HomeMy WebLinkAboutBoard of Commissioners - Minutes - 10/06/19980 0 Call to Order The Otter Tail County Board of Commissioners convened Tuesday, October 6, 1998 at 9:30 a.m. at the Otter Tail County Courthouse with Commissioners Malcolm Lee, Chair; Syd Nelson, Vice- Chair; Andy Lindquist, Virginia Partmann, and Bill Stone present. Approval of Agenda Motion by Partmann, second by Stone, and unanimously carried to approve the County Board agenda of October 6, 1998 as mailed. Approval of Minutes Motion by Lindquist, second by Nelson, and unanimously carried to approve the County Board minutes of September 22, 1998 as mailed. Request for Extension of CUP Landowner, Terry Colton, requested an extension for Conditional Use Permit No. 3402 for Scenic Point Resort on Clitherall Lake. Mr. Colton explained that the permit was issued in 1986 and that a continuing plan had been submitted at that time. Mr. Colton wants to add two new structures at the resort and is requesting an extension because he did not know that the CUP had an expiration date. Land & Resource Director, Bill Kalar, reviewed additions to the resort based on CUP No. 3402. Mr. Kalar noted that an extension had been approved once in 1988 to extend the permit to the end of 1988. No other extensions or comments are on record for this particular permit. A variance was received in November of 1986 on this property. Mr. Kalar stated that the variance stays with the property, however, according to the Shoreland Management Ordinance a CUP is effective for one year unless otherwise specified. Discussion followed. The commissioners requested Mr. Colton to apply for a CUP for the proposed structures and meet with the Planning Commission as CUP No. 3402 is expired. GIS Update GIS Coordinator, Bob Block, reviewed the recommended Memorandum of Agreement between Otter Tail County and Cloud Cartographies, Inc. He stated that Cloud Cartographies would provide; 1) an additional page in the County Extension Plat books to show roads, 2) an official county map, and 3) emergency service maps. Commissioner Partmann stated that the agreement did not include verification of ownership of the original maps to ensure that a company could not sell Otter Tail County maps for profit. Mr. Block stated that he would check into the issue of ownership of the original maps. Discussion continued regarding signage, budget, in-service for dispatchers, and current map disclaimer. Approval of Prepaid Bills Motion by Partmann, second by Lindquist, and unanimously carried to approve the following prepaid bill: Stepp Manufacturing co., Inc. -43,200 Pounds of Crackseal Material Total Billing -$8,741.52 -Discount Received -$82.08 = Amount Paid -$8.659.44 Otter Tail County Board of Commissioners October 6, 1998 Page 2 State Audit Report Auditor, Wayne Stein, submitted a "Summary of Auditor's Results" for Otter Tail County's 1997 O financial audit. Payment Approval Motion by Lindquist, second by Partmann, and unanimously carried to approve payment to the Otter Tail County Humane Society, in the amount of $239.39, for services provided under the provision of Minnesota Statute §343.23 Payment Approval Motion by Lindquist, second by Partmann, and unanimously carried to approve payment to the Fergus Falls Medical Group, PA, in the amount of $66.50, for services under the provision of Minnesota Statute §609.35. Notice of Proposed Adoption of a TIF Plan Mr. Stein reported that the City of New York Mills will be considering the adoption of a Tax Increment Financing Plan for a redevelopment tax increment financing district located within Development District No. 1. A public hearing will be held at the NYM City Hall on Monday, October 26, 1998 at 5:00 p.m. The proposed TIF district is to facilitate construction of 1 O to 14 multi-family housing units. Authorization for Exemption for Lawful Gambling License The Pelican Rapids Area Chamber of Commerce has submitted an application for exempt permit for an event scheduled for October 10, 1998 at the Pelican Supper Club. The application was received less than 30 days prior to the scheduled event, therefore, the Pelican Rapids Area Chamber of Commerce requested the County Board to waive the 30-day requirement. Motion by Lee, second by Lindquist, and unanimously carried to waive the 30-day waiting period as requested by the Pelican Rapids Area Chamber of Commerce for the above referenced application. Premise Permit Otter Tail County Resolution No. 98 -55 UPON a motion by Nelson, second by Lee, and unanimously carried, the Otter Tail County Board of Commissioners adopts the following resolution: WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of licenses and permits for the conduct of lawful gambling lies with the Minnesota Gambling Control Board; and WHEREAS, The National Multiple Sclerosis Society -Minnesota chapter, Minneapolis, MN, has made an application to the Gambling Control Board for a premise permit to conduct lawful gambling at Perry's in Dora Township of Otter Tail County; and 0 WHEREAS, Minnesota Statute §349.213 provides that the Gambling Control Board may not issue a permit unless they receive