HomeMy WebLinkAboutBoard of Commissioners - Minutes - 05/19/19980 Q 0 Call to Order The Otter Tail County Board of Commissioners convened Tuesday, May 19, 1998 at 9:30 a.m. at the Otter Tail County Courthouse with Commissioners Malcolm Lee, Chair; Andy Lindquist, Bill Stone, and Virginia Partmann present. Vice Chair Syd Nelson was absent. Approval of Agenda Motion by Partmann, second by Lindquist, and unanimously carried to approve the County Board agenda of May 19, 1998 with one addition: Consideration of Law Library Fees Approval of Minutes Motion by Stone, second by Lindquist, and unanimously carried to approve the County Board minutes of May 12, 1998 as submitted. Detention Facility Construction Rick Sytsma, Physical Plant Manager, and John Halvorson, Detention Facility Administrator, along with representatives from the DOC and YHR Architectural firm, presented an update regarding the proposed detention facility construction. · Jeff Sjoquist of YHR Partners in Moorhead explained the remote podular housing concept for inmates. Another concept presented to the commissioners is direct supervision where an officer is stationed directly in the housing area. The direct supervision method provides flexibility by the Jail Administrator and Sheriff in dealing with inmates. Mr. Sjoquist estimated $345,000 to remodel the second floor using the remote podular method and approximately $300,000 for the direct supervision method. DOC New Construction Specialist, Alan Brinkman, spoke in favor of the direct supervision method as classification of inmates has changed from the type of sentence to behavior. Mr. Halvorson noted that new beds are needed in Otter Tail County and by contracting with the state and federal government to provide beds to generate revenues, costs for construction would be defrayed. Commissioner Lindquist reported that the county has a guarantee of 18 additional prisoners. He reported on behalf of the Building Committee an approximate cost of $325,000 for construction and equipment. The money could be borrowed from .General Revenue and paid back in about one year. Motion by Partmann, second by Lindquist, and unanimously carried to accept the concept presented as direct supervision for the detention facility remodeling project (second floor of jail building) and to authorize the Physical Plant Manager to proceed with advertising for bids for the project. Otter Tail County Board of Commissioners May 19, 1998 Page 2 Applications for Exemption from Lawful Gambling The St. James Church at Maine has submitted an application for exempt permit to the Minnesota Gambling Control Board for an event scheduled for July 26, 1998. The St. Lawrence Church has submitted an application for exempt permit to the Minnesota Gambling Control Board for an event Q scheduled for August 2, 1998. No action was taken to prohibit the activities. Liquor License Applications Motion by Stone, second by Lindquist, and unanimously carried to approve the following applications for license subject to approval of the County Attorney: Fair Hills Resort Detroit Lakes, MN Klimp's Kountry Korner Marlys Klimp Battle Lake, MN Peak Supper Club Thomas M. Davick-Ha/fen et al: Motion by Lindquist, second by Partmann, and unanimously carried to approve a Conditional Use Permit to change an existing cluster development by adding decks to two units, repair canopy, and replace a storage/mechanical building on Silver Lake (Section 28, Twp. 133. R. 40, Everts Township, 56-302) as presented. Preliminary Plat & Conditional Use Permit-"Long Lake Shores", Art Riestenberq: Motion by Partmann, second by Lindquist, and unanimously ca·rried to approve the Preliminary Plat of "Long Lake Shores" consisting of 6 residential lots and a Conditional Use Permit to construct a road to service the plat on Long Lake (Section 28, Twp 137, R. 40, Hobart Township, 56-388). This approval is subject to conditions as recommended by_ the Planning Commission. Preliminary Plat and Conditional Use Permit -"Spanswick Addition". Richard Spanswick: Motion by Partmann, second by Stone, and unanimously carried to approve the Preliminary Plat of "Spanswick Addition" consisting of 7 residential lots and a Conditional Use Permit to construct a Q road to service the plat on Hanson and Ethel Lakes (Section 4, Twp. 133, R. 39, Girard Township, 56-197 and 56-193). The approval is subject to conditions as recommended by the Planning Commission. Further, Commissioner Partmann requested a clarification in the Planning n Commission minutes under condition No. 2 to state removal of "solid waste" rather than "refuse" to "-I include removal of garbage in the area rather than simply construction refuse resulting from construction of the road. Q Otter Tail County Board of Commissioners May 19, 1998 Page 3 Preliminary Plat and Conditional Use Permit -"Long Lake Shores Second Addition", DuWayne Sonnenberg: Motion by Lee, second by Lindquist, and unanimously carried to approve the Preliminary Plat of "Long Lake Shores Second Addition" consisting of 6 residential lots and a Conditional Use Permit to construct a road to service the plat on Long Lake (Section 28, Twp. 137, R. 40, Hobart Township, 56-388). The approval is subject to conditions as recommended by the Planning Commission. Further, a clarification in the Planning Commission motion was requested to read as follows: "the dedicated right-of-way will not go to the westerly property line". Conditional Use Permit -Lawrence E. Kemnitz: Motion by Lindquist, second by Partmann, and unanimously carried to approve a Conditional Use Permit to construct a driveway from a township road to a dwelling on Silver Lake (Section 21, Twp. 133, R. 40, Everts Township, 56-302) with conditions as recommended ,.by the Planning Commission. Conditional Use Permit-Otter Tail County Highway Department: Motion by Lindq'uist, second by Stone, and unanimously carried to approve a Conditional Use Permit for S.A.P. 56-680-03, reconstruction of CSAH No. 80 on the Otter Tail River (Section 14, 23, & 24, Twp. 136N, R. 39W, Perham Township, 56-OTR) as presented. Conditional Use Permit -Big McDonald Resort. Gerald Lowe: Motion by Stone, second by Lindquist, and unanimously carried to approve a Conditional Use Permit to convert