HomeMy WebLinkAboutBoard of Commissioners - Minutes - 03/17/19980 Call to Order The Otter Tail County Board of Commissioners convened Tuesday, March 17, 1998 at 9:30 a.m. at the Otter Tail County Courthouse with Commissioners Syd Nelson Vice-Chair; Andy Lindquist, Bill Stone, and Virginia Partmann present. Malcolm Lee, Chair; absent. Approval of Agenda Motion by Stone, second by Partmann, and unanimously carried to approve the County Board agenda of March 17, 1998 as submitted. Approval of Minutes Motion by Partmann, second by Stone, and unanimously carried to approve the County Board minutes of March 10, 1998 as presented. Ag Update Extension Educator, Bob Stommes, presented an overview of some agricultural activities occurring over the last couple of months. Reserve for Legal Contingency Otter Tail County Resolution No. 98-18 Upon a motion by Partmann, second by Lindquist, and unanimously carried, the Otter Tail County Board of Commissioners adopts the following resolution: WHEREAS, Otter Tail County did budget in 1997 for Legal Contingency in the amount of $100,000 and due to the fact that no unusual and unforeseen legal expenses were incurred in 1997, the unexpended balance of $100,000, shall be placed in a Reserve for Legal Contingency. This Reserve shall be issued at the County Board's direction to cover such expenditures for legal matters such as, but not limited to: County Attorney legal expenses, Court Services legal expenses, Court Administrative legal expenses, etc. The County Auditor's Office at the end of each year shall reserve any and all budgeted unexpended funds to the Reserve for Legal Contingency. Planning Commission Recommendations Conditional Use Permit: Brad and Mary Drenttel Motion by Partmann, second by Lindquist, and unanimously carried to approve a Conditional Use Permit for a Lake Shore Office and the manufacture of picture frames on West Battle Lake (Section }2, Township 133, R. 39, Girard 56-239) as presented. ,.;t Conditional Use Permit: Katherine E. Sasseville Motion by Lindquist, second by Partmann, and unanimously carried to approve a Conditional Use Permit for a Bed and Breakfast on Jewett Lake (Section 24, Township 134, R. 43W, Elizabeth 56- 877) provided the maximum number of bedrooms is four (4). Conditional Use Permit: Rush Lake Township Motion by Partmann, second by Lindquist, and unanimously carried to approve a Conditional Use Permit for the Township of Rush Lake to repair the "Head Lake Fire Trail" (Sections 21, 22, 27 & 28, Township 135, R. 39, Rush Lake 56-213). The purpose is to make it possible for emergency vehicles and fire fighting equipment to protect the Head Lake Game Refuge and adjacent wildlife areas. The repair material is to be taken from the existing ditch and put onto the surface of the trail. Conditional Use Permit: Gaylord and Joy Johnson Motion by Nelson, seconded by Lindquist, and unanimously carried to table a Conditional Use Permit for next County Board meeting regarding Lake Lida off of County Road 3, to basically create a flat spot on a hill. Conditional Use Permit: Donald J. & Kerry Tomlinson 0 Motion by Partmann, second by Nelson, and unanimously carried to approve a Conditional Use Permit for operation of a small engine repair service sales business, to grow vegetables and herbs for resale on existing cleared fields, and to open and operate a gift shop in pre0existing building ·o (Section 31, Township 137, R. 038, Corliss 56-142) as presented. · ·· 0 0 Otter Tail County Board of Commissioners March 17, 1998 Page 3 Final Plat -Sandy Beach Estates Motion by Partmann, second by Lindquist, and unanimously carried to approve the Final Plat for Sandy Beach Estates on Sand Lake in Section 36, Township 137, R. 43, Scambler Twp. Natural Resources Water Plan Wetland Conservation Act and Soil and Water Update Land & Resource Director, Bill Kalar, informed the Board that Otter Tail County's 1998 Natural Resources Block Grant Request ($77,001) has been approved by the BWSR and that the check has been received. Mr. Kalar also informed the Board that $19,333.34 of the WCA portion of the grant will go the SWCDs ($9.666.67 each). Proposed Chapter Sanitation Code Revisions Mr. Kalar informed the Board that a draft copy of the proposed Sanitation Code was sent to the Minnesota Pollution Control Agency (MPCA) in Detroit Lakes for review and comment. From the comments received, it appears that there may be some benefit in adopting Minnesota Rules Chapter 7080 with County Specific Amendments. Discussion followed. Mr. Kalar also informed the Board that the Minnesota Pollution Control Agency (MPCA) will be holding an informative meeting in Detroit Lakes regarding proposed changes to Chapter 7080. This meeting is scheduled for Tuesday, March 24th at the Country Inn & Suites, 1330 Highway 10 East from 2:00 to 5:00 p.m. Bid Review and Recommendation for Award Project CP 98:31 B & Etc. Highway Engineer, Rick West, provided a is review of bids and awards for Project CP 98:31B & Etc. He indicated bids were opened March 12, 1998 and presented a map showing project locations. Bid summary is as follows: Engineer's Estimate Bauerly Bros., Companies Sauk Rapids, MN Sherbrooke Asphalt, Inc. Detroit Lakes, MN Mark Sand & Gravel Acquisition Company Bemidji/Fergus Falls, MN Tri-City Paving, Inc. Little Falls, MN Central Specialties, Inc. Project Update Mr. West reported the last Construction and Design Project Update was in December of 1997 . . . Project construction is complete -final quantities has been confirmed. The Conference Committee will make final decision on this. He indicated that county boards would be provided specific information relative to the Engineers, Lobbing group.
