HomeMy WebLinkAboutBoard of Commissioners - Minutes - 01/05/19990 0 0 Statutory Meeting -Call to Order Pursuant to Minnesota Statute, the Otter Tail County Board of Commissioners convened Tuesday, January 5, 1999 at 9:30 a.m. at the Otter Tail County Courthouse with Commissioners Syd Nelson, Malcolm Lee, Andy Lindquist, and Roger Froemming present. Commissioner Virginia Partmann was absent. 1999 Otter Tail County Board Chair Selected ,county Board Clerk, Larry Krohn, requested nominations for the 1999 Otter Tail County Board 1Chair. Motion by Lindquist, second by Lee, and unanimously carried with Nelson abstaining, to ~lee! Commissioner Sydney Nelson as the Otter Tail County Board Chairman for 1999. 1999 Otter Tail County Board Vice-Chair Selected ,1999 County Board Chairman, Sydney Nelson, assumed the chair and requested nominations for ,the 1999 Otter Tail County Board Vice-Chair. Motion by Lindquist, second by Lee, and unanimously carried to elect Commissioner Virginia Partmann as the Otter Tail County Board Vice- Chairman for 1999. Oath of Office 'At 9:31 a.m., District Court Judge, Wally Senyk, administered the Oath of Office to Second District -Commissioner, Malcolm Lee, to begin a new four-year term. Judge Senyk then administered the Oath of Office to Fourth District Commissioner, Roger Froemming, to begin his first four-year term. Approval of Agenda Motion by Lindquist, second by Lee, and unanimously carried to approve the County Board agenda of January 5, 1999 as mailed. Approval of Minutes Motion by Lee, second by Froemming, and unanimously carried to approve the County Board minutes of December 22, 1998 as mailed. Forgiveness of Penalty Request Property owner, Michael Treis, provided a packet of information relative to a forgiveness of penalty request on parcel number 51-000-24-0181-001. The request was for forgiveness of interest and penalty in the amount of $139.93. Treasurer, Steve Andrews stated that Mr. Treis had submitted a check in the amount of $936, which was payment of tax without penalty included. Mr. Andrews notified Mr. Treis by letter that the payment was not accepted because of failure to include the penalty and interest accrual. Discussion followed regarding a snow removal bill that has been paid by the County. The County Attorney stated that the snow removal issue was a separate issue from the payment of taxes. Chairman Nelson stated that the forgiveness of penalty and interest request will be taken into consideration. Otter Tail County Board of Commissioners January 5, 1999 Page 2 Approval of Final Plat -"North Bass Lake Shores" Motion by Lee, second by Lindquist, and unanimously carried to approve the final plat of Max and Q Irene Stroschein known as "North Bass Lake Shores" (Sec. 36, Twp. 133N, R. 42W, 56-570) as recommended by the Land & Resource Director. Approval to Hire a Full-Time Inspector Land & Resource Director, Bill Kalar, provided organizational charts for his office including a new full-time Inspector position and full-time, permanent clerical position. Mr. Kalar also provided information regarding increased permit applications which is largely due to the countywide sanitation code effective in 1998. Chairman Nelson questioned if this additional staffing would be sufficient for the next couple of years? Mr. Kalar stated that the properties his office is now dealing with are becoming less than ideal for building purposes and on-site inspections before permits are issued may, in the future, put an additional workload on his office staff. With many changes occurring, it is difficult to determine future staffing needs. Motion by Lee, second by Lindquist, and unanimously carried to authorize the Land & Resource • Director to begin the hiring process for an additional full-time Inspector and a full-time; permanent Office Tech I position. Kunz Rocky's Resort RR 1, Box 118 Dent, MN 56538 Approval of State Auditor's Audit Engagement Letter Motion by Lee, second by Lindquist, and unanimously carried to authorize the appropriate County officials' signatures on the Office of the State Auditor's audit engagement letter for services to be provided pursuant to Minnesota Statute 6.48 for Otter Tail County for year-end December 31, 1998. 