Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, July 20, 1999 at 9:30 a.m. at
the Otter Tail County Courthouse with Commissioners Sydney Nelson, Chair; Virginia Partmann,
Vice-Chair; Malcolm Lee, Andy Lindquist, and Roger Froemming present.
Approval of Agenda
Motion by Lindquist, second by Froemming, and unanimously carried to approve the County Board
agenda of July 20, 1999 as mailed.
Approval of Minutes
Motion by Partmann, second by Lee, and unanimously carried to approve the County Board
minutes of July 13, 1999 as mailed.
Snowmobile Grant-In-Aid Systems Resolution
Otter Tail County Resolution No. 99-31
UPON a motion by Nelson, second by Lindquist, and unanimously carried, the Otter Tail County
Board of Commissioners adopts the following resolution:
WHEREAS, Otter Tail County has sponsored Grant-In-Aid Trail Systems in the past; and
WHEREAS, acceptance of the Grant-In-Aid Trail Systems proposed extensions are subject to the
review and approval of the County Attorney;
THEREFORE, BE IT RESOLVED that Otter Tail County shall sponsor Grant-In-Aid Trail Systems
as they exist for Otter Trail Riders Association and proposed extensions of Grant-In-Aid Trails with
the aforementioned condition.
Adopted this 20th day of July, 1999.

Intervention/Prevention Grant
Court Services Director, Chuck Kitzman, reported back to the board as requested regarding the
Intervention/Prevention Grant proposal of Peaceful Solutions and Lakeland MHC. He reported that
the service learning component was removed from the grant outline. It is still unclear whether the
state will accept third party reimbursement as a local match for the grant. However, Mr. Kitzman
noted that there is no risk to the county in agreeing to act as fiscal agent for the grant. If the state
does not accept the proposed form of local match, the grant would be denied.

Motion by Partmann, second by Lee, and unanimously carried to authorize Otter Tail County to act
as fiscal agent for the proposed grant request of Peaceful Solutions and Lakeland MHC for funding 0
for prevention/intervention services.
County Ditch No. 25
County Auditor, Wayne Stein, presented a petition with 15 signatures requesting a replacement of
a culvert under a township road (Edna Twp.) across County Ditch No. 25. Motion by Lindquist,
second by Partmann, and unanimously carried to accept the petition and refer the matter to the
County Attorney and County Ditch Inspector to determine whether an engineers report and
redetermination of benefits would be required.

Motion by Lindquist, second by Froemming, and unanimously carried to approve the following

UPON a motion by Nelson, second by Lindquist, and unanimously carried, the Otter Tail County
Board of Commissioners adopts the following resolution:
RESOLVED by the Otter Tail County Board of Commissioners of Otter Tail County, Minnesota,
that;
WHEREAS, Dale and Marlene Wiirre, representative of heirs of Hulda Nilimaa, former fee owner of
record, has made application to repurchase the following legally described parcel:
Parcel 40-000-99-0377-000
Northwest Quarter of the South One Acres of
Lot a, Block 1
Southside Addition to New York Mills
Said property having forfeited to the State of Minnesota on the 28th day of August, 1998 for
nonpayment of the 1992, 1993, 1994, 1995, 1996, and 1997 property taxes, and
WHEREAS, an application to repurchase was submitted timely on July 19, 1999; and

WHEREAS, the sum of $3,562.81 has been submitted representing the aggregate of all delinquent
and current taxes, penalties, costs, assessments, and fees, as of July 31, 1999 that would have
been due and payable had the above described parcel not forfeited to the State of Minnesota, and;
WHEREAS, the applicant has requested that the Otter Tail County Board of Commissioners
consider the application to repurchase the above-described parcel and has requested that the
Otter Tail County Board of Commissioners approve the applicant's request to repurchase.
NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners
hereby approves the repurchase of the above described tax forfeited property and finds that the
repurchase is in the best public interest and that it will relieve undue hardship resulting from the
forfeiture.

At 9:56 a.m., Chairman Nelson declared the meeting of the Otter Tail County Board of
Commissioners recessed for a short break. At 10 a.m., Chairman Nelson reconvened the Board of
Commissioners meeting to resume the regularly scheduled agenda.
Planning Commission Recommendations
Conditional Use Permit -Amor Township:
Motion by Froemming, second by Lee, and unanimously carried to approve a conditional use
permit for the Oak Ridge Beach road project on Otter Tail Lake (Sec. 14, Twp. 134N, R. 40W,
Amor Township, Lake #56-242) as presented.
Preliminary Plat & Conditional Use Permit -Delbert Turner, et al:
Tim Griep, Assistant Director of the Land & Resource office, reported that the Delbert Turner
prelimary plat and CUP request was denied by the Planning Commission. The commission was
concerned because of the wetlands on the property and because the lots do not have a lot of
buildable area. Developer, Clem Hendrickson of Anderson's Land Surveying, spoke on behalf of
the applicant. He stated that the staking initially was inaccurate and by moving the road toward the
resort area the wetland area could be avoided. He requested that the application be remanded
back to the Planning Commission for changes. Discussion followed.
Motion by Lindquist, second by Lee, and unanimously carried to uphold the denial of the Planning
Commission for a preliminary plat and CUP on the Otter Tail River (Sec. 5 & 8, Twp. 133, R. 40,
Everts Township, 56-OTR).
Conditional Use Permit -Wil-O-Wood Resort -Timothy & Heidi Lambertson:
Motion by Froemming, second by Lee, and unanimously carried to approve a conditional use
permit to add a trailer and 5 RV spots to the resort on Otter Tail Lake (Sec. 23, Twp. 135, R. 39

West, Rush Lake Township, Lake #56-141) with conditions as recommended by the Planning n

Conditional Use Permit -Darrell & Marlene Gast:
Mr. Griep briefed the board on the background of the conditional use request. This request was
previously denied because of violations that were resolved through district court proceedings. The
applicant's engineer, Pat Reisnour, drew a diagram of the proposed project to show the water flow
on the lot. Commissioner Froemming expressed concern on the amount of fill that will be required.
Neighbor, Don Van Der Weide spoke in opposition of the plan and requested that no fill be
allowed. Engineer, Richard Gunderson with Houston Engineering in Fargo, spoke on behalf of the
Ven Der Weides. He noted that the drainage problems could be resolved without fill and
expressed concern that elevations are too high. Discussion continued regarding the elevation of
Mr. Van Der Weides garage and the proposed pipe that would be very close to his garage.
Mr. Reisnour agreed that drainage flows can be corrected without fill, however, the fill is required
for access to Mr. Gast's garage and the driveway would act as a dike or berm to keep water south
or west. Neighbor, Debbra Rehm spoke in opposition to the project. Commissioners requested
that neighbors meet and come up with an agreeable plan before coming back to the County Board.
Motion by Froemming, second by Lindquist to table the conditional use permit application of Darrell
& Marlene Gast on Otter Tail Lake (Sec. 14, Twp. 134, R. 40 West, Amor Township, Lake #56-
242) for thirty (30) days to encourage all parties involved to meet and agree on a plan.
Discussion followed. County Attorney, David Hauser informed the Board that their decision is what
amount of fill, if any, should be allowed and if there are water flow consequences that affect the Q
neighbor, the applicant is responsible subject to a suit on losses.
Chairman Nelson called for a vote. Motion carried unanimously (applicant agreed to a thirty (30)
day delay on a decision regarding the permit).

Motion by Partmann, second by Lindquist, and unanimously carried, to approve bills per
Attachment A of these minutes which include the following lodging payments:

At 11:15 a.m., Chairman Nelson declared the meeting of the Otter Tail County Board of
