HomeMy WebLinkAboutBoard of Commissioners - Minutes - 03/16/1999Q Call to Order The Otter Tail County Board of Commissioners convened Tuesday, March 16, 1999 at 9:31 a.m. at the Otter Tail County Courthouse with Commissioners Sydney Nelson, Chair; Virginia Partmann, Vice-Chair; Malcolm Lee, Andy Lindquist, and Roger Froemming present. Approval of Agenda Motion by Lee, second by Partmann, and unanimously carried to approve the County Board agenda of March 16, 1999 with the following additions: Bid Review & Recommendation -CSAH No. 8 & C.H. 137 Capital Improvement Committee Meeting Signage Committee Mtg for Rural Addressing -March 22, 1999 Approval of Minutes Motion by Lindquist, second by Froemming, and unanimously carried to approve the County Board minutes of March 9, 1999 with the following correction: Page 3, under Heading "Discussion -Agricultural Funding" (first paragraph, last sentence) should read as follows: Mr. Holm requested approval to testify at the Senate Ag Committee, House Ag Committee, and Senate Ag Finance Committee on behalf of the Minnesota Association of County Agricultural Inspectors (MACAI) in favor of this proposed legislation. Ag Update Extension Educator, Bob Stommes updated the Board regarding the Minnesota Extension Service Master Gardener program. He explained the educational and volunteer opportunities available through this program. Otter Tail County Historical Society Executive Director, Chris Schuelke noted that the master gardeners have been instrumental in the success of the heirloom garden started about four years ago in front of the museum. Mr. Stommes provided several handouts. Educator, Bill Saumer spoke about the financial challenges experienced by many farmers. Lengthy discussion followed. Contract Approval -1999 Countywide Traffic Marking Project Motion by Lindquist, second by Froemming, and unanimously carried to authorize the Chair's signature to execute a contract between the County of Otter Tail and Traffic Marking Service, Inc. of Buffalo, MN for 1999 countywide traffic marking (C.P. 99:TM). Contract Approval -1999 Countywide Sealcoat Project Motion by Partmann, second by Lee, and unanimously carried to authorize the Chair's signature to execute a contract between the County of Otter Tail and Morris Sealcoat & Trucking, Inc. of Morris, MN for countywide sealcoat project (S.A.P. 56-601-38 & Etc.). Otter Tail County Board of Commissioners March 16, 1999 Page 2 , Contract Approval -Rural Addressing Intersection Signs 0 Motion by Partmann, second by Lindquist, and unanimously carried to authorize the Chair's '" signature to execute a contract between the County of Otter Tail and Earl F. Andersen, Inc. of Bloomington, MN for rural addressing intersection signs (C.P. 98:RASP). Bid Award -S.A.P. 56-622-06 & Etc. (CSAH 22 & paving for Lida Twp) After previously advertising, Highway Engineer Rick West, opened the following bids at 1 :00 p.m, on March 10, 1999 for S.A.P. 56-622-06 & Etc, (bituminous base, leveling, & wearing course, aggregate base, aggregate shouldering & topsoil). Planning Commission Recommendations Conditional Use Permit -Otter Tail County Highway Dept: Motion by Lindquist, second by Partmann, and unanimously carried to approve a Conditional Use O Permit to reconstruct a portion of CSAH No, 82 near unnamed lakes (56-830, 56-832, 56-848, & . 56-849-Sec. 2, 11, 13, 14, 25, & 30, Twp. 132N, R43W42W, Buse and Dane Prairie Townships) with conditions as recommended by the Planning Commission, Q Conditional Use Permit -Duane Donley/Larry Stoller: Otter Tail County Board of Commissioners March 16, 1999 Page 3 Land & Resource Director, Bill Kalar invited the applicants to address issues regarding this Conditional Use Permit application. Attorney, Bob Russell introduced developers Steve Hyland and Larrry Stoller and spoke on their behalf. Mr. Russell explained that his clients attended a Planning Commission meeting to obtain a CUP to construct a road in Dead Lake Township near Lake Alice. He presented a diagram of the road. The proposed lots are in excess of the 5-acre minimum requirement and minimum lake frontage of 212 feet as required in the SCO. The CUP request is for the proposed road only. The road is not going to be constructed where the current pathway is located and it is designed to fully comply with county specifications. Mr. Russell indicated that his clients, at the Planning Commission meeting, understood the matter would not be passed and in fact, that the Planning Commission would recommend against granting a permit unless there was an Environmental Assessment Worksheet (EAW) completed. Therefore, his clients agreed to table the motion. Mr. Russell requested that the County Board proceed and issue the CUP for the construction of the road and not require an EAW as recommended by the Planning Commission. Land & Resource Director, Bill Kalar stated that his staff, who attended the meeting, indicated that the intent of the Planning Commission was to recommend an EAW needs determination at this point, not that an EAW be completed. The EAW needs determination would