Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, September 15, 1998 at
9:30 a.m. at the Otter Tail County Courthouse with Commissioners Malcolm Lee, Chair;
Andy Lindquist, Virginia Partmann, and Bill Stone present. Vice-Chair, Syd Nelson was absent.
Approval of Agenda
Motion by Partmann, second by Lindquist, and unanimously carried to approve the County Board
agenda of September 15, 1998 with the following changes:
10:30 a.m. -cancel Carl Annalora
Add -Appointment to the Bois De Sioux Watershed District
Approval of Minutes
Motion by Lindquist, second by Partmann, and unanimously carried to approve the County Board
minutes of September 8, 1998 as mailed.
Dog Bite Findings
Public Health Nurse, Phyllis Knutson reported that she visited Jeff Borstad's home in Dalton as
directed by the County Board al the last Human Services meeting. She reported that there is an
existing kennel on the back lot where Mr. Borstad resides that is currently full of car parts. The
owner of the property has no objection to the resident building a dog run or kennel and there is
plenty of room on the property. An option to fence the property was discussed. After viewing the
property, Ms. Knutson's recommendation is to require the use of a kennel or dog run when the dog
is outside in order to separate the dog from children.
Motion by Lindquist, second by Partmann, and unanimously carried to require that a dog run or
kennel (some type of enclosed area) be used when Jeff Borstad's dog is outside to ensure the
safety of children in the area.
Ms. Knutson visited the residence of Tom Stanfield, Green Acres Trailer Court in Fergus Falls.
She reported that the owners of the property do not allow fencing or kennels of any kind and that
the lot is very small. The dog in this case with a two-bite history is a small beagle.
Motion by Lindquist, second by Partmann, and unanimously carried to require that the owner
(Tom Stanfield) of the dog must be outside with the dog and when the owner is not home, the dog
must be confined within the home.
Appointment -Bois De Sioux Watershed District
Motion by Lindquist, second by Stone, and unanimously carried to appoint Don Davenport of
· Fergus Falls to the Bois De Sioux Watershed District for the unserved term of Warren Erickson
effective September 15, 1998.

Simulated Bus Accident
Motion by Partmann, second by Lindquist, and unanimously carried to approve a request from
Fergus Falls Public Safety Director John Wagner, to conduct a bus accident exercise on
September 28, 1998 in cooperation with the Sheriffs department and Lake Region Hospital at the
intersection of CR 1 and 15.
Henning Transfer Station
Solid Waste Director, Mike Hanan provided traffic count statistics on the use of the Henning
Transfer Station Road. Traffic on the road has increased significantly with 46% of the total traffic
going to the Transfer Station.
Planning Commission Recommendations
Conditional Use Permit -Darrell & Marlene Gast:
Land & Resource Director, Bill Kalar reviewed the reasons for the recommended denial by the
Planning Commission of this CUP request. Richard Henderson, attorney representing Mr. & Mrs.
Gast requested that the County Board refer this request back to the Planning Commission to allow

time to address all of the issues and then re-address the request for a Conditional Use Permit.
Discussion followed including the process of notification that occurs when a CUP is requested. Q
Motion by Stone, second by Partmann, and unanimously carried to deny a CUP for Darrell &
Marlene Gast on Otter Tail Lake (Sec. 14, Twp. 134, R. 40W, Amor Township -1187A) as
recommended by the Planning Commission.