an existing 1 bedroom cabin into a 3 bedroom cabin on Big McDonald Lake (Section 18, Twp. 136, R. 40, Edna Township, 56-386) as presented. Conditional Use Permit -"Linden Park Resort", Janet Judd: Motion by Stone, second by Lindquist, and unanimously carried to approve an after-the-fact Conditional Use Permit for changing a 14' x 72' trailer to a 16' x 80' trailer on East Battle Lake (Section 26,Twp 133, R. 39, Girard Township, 56-138) as presented. Position Authorization Amended Land & Resource Director, Bill Kalar, requested authorization to hire a temporary inspector instead of technician based on changing situations with staff in the office. Motion by Partmann, second by Lindquist, and unanimously carried to amend the motion of April 7, 1998 to authorize a temporary inspector position rather than the former authorized temporary technician position. Conciliation Court Law Library Fees Otter Tail County Resolution No. 98-35 UPON a motion by Stone, second by Partmann, and unanimously carried, the Otter Tail County Board of Commissioners adopts the following resolution: WHEREAS, the filings in the Conciliation Court by parties create a financial burden on the Otter Tail County Courts and; 0 · WHEREAS, the Minnesota-statutes allow the county to charge a law library fee for filing in Conciliation Court and; WHEREAS, the Law Library Board wants to create a law library fee for Conciliation Court; Otter Tail County Board of Commissioners May 19, 1998 Page 4 WHEREAS, the effective date for the Conciliation Court law library fee will by July 1, 1998; THEREFORE, BE IT RESOLVED, the Otter Tail County Board of Commissioners hereby approves 0 a five-dollar ($5) Conciliation Court law library filing fee, effective July 1, 1998. The Chairman reconvened the meeting at 10:45 a.m. Fergus Falls Canister Sites Mike Hanan, Solid Waste Director, continued discussion from the last County Board meeting regarding comments relative to the suggestion to move recycling bins from four sites in the City of Fergus Falls and place canisters at the Recycling Center location. Commissioner Partmann asked for public comment last Wednesday on the radio. '...,I Discussion continued regarding the fact that the county was not removing access to recycling canister after hours. The proposal was simply to change location to the Recycling Center to facilitate a well-monitored site. Mr. Hanan reported that the sites with most of the litter problems are Pamida, More-4, and K-Mart. In other areas of the county, the recycling canisters are located at the Recycling/Redemption Centers. Dan Edwards, representing the City of Fergus Falls, stated that the canisters are a benefit to the city in the present locations. He requested a delay in action so additional facts and data could get out to the public. Commissioner Partmann suggested that students working for the city help monitor the areas around the canisters and assist in clean up. Motion by Partmann, second by Stone, and unanimously carried to delay action regarding the location of the recycling canisters for thirty (30) days for further study and an opportunity for the county and city to work out a plan to monitor recyclables/garbage at the sites. Mr. Hanan noted that additional stops by the county route trucks are not possible. Central Lakes Trails Highway Engineer, Rick West, introduced Duane Rose of OCTA to explain the insurance issue for the portion of the Central Lakes Trails in Otter Tail County. Mr. Rose reported that OCTA has Q. obtained insurance for the trail by adding an endorsement to their insurance policy. This insurance will insure liability for hiking and biking, however, will not cover roller blades. Mr. Rose explained that the endorsement does not raise the present insurance cost for OCTA. However, he stressed 0 Otter Tail County Board of Commissioners May 19, 1998 Page 5 that the Fergus Falls Chamber and hikers/bikers should form a club to help support the trail and raise money to maintain the system. Steve Emerson, representing the Fergus Falls Chamber, stated that the Chamber is committed to the project. He did not guarantee maintenance funds, however, noted that the Chamber would facilitate raising money for this purpose. Mr. West reported that the enforcement issue was addressed at the public information meeting. If the Sheriff's Department receives a call, the Sheriff's Department will respond as they would in other areas of the county. Mr. West reported that Jim Schoeneck of MnDOT has assembled information regarding the ownership of the railbank property and sent the information to Mr. Philips. When a date and time has been set for a meeting with the Attorney General's office, all property owners will be notified by letter. Commissioner Lindquist requested that an evening meeting be arranged to accommodate the public. No action was taken. The agreement relative to this trail approved four years ago is the same as other trails throughout the county. Mrs. Jerry Hess, property owner, stated that maintenance was not defined. Jerry Hess, property owner, expressed several concerns including easement vs. ownership and loss of tax dollars. Commissioner Partmann reported that she received many calls in support of the trail and Q encouraged the Chamber to organize a user's group. 0 Mr. Rufer questioned the process to apply for crossings. Mr. West advised that the application for crossings be sent to the Mn DOT office in Detroit Lakes. Bills & Claims Motion by Lindquist, second by Partmann, and unanimously carried to approve bills per Attachment A of these minutes. Highway Engineer -Reappointment Motion by Lindquist, second by Partmann, and unanimously carried to reappoint Highway Engineer, Rick West, for a four-year term effective May 24, 1998. County Commissioners commended Mr. West for "a job well-done". Cormorant Lake Watershed District County Attorney, David Hauser, briefed the board regarding the Cormorant Lake situation. He reported that the state would not issue an emergency permit. There are provisions to allow people to write objections to the state. Mr. Hauser will attend a meeting on this issue next Wednesday and convey the county's concerns that releasing the water will affect Otter Tail County property owners adversely.