a resolution from the Otter Tail County Board of Commissioners Q approving the permits; and 0 0 Otter Tail County Board of Commissioners October 6, 1998 Page 3 WHEREAS, the Otter Tail County Board of Commissioners is aware of no reason to oppose the conduct of lawful gambling by the National Multiple Sclerosis Society -Minnesota Chapter, Minneapolis, MN, at Perry's in Dora Township of Otter Tail County. NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners hereby approves the conduct of lawful gambling by the National Multiple Sclerosis Society - Minnesota Chapter, Minneapolis, MN, at Perry's in Dora Township of Otter Tail County provided the applicant meets all the necessary criteria for the licenses and permits as required by the Gambling Control Board. IT IS FURTHER RESOLVED, that notice of this application and approval shall be provided to the Township of Dora by sending them a copy of this resolution. Adopted this 61h day of October, 1998 Dated: Dcf;,J .. •.:i /3, I 9'U, Att9m ~i~ LanyKr n~lerk OTTER TAIL COUNTY BOARD OF COMMISSIONERS By~--t::L<' Macoin{ Kiee, Chairman Resolution Waiving the Thirty Day Notification Period Pursuant to Minnesota Statutes, Section 469.175, Subdivision 2 Otter Tail County Resolution No. 98 -56 UPON a motion by Lindquist, second by Partmann, and unanimously carried, the Otter Tail County Board of Commissioners adopts the following resolution: WHEREAS, the City Council of the City of Ottertail is considering the establishment of Tax Increment Financing District No. 1-2; and WHEREAS, Minnesota Statutes, Section 469.175, subd. 2 requires that the County Board be provided notice of the creation of District No. 1-2 and the estimate of fiscal and economic implications of the proposed District No. 1-2 at least thirty days before the public hearing required by Minnesota Statutes, Section 469.175, subd. 3; and WHEREAS, the County Board for Otter Tail County is in receipt of the Fiscal and Economic Implications for District No. 1-2 proposed to be established by the City of Ottertail; and WHEREAS, the City Council has requested a waiver of the County's thirty-day comment period provided by Minnesota Statutes, Section 469.175, subd. 2; and WHEREAS, the County Board has reviewed the fiscal impacts of the projects; and WHEREAS, the County Board desires to waive the thirty-day notification requirement in order to expedite the City's creation of the Tax Increment Financing District. NOW, THEREFORE, BE IT RESOLVED THAT THE COUNTY BOARD WAIVES ITS THIRTY-DAY REQUIREMENT. Mr. Annalora stated that four years ago the County Board approved a resolution whereby a challenge grant was received for the upper watershed improvement district. He reviewed the projects made available with that grant including fencing on farm property, alternate livestock watering ponds, erosion control, bank strengthening, participation in three ag/waste systems, and a 12 acre livestock resting area that is now fully vegetated and is being used for educational purposes in cooperation with the Perham High School. Extensive discussion continued regarding the benefits of developing a lake improvement district. Mr. Annalora stated that property owners were polled by way of a newsletter on the two lakes and 47% of those polled sent back a return postcard with an affirmative response. Chairman Lee stated that the budget for lake improvement districts is added to the county's budget, and with levy limits, this becomes a problem. Under this structure, the county could not approve a lake improvement district; however, Chairman Lee encouraged the lake owners to appeal to the state legislature by way of their state representatives to change the law. Lake improvement district's budgets should stand-alone as the SWCD's and like entities and not be added to the county budget. Petty Cash Fund for Jail Canteen Operations Accountant, Mitzi Pederson, reported that the money generated by inmates to purchase amenities for the jail facility such as encyclopedias, educational materials, VCR, etc. is placed in a checking account. The state audit report recommends that these funds are deposited in the County's General Fund and then dispersed as needed. Detention Facility Administrator, John Halvorson, recommended a petty cash fund of $8,000. Motion by Lindquist, second by Partmann, and unanimously carried to approve an impress petty cash fund to be established December 31, 1998 with Jail Administrator, John Halvorson as custodian. This petty cash fund shall be used to purchase such items as: inventory for resale, miscellaneous services for the inmates, and other approved purchases which do not exceed the net revenues of the Jail Canteen Operations. All funds currently held in the Jail Canteen Account will be turned over to the County Treasurer. Discussion -Donations for Phelps Mill Park 0 Phelps Mill Caretaker, Lynd lunghuhn, reported that he is frequently approached by citizens or groups that wish to donate money for maintenance and preservation of the park. Mr. lunghuhn and Accountant, Mitzi Pederson, requested direction from the County Board in regards to a policy Q or procedure to follow to accept the donations. Mr. lunghuhn would like to encourage those choosing to donate money and acknowledge such donations in the way of a plaque and/or thank you card. The County Board requested that Ms. Pederson draft a recommendation for procedures to follow to make a donation process possible. 