0 Minnesota Rural Counties Caucus ·o Motion by Lindquist, second by Froemming, and unanimously carried to approve payment to the • Minnesota Rural Counties Caucus, in the amount of $2000, for Otter Tail County's 1999 membership in the MRCC. 0 0 0 Otter Tail County Board of Commissioners January 5, 1999 Page 3 •Motion by Lindquist, second by Froemming with Nelson abstaining, to appoint Commissioner Syd Nelson as Otter Tail County's 1999 delegate to the MRCC. Motion by Nelson, second by Lee, with Froemming abstaining, to appoint Commissioner Roger Froemming as Otter Tail County's 1999 alternate delegate to the MRCC. Family Services Collaborative Program Fund Auditor, Wayne Stein, reported that on Tuesday, October 20, 1998, the Otter Tail County Board of Commissioners requested a review of the Collaborative program funding. This review has been completed with no areas of concern being noted. Classification of Tax Forfeited Land and Request for DNR Approval Otter Tail County Board Resolution No. 99-01 UPON a motion by Lee, second by Froemming and unanimously carried, the Otter Tail County Board of Commissioners adopts the following resolution: 0WHEREAS, The County Board of Commissioners of the_ County of Otter Jail, State of Minnesota desire to offer for sale the following described parcel of land that has forfeited to the State of Minnesota for non-payment of taxes: 79-000-30-0006-001 Section 30 Township 135 Range 44 Sub Lot 6 of Government Lot 3, Except the South 80', and WHEREAS, Said parcel of land has been view by the County Board of Commissioners and has 0b_een classified as non-conservation land as provided for in Minnesota Statutes 282.01 NOW, THEREFORE, BE IT RESOVED, That the Otter Tail County Board of Commissioners -hereby certifies that the parcel of land described above has been viewed and complies with the ,provisions of Minnesota Statutes 85.012, 92.461,282.01 Subd. 8,282.018, and the 1991 Laws of Minnesota Chapter 354, Art. 10, Sec. 9, amending Minnesota Statute Section 282.018, Subd 2 (1990). The Independent Delinquent Tax List Perham Enterprise Bulletin Perham Enterprise Bulletin First Publication Second Publication First Publication Second Publication $9.20 per S.A.U. $9.20 per S.A.U. $9.20 per S.A.U. $9.20 per S.A.U. $5.45 per S.A.U. 0 0 0 0 0 Pocket Gopher Bounty Otter Tail County Board of Commissioners January 5, 1999 Page 5 Otter Tail County Resolution No. 99-02 UPON a motion made by Lindquist, seconded by Lee, and unanimously carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County, Minnesota, that The sum of thirty cents ($.30) be paid out of the General Revenue Fund of Otter Tail County for every pocket gopher killed in said County during the year 1999 in cases where the township in which the pocket gophers were so killed shall provide for the payment of at least an additional bounty of forty cents ($.40) for each pocket gopher so killed. RESOLVED further that said payment of such bounty shall be made by the County Auditor upon certificates executed by the Chairman and/or Clerk of the Town Board of said Township setting forth that the township had issued and delivered to each claimant a payment for at least seventy c,ents ($.70) for each pocket gopher so killed. Adopted at Fergus Falls, MN this 5th day of January 1999. Dated: Attest Tax Forfeited Land Sale Apportionment Otter Tail County Resolution No. 99-03 UPON a motion made by Lee, seconded by Lindquist, and unanimously carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County, Minnesota, that WHEREAS, it is provided in Minn. Stat. 282.05 for the apportionment of proceeds from the sale of tax forfeited lands, and WHEREAS, the County Auditor shall apportion the tax sale proceeds to the taxing district pursuant to Minn. Stat. 282.08 and WHEREAS, Minn Stat. 282.08 (4) (b) provides that the County Board may set aside 20% of the proceeds remaining after the value of public improvements, special assessments and bond issues levied on the property have been paid, for acquisition and maintenance of county parks and recreational areas, and 0 WHEREAS, Otter Tail County has a park and recreational area which would benefit by such an apportionment. In 1998, the cost to publish the Delinquent Tax Lisi was $13,698.44. There were approximately 639 parcels published for a per parcel cost of $21.44. Based on the 1999 publication bid the cost will be approximately $14,122.60 or a per parcel cost of $22.00. There is statutory authority for the County Board