HomeMy WebLinkAboutBoard of Commissioners - Minutes - 05/04/1999Call to Order The Otter Tail County Board of Commissioners convened Tuesday, May 4, 1999 at 9:30 a.m. at the Otter Tail County Courthouse with Commissioners Sydney Nelson, Chair; Virginia Partmann, Vice-Chair; Malcolm Lee, Andy Lindquist, and Roger Froemming present. Approval of Agenda Motion by Lindquist, second by Lee, and unanimously carried to approve the County Board agenda of May 4, 1999. Approval of Minutes Motion by Lee, second by Froemming, and unanimously carried to approve the County Board minutes of April 27, 1999 as mailed. Snowmobile Grant-In-Aid Trail Systems Resolution Otter Tail County Resolution No. 99-21 0 UPON a motion by Lee, second by Lindquist, and unanimously carried, the Otter Tail County Board of Commissioners adopts the following resolution: 0 WHEREAS, Otter Tail County has sponsored Grant-In-Aid Systems in the past; and WHEREAS, acceptance of the Grant-In-Aid Systems proposed extensions are subject to the review and approval of the County Attorney. THEREFORE, BE IT RESOLVED that Otter Tail County shall continue to sponsor Grant-In-Aid Trail Systems as they exist for Otter Country Trail Association and proposed extensions of Grant- In-Aid Trails with the aforementioned condition. Stat. §163.11, Subd. 4, when a relocated highway is open for travel and takes the place of and serves the same purpose as any portion of another county highway, the County Board may vacate any such portion of the other highway by resolution; and WHEREAS, the legal descriptions and owners of the right-of-way to be vacated are as follows (Exhibits attached to official minutes): Legal description attached (Exhibit 1) -Lydia Klatt Legal description attached (Exhibit 2) -Douglas L. Motion by Partmann, second by Lindquist, and unanimously carried to authorize the Chairman's signature to execute a contract between the County of Otter Tail and Mark Sand & Gravel Acquisition Co. for the 1999 seasonal supply of hot mix bituminous for West Otter Tail County. Motion by Lee, second by Lindquist, and unanimously carried to authorize the Chairman's signature to execute a contract between the County of Otter Tail and Mark Sand & Gravel Acquisition Co. for the 1999 seasonal supply of hot mix bituminous for North Otter Tail County. 0 0 Otter Tail County Board of Commissioners May 4, 1999 Page 3 Motion by Partmann, second by Froemming and carried, with Lee abstaining, to authorize the Chairman's signature to execute a contract between the County of Otter Tail and Sherbrooke Asphalt, Inc. for the 1999 seasonal supply of hot mix bituminous for North Otter Tail County. Motion by Lee, second by Partmann, and unanimously carried to authorize the Chairman's signature to execute a contract between the County of Otter Tail and Unistrut Northern for C.P. 98:RASP, sign posts & hardware. Motion by Lindquist, second by Lee, and unanimously carried to authorize the Chairman's signature to execute a contract between the County of Otter Tail and Riley Bros. Construction Inc. for S.A.P. 56-612-09 from CSAH No. 82 to Center Street (bridge replacement, utility improvements, and street construction). Motion by Froemming, second by Lee, and unanimously carried to authorize the Chairman's signature to execute a contract between the County of Otter Tail and Central Specialties, Inc. for S.A.P. 56-614-12 & Etc. (bituminous overlay on CSAH No. 14 & CSAH No. 44). Motion by Nelson, second by Lindquist, and unanimously carried to authorize the Chairman's signature to execute a contract between the County of Otter Tail and Mark Sand & Gravel Acquisition Company for S.A.P. 56-608-20 & Etc. (bituminous overlay on CSAH No. 8 & C.R. No. 137). Motion by Lee, second by Partmann, and unanimously carried to authorize the Chairman's signature to execute a contract between the County of Otter Tail and Mark Sand & Gravel Acquisition Company for S.A.P. 56-622-06 & Etc. (bituminous overlay on CSAH No. 22 & Lida Twp road). Bid Award -S.P. 56-624-10 Highway Engineer, Rick West submitted the following quotations for S.P. 56-624-10, right-of-way platting for CSAH No. 24 reconstruction: Anderson Land Surveying Fergus Falls, MN Interstate Engineering, Inc. Fergus Falls, MN Ackerman Land Surveying Wahpeton, ND $14,355.00 $17,800.00 $18,900.00 Motion by Lee, second by Froemming, and unanimously carried to award S.P. 56-624-10 (right-of- way platting for CSAH No. 24 reconstruction) to the low bidder, Anderson Land Surveying of Fergus Falls, in the amount of $14,355.00. Approval of Phelps Mill Park Signs Motion by Partmann, second by Froemming, and unanimously carried to approve an expenditure of $958 for replacement of two Phelps Mill Park signs at the intersection of TH 210 and CSAH No. 35 near Underwood Otter Tail County Board of Commissioners May 4, 1999 Page 4 Miscellaneous Milling Equipment Mr. West introduced discussion regarding old milling equipment that has been stored for a long time in a garage on the east side of the park. Discussion followed. Mr. West recommended that the County dispose of the milling equipment by way of consultation with the County Historical Society and the Friends of Phelps Mill. County commissioners concurred. Furniture Contract Motion by Partmann, second by Lindquist, and unanimously carried to authorize the Chair's signature to execute an agreement between the County of Otter Tail and Coopers Office Supply, Inc. of Fergus Falls for modular furniture systems and seating relative to the first floor Courthouse remodeling project. Institution Community Work Crew (ICWC) House Building Program JPA Motion by Lindquist, second by Lee, and unanimously carried to authorize the Chair's signature to execute a Joint Powers Agreement between the State of Minnesota DOC and the County of Otter Tail for FY 2000-2001 for the ICWC state inmate house building program. The total