditional Use Permit -Michael Huffman & John Marks: Motion by Lee, second by Lindquist and unanimously carried to approve a conditional use permit to build a garage on a back lot on Pelican Lake (Sec. 11, Twp. 137, R. 43, Scambler Township, Lake No. 56-786) with conditions as recommended by the Planning Commission. Conditional Use Permit -Michael Huffman: Motion by Lee, second by Froemming and unanimously carried to approve a conditional use permit for Michael Huffman on Pelican Lake (Sec. 11, Twp. 137, R. 43, Scambler Township, Lake No. 56-786) with conditions as recommended by the Planning Commission. "Krueger Addition" -Star Lake: Motion by Lee, second by Lindquist and unanimously carried to require the lake access/aquatic vegetation removal approval from the DNR be included on the final plat as recommended by the Planning Commission in the October 13, 1999 Planning Commission minutes. Preliminary Plat -"Little McDonald North Shore Estates". Mark & Barbara Lenius: Motion by Nelson, second by Lindquist and unanimously carried to approve the preliminary plat of "Little McDonald North Shore Estates" consisting of 7 residential lots with conditions as recommended by the Planning Commission. The property is described as Lots 1 & 2 Ex Platted Ex Trs (38.02 Ac) Section 3 of Edna Township, Little McDonald Lake (56-328) GD. Closed to the Public Adjournment At 11 :26 a.m., Chairman Nelson declared the meeting of the Otter Tail County Board of Commissioners closed to the public for the purpose of evaluating the performance of Physical Plant Manager, Rick Sytsma, pursuant to M.S. §471.705 Subd. 1d(d). All five seated commissioners were present. A summary of performance conclusions will be provided at the next regular board meeting. At 11 :55 a.m., upon conclusion of the closed session, Chairman Nelson declared the County Board meeting adjourned until Tuesday, October 26, 1999.
