Approval of ~genda,. ,, Motion by Partmann, second by Lindquist, and unariimo'usly carried to approve the County Board agenda of May 18, 1999 with the following changes: Bill Kalar -include a final plat . Rick West -agenda canceled'exceptbid award Mark Morris -10:5.5, a.f!l: -request for payment-approval Approval of Minutes· Motion by Lindquist, second by Partmann, and unanimously carried to approve the County Board minutes of May 11, 1999 as mailed. Q · · . Veterans Memorial Drive Perrie Sheldon·,· representing the DAV, requested approval of a Veterans Memorial Drive throughout Otter Tail County. He stressed that veterans are deserving of honor in their memory for service given to our nation. Mr. Sheldon noted that the DAV will purchase signs for the drive and requested Otter Tail County to furnish posts and erect the signs. f,fter verifying that the signs will not have an adverse impact on the E-911 project or Highway signing, motion by Lindquist, second by Lee, and unanimously carried to approve the Veterans Memorial Drive as presented and county assistance with furnishing posts and installing signs. Approval to Purchase Truck for Recycling Collection Sol.id Waste Director, Mike Hanan, requested approval to purchase a 1988 GMC Dump Truck (unit 112) from the Highway Department and convert the truck to a compactor truck by purchasing a new or used 16-18 yard compactor. Total cost of the truck and compactor is estimated at $27,000 0 $30,000. The use of the garbage truck will significantly impact the amount of time currently required to collect loose cardboard and possibly other recyclables. Mr. Hanan requested a transfer of currerit budgeted Capital Improvement funds set aside for a truck for the Henning Transfer Station in the amount of $18,000 to be useq towards payment of this truck and/or compactor. Motion by Pqrtmann, second by Froemming, and unanimously carried to authorize the Solid Waste Director to purchase unit 112 from the Highway Department and a compactor for the truck for use by the Solid Waste Departmentas described above. · 0 Oscar Township Road Issue County-Attorney, David Hauser, stated that Oscar Towr:iship is petitioning the County Board for their position regarding a one-mile stretch of road that is currently maintained by Oscar Township. The Wilkin County Board submitted correspondence that the current maintenance situation of this Otter Tail County Board of Commissioners May 18, 1999 Page 2 road between Oscar Township and Akron Township is equitable as currently stands and should remain the same. Q Motion by Lee, second by Lindquist, and unanimously carried that the cost of maintenance for this one-mile stretch of road should be shared equitably between Oscar Township and Akron Township. Additionally, the motion directed the County Attorney to send a letter to Oscar Township relative to the issue. Planning Commission Recommendations Conditional Use Permit-Roger & Toni Brakke: Motion by Partmann, second by Lee, and unanimously carried to approve a Conditional Use Permit for an earthmoving project as presented, not requiring an engineer's plan, subject to the completion of the purchase of proper,ty. to_ the west as conditioned and recommended by the Planning Commission. The CUP is for property on Lake Lizzie (Sec. 20, Twp. 137, R. 42, Dunn Township -Lake #760). ' ' · Conditional Use Permit -Duane Donley/Larry Stoller: Land & Resource Director, Bill Kalar, introduced discussion regarding the request for a Conditional Use Permit for Duane Donley/Larry'Stoller as presented'on the revised map dated May 3, 1999. Attorney Bob Russell, representing the applicants,· reviewed the history of the CUP application. The application request was tabled by the Planning Commission, referred for an EAW, an EAW needs determination hearing was held and an EAW was determined not to be necessary since potential environmental impacts could be mitigated or reversed by an erosion control plan. The ~ County Board approved the recommendation regarding the EAW needs determination and turned ( ·, the CUP request back to the Planning Commission for consideration. Mr. Russell stated that the~ developer has no problem with obtaining the proper MPCA permits, however, feel that they can meet all county criteria without an engineer's plan. He requested that the condition requiring the engineer's plan be removed by the County Board because it is cost prohibitive and the project may not be able to move forward. The applicant and surveyor spoke on the same issue. Elizabeth Maxwell, property owner near the proposed development, spoke in opposition of the project and read a letter for the record regarding environmental issues she felt had not been considered. Commissioner Lindquist stated that an EAW study was completed to address environmental issues. An engineer on the project allows a registered, licensed