MINUTES OF THE
OTTER TAIL COUNTY BOARD OF COMMISSIONERS

Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, September 21, 1999 at
9:31 a.m. at the Otter Tail County Courthouse with Commissioners Sydney Nelson, Chair;
Virginia Partmann, Vice-Chair; Malcolm Lee, Andy Lindquist, and Roger Froemming present.
Approval of Agenda
Motion by Lee, second by Partmann and unanimously carried to approve the County Board
agenda of September 21, 1999 with the following additions:
Assessor Bob Moe -10:50 a.m. for Resolution Approval

Approval of Minutes
Motion by Froemming, second by Partmann and unanimously carried to approve the County Board
minutes of September 14, 1999 as mailed.
Bid Award -C.P. 99:34RG
After previously advertising for bids, Rick West, Highway Engineer opened the following bids for
C.P. 99:34RG, Grading and Surfacing at 1 :00 p.m. on September 15, 1999:

by the Highway Engineer.

Motion by Lee, second by Froemming and unanimously carried to authorize the Chairman's
signature to execute a contract between the County of Otter Tail and Riley Brothers Construction,
.Inc. for S.A.P. 56~599-49 & Etc. (Rd. No. T-682, Dead Lake/Star Lake Twp Rd. No. T-805 & CSAH
No. 35.

Approval of Agreement -Widseth, Smith, & Nolting Engineers
•
Motion by Partmann, second by Lee and unanimously carried to authorize the County Auditor to
enter into an agreement with Widseth, Smith, & Nolting for demolition and construction observation
services related to the underground storage tank removal and building demolition projects in
Rothsay, Newton Township, and the City of New York Mills to be billed on an hourly basis not to
exceed $5,000.
Closed to the Public
Reconvene in Open Session
At 10:05 a.m., Chairman Nelson declared the meeting of the Otter Tail County Board of
Commissioners closed to the public for the purpose of evaluating the performance of MIS Director,
Tim Brand, pursuant to M.S. §471.705 Subd. 1d(d). All five seated commissioners were present.
A summary of performance conclusions will be provided at the next regular board meeting. At
10:25 a.m., upon conclusion of the closed session, Chairman Nelson declared the County Board
meeting recessed for a short break. He reconvened the meeting at 10:31 a.m.

Approval to Pay Bills
Motion by Lindquist, second by Froemming and unanimously carried to approve bills per Q
Attachment A of these minutes which includes the following lodging payment:

State Assessed Valuation Resolution
Otter Tail County Resolution No. 99 -43
Upon a motion by Partmann, second by Froemming and unanimously carried, the Otter Tail
County Board of Commissioners adopts the following resolution:
WHEREAS, each year the Minnesota Department of Revenue determines market value for utility
property in each county and sends these values to each county either as Commissioner Orders or
recommended values per M.S. §273.37, Subd. 2; and
WHEREAS, the state recommended values are routinely followed and implemented by the
counties; and
WHEREAS, the Commissioner of Revenue is responsible to defend appeals in Tax Court on
Commissioner Orders and the individual County Attorneys are responsible to defend the values
shown as recommended values; and
WHEREAS, the counties are not familiar with nor are part of the valuation process of
recommended state assessed valuation and are not equipped to defend these values; and
WHEREAS, County of Otter Tail believes that legislation should be proposed that will make the
Commissioner of Revenue responsible to defend all state assessed valuations including
recommended values.

NOW, THEREFORE, BE IT RESOLVED, that Otter Tail County does hereby request that
legislation be proposed by the Association of Minnesota Counties to require the Commissioner of
Revenue to provide defense for Tax Court appeals of Commissioner Order and recommended
values of state assessed properties.

