HomeMy WebLinkAboutBoard of Commissioners - Minutes - 06/16/19980 0 Call to Order The Otter Tail County Board of Commissioners convened Tuesday,"'June 16, 1998 at 9:30 a.m. at the Otter Tail County Courthouse with Commissioners Malcolm Lee, Chair; Syd Nelson, and Andy Lindquist present. Commissioners Virginia Partmann and Bill Stone were absent. Approval of Agenda Motion by Lindquist, second by Nelson, and unanimously carried to approve the County Board agenda of June 16, 1998 with the following addition: Mark Morris -10:55 a.m. for consideration of Exhibition & Shows Ordinance and approval of secretarial position. Approval of Minutes Motion by Nelson, second by Lindquist, and unanimously carried to approve the County Board minutes of June 9, 1998 as submitted. 1998 Overall Economic Development Plan EDA Planning Specialist, Mike Schreiner, from the West Central Initiative requested commissioner's support to assist in obtaining economic development resources for the region. Mr. Schreiner reported that every five years the WCI prepares a report of the region's Overall Economic Development Program (OEDP). That report was completed last year. He presented an update to the OEDP that is completed on an annual basis. This year, Mr. Schreiner visited with smaller communities to make it possible for the economic development projects of local units of government in the region to qualify for consideration for grant support from the federal Economic Development Administration (EDA). · RESOLUTION IN SUPPORT OF 1998 OVERALL ECONOMIC DEVELOPMENT PROGRAM FOR WEST CENTRAL MINNESOTA Otter Tail County Resolution No. 98 -38 UPON a motion by Lindquist, second by Nelson, and unanimously carried, the Otter Tail County Board of Commissioners adopts the following resolution: WHEREAS, the West Central Minnesota Initiative Fund has prepared an Overall Economic Development Program (OEDP) for the region containing Becker, Clay, Douglas, Grant, Otter Tail, Pope, Stevens, Traverse, and Wilkin Counties of Minnesota (west central Minnesota); and WHEREAS, the OEDP contains analysis, economic data, economic development projects, and goals and objectives for the betterment of the region; and WHEREAS, availability of an approved OEDP and related annual updates are a condition for qualifying for grants for local economic development projects from the Economic Development Administration of the U.S. Department of Commerce; and Otter Tail County Board of Commissioners June 16, 1998 Page 2 • NOW, THEREFORE, BE IT RESOLVED that the Board of County Commissioners of Otter Tail County, Minnesota, approves the 1998 Overall Economic Development Program for west central Minnesota. 0 Adopted this 16th day of June, 1998. Lee, Chair Approval of Otter Tail Lake Independence Day Parade Motion by Lindquist, second by Nelson, and unanimously carried to approve the closure of Highway 72 for the annual Independence Day Parade on the west side of Otter Tail Lake on July 5, 1998 at 1 :00 p.m. This motion is subject to the approval of the Sheriffs Department, proof of insurance, and that Otter Tail County is held harmless relative to liability. Planning Commission Recommendations Conditional Use Application -Bruce Vistad: Motion by Lindquist, second by Nelson, and unanimously carried to deny a Conditional Use Permit for Bruce Vistad on Jewett Lake (Section 23, Twp. 134, R. 43, Elizabeth Township, 56-877) as recommended by the Planning Commission. Q Conditional Use Application -James & Jennifer Caliandro/Taylor Inv. Corp: Motion by Lindquist, second by Nelson and unanimously carried to deny a Conditional Use Permit to create a boat access to benefit a subdivision on North Turtle Lake (Section 30, Twp. 133, R. 40, Everts Township, 56-379) as recommended by the Planning Commission. Conditional Use Application -Reggie & Myrna Wenaas: Motion by Nelson, second by Lindquist, and unanimously carried to reduce a ridge approximately 66' long by 30' wide as an access to the lakeshore on Paul Lake (Section 15, Twp. 136, R. 40, Edna Township, 56-335) with conditions as recommended by the Planning Commission. Preliminary Plat & Conditional Use Application Kenneth Lyden & Cecil Poss. "Crystal Springs First Addition": Motion by Lee, second by Lindquist, and unanimously carried to approve the Preliminary Plat of "Crystal Springs First Addition" consisting of ten (10) residential lots and two (2) blocks and a Conditional Use Permit to construct a road to service the plat on Franklin Lake (Section 3, Twp. 136, R. 42, Lida Township, 56-759). Approval of this CUP is subject to conditions as recommended by the Planning Commission. Conditional Use Application -Randolph & Marian Wasvick and Robert & Mary Womer: Motion by