HomeMy WebLinkAboutBoard of Commissioners - Minutes - 10/20/19980 0 Call to Order The Otter Tail County Board of Commissioners convened Tuesday, October 20, 1998 at 9:30 a.m. at the Otter Tail County Courthouse with Commissioners Malcolm Lee, Chair; Syd Nelson, Vice- Chair; Andy Lindquist, Virginia Partmann, and Bill Stone present. Approval of Agenda Motion by Lindquist, second by Partmann, and unanimously carried to approve the County Board agenda of October 20, 1998 as mailed. Approval of Minutes Motion by Partmann, second by Nelson, and unanimously carried to approve the County Board minutes of October 13, 1998 as mailed. 4-H Update Educators, Steve Handegaard and Donna Geiser, updated board members on 4-H activities and provided handouts. They presented a magazine, "4-H in Otter Tail County", promoting national 4- H week of October 4-10, 1998 and a Cluster 7 4-H Ambassador Training brochure. Discussion followed. Notification of TIF District Commissioner Lee acknowledged a letter from the City of Vergas that notifies Otter Tail County of a proposed modification of District No. 1-1 (a housing tax increment financing district). The public hearing is scheduled at 7:00 p.m. on December 7, 1998. Ditch No. 48 Report County Attorney, David Hauser, responded to last week's inquiry of the County Board regarding Ditch No. 48. He reported that as far as bridges and culverts are concerned, they are primarily the responsibility of the road authority. Because in Ditch System No. 48, the bridge request is clearly not a repair, it would be inappropriate for the County Board to take action based on the petition that was filed at last week's regular County Board meeting. Change Fund Increase Motion by Partmann, second by Lindquist, and unanimously carried to approve an increase in the Driver's License change fund from $25 to $50. Land Surveyor's Certificates of Correction to Plat Motion by Lindquist, second by Nelson, and unanimously carried to approve the following Land Surveyor's Certificates of Correction to the following plats: Kozelnik's Beach First Addition to Kozelnik's Beach Second Addition to Kozelnik's Beach Otter Tail County Board of Commissioners October 20, 1998 Page2 I Appointments to Canvassing Board -= Chairman Lee appointed Commissioner Bill Stone and Syd Nelson to the Canvassing Board for Q the State General Election. The Canvassing Board will meet on Monday, November 9, 1998 at 10:00 a.m. Audit Committee Appointed Chairman Lee appointed Auditor, Wayne Stein, Accountant, Mitzi Pederson, and Accountant, Leon Anderson to work with the County Coordinator and Public Health Director to audit the Collaborative program. Budget Committee Report Commissioner Lindquist reported that the Budget Committee has reduced the budget by $400,000. He reported that the courthouse remodeling and jail remodeling is within the estimated budget. Mr. Lindquist stated that the Budget Committee is continuing to work to cut the overall county budget. Planning Commission Recommendations Conditional Use Permit -Larry & Deb Otto: Commissioner Lindquist questioned how erosion control will be accomplished during construction of a stairway and expressed a concern because of sandy soil in the area. He also questioned whether or not a decision on this CUP would set a precedent for future requests. Bill Kalar, Land & Resource Director, stated that as far as stabilization is concerned, the area is to be sodded on both _sides with a silt fence installed as a temporary measure during construction. Commissioner Partmann expressed concern and requested that the Land & Resource Director view the property 0 .before action is taken. The Chairman stated that this CUP request would be deferred until next ·- week's regular board meeting after Mr. Kalar has had an opportunity to view the property. Preliminary Plat -"Second Addition to Sunrise Cove" Arlhur S. Peterson et al: Motion by Lindquist, second by Partmann, and unanimously carried to approve the preliminary plat of "Second Addition to Sunrise Cove" consisting of 5 residential lots (Sec. 23, Clitherall Twp., Clitherall Lake 56-238) with conditions as recommended by the Planning Commission. Preliminary Plat -Jeff Ki/de/ "K & K Beach": The Land & Resource Director reported that this plat had been modified and now consists of two residential lots with the buildable area outside of the wetland area. Lengthy discussion followed regarding condition No. 3 of the Planning Commission recommendations that reads "No variances are to be granted on these lots". Motion by Lee, second by Lindquist, and unanimously carried to approve the preliminary plat of "K & K Beach" consisting of two residential lots (Sec. 33 of Aurdal Twp., Wall Lake -56-658) with conditions as recommended by the Planning Commission. The provision of recommendation No. 3 (no variances being granted on the property) serves as notice to the public. Conditional Use Permit -Brian Fronninq: Motion by Lindquist, second by Partmann, and unanimously carried to approve a Conditional Use !'\. Permit to help with a drainage problem and stop erosion (Sec. 22, Twp. 132N, R 43W, Buse Twp, I.,;;,,/ Horseshoe Lake, 56-834) with conditions as recommended by the Planning Commission. 