HomeMy WebLinkAboutBoard of Commissioners - Minutes - 02/16/19990 Q 0 Call to Order The Otter Tail County Board of Commissioners convened Tuesday, February 16, 1999 at 9:30 a.m. at the Otter Tail County Courthouse with Commissioners Sydney Nelson, Chair; Virginia Partmann, Vice-Chair; Malcolm Lee, Andy Lindquist, and Roger Froemming present. Approval of Agenda Motion by Lee, second by Partmann, and unanimously carried to approve the County Board agenda of February 16, 1999 with the following additions: Solid Waste Committee Meeting Capital Improvement Committee Meeting Update -GIS Internal Meeting (02/18/99 at 9 a.m. at Cavour Building) Approval of Minutes Motion by Lee, second by Partmann, and unanimously carried to approve the County Board minutes of February 9, 1999 as mailed. Approval of 1999 Solid Waste Haulers' Applications Motion by Lindquist, second by Partmann, and unanimously carried to approve the following Solid Waste Haulers' applications for 1999: Meyers Garbage Service Rt. 1, Box 291 Perham, MN 56573 Region Waste Systems Rt. 1 , Box 340 Dalton, MN 56324 1998 Waste Reduction Awards West Tool and Design and Perham Elementary/Middle School Solid Waste Public Information and Education Officer, Marie Tysdal, reported that the Solid Waste Advisory Committee has selected two organizations for the 1998 Waste Reduction /;\ward. Haulers' records and business surveys are used to determine organizations that have reduced their waste. Ms. Tysdal then telephoned businesses with large reduction in solid waste and asked about their waste disposal and recycling methods. She provided a handout summarizing the responses from the businesses. West Tool and Design of Fergus Falls was selected as the small business winner and the Perham Elementary/Middle School was selected as the large business award winner. Ms. Tysdal noted that all candidates would receive recognition for their efforts in reusing and recycling products. Approval of Acquisition of a Waterfowl Easement At 9:45 a.m. with Vice-Chair Partmann presiding during a brief absence of Chairman Nelson, Don Kleven of the U.S. Fish & Wildlife Service requested approval of acquisition of a waterfowl easement. He explained that this piece of property is part of larger parcels in Douglas County. The owner has decided to enhance the property with restored wetlands. Otter Tail County Board of Commissioners February 16, 1999 Page 2 Motion by Lindquist, second by Lee, and unanimously carried to approve the acquisition of the 0 following property for purposes of a waterfowl easement: T. 131N. R. 39 w. 5th P.M. Section 34, S½SW¼ except that part of the SW¼SW¼ of said section lying southwesterly of the township road. Chairman Nelson returned at 9:48 a.m. and assumed the Chair. Review of Proposed State Wildlife Land Acquisition Otter Tail County Resolution No. 99-07 UPON a motion by Lindquist, second by Lee, and unanimously carried, the Otter Tail County Board of Commissioners adopts the following resolution: WHEREAS, in accordance with Minnesota Statutes 97A.145 Subd. 2, the Commissioner of the Department of Natural Resources on February.· 16, 1999 provided the County Board and Jhe appropriate town officers with a description of lands to be acquired by the State of Minnesota for water and wildlife conservation purposes. WHEREAS, the lands to be acquired are described as follows: Approximately 41 Ac in the NE ¼ Section 32, Township 131, Range 44 (Western Township) THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of Otter Tail County on February 16, 1999 that the State's proposed acquisition of the above-described property be approved. Chairman Nelson accepted the report and signed the summary as presented. Planning Commission Recommendations 0 Conditional Use Permit -Dora Township: 0 Motion by Lee, second by Lindquist, and unanimously carried to approve a Conditional Use Permit for Dora Township to tar a road and improve two other roads on Club, Spirit, and Big McDonald Q (J Otter Tail County Board of Commissioners February 16, 1999 Page 3 Lakes (Sec. 29, 17, & 24, Twp. 136, R. 41, Dora Township) with conditions as recommended by the Planning Commission. Greenwood Lake Aire Villas -Donald/Julie Ulrich: Motion by Partmann, second by Froemming, and unanimously carried to approve a Conditional Use Permit to relocate a cabin and increase the size of the cabin on Ottertail Lake (Sec. 29, Twp, 134N, R. 39W, 56-242, Otter Tail Township) as presented. Conditional Use Permit -Timothy & Tammy Lueders: Motion by Froemming, second by Lee, and unanimously carried to approve a Conditional Use Permit to operate a woodworking shop on Long Lake (Sec. 23, Twp. 134N, R. 39W, 56-201 Otter Tail Township) with conditions as recommended by the Planning Commission. Conditional Use Permit -Thomas Prieve/Sue Wika: Motion by Lee, second by Partmann, and unanimously carried to approve a Conditional Use Permit to level an area for horseback riding on Unnamed Lake (Sec. 34, Twp. 135N, R. 42W, · 56°743, Maplewood Township) with conditions as recommended by the Planning Commission. Bid Award -1999 Countywide Seal Coat Project After previously advertising, Highway Engineer Rick West, opened the following bids at 1 :00 p.m. on February 10, 1999 for the 1999 Seal Coat Project: Morris Sealcoat & Trucking, Inc. Morris, MN Astech Surface Technologies Corporation St. Cloud, MN McLaughlin & Schultz, Inc. Marshall, MN $800,883.14 $827,232.23 $948,456.48 Motion by Lindquist, second by Lee, and unanimously carried to award the 1999 Countywide Seal Coat Project (SAP 56-602-05 & Etc.) to the low bidder, Morris Sealcoat & Trucking, Inc. of Morris, MN in the amount of $800,883.14. Legislative Discussion The Highway Engineer presented a draft letter addressing the proposed reduction in vehicle registration fees and resulting affect on transportation funding for commissioner's review. Commissioners directed Mr. West to send the letter as presented to local legislators. 