HomeMy WebLinkAboutBoard of Commissioners - Minutes - 03/02/1999Call to Order The Otter Tail County Board of Commissioners convened Tuesday, March 2, 1999 at 9:31 a.m. at the Otter Tail County Courthouse with Commissioners Sydney Nelson, Chair; Virginia Partmann, Vice-Chair; Malcolm Lee, Andy Lindquist, and Roger Froemming present. Approval of Agenda Motion by Lee, second by Lindquist, and unanimously carried to approve the County Board agenda of March 2, 1999 with the following addition: Capital Improvement Committee Meeting Approval of Minutes Motion by Lindquist, second by Partmann, and unanimously carried to approve the County Board minutes of February 23, 1999 as mailed. Date of Agreement January 1, 1999 Annual County Boat and Water Safety Agreement Otter Tail County Resolution No. 99 -10 County Amount of Terms of Agreement Payment Otter Tail $42,902.00 January 1, 1999 -December 31, 1999 Upon a motion by Lindquist, second by Lee, and unanimously carried, the Otter Tail County Board of Commissioners adopts the following resolution: WHEREAS, under the provisions of M.S. Section 86B.105 the sheriff of each county is required to carry out the provision of Chapter 86B and the Boat and Water Safety Rules, hereinafter referred to as the "Minn. Rules," promulgated by the Commissioner of Natural Resources, including patrol, enforcement, search and rescue, watercraft inspection, waterway marking and accident investigation, all hereinafter referred to as the "Sheriff's Duties"; and WHEREAS, in connection with the Sheriffs Duties M.S. Section 86B.701 provides that the County submit to the Commissioner of Natural Resources a budget to carry out the Sheriffs Duties; and WHEREAS, M.S. Section 86B.701 and the Minn. Rules provide for the allocation of funds by the Commissioner to the County based on certain criteria and conclusions to assist the funding of the Sheriff's Duties; and WHEREAS, the County has submitted a proposed budget to the State. Dated: J1t\gt>-<-!-.J 1 1i~1 Attest 14!, ~ Larry Kr n, erk Discussion -Utility Counties' Meeting Assessor, Bob Moe, reported on a recent utility counties meeting and provided the Coalition of Utility Counties' response to proposed legislation to exempt utilities from personal property tax for the County Board's review. Commissioner Lindquist noted that Investor Owned Utilities, (IOU) receive a tax credit and suggested that fact be included in the letter opposing this legislation. Lengthy discussion followed regarding the varying amount of impact on county budgets and the coalition's opposition to S.F. 947 and H.F. 847 to exempt personal property tax on a specific peak shaving plant facility proposed for construction in Martin County. Repeal of State Sales Tax on Local Government Purchases Otter Tail County Resolution No. 99 -11 Upon motion by Lee, second by Froemming, and unanimously carried, the Otter Tail County Board of Commissioners adopts the following resolution: WHEREAS, the current taxation scheme allowing the State to tax purchases by the County has the effect of shifting local property tax dollars to the State; and WHEREAS, the above-mentioned taxation scheme helped balance the state budget, but also raised local costs and property taxes; and WHEREAS, the above-mentioned taxation scheme is bad public policy. NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners hereby approves this resolution in support of the repeal of the State sales tax on local government purchases. No action was taken. Premise Permit .. OtterTail County Resolu.tion No. 99 -12 Upon a motion by Lindquist, second by Froemming, and unanimously carried, the Otter Tail County Board of Commissioners adopts the following resolution: WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of licenses and permits for the conduct of lawful gambling lies with the Minnesota Gambling Control Board: and WHEREAS, Underwood Lions Club, Underwood, MN, has made an application to the Gambling Control Board for a premise permit to conduct lawful gambling at the Riverfront Lounge, in Sverdrup Township of Otter Tail County; and WHEREAS, Minnesota Statute 349.213 provides that the Gambling Control Board may not issue a premise permit unless . they receive a resolution from the Otter Tail County Board of Commissioners approving the permits; and WHEREAS, the Otter Tail County Board of Commissioners is aware of no reason to oppose the conduct of lawful gambling by the Underwood Lions Club, Underwood, MN, at the Riverfront Lounge, in Sverdrup Township of Otter Tail County. NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners hereby approves the conduct of lawful gambling by the Underwood Lions Club, Underwood, MN, at the Riverfront Lounge, in Sverdrup Township of Otter Tail County, provided the applicant meets all the necessary criteria for the licenses and permits as required by the Gambling Control Board. IT IS FURTHER RESOLVED, that notice of this application and approval shall be provided to the Township of Sverdrup by sending them a copy of this resolution. Q Adopted this 2nd day of March, 1999. He reported that he talked to local legislators about introducing legislation to obtain funds for the recovery of the facility. A public forum is tentatively scheduled for Tuesday, March 30, 1999 in Perham regarding the facility. Commissioner Lindquist stressed that the County is interested in the most economical and most environmentally friendly manner to dispose of waste in the region. Mr. Hanan reported that the Minnesota Resource Recovery Association is supportive of grant monies being used for the resource facility in Perham.