inaividual to be responsible and liable in case there are any problems. Motion by Nelson, second by Lindquist, and unanimously carried to approve a Conditional Use Permit to construct a road on Alice Lake (Sec. 25 & 36, Twp. 135, R. 40, Dead Lake Township, Lake #56-244) with conditions as recommended by the Planning Commission and subject to the complete removal of the old garbage sites. Conditional Use Permit -Kenneth & Evelyn Beauchamp: Motion by Nelson, second by Lindquist, and unanimously carried to approve a Conditional Use Permit to allow a boat access on Lake Marion (Sec. 12, Twp, 135, R. 40, Dead Lake Township, Lake #56-243) with conditions as recommended by the Planning Commission. I'---. Preliminary Plat -"Pine Island Estates''/Steve & Denise Zimmerman: '.._) Bill Kalar noted that the Planning Commission recommended approval of the preliminary plat with changes. .. Otter Tail County Board of Commissioners May 18, 1999 Page 3 . Attorney, Jim Sinclair spoke for the applicants. Mr. Sinclair stated that the applicants objected to Gthe recommendations of the Planning Commission. The Planning Commission gave 6 reasons for ' modifying the plan as presented. They recommended approval of 4 lots instead of 8 lots and Mr. Sinclair felt that the reasons given are not justifiable. He then reviewed each reason. He requested thatthe county approve the preliminary plat of "Pine Island Estates" as presented. Mr. Kalar provided a background relative to this property which, at one time, was attached to a plat called Pine Lake Shores. In 1993, the Planning Commission denied the proposed subdivision of Pine Lake Shores with 26 lake lots and 5 proposed back lots. The reasons for denial at this time are the same reasons cited for the reduced number of lots· relative to the preliminary plat of "Pine Island Estates". In 1995, a revised plat was submitted with a reduced number of lake front lots requested and the area being considered today was removed from the plat. There is no restriction that prohibits the land from being subdivided and there are no wetlands, present. Lengthy discussion followed. Motion by Nelson, second by Lee, to approve the Preliminary Plat of "Pine Island Estates" near Little Pine Lake (Sec. 35 of Gorman Township, Lake #56-142) as presented (8 lots). Conditional Use Permit-Glen Anderson/Tom Falk: Motion by Lee, second by Lindquist, and unanimously carried to deny a Conditional Use Permit to operate Tom's Backhoe Services on Sybil Lake (Sec. 6, Twp. 136, R. 40, Edna Township, Lake #387) as recommended by the Planning Commission. Conditiona/Use Permit-Tom & Mary Rocheford: Motion by Nelson, second by Lee, and unanimously carried to approve a Conditional Use Permit to remove a tree and level part of the dirt (ice) ridge on Big Pine Lake (Sec. 32, Twp. 137, R. 38, Corliss Township, Lake #56-130) with conditions as recommended by the Planning Commission. Final Plat -"River View" Motion by Lee, second by Partmann, and unanimously carried to approve the final plat of "River View" on West Red River Lake and Otter Tail River (Sec. 34, Twp., 134, R. 42, Friberg Township). 0 Approval of Certificates of Correction to Plat · · Motion by Lindquist, second by Partmann, and unanimously carried to approve, as prepared by David A. Motion by Partmann, second by Froemming, and unanimously carried to approve purchase of equipment (marine radios) for the boat and water area from the Capital Improvement fund. Performance Evaluation Summary Motion by Partmann, second by Froemming, and unanimously carried to place the positive performance evaluation summary in the personnel file of County Coordinator, Larry Krohn. Bid Award: S.A.P. 56-682-0STB After opening bids at 1:00 p.m. on May 12, 1999, County Engineer, Rick West, provided a bid summary and recommendation for award on S.A.P. 56-682-05TB Grading, Aggregate Base, Bituminous Surface, Bituminous Concrete, Curb and Gutter, & Bituminous Mill & Overlay. The bids were: Mark Sand & Gravel Acquisition Co. Fergus Falls, MN Central Specialties, Inc. Alexandria, MN $2,367,600.48 $2,450,051.98 Motion by Lee, second by Lindquist, and unanimously carried to award the to the lowest bidder, Mark Sand & Gravel Acquisition Co., Fergus Falls, MN, in the amount of $2,367,600.48 as recommended by the County Engineer. 0 Reclassification Due to restructuring in the Land & Resource Management Department, the position of Assistant Office Manager, Grade 9, was substantially changed. After the David M. Griffith (DMG) evaluation process was completed, the position was classified as Permit Technician, Grade 11. Motion by Lee, second by Partmann, and unanimously carried to approve the DMG change in Compensation Grade of the restructured position as outlined above, and to approve the resulting salary change from $11.06/hour to $11.13/hour effective March 1, 1999.
