HomeMy WebLinkAboutBoard of Commissioners - Minutes - 08/17/1999I - 0 0 0 MINUTES OF THE OTTER TAIL COUNTY BOARD OF COMMISSIONERS Otter Tail County Courthouse Commissioners' Room, Floor 1-B Tuesday,August17,1999 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, August 17, 1999 at 9:31 a.m. at the Otter Tail County Courthouse with Commissioners Sydney Nelson, Chair; Virginia Partmann, Vice-Chair; Malcolm Lee, Andy Lindquist, and Roger Froemming present. Approval of Agenda Motion by Partmann, second by Lee, and unanimously carried to approve the County Board agenda of August 17, 1999 as mailed. Approval of Minutes Motion by Lindquist, second by Lee, and unanimously carried to approve the County Board minutes of August 10, 1999 as mailed. Amended Enhanced 911 Ordinance At approximately 9:30 a.m., Chairman Nelson convened the public hearing to enact an Amended Enhanced 911 Ordinance with staff members present. No one from the public was in attendance. GIS employee, Brian Armstrong, explained the change in the ordinance. The amended ordinance will require Otter Tail County to provide and place the initial address number signs at each E-911 address. The property owner at each E-911 address would be charged for the cost of the sign which would be made a special assessment upon the property served. The property owner would be responsible to maintain and replace the signs thereafter. Motion by Lee, second by Partmann, and unanimously carried to enact the Amended Enhanced 911 Ordinance effective August 17, 1999 as presented. A copy of the ordinance is on file with the Office of the County Auditor. Consulting Services Agreement Motion by Partmann, second by Lindquist, and unanimously carried to authorize the Chair's signature to execute the Amended Enhanced 911 Consulting Services Agreement between the County of Otter Tail and Robert Block for the period of July 1, 1999 through January 1, 2000 subject to the approval of the County Attorney. Presentation of Retirement Plaque Chairman Nelson presented a retirement plaque to MIS Programmer, Dick Lundin, in appreciation of 14 years of service with Otter Tail County. Payments Approved Motion by Lindquist, second by Froemming, and unanimously carried to approve payment to Widseth Smith Nolting and Associates, Inc. in the amount of $2,735.50 for costs incurred in the preparation of the demolition specifications through July 29, 1999. Otter Tail County Board of Commissioners August 17, 1999 Page 2 Motion by Lindquist, second by Partmann, and unanimously carried to approve payment to r, Minnesota Abatement in the amount of $7,450 for the removal of asbestos-containing materials at "- Otter Tail County's three tax forfeited sites. The above total exceeds the original quote amount of $6,500 for additional removal charges for items not identified when the original quote was secured. TIF District -City of Battle Lake County Auditor, Wayne Stein, provided information regarding intent to create Tax Increment Financing District No. 3, City of Battle Lake for the purpose of constructing a multi-unit senior assisted-living residential facility in South Battle Lake 4th Addition. Motion by Lindquist, second by Froemming, and unanimously carried to waive the 30-day notice requirement for the above-proposed TIF District. Consulting Services Agreement -Perham Resource Recovery Facility Motion by Lee, second by Lindquist, and unanimously carried to authorize the Chair's signature to execute a Consulting Services Agreement between the County of Otter Tail and The Barlow Group relative to consulting services performed for the Perham Resource Recovery Facility. All costs except $4,600 are grant eligible through the Office of Environmental Assistance. Approval to Pay Bills Motion by Froemming, second by Lindquist, and unanimously carried to approve bills per Attachment A of these minutes. State Survey Q County Coordinator, Larry Krohn, reviewed the state-imposed mandates questionnaire/survey. The commissioners requested the County Coordinator to send the completed survey to the Office of the Legislative Auditor by August 18, 1999. Recess & Reconvene At 10:31 a.m., Chair Nelson recessed the meeting of Commissioners until the next agenda item at 11 :00 a.m. 11 :00 a.m. for the remainder of the agenda items. the Otter Tail County Board of The meeting was reconvened at Planning Commission Recommendations Conditional Use Permit -David 8. Arnoldy: Land & Resource Director, Bill Kalar, noted that the Planning Commission recommended denial of filling a 12' by 175' long area for access to the lake because it is a wetland area. They did recommend approval to fill an area outside of the wetland that is approximately 40' by 45'. Applicant, David Arnoldy, requested more cubic yards of fill for the 40' by 45' area than the figure given by the Planning Commission as he calculated that it would take 67 cubic yards to fill this area. Additionally, he requested moving the initial walkway area rather than using the wooden walkway suggested by the Planning Commission. Mr. Kalar responded that a change in the original request requires a new CUP application. Motion by Nelson, second by Lindquist, and unanimously carried to deny the proposed access path request as recommended by the Planning Commission and to approve a CUP to fill the Q requested 40' by 45' area and to allow fill necessary for this area not to exceed 1 foot in height and/or 67 cubic yards of fill. This CUP is for David B. Arnoldy on Rush Lake (Sec.30, Twp. 135, R. 38, Otto Township, Lake #56-141). 