Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, April 7, 1998 at 9:30 a.m. at
the Otter Tail County Courthouse with Commissioners Malcolm Lee Chair; Syd Nelson, Vice-Chair,
Andy Lindquist, Bill Stone, and Virginia Partmann present.
Approval of Agenda
Motion by Stone, second by Nelson, and unanimously carried to approve the County Board
agenda of April 7, 1998 with one addition: Land & Resource Director -10:20 a.m.
Approval of Minutes
Motion by Lindquist; second by Partmann, and unanimously carried to approve the County Board
minutes of March 24, 1998 as presented.
Approval to Advertise for Equipment
Solid Waste Director, Mike Hanan, requested approval to advertise for recycling equipment. The
estimated cost of the recycling equipment was included in the 1998 budget. Motion by Partmann,
second by Lindquist, and unanimously carried to authorize the Solid Waste Director to advertise
and receive bids for a forklift, recycling trailer, and recycling roll-off boxes. The motion further set
the bid opening date on May 6, 1998

Motor Vehicle Report
Auditor, Wayne Stein, reviewed the 1997 Motor Vehicle Report. He noted a good application
accuracy rate, total number of customers/transactions, and total collections. Discussion followed
regarding state revenues from licensing vs the county's processing fees.
Tax Forfeited Public Land Sale
Otter Tail County Resolution No. 98-25
Upon a motion by Partmann, second by Lindquist, and unanimously carried, the Otter Tail County
Board of Commissioners adopts the following resolution:
BE IT RESOLVED, by the Board of County Commissioners of Otter Tail County, Minnesota,
that. all parcels of tax-forfeited land included on the attached list have been classified as non-
conservation land; that the basic sale price of each parcel included on the *attached list, be
approved and authorization for a public sale of this land be granted, pursuant to the Minnesota
Statute 282; that the sale will be held at 9 a.m. Friday, June 5, 1998 by the Otter Tail County
Auditor in the Otter Tail County Commissioners Room in the Otter Tail County Courthouse, for not
less than the basic sale price; and that all sales shall be for full cash payment per the terms as set
forth in the Notice of Public Sale of Tax Forfeited Lands.

City of Fergus Falls, the City of Pelican Rapid~ and the City of Urbank, for private sale to the

Upon a motion by Lindquist, second by Partmann, and unanimously carried, the Otter Tail County
Board of Commissioners adopts the following resolution:
WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of licenses
and permits for the conduct of lawful gambling lies with the Minnesota Gambling Control Board;
and
WHEREAS, the Pelican Rapids Fire Relief Association, Pelican , Rapids, MN, has made an
application to the Gambling Control Board for a premise permit to conduct lawful gambling at
Dunvilla in the Country in Dunn Township of Otter Tail County; and
WHEREAS, Minnesota Statute 349.213 provides that the Gambling Control Board may not issue a
permit unless they receive a resolution from the Otter Tail County Board of Commissioners
approving the permit; and
WHEREAS, the Otter Tail County Board of Commissioners is aware of no reason to oppose the
conduct of lawful gambling by the Pelican Rapids Fire Relief Association, Pelican Rapids, MN, at
Dunvilla in the Country in Dunn Township of Otter Tail County .
NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners
hereby approves the conduct of lawful gambling by the Pelican Rapids Fire Relief Association,
Pelican Rapids, MN, at Dunvilla in the Country in Dunn Township of Otter Tail County, provided the
applicant meets all the necessary criteria for the licenses and permits as required by the Gambling
Control Board.

WOTSWCD District Manager, Brad Mergens, and Chairman, Richard Viger, reported on the basic
work plan of the SWCD. The work plan detailed the SWCD's concerns of water quality, wind
erosion, wetland preservation, etc. Goals and objectives, staff workload, and a calendar of events
were included in the plan. Mr. Mergens noted that the SWCD was awarded $5,000 for the Water
Quality Program to install shallow wells within Otter Tail County. The SWCD is working with the
MN Department of Agriculture with this project. Mr. Viger thanked Commissioner Lindquist for his
efforts to obtain the $5,000 grant to help with the shortfall for the Water Quality Project. Discussion
continued.
Approval of Agreement
Motion by Lindquist, second by Portmann, and unanimously carried to authorize the Highway
Engineer to enter into an agreement between the Otter Tail County Highway Department and
Braun lntertec for sub-surface soils investigation on CSAH No. 4 from TH 59 east to CSAH 31 in
the amount of $2,900.
Bid Review and Recommendation for Award
Highway Engineer, Rick West, after previously advertising, opened bids on March 25, 1998, for
S.A.P. 56-652-09 & Etc. as follows:

Motion by Stone, second by Lindquist, and unanimously carried to award S.A.P. 56-652-09 & Etc.
to the lowest bidder, Central Specialties, Inc. of Alexandria, MN in the amount of $851,805.95 as
recommended by the Highway Engineer.
Approval of Final Payment-S.A.P. 56-635°21 & Etc.
Motion by Lindquist, second by Partmann, and unanimously carried to approve final payment to
Mark Sand & Gravel Co. in the amount of $37,400.25 (estimate No. 9) for completion of S.A.P. 56-
635-21 & Etc. as recommended by the Highway Engineer.
Approval to Pay Bills
Motion by Lindquist, second by Portmann, and unanimously carried to approve the bills per
Attachment A of these minutes which include lodging payments as follows:

At 10:30 a.m., Chairman Lee recessed the meeting of the Otter Tail County Board of
Commissioners for a short break. The Chairman reconvened the meeting for additional business
at 10:50 a.m.

Discussion -Draft Sanitation Code
Land & Resource Director, Bill. Kalar, presented a draft Sanitation Code for Otter Tail County.
Mr. Kalar noted that the draft proposal basically adopts Chapter 7080 with a few differences. One •
change is that under 7080, the county is required to ensure compliance with sanitation standards
within cities. If cities do not adopt Chapter 7080, then the county is responsible. He reviewed
items that Chapter 7080 does not include that are necessary for Land & Resource enforcement.
The draft proposal has been sent to the MPCA for their review and determination of whether the
proposal follows state law. Otter Tail County Sanitation Codes must be adopted by January 1,
1999. Discussion continued regarding staffing that might be required to comply with countywide
sanitation codes.
Motion by Stone, second by Partmann, and carried, with· Nelson opposed, to authorize two
temporary positions (one clerical position and one technician position) in the Land & Resource
office contingent upon job descriptions and approval of corresponding salary grade by DMG.
Board of Review Schedule
Bob Moe, Assessor, provided the schedule of equalization meetings. Discussion followed.
Representative on the Otter Tail/Wadena Community Action Council
Motion by Stone, second by Partmann, and carried, with Nelson abstaining, to appoint
Commissioner Syd Nelson to serve on the Otter Tail/Wadena Community Action Council to replace
the term of Joe Fehrenbach.
Closed to the Public
Adjournment
At 11 :45 a.m., Chairman Lee declared the meeting of the Otter Tail County Board of
Commissioners closed to the public for the purpose of evaluating the performance of Bob Moe,
Assessor, pursuant to M.S. 471. 705 Subd. 1d (d). All five seated commissioners were present. A
summary report of performance conclusions will be provided at the next regular board meeting. At
12:30 p.m., Chairman Lee declared the closed session and the Otter Tail County Board of
Commissioners meeting adjourned until 1 :00 p.m. on Tuesday, April 14, 1998.