Motion by Lindquist, second by Stone, and unanimously carried to approve a CUP to construct a

recommended by the Planning Commission.
Preliminary Plat -"Shady Grove" -Olga Maver:
Motion by Partmann, second by Lindquist, and unanimously carried to approve the preliminary plat
of "Shady Grove" consisting of 2 residential lots near Paul Lake (Sec. 10, Twp. 136, R. 40, Edna
Township, 56-335) as presented.
Preliminary Plat & Conditional Use Permit.
"Tradewells Woodlands Second Addition -Richard Tradewe/1:
Motion by Lindquist, second by Partmann, and unanimously carried to approve the revised
preliminary plat of 'Tradewells Woodlands Second Addition" and a CUP to construct a road to
service the plat near East Lost Lake (Sec. 1 & 2, Twp. 133, R. 41, Sverdrup Township). The
approval is subject to conditions as recommended by the Planning Commission.
Conditional Use Permit -Duane Haugen:
Motion by Partmann, second by Stone, and unanimously carried to approve a CUP for Plan B with
conditions for Duane Haugen on Little Pine Lake (Sec. 35, Twp. 137, R. 39, Gorman Township) as
recommended by the Planning Commission.
Conditional Use Permit -Loren Ka/pin et al:
Motion by Stone, second by Partmann, and unanimously carried to approve a CUP to construct a
road new Adley Lake (Sec. 28, Twp. 131, R. 37, Parkers Prairie Township, 56-31) with conditions
as recommended by the Planning Commission.
Conditional Use Permit -"Linden Park Resort" -Jerry & Linda Loofe:
Motion by Stone, second by Partmann, and unanimously carried to replace a mobile home with a
larger mobile home near East Battle Lake (Sec. 26, Twp. 133, R. 39, Girard Township, 56-138)
with conditions as recommended by the Planning Commission.
Conditional Use Permit-Dora Township:
Motion by Lee, second by Lindquist, and unanimously carried to approve a CUP to raise a road
near West McDonald Lake (Sec. 13, Twp. 136, R. 41, Dora Township, 56-386) with conditions as
recommended by the Planning Commission.
Final Plat
Motion by Lindquist, second by Stone, and unanimously carried to approve the final plat of
"Spanswick Addition" near Hanson Lake (Sec. 4, Twp. 133, R. 39, Girard Township).

After discussion and consideration, a motion was offered by Lindquist, seconded by Lee, and
unanimously carried to adopt the following resolution:
WHEREAS, on September 15, 1998, Otter Tail County must adopt a proposed budget for fiscal
year 1999 and must adopt and certify a proposed net property tax levy for payable 1999, and
WHEREAS, the Otter Tail County Budget committee has held numerous committee meetings to
consider and discuss the 1999 budget request and tax levy information.
BE IT RESOLVED, by the otter Tail County Board of Commissioners of Otter Tail County,
Minnesota , that
The amount of $15,773,722 be adopted as the County's proposed gross property tax levy for the
payable year 1999 representing a 4.49% increase over the gross property tax levy for the payable
year 1998, and that the amount of $12,886,606 be adopted as the County's proposed net property
tax levy for the payable year 1999 representing a 5.24% increase over the net property tax levy for
the payable year 1998;
And that,
The amount of $146,284 be adopted as the County's proposed gross market value tax levy for the
payable year 1999 representing a 1.46% increase over the gross market value tax levy for the
payable year 1998 and that the same amount be adopted as the net market value tax levy for the
payable year 1999, for a total proposed payable 1999 net property tax levy of $13,032,890

BE IT FURTHER RESOLVED, that the amount of $43,500,000 be adopted as the County's
proposed budget for the General Fund, for the Budgeted Special Revenue Funds and for the
Budgeted Debt Service Funds for the fiscal year 1999, representing an increase of 3.08% over the
County's 1998 proposed budget (Attachment 8).