Coordinator's Office -Temporary Location
County Commissioners authorized the County Coordinator to close his office on Monday,
September 27, 1999 to facilitate a temporary move to the Court Street building to allow for
remodeling.
WCAAA Update
Commissioner Partmann, as the Board's representative on the West Central Area Agency on
Aging Joint Powers Board, updated commissioners regarding the agency's staffing. Director,
Ben Delong has resigned and the Joint Powers Board has named Darlene Ackerman as Acting
Director for an interim period. She noted that Public Health's Aging Coordinator, Lyle Hoxtell has
researched the current nutrition program and found positive results in most areas.
Planning Commission Recommendations
Conditional Use Permit -Fair Hills. Inc:
Motion by Lee, second by Partmann and unanimously carried to approve a conditional use permit
to build 3 additional cabins on Lake Five (Sec. 5, Twp. 137, R. 40W, Hobart Township, Lake No.
56-357) with conditions as recommended by the Planning Commission.
Conditional Use Permit -Otter Tail County Highway Department:
Motion by Froemming, second by Lindquist and unanimously carried to approve a conditional use
permit to conduct a grade raise and resurfacing of an existing county road on Rusch Lake (Sec.
10, 15, & 16, Twp. 136N, R. 40W, Edna Township, Lake No. 1641) with conditions as
recommended by the Planning Commission.
Conditional Use Permit -B. John Barry:
Motion by Lee, second by Froemming and unanimously carried to approve a conditional use permit
to add 3' to the existing berm on the east side of property on Pelican Lake (Sec. 9, Twp. 137, R.
42, Dunn Township, Lake No. 56-786) as presented.
Conditional Use Permit -Hidden Haven Resort (Earl E. Foss):
Motion by Nelson, second by Lee and unanimously carried to approve a conditional use permit to
add 10 new campsites on Rush Lake (Sec. 23, Twp. 135, R. 39, Rush Lake Township, Lake No.
56-141) with conditions as recommended by the Planning Commission.

Conditional Use Permit Extension Request -Steven Lenthe/B. John Barry:
Motion by Lee, second by Partmann and unanimously carried to approve an extension of 42 days
for CUP #5629 (Steven Lenthe/8. John Barry) as recommended by the Planning Commission.
Conditional Use Permit -Michael & Sandra Doyle:
Property Owner, Michael Doyle briefed the board on the history of his property as well as the
easement and culvert situation. He requested approval to fill a wetland area for a driveway.
Mr. Kalar noted that he had been on-site and there is a driveway that allows ingress and egress to
the property. According to the Wetlands Conservation Act (WCA), avoidance is the first step and
filling in the wetland in this case can be avoided. Discussion continued regarding the culvert and
whether or not the wetlands were man-made.
Motion by Nelson, second by Froemming and unanimously carried to deny a conditional use permit
to fill wetland on Dead Lake (Sec. 25, Twp. 135, R. 40, Dead Lake Township, Lake No. 56-383) as
recommended by the Planning Commission and to direct the Land & Resource Director to work
with the applicant to develop an alternate plan.
Preliminary Plat & Conditional Use Permit -"Turner Point'1/Delbert Turner. et al:
As previously directed, Mr. Kalar was on-site and provided photographs of the proposed
preliminary plat of "Turner Point". Clem Hendrickson and Terry Colton represented the application.
Lengthy discussion took place regarding whether or not there should be 4 lots approved. Mr. Kalar
noted that there are limitations in the size of the home that can be built on lots 1 & 4. The Planning
Commission motions were read for the record.
Motion by Lindquist, second by Partmann to approve the preliminary plat of "Turner Point" with 3
residential lots (rather than 4 as requested) and conditional use permit to construct a road to
service the plat with conditions as recommended by the Planning Commission. Discussion
followed regarding lot 1 and the type of house that could be built on that specific lot. The motion
and second were withdrawn.
Motion by Lindquist, second by Lee and carried, with Partmann opposed, to approve the
preliminary plat of "Turner Point" consisting of 4 residential lots and conditional use permit to
construct a road to service the plat with conditions as recommended by the Planning Commission
subject to a document (prepared by the County Attorney and Land & Resource Director) attached
to the plat notifying purchasers of limited buildable lot size on Lots 1 & 4. The location of this plat
is on the Otter Tail River (Sec. 5 & 8, Twp. 133, R. 40, Everts Township, Lake No. 56-OTR).
Snowmobile Trail Assistance Program Agreements
Motion by Lindquist, second by Lee and unanimously carried to authorize the Chair's signature to
execute the following snowmobile trail agreements between the State of Minnesota DNR and the
County of Otter Tail for FY 2000:
