Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, October 5, 1999 at 9:30 a.m.
at the Otter Tail County Courthouse with Commissioners Sydney Nelson, Chair; Virginia Portmann,
Vice-Chair; Malcolm Lee, Andy Lindquist, and Roger Froemming present.
Approval of Agenda
Motion by Portmann, second by Froemming and unanimously carried to approve the County Board
agenda of October 5, 1999 with the following additions:
Pine Lakes Improvement District Appointments
Request for Approval of Benefit Option
Request for Clarification -September 21, 1999
Clarification of Minutes -September 21, 1999
Motion by Lindquist, second by Lee and unanimously carried to clarify the County Board minutes
of September 21, 1999 (Page 4, heading Preliminary Plat & Conditional Use Permit -"Turner
Point"/Delbert Turner. et al as follows: remove "with conditions as recommended by the Planning
Commission" and the sentence, therefore, shall read: "Motion by Lindquist, second by Lee and
carried, with Portmann opposed, to approve the preliminary plat of "Turner Point" consisting of 4
residential lots and conditional use permit to construct a road to service the plat subject to 1) a
document (prepared by the County Attorney and Land & Resource Director) attached to the plat
notifying purchasers of limited buildable lot size on Lots 1 & 4, 2) the degree of road curvature
(Schwartz Property) be reduced, and 3) mitigation for the wetland loss must be done in
accordance with the provisions of the Wetland Conservation Act."
Approval of Minutes
Motion by Lindquist, second by Froemming and unanimously carried to approve the County Board
minutes of September 28, 1999 as mailed.
Premise Permit
Otter Tail County Resolution No. 99 -48
Upon a motion by Lindquist, second by Portmann and unanimously carried, the Otter Tail County
Board of Commissioners adopts the following resolution:
WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of licenses
and permits for the conduct of lawful gambling lies with the Minnesota Gambling Control Board;
and
WHEREAS, the American Legion Post 30, Fergus Falls, MN, has made an application to the
Gambling Control Board for a premise permit to conduct lawful gambling at Wee Villa Lodge in
Elizabeth Township of Otter Tail County; and

WHEREAS, Minnesota Statue 349.213 provides that the Gambling Control Board may not issue a n
premise permit unless they receive a resolution from the Otter Tail County Board of w
Commissioners approving the permit; and
WHEREAS, the Otter Tail County Board of Commissioners is aware of no reason to oppose the
conduct of lawful gambling by the American Legion Post 30, Fergus Falls, MN, at Wee Villa Lodge
in Elizabeth Township of Otter Tail County.
NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners
hereby approves the conduct of lawful gambling by the American Legion Post 30, Fergus Falls,
MN, at Wee Villa Lodge in Elizabeth Township of Otter Tail County, provided the applicant meets
all the necessary criteria for the licenses and permits as required by the Gambling Control Board.
IT IS FURTHER RESOLVED, that notice of this application and approval shall be provided to the
Township of Elizabeth by sending them a copy of this resolution.

Upon a motion by Partmann, second by Lindquist and unanimously carried, the Otter Tail County
Board of Commissioners adopts the following resolution:
WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of licenses
and permits for the conduct of lawful gambling lies with the Minnesota Gambling Control Board;
and
WHEREAS, the Dent Fire Fighters Relief Association, Dent, MN, has made an application to the
Gambling Control Board for a premise permit to conduct lawful gambling at the Galaxy Resort in
Star Lake Township of Otter Tail County; and

MN, at Huckleberry's Bar and Grill in Dora Township of Otter Tail County provided the applicant
meets all the necessary criteria for the licenses and permits as required by the Gambling Control
Board.

Upon a motion by Nelson, second by Lindquist and unanimously carried, the Otter Tail County
Board of Commissioners adopts the following resolution:
WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of licenses
and permits for the conduct of lawful gambling lies with the Minnesota Gambling Control Board;

Contract Approval -Tank Removal & Building Demolition
Motion by Partmann, second by Lee and unanimously carried to authorize the appropriate county
officials' signatures to execute a contract agreement between Otter Tail County and Zervas

Industrial Petroleum Co. for underground storage tank removal and building demolition at the three
tax-forfeited sites in Otter Tail County.
Payment Approval
Motion by Lindquist, second by Lee and unanimously carried to approve payment to Lake Region
Healthcare Corporation, in the amount of $564.70, for the costs of a medical examination
conducted under the provision of Minnesota Statute §609.35.
Approval of "Work Around" PERA Life Option
Motion by Lindquist, second by Partmann and unanimously carried to authorize the County
Coordinator to offer a "work around" PERA life insurance option.
Payment Approval
Motion by Lindquist, second by Lee and unanimously carried to authorize payment for expanded
use of the SandCreek Employee Assistance Program in an amount not to exceed $3,000.
Approval to Proceed with Bids -Residential Markers
The County Attorney introduced discussion regarding the residential markers for the E-911 project.
Lengthy discussion followed regarding the possibility of bonding or requesting a change in
legislation that allows counties to assess for the cost of the markers/signs. Commissioner
Partmann noted that everyone should pay for their own sign; however, the project needs to move
forward and at the same time Otter Tail County should pursue a change in legislation.

proceed with the bid process for E-911 residential markers subject to the intention of Otter Tail
County to pursue legislation that will facilitate the reimbursement of cost for the E-911 residential
markers through service fees and assessments.