Lindquist, second by Nelson, and unanimously carried to move 1,500 -2,000 yards of dirt for building a driveway on West Lost Lake (Section 31, Twp. 134, R. 41, Maine Township, Q 56-481) as presented. - 0 0 Otter Tail County Board of Commissioners June 16, 1998 Preliminary Plat & Conditional Use Application -Bonnie Kemp. "Shoreline Acres": Page 3 Motion by Nelson. second by Lindquist, and unanimously carried to approve the Preliminary Plat of "Shoreline Acres" consisting of four (4) lots and one (1) block and a Conditional Use Permit to construct a road to service the plat on First Silver Lake (Section 28, Twp. 136, R. 40, Everts Township, 56-302) with conditions as recommended by the Planning Commission. Preliminary Plat and Conditional Use Application Richard Tradewe/1 -"Tradewells Woodlands Second Addition": Motion by Lindquist, second by Nelson, and unanimously carried to deny approval of the Preliminary Plat of "Tradewells Woodlands Second Addition" and CUP to relocate the existing roadway on East Lost Lake (Section 1, Twp. 133, R. 41, Sverdrup Township, 56-378) as recommended by the Planning Commission. Recess & Reconvene At 10: 15 a.m., Chairman Lee declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. He provided a copy of several letters of appeal for the Board's review. Exhibition and Shows Ordinance William Marts of the Prometheus Motorcycle Club requested a waiver from obtaining a permit under the county Exhibition and Shows Ordinance for an event to be held on June 27, 1998. The County Attorney explained that the ordinance was adopted in the late 1960's to allow for some control for large celebrations to avoid opening up the county to liability and provide a safe event. A waiver is required to eliminate unnecessary compliance to the ordinance but not to avoid its purposes. Lieutenant, Mike Boen, reported that a potential problem was brought to the attention of the Sheriffs office from a poster displayed at a liquor establishment in the City of Fergus Falls. The poster advertised a band, free beer, and wet T-shirt contests. > Chief ,Deputy, Mark Morris, expressed his concern with a potentially larger crowd than has been present in the past and the need for the Sheriffs Department to be prepared. Mr. Marts explained that their promoter had displayed the poster without authorization from the club and provided the· club's poster that did not promote free beer or wet T-shirt contests. He explained that the event is well run, no one under age uses alcohol and parking is not a problem. This is the 13th annual event and the proceeds are donated to the Chahinkapa Zoo. Kathy Diekman, Chahinkapa Zoo Director, spoke in favor of the event and explained the value of the past twelve years of donations from this club. She asked that the commissioners not require a permit because that could cancel the event. Randy Stinogel of the Christian Motorcycle Association spoke in favor of the event. Kathy Diekman and Bill Marts will speak on several radio stations before the motorcycle run and clarify the false advertising issue. Lengthy discussion took place regarding the requirements of the ordinance. Commissioner Lindquist asked the Chief Deputy how his office could deal with this situation. The Chief Deputy stated that, because in his position he must expect the worst, the Sherriffs office would require four extra deputies on duty the weekend of June 27. He estimated the extra cost at approximately $600. Discussion continued. Motion by Lindquist, second by Nelson, and unanimously carried to grant a variance (waiver) from obtaining a permit under the county Exhibition and Shows Ordinance subject to the Prometheus Motorcycle Club submitting cash or a certified check, in the amount of $600, to the Otter Tail County Auditor's office by June 23, 1998, to cover the expense of extra deputies. Additionally, the motion included a request for a written report after the event. Approval of Bills Motion by Lindquist, second by Nelson, and unanimously carried to approve the bills per Attachment A of the official minutes which include lodging payments as follows: Holiday Inn Arden Hills Holiday Inn -Plymouth Sheraton Inn Midway Sergeants, Mark Englund & Brian Fox Water Patrol Officer, Kelly Thomas Assessor, Robert Moe Otter Tail County Board of Commissioners June 16, 1998 Page 6 Approval of Secretarial Position -Sheriff's Department Chief Deputy, Mark Morris, requested board approval of an additional secretarial position effective April 1, 1998. All other requirements have been met including job description and budgeting. Q Motion by Lindquist, second by Lee, and unanimously carried to approve the additional secretarial position as described by the Chief Deputy.