determine whether there is significant environmental impact to require an EAW study. Applicant, Larry Stoller, requested the process required by an EAW needs determination. Mr. Kalar explained the process. County Attorney, David Hauser stated that the Planning Commission is looking for more information and the Planning Commission has the authority to implement an EAW process without a petition. Motion by Lindquist, second by Froemming to direct this request for a CUP back to the Planning Commission for the purpose of conducting an EAW needs determination (sec 25 & 36, twp. 135, R. 40, 56-244, Dead Lake Township). Discussion followed. Property owner, Peggy Maxwell, expressed opposition to the project. Chairman Nelson called for a vote. Motion passed with Partmann opposed. Conditional Use Permit -Walter & Nancy Jehs: Motion by Lee, second by Lindquist, and unanimously carried to approve a Conditional Use Permit to shore up the NE corner of their home on Pelican Lake (Sec. 11, Twp. 137, R43, 56-786, Scambler Township) with conditions as recommended by the Planning Commission. Conditional Use Permit -Robert & Julie Budke: Motion by Partmann, second by Lindquist, and unanimously carried to approve a Conditional Use Permit to add up to 2 additional apartments to an existing structure on Unnamed Lake (Sec. 16, Twp. 132, R.43, 56-835, Buse Township) as presented. Conditional Use Permit -Glen A. Noyes: 'Motion by Lindquist, second by Lee, and unanimously carried to approve a Conditional Use Permit to construct a roadway on Indian Lake (Sec. 21, Twp. 132, R. 42, Dane Prairie Township) as presented. Otter Tail County Board of Commissioners March 16, 1999 Page 4 Conditional Use Permit -Allen Chaser/Ethel Lake Resort: Motion by Froemming, second by Lee, and unanimously carried to approve a Conditional Use Permit to build a screen porch and to enclose freezers and coolers on Ethel Lake (Sec. 4, Twp. 133, R. 39, 56-193, Girard Township) with conditions as recommended by the Planning Commission. Additionally, the motion includes that this Conditional Use Permit is valid for a 2-year period. Beaver Damage Control Program Otter Tail County Resolution No. 99-13 UPON a motion by Lee, second by Lindquist, and unanimously carried, the Otter Tail County Board of Commissioners adopts the following resolution: WHEREAS, the State of Minnesota Department of Agriculture has designated funding to be used in allocation for beaver damage control to the joint Power Board in a fifteen County and Red Lake Nation area, and WHEREAS, Otter Tail County's share of these funds are to be used in those townships who elect to participate in the program, and WHEREAS, the State of Minnesota Department of Agriculture requires a matching share for each County that participates; NOW, THEREFORE, BE IT RESOLVED, that Otter Tail County, participating in the Beaver Damage Control Program, will authorize the matching fund requirement for the State of Minnesota Department of Agriculture. Authorization for Exemption from Lawful Gambling Licenses The Maidens of the Prairie to Lakes, DU have submitted an application for Authorization for an Exemption from Lawful Gambling License for an event scheduled at the Peak Supper Club on April 17, 1999. The Spring Migration #162, DU has submitted an application for Authorization for an Exemption from Lawful Gambling License for an event scheduled at the Pier on April 16, 1999. No action was taken to prohibit the scheduled events. At 10:50 a.m., Commissioner Lee left the meeting for a brief period, returning at approximately 11:00 a.m. Motor Vehicle Report Wayne Stein, County Auditor presented the 1998 Motor Vehicle report. He stated that the report is very good and reflects excellent work with very few errors by the Motor Vehicle staff. He reported that the Quadrant retrofit bill has been introduced in both the house and the senate. Solid Waste Director, Mike Hanan, is appearing in St. Paul at the request of Representative Roxann Daggett regarding landfill closing(s). Sheriff Nelson is testifying on the sale of guns bill. The AMC expressed a concern with the possibility of legislation being introduced for a property tax freeze this session. Flexible Benefits Plan Otter Tail County Resolution No. 99-14 UPON a motion by Partmann, second by Lindquist and unanimously carried, the Otter Tail County Board of Commissioners adopts the following resolution: RESOLVED, that the Otter Tail County Flexible Benefits Plan, be and the same is adopted; and BE IT FURTHER RESOLVED, that any proper members of the Board of Commissioners are hereby authorized to make such contributions from the funds of the County as are necessary to 0 carry out the provisions of said plan at any time; and Q BE IT FURTHER RESOLVED, that in the event any conflict arises between the provisions of said Plan and the Employee Retirement Income Security Act of 197 4 (ERISA) or any other applicable law or regulation (as such law or regulation may be interpreted or amended), the County shall resolve such conflict in a manner which complies with ERISA or such law or regulation.