Motion by Lindquist, second by Lee and unanimously carried to authorize the Chair's signature to
execute an agreement between the State of Minnesota and County of Otter Tail to provide
maintenance funds for the OCTA snowmobile trails for FY2000. This agreement provides for
distribution of funds based on a percentage basis of work performed.

Transportation Letter r"\
Highway Engineer, Rick West, presented a draft letter to express the county's concerns regarding •
the emergency transportation bonding bill of 1999. Commissioners approved the letter as
submitted.
Approval to Pay Bills
Motion by Froemming, second by Portmann and unanimously carried to approve bills per
Attachment A of these minutes which includes the following lodging payment:

Closed to the Public
At 10:15 a.m., Chairman Nelson declared the meeting of the Otter Tail County Board of
Commissioners closed to the public for purposes of discussing labor negotiation strategies with the
county's collective bargaining units. All five seated commissioners were present.
Recess & Reconvene
At 10:30 a.m., upon conclusion of the closed session, the Chairman recessed the meeting of the
Otter Tail County Board of Commissioners. He declared the meeting reconvened at 11 :00 a.m.
Approval of Social Services Supervisor Position
Motion by Portmann, second by Lee and unanimously carried to approve an additional Social
Services Supervisor position at a DMG salary grade 22 as budgeted.
Resolution Requesting an Agricultural Disaster 0
Otter Tail County Resolution No. 99 -52
Upon a motion by Froemming, second by Lindquist and unanimously carried, the Otter Tail County
Board of Commissioners adopts the following resolution:
WHEREAS, many residents of Otter Tail County, subdivision of the State of Minnesota, are
experiencing extreme financial losses as a result of poor crop prices; and
WHEREAS, all farmers in Otter Tail County have been affected with continued low crop prices; and
WHEREAS, the recent and current county posted prices are approximately $1.50/bu. for corn,
$1.30/bu for barley, $.80/bu for oats, $2.30/bu for wheat, $6.25/cst for sunflowers and $4.10/bu for
soybeans and, even with average yields in Otter Tail County, projected losses will be $7.5 million
for corn, $2.5 million for soybeans, $1.5 million for wheat and $5.4 million for hay; and
WHEREAS, Otter Tail County anticipates a negative economic impact which extends well beyond
the farming community and to other segments of the county; and
WHEREAS, Otter Tail County farmers are in need of immediate financial assistance to alleviate
pending economic disasters.
NOW, THEREFORE, BE IT RESOLVED that the Board of County Commissioners for, and on 0-.
behalf of the citizens of Otter Tail County, request that the Governor of the State of Minnesota
petition the U.S. Secretary of Agriculture to declare Otter Tail County an economic disaster.

National 4-H Week -October 3-10,1999
Extension Educators, Steve Handegaard and Donna Geiser, and 4-H youths (Rose Stenoien,
Suzie Rethmeier, Mike Hendrickx, and Heidi Brenden) presented an overview of 4-H community
service activities and requested approval of the following 4-H Week Proclamation:
National 4-H Week Proclamation

Upon a motion by Lee, second by Froemming and unanimously carried, the Otter Tail County
Board of Commissioners adopts the following resolution:
WHEREAS, social problems concern our nation and threaten its future; and
WHEREAS, connecting youth and adults to work together through volunteer service can bridge the
differences that separate people and help solve problems; and
0 WHEREAS, we, the American people, have a tradition of philanthropy and volunteerism; and,
WHEREAS, more than 6.5 million youth touch and enhance the lives of others during National
4-H Week and throughout the year by doing good, by giving where there is a need, rebuilding what
had been torn down, teaching where there was a desire to learn and inspiring those who had lost
hope; and,
WHEREAS, 4-H, 4-H youth, volunteers and Extension staff have joined to promote a week of
national, collaborated volunteer community service; and,
WHEREAS, volunteer community service is an investment in the future we all must share.
NOW, THEREFORE, I, Sydney Nelson, County Board of Commissioners Chairman, do hereby
proclaim:
October 3-10, 1999
National 4-H Week
in Otter Tail County, and urge my fellow citizens to observe this week by connecting with youth,
friends, fellow employees and relatives, and with school, community and civic groups to engage in
projects benefiting their community.