0 Preliminary Plat -"Second Addition to Stenstrom Beach": Otter Tail County Board of Commissioners October 20, 1998 Page 3 Mr. Kalar reported that the Planning Commission denied this preliminary plat consisting of one lot to be attached to lot 7 of First Addition to Stenstrom Beach. He stated that there were concerns with wetland area and access to the property. Neighboring landowner, Mike Partain, presented a letter to the County Board. He expressed concerns regarding the proposed location of the road over the wetland and the potential of the wetlands to back up. As a neighbor, Mr. Partain expressed his opposition to this CUP request. Motion by Lee, second by Partmann, and unanimously carried to uphold the denial of the Planning Commission for the preliminary plat of "Second Addition to Stenstrom Beach". Conditional Use Permit -William King/Loon Echo Resort: Motion by Nelson, second by Stone, and unanimously carried to approve the Conditional Use Permit to add a 2nd story to Unit #1 (Sec. 8, Twp. 137, R. 40, Hobart Twp., Rose Lake -56-360) with conditions as recommended by the Planning Commission. Conditional Use Permit -William Lemke/Brad Botner: Commissioner Lindquist expressed concern that the proposed road to service this plat is narrower than county specification requirement. He expressed a concern that if this plat is developed in the future, the road would not be sufficient for school busses, garbage trucks, etc. Discussion followed. l,-. Motion by Lindquist, second by Partmann, and unanimously carried to approve a Conditional Use ~o Permit to build a driveway (Sec. 23, Twp. 133 N, R. 43W, Fergus Falls Twp, Unnamed Lake, 56- ,· 1480) with conditions as recommended by the Planning Commission. The motion included a 0 clarification that if the land is developed by way of plat, the road would need to meet county specs and if the land is developed by metes and bounds, the township must approve the road. Commissioner Partmann suggested that the developer(s) be informed of this in case they would choose to widen the road at this time. Conditional Use Permit-Syvertsen Trust: Motion by Stone, second by Nelson, and unanimously carried to uphold the denial of the Planning Commission for a Conditional Use Permit to construct a retaining wall out of concrete (Sec. 12, Twp. 134, R. 40, Amor Twp., Otter Tail Lake, 56-242). Amendment to Conditional Use Permit #5568: On behalf of Eric Canfield, the Land & Resource Director requested approval of an amendment to CUP #5568 to not require the construction of seclusion point road on Big McDonald Lake to meet county specifications. Discussion followed. · · Motion by Nelson, second by Stone, to concur with the Planning Commission to allow an exception to the county road specification requirement for CUP #5568 because the applicant only wants a private driveway. Chairman Lee called for a vote. The motion failed with three NAY votes. Proposed Golf Course -"Fox Run" Mr. Kalar reviewed the CUP request of Mr. Chuck Will for a proposed golf course near Stalker Lake. He reported that Mr. Will submitted a preliminary proposal on October 5, 1998. Rick West, Highway Engineer, reviewed the proposal and submitted an estimate for the amount of the required performance bond. Based upon the information provided, the Highway Engineer estimated that a $10,000 performance bond should be required. The relocation of the road to Otter Tail County Board of Commissioners October 20, 1998 Page 4 service this area has not been agreed upon with Tordenskjold Township at this time. Lengthy discussion occurred regarding this road. The County Board suggested the road issue be resolved Q with the Tordenskjold Town Board. Extension Approved The Land & Resource Director presented a request from Pat Reisnour of Interstate Engineering. The request was for an extension date for earth moving to November 15 1998 for a project on Norway Lake. Motion by Lindquist, second by Partmann, and unanimously carried to extend the earth moving date specified in the SMO to November 15 1998 for a Sverdrup Township road project as requested by Engineer, Pat Reisnour. Final Plat Approved -"Bridgeview" Motion by Lee, second by Lindquist, and unanimously carried to approve the final plat of "Bridgeview" (Sec. 27, Twp. 134, R. 32, Friberg Twp., West Red River Lake, 56-711). Approval of Bills Motion by Lindquist, second by Partmann, and unanimously carried to approve the bills per Attachment A of these minutes which include the following lodging payments: Holiday Inn Hotel & Suites Ramada Inn -Minn-St. Paul Sheraton Inn Midway Assessor, Robert Moe Assessment Tech I, Twyla Neumann Sheriff, Gary Nelson Approval of Dog Bite Fact and Orders Motion by Partmann, second by Lindquist, and unanimously carried to authorize the Chair's signature to execute the following Findings of Fact and Order; 1) the dog ""Storm" owned by Richard Berge and, 2) the dog "Butch" owned by Harold and Maryanne Thoennes. Adjournment At 11 :02 a.m., Chairman Lee declared the meeting of the Otter Tail County Board of Commissioners adjourned until 1 :00 p.m. on Tuesday, October 27, 1998.