amount of the contract to be provided to the County by the State is $266,450. Public Health Endowment Otter Tail County Resolution No. 99-23 UPON a motion by Partmann, second by Lee, and unanimously carried, the Otter Tail County Board of Commissioners adopts the following resolution: 0 WHEREAS, Minnesota will be receiving tobacco settlement money, a portion of which is to be 0 allocated by the State Legislature; and WHEREAS, one recommendation for the use of these funds is to create a Public Health Endowment Fund by setting aside $260 million from the settlement for public health activities; and WHEREAS, a 5% draw would be made annually against the endowment to generate approximately $5,150,000 in Fiscal Year 2002; and WHEREAS, the proposal is to distribute funds to community health boards on a formula basis in accordance with the local public health act (MS 145A); and WHEREAS, local public health departments are governed by County Commissioners with input from local citizens and health care providers who serve on the Community Health Advisory Committee; and WHEREAS, local public health agencies must develop a comprehensive plan every four years to identify health problems and prepare a plan to address those public health problems, some of which are mandated to be addressed within the limits of available funding; and WHEREAS, to assure accountability for these fund expenditures; outcomes of public health programs are reported annually to County Boards, the local Community Health Advisory Committees, the Minnesota Department of Health, and the State Legislature. Request for Correction of Road Name Citizen, Terry Marthaler, appeared along with Edna Township Official, Keith Brakke, to request a correction/change of a road name from Kratzke Road to Little McDonald Lake Estates Road in Otter Tail County. Kratzke Road is the name assigned for the emergency 911 system being implemented in Otter Tail County. Terry Marthaler presented a handout explaining the situation and spoke in favor of changing the road name back to Little McDonald Lake Estates Road because he felt a mistake had been made and asked to keep the existing road name. Q Edna Township Official, Keith Brakke, spoke in favor of changing the name back to Little McDonald Lake Estates Road. Lengthy discussion followed. 0 Bob Williams, who owns property on this road, expressed a concern about citizen representation. Bob Block explained the process used for road naming for the E-911 project and expressed that the department felt that township input was very important in the process. Chief Deputy, Mark Morris stated that he understood concerns of the road name expressed by the citizens living on that road, however, his concern is with public safety issues and if the county starts changing road names at this point, the project could be delayed. Chairman Nelson requested comments from the County Commissioners. Commissioners expressed that even though this particular situation may have been caused by miscommunication, they did not want to delay the E-911 system in Otter Tail County. They expressed an importance in finding people during emergencies, which takes a higher precedence than a name given to a specific road. Chairman Nelson stated that he felt there was miscommunication and felt it may be possible to resolve the issue. No action was taken. 1999 BWSR Natural Resource Block Grant Motion by Lindquist, second by Froemming, and unanimously carried to authorize the appropriate county officials' signatures to execute the Otter Tail County 1999 BWSR Natural Resources Block Grant Agreement between the County of Otter Tail and State of Minnesota. The grant agreement provides the county $78,584 from the state with a required county and SWCD match of $67,508 for local water planning, WCA, DNR Shoreland, and ISTS. Otter Tail County Board of Commissioners May 4, 1999 Page 6 Payment Approval -Consulting Services Motion by Lindquist, second by Partmann, and unanimously carried to approve final payment to Pro-West & Associates, Inc. for Rural/Addressing/E-911 Consulting Services Agreement in the amount of $10,828. Approval of Tobacco License Application Motion by Nelson, second by Lindquist, and unanimously carried to approve the following application for license: Marlene Brown Huckleberry's Bar and Grille LLP Dent, MN 56528 Tobacco Approval of Bills Motion by Lindquist, second by Froemming, and unanimously carried to approve the bills per Attachment A of these minutes which include the following lodging payments: Cragun's Lodge & Conference Detention Officers, John Barthel, Doug Rapp, Jill Kluck, Days Inn Radisson Hotel-St. Paul Sheraton Inn Midway (reimbursable by MCCC) and Tina Tungseth -Jail Administrator, Gary Waskosky Deputy, Mark Englund Commissioner, Syd Nelson Sheriff, Gary Nelson Oscar Township Road Issue 0 County Attorney, David Hauser updated the board on one mile of road that is presently being 0 maintained by Oscar Township. The County Attorney reviewed the situation and noted that Oscar Township is petitioning the County Board to review the matter. Discussion followed. The County Board directed Mr. Hauser to draft a letter to state the Otter Tail County Board's position that the cost for this one-mile stretch of road should be shared equitably between Oscar and Akron townships. Closed to the Public At 10:50 a.m., Chairman Nelson declared the meeting of the Otter Tail County Board of Commissioners closed to the public to discuss pending litigation as authorized by attorney-client privilege, M.S. 471.705 Subd. 1d. Present were all seated commissioners, the County Attorney, County Coordinator, Recording Secretary, and HR Coordinator. Adjournment At 11 :09 a.m., upon conclusion of the closed session, Chairman Nelson declared the meeting of the Otter Tail County Board of Commissioners adjourned until 1 :00 p.m. on Tuesday, May 11, 1999.