0 Conditional Use Permit -Eagle Lake Township: Otter Tail County Board of Commissioners August 17, 1999 Page 3 Motion by Portmann, second by Froemming, and unanimously carried to approve a conditional use permit for Eagle Lake Township, near Christina and Unnamed Lakes (Sec. 31 & 32, Twp. 131, R. 40, Eagle Lake Township, Lake No. 56-275 & 21-375) with conditions as recommended by the Planning Commission. Conditional Use Permit -Dennis Hanson: Motion by Lindquist, second by Lee, and unanimously carried to approve a conditional use permit for Dennis Hanson on Swan Lake (Sec. 30, Twp. 132, R. 42, Dane Prairie Township, Lake #56-781) with conditions as recommended by the Planning Commission. Conditional Use Permit -Thomas & Jodie Collins Et Al: Motion by Lee, second by Lindquist, and unanimously carried to approve a conditional use permit for Thomas & Jodie Collins, et al on Dead Lake (Sec. 34, Twp. 135, R. 41W, Star lake Township, Lake #56-383) as requested. Conditional Use Permit -John H. Walsh: Mr. Kalar acknowledged receipt of a letter from Benjamin R. Skjold in opposition of this conditional use request for a cluster development. Two other Clitherall Lake property owners expressed opposition to this proposed cluster development. Lengthy discussion took place regarding the difference between single family home shoreland regulations vs. cluster developments, lakeshore frontage and total area density used to determine criteria for total number of units allowed. 0 Motion by Lindquist, second by Partmann, and carried with Nelson opposed, to approve the conditional use permit of John H. Walsh on Clitherall Lake (Sec. 12, Twp. 132, R. 40, Clitherall Township, Lake #56-238) with conditions as recommended by the Planning Commission. () Conditional Use Permit -Upper Lightning Hunt Club, Inc: Motion by Lindquist, second by Lee, and unanimously carried to approve a conditional use permit for the Upper Lightning Hunt Club Inc. on Upper Lightning Lake (Sec. 25 & 36, Twp. 131, R. 44, Western Township, Lake #56-957) with conditions as recommended by the Planning Commission. Conditional Use Permit -Mike Arends: Motion by Lindquist, second by Froemming, and unanimously carried to approve an after-the-fact conditional use permit for Mike Arends on Stalker Lake (Sec. 34, Twp. 132, R. 41, Tordenskjold Township, Lake #56-437). Conditional Use Permit -Wade Siolie: Motion by Lee, second by Partmann, and unanimously carried to deny a conditional use permit for Wade Sjolie on Star Lake (Sec. 1, Twp. 135, R. 41, Star Lake Township, Lake #56-385) as recommended by the Planning Commission. Conditional Use Permit -Don Monk: Motion by Portmann, second by Froemming, and unanimously carried to deny a conditional use permit for Don Monk on Otter Tail Lake (Sec. 31, Twp. 134, R. 39, Otter Tail Lake, Lake #56-242) as recommended by the Planning Commission. Otter Tail County Board of Commissioners August 17, 1999 Page 4 Maet-Boh Subdivision Motion by Froemming, second by Lee, and unanimously carried to decline an additional extension for the Maet-Boh subdivision and to request that the developers return for final approval upon receipt of clear title on the property. Tubing Operations Mr. Kalar reviewed the conditional use permit conditions of two commercial tubing businesses on the Otter Tail River. Land & Resource Department Mr. Kalar reported that the Land & Resource Department will be moving back to the 1st level of the courthouse next Wednesday, August 25th. They will notify installers that the office will not be open because of the move. Humane Society -Budget Discussion Humane Society Executive Director, Carol Schaaf requested the county pay for the cost of mileage and after-hours time relative to picking up animals. Lengthy discussion followed regarding the necessary work in picking up animals and legislative budgetary constraints. The County Board referred this issue to the County Attorney. Application for License 0 Motion by Froemming, second by Lindquist, and unanimously carried to approve the following application for license: Hi-Way Park Enterprises Consumption & Display Set-Up Q Henning, MN On-Sale 3.2 Malt Liquor License Subject to approval of the Sheriff and County Attorney. Adjournment At 12:20 p.m., Chairman Nelson declared the meeting of the Otter Tail County Board of Commissioners adjourned until the next scheduled meeting on Tuesday, August 24, 1999.