Payments Approved
Motion made by Lindquist, second by Partmann, and unanimously carried to approve payment to
the Fergus Falls Medical Group PA, in the amount of $91.00, and to Lake Region Healthcare
Corporation, in the amount of $263.50 for the cost of a medical examination incurred under
Minnesota Statute 609.35
Exempt Permit Application
The Rocky Mountain Elk Foundation has submitted an application for exempt permit for an event
scheduled for September 18, 1998 at the Pier Restaurant. Since their application was received
less than 30 days prior to the scheduled event, a motion from the County Board of Commissioners
waiving the 30 day waiting period is required to hold the event on September 18th .
Motion by Lindquist, second by Stone, and unanimously carried to waive the 30 day waiting period
for the above referenced application and applicant.
Approval of Grant Application
Motion by Partmann, second by Lindquist, and unanimously carried to approve a grant application
for the Sexual Assault program for victims in need of an immediate cash payment.
Closed to the Public
Recess
At 11 :20 a.m., Chairman Lee declared the meeting of the Otter Tail County Board of
Commissioners closed to the public pursuant to M.S. 471.705 Subd. 1d(d) for purposes of
conducting a performance evaluation of Public Health Director, Diane Thorson. Commissioners
Partmann, Lindquist, Stone, and Lee were present during the evaluation. A summary report of
performance conclusions will be provided at the next regular board meeting. The Chair declared
the closed session concluded at 11 :45 a.m. and recessed the board meeting for lunch break.

Pier Lodge Tax Abatement Request
Chairman Lee opened discussion regarding the tax abatement request of Landis Weaver for the
proposed Pier Lodge and Convention Center. A letter from Bob Mo.e was read for the record
regarding the difficulty in estimating the potential tax for the project because of unknown factors at
this time. Commissioner Lindquist expressed concern with several items of the economic policy
approved at last week's meeting relative to whether or not the proposed project meets all
guidelines. Land & Resource Director, Bill Kalar reviewed concerns regarding the plan presented
to the Planning Commission on February 11, 1998. Pedestrian safety across Highway 78 was
discussed. Commissioner Lindquist expressed a need to change state law so a tax deferral rather
than abatement would be possible. Chairman Lee expressed a desire to delay a decision until
next week because one commissioner was absent. Mr. Weaver assured the Board that he would
meet all criteria required relative to financial information and information needed by Land &
Resource office.
Motion by Stone, second by Partmann, to grant tax abatement for the proposed Pier Lodge and
Convention Center using Item No. 17 of the Otter Tail County Policy on Economic Development
Tax Abatements (adopted 9/8/98) that allows 75% abatement the first year, 50% the second year,
and 25% the third year. The motion was subject to a financial prospectus being submitted and
approved by Otter Tail County. The Chair called for a roll call vote as follows:

Resolution of Commitment to Land Use Planning
Otter Tail County Resolution No. 98-50
Upon motion by Partmann, second by Lee, and unanimously carried, the Otter Tail County Board
of Commissioners adopts the following resolution:
WHEREAS, for purposes of promoting the health, safety, morals and general welfare of the
community, Otter Tail County is authorized to carry on county planning and zoning activities
pursuant to Chapter 394 of the Minnesota Statutes; and
WHEREAS, the Otter Tail County Board of Commissioners appointed a Land Use Study Advisory
Committee, which recommended to the County Board that ii adopt a Comprehensive Land Use
Plan and an ordinance for countywide land use controls; and
WHEREAS, ii is estimated that the cost of developing a Comprehensive Land Use Plan is up to
$200,000.00 for Otter Tail County; and

WHEREAS, the county presently does not have the resources to pay for a community-based
planning project, but has passed a resolution for a referendum to have the voters approve an
increase in the levy for the purposes of adopting and implementing land use planning pursuant to
Minnesota Statute §275. 73 at the election to be held on November 3, 1998; and
WHEREAS, Otter Tail County will contribute resources to the community-based planning in the
form of staff time, equipment and materials; and
WHEREAS, only if the voters approve an increase in the levy will Otter Tail County be in a position
to make a financial contribution toward community-based planning; and
WHEREAS, the county is making an application for a community-based planning grant; and
WHEREAS, the county is committed to working with the township officials and the citizens of the
community in developing a Comprehensive Plan and Land Use Ordinance.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the Otter Tail County Board of
Commissioners that the county will commit local resources for a community-based planning project
to develop and implement a Comprehensive Land Use Plan and Ordinance for countywide land
use controls.