4-H Update Extension Educators, Steve Handegaard and Donna Geiser, updated board members regarding 4-H activities. They reported on Cluster Project Days, Cluster Communications Contest, and the annual Creative Sewing Expo as well as Conservation Days (attended by all 5th graders in the County) and Youth Health Day (attended by all 9th graders in the County). • Otter Tail County Board of Commissioners February 16, 1999 Page 4 PERA Proposed Legislation Q Larry Krohn, County Coordinator, reported that the Public Employees Retirement Association has · requested that Otter Tail County support draft legislation introduced by PERA to change eligibility requirements from dollar amount earned to the number of hours worked in a calendar year. Motion by Lee, second by Froemming, and unanimously carried to support the proposed legislation to change how public employees become eligible to participate in PERA. Personnel Administration Policies Motion by Partmann, second by Lee, and unanimously carried to adopt the following long standing past practices: Reclassifications: In the case of a position reclassification to a higher grade, it is the policy of the county to establish the employee's compensation at the next highest step in the new salary grade. In the event of a demotion or reclassificaiion · resulting in a lower--salary grade, thP. employee's compensation will be frozen at the current level until cost of living increases allow the salary grade to reach the employees compensation rate. The effective date for reclassifications will be the date the material is forwarded to the classification consultant. New Hires: New hires will start on step one of the appropriate salary grade with the following exceptions. If the candidate has performed the same set of duties in previous employment or has been employed by a county the candidate may start at the step two level. If the candidate has performed the same set of duties while employed by another county, the candidate may start on step three of the appropriate salary grade. Promotions: Promotions are handled as reclassifications providing the compensation level is greater than step four of the promotion range. If below step four, the compensation level will be established as if a new hire. Request for Federal & State Response to the Current Economic Crisis Facing Farm Families and Rural Communities Otter Tail County Resolution No. 99 -08 UPON a motion by Froemming, second by Partmann, and unanimously carried, the Otter Tail County Board of Commissioners adopts the following resolution: WHEREAS, Minnesota farm operators are currently receiving the lowest grain and livestock commodity prices in decades and in many cases these price levels are below the cost of production. ._ WHEREAS, Minnesota farm families engaged in pork production are facing the most severe 0 economic crisis in several decades, a crisis which could force thousands of farm operators out of business. 0 0 0 Otter Tail County Board of Commissioners February 16, 1999 Page 5 WHEREAS, Minnesota farm families affected by this severe economic crisis are in need of immediate assistance to address the financial needs of their farm business and the financial and emotional stresses facing their family. WHEREAS, Agriculture is a major industry in Minnesota and the economic crisis facing the swine industry and other segment's of the state's agriculture industry could have a highly negative economic impact on the economy of most rural communities in Minnesota. BE IT RESOLVED THAT the Otter Tail County Board of Commissioners requests that the Federal and State Government take appropriate and immediate action to address the current economic crisis facing farm families and rural communities in Minnesota. Dated: ~,e)A •• 9 '/1-M J'f'l'l Attest.~ ~ Lari0<ro: Clerk DISCUSSION -REALIGNMENT OF COURT SYSTEM FUNDING As previously directed, the County Coordinator Larry Krohn, Court Administrator Kathy Ouren, and County Auditor Wayne Stein reported on the financial impact of the state overseeing the court system. The County Coordinator reported that Otter Tail County receives more state aid than court costs. Since this proposed change is supposed to be revenue neutral, the position of the County would be an agreement with the proposed change as long as the HAGA dollars are not affected beyond the projected expenses of the Court Administrators office. Judge Tom Stringer reported that the judges did not oppose the concept of the state plan, however, the judges had many questions that have not been answered. Ms. Ouren noted that after researching state benefits, salaries, and administrative questions, she would not be opposed to a resolution in support of state funding. Lengthy discussion followed regarding the ath District pilot project, Otter Tail County's current system that is working well, and HAGA dollars. A motion was presented by Partmann, seconded by Lee, and unanimously carried not to oppose the State Funding Plan for the court system provided the County does not lose more State funding than the expenses taken over by the State or reduced services to Otter Tail County's constituents. Approval of Consumption & Display Application Motion by Nelson, second by Lindquist, and unanimously carried to approve a Consumption and Display permit for Pair-A-Dice of Perham, MN. Approval of 911 Agreement Sheriff Gary Nelson and Chief Deputy Mark Morris, requested approval of a 911 agreement which has evolved as a result of the deregulation of the communications industry. Motion by Lindquist, second by Lee, and unanimously carried to authorize the Chair's signature to · execute a 911 Agreement between the County of Otter Tail and Otter Tail Telcom in order to provide 911 services in the County 911 system subject to the approval of the County Attorney.