to establish the fee at the greater of $10.00 or a reasonable fee to recover all the cost incurred against each parcel included in the Delinquent Tax List (Minn. Stat. 279.092). Approval to Pay Annual Appropriations Motion by Lindquist, second by Froemming, and unanimously carried to authorize payment of the O .. following 1999 annual appropriations: Otter Tail Country Tourism Association West Otter Tail Fair Association East Otter Tail Fair Association West Central MN Initiative Fund $ 5,000 $12,000 $12,000 $15,212 The above appropriations are paid in full in either January or February of each year. All other appropriations are paid monthly, with the exception of the Viking Library System, which receives 50% in July and 50% in December. County Board of Equalization Meeting Dates Set Motion by Lee, second by Lindquist, and unanimously carried to convene the County Board of Equalization on Thursday, June 17, 1999, at 9:00 a.m. and to reconvene the County Board of Equalization for final action on Wednesday, June 30, 1999 (Minn. Stat. 274.14). Discussion -Mileage Reimbursement Mr. Stein reported that the allowable IRS mileage rate for business travel for 1999 has been reduced to $.31 per mile. The State MA reimbursement rate is $.325 per mile and as referenced in the most recent County Board minutes (Dec. 22, 1998) a motion was passed to increase all County mileage reimbursement to $.325 per mile. The County Board elected to keep the same reimbursement rate throughout the County. However, Mr. Stein reported that because the IRS Q rate is being reduced, the County would be responsible to report withholding for the difference of ,. $.325 per mile and $.31 per mile. Q 0 0 Otter Tail County Board of Commissioners January 5, 1999 Page 7 Motion by Lindquist, second by Froemming, and unanimously carried to rescind the previous motion of December 22, 1998 regarding the establishment of County mileage reimbursement at $.325 per mile and effective Monday, January 4, 1999 set the County mileage reimbursement rate at $.31 per mile for employees. The State MA reimbursement rate will apply where applicable. Sanitation 3810 Minnesota St. Alexandria, MN 56308 Approval of Purchase of Vehicles -Sheriff's Department Motion by Lee, second by Froemming, and unanimously carried to authorize the Sheriff to purchase three (3) Ford Crown Victoria Police Cars and recondition four (4) police cars pursuant to State Contracts (A-174-5) and A-207-5) in the amount of $119,206.43. Reduction in Retainage -S.A.P. 56-680-03 Highway Engineer, Rick West, reported that Strom Construction Co. requested a reduction in retainage from 5% to 2% on the CSAH No. 80 project in Perham. Motion by Lindquist, second by Lee, and unanimously carried to approve a reduction in retainage from 5% to 2.5% for the CSAH No. 80 project as recommended by the Highway Engineer. Mr. West reported that Minnerath Construction Inc. requested a reduction in retainage for the CSAH No. 13 project. Mr. West reported that 62% of the project was complete and did not recommend a reduction. No action was taken. Appointment to the WCAAA for 1999 Motion by Nelson, second by Lee, and unanimously carried to appoint Commissioner Virginia Partmann to the West Central Area Agency on Aging for 1999. The first meeting of the •WCAAA is January 8, 1999. Appointment to Lakeland Mental Health Center Board Motion by Froemming, second by Lee and unanimously carried to appoint Commissioner Andy Lindquist to the Lakeland Mental Health Center Board. Otter Tail County Board of Commissioners January 5, 1999 Page 8 Ditch No. 64 -Discussion Q County Attorney, David Hauser, reported on Ditch No. 64. Commissioners directed Mr. Hauser, and Ditch Inspector, Tiny Holm, to research additional facts regarding Ditch No. 64, meet with an authority on drainage ditches, and report back to the County Board. Family Services Collaborative -County Board Letter of Commitment Mr. Hauser drafted the County Board's letter of commitment to the Family Services Collaborative and provided the draft to Board members for review. Discussion followed regarding funding and governing structure of the collaborative. Chairman Nelson signed the County Board "Letter of Commitment". Denial of Forgiveness of Penalty and Interest Request Discussion took place regarding the previous forgiveness of penalty and interest request.