0 0 0 ·, Otter Tail County Board of Commissioners October 6, 1998 Environmental Assistance Grant Program Otter Tail County Resolution No. 98 -57 Page 5 UPON a motion by Partmann, second by Lindquist, and unanimously carried, the Otter Tail County Board of Commissioners adopts the following resolution: WHEREAS, Otter Tail County has applied for a grant from the Minnesota State Office of Environmental Assistance (OEA), under its Environmental Assistance Grant Program; and WHEREAS, Otter Tail County is committed to implementing the proposed projects as described in the grant application, if OEA funding is received; and WHEREAS, OEA requires that Otter Tail County enters into a grant agreement with OEA that identifies the terms and conditions of the funding award. BE IT RESOLVED THAT the Otter Tail County Board of Commissioners of Otter Tail County authorizes and directs the Otter Tail County Solid Waste Department to enter into a grant agreement with the OEA to carry out the project specified therein and to comply with all of the terms, conditions, and matching provisions contained therein. NOW, THEREFORE, BE IT RESOLVED that Otter Tail County fully supports the submission of a grant application to the OEA for a Waste Education Grant. Lee, Chairman Henning Transfer Station Road Highway Engineer, Rick West, provided a handout with cost estimates to tar from TH 210 to the Henning transfer station road entrance. Mr. West noted the breakdown for cost estimate to be Otter Tail County ($170,522), City of Henning ($24,798.60), Henning Township ($57,863.40). The Highway Engineer noted that the main concerns of this gravel road are dust and roughness, which are caused by the type of gravel and the dry weather. An alternative discussed was the application of good surfacing gravel and calcium chloride to control dust. Discussion continued. The County Board requested that a committee of county, township and city officials meet to discuss the options regarding the Henning transfer station road and return to the board with a recommendation. Project Update The Highway Engineer provided a project update. Right-of-Way Vacations Motion by Nelson, second by Stone, and unanimously carried to approve vacating right-of-ways on CSAH No. 80 and old highway No. 10 in Perham Township. Otter Tail County Board of Commissioners October 6, 1998 Page 6 Minnesota State Transportation Fund Resolution For Construction of County Bridge No. 91933 -S.A.P. 56-613-01 Otter Tail County Resolution No. 98 -58 UPON a motion by Nelson, second by Partmann, the Otter Tail County Board of Commissioners adopts the following resolution: WHEREAS, the County of Otter Tail has applied to the Commissioner of Transportation for a Grant from the Minnesota State Transportation Fund for the Construction of County Bridge No. 91933 (S.A.P. 56-613-01) over the Toad River; and WHEREAS, the amount of the grant has been determined to be $24,664.00 by reason of lowest responsible bid. NOW, THEREFORE, BE IT RESOLVED, that the County of Otter Tail does hereby affirm that any cost of the bridge in excess of the grant will be appropriated from the funds available to the County of Otter Tail, and that any grant monies appropriated for the bridge but not required, based on the final estimate, shall be returned to the Minnesota State Transportation Fund. No. 98:20PU Otter Tail County Resolution No. 98 -60 UPON a motion by Lindquist, second by Portmann, the Otter Tail County Board of Commissioners adopts the following resolution: WHEREAS, Fair Hills, Inc. operates Fair Hills Resort on the South side of CSAH No. 20 located in Section 4-T137N-R42W, Otter Tail County and also operates Wildflower Golf Course on the North side of CSAH No. 20 located in Section 33-T138N-R42W, Becker County; AND WHEREAS, these facilities generate pedestrian traffic, golf cart traffic, and maintenance equipment traffic which cross CSAH No. 20 between the resort and the golf course; AND WHEREAS, Fair Hills, Inc. pursuant to Minnesota Statute §160.25 has requested Otter Tail County and Becker County to jointly install a pedestrian tunnel under CSAH No. 20 which will provide a safe and convenient crossing for pedestrians, carts, and equipment between the resort and the golf course; AND WHEREAS, Fair Hills, Inc. acknowledges that they are responsible for the costs of installing a pedestrian tunnel under CSAH No. 20. NOW, THEREFORE, BE IT RESOLVED that the Otter Tail County Board of Commissioners does hereby authorize the County Engineer to proceed with the project providing the design, engineering, and construction supervision required to complete the project in cooperation with Becker County. AND FURTHER BE IT RESOLVED that Otter Tail County will be the lead agency for this project and that Fair Hills, Inc. will be responsible for all costs of the project.
