';\9~r:r~~t~Jf ~tf !J:s,m:: Call to Order The Otter Tail County Human Services Board convened Tuesday, March 10, 1998 at 9:31 a.m. at the Otter Tail County Courthouse with Bill Stone, Chair; Syd Nelson, Vice-Chair; Andy Lindquist, Secretary; Malcolm Lee, and Virginia Partmann present. Approval of Agenda Motion by Lee, second by Partmann, and unanimously carried to approve the Human Services agenda of March 10, 1998. Approval of Minutes Motion by Nelson, second by Partmann, and unanimously carried to approve the Human Services minutes of February 24, 1998 as presented. Approval -Grant Application for Permanent Dental Clinic Motion by Partmann, second by Nelson, and unanimously carried to authorize the Public Health · Director, Diane Thorson, to apply for planning grant funds from the West Central Initiative Fund for the planning for implementation of a permanent public health dental clinic and rural dental education initiative. FDA Compliance Checks Public Health Director, Diane Thorson, reported receipt of correspondence from the MOH regarding insurance relative to youth involved with FDA tobacco compliance checks. Motion by Nelson, second by Lee and carried, with Stone opposed, to authorize youth involved with tobacco compliance checks to be hired by the State of Minnesota. Bills & Claims Motion by Lindquist, second by Partmann, and unanimously carried to approve the Human ·. Services bills and claims as submitted. Temporary Intake Worker Position Rosann Sauck, Social Services Supervisor, requested a temporary/emergency appointment for six weeks, four hours per day (1-5 p.m.) to provide intake coverage. Motion by Partmann, second by Lee, and unanimously carried to direct the County Attorney to review the proposed position with the Personnel Coordinator to determine whether this position should be a merit system emergency appointment or a contracted position. Welfare to Work for Rural Minnesota <:.) Rosann Sauck requested approval of a contract to assist welfare clients prepare for work. Motion by Stone, second by Partmann, and unanimously carried to authorize the Chair's signature to execute a contract between the Department of Social Services and Rural MN CEP for the transition from welfare to work. Otter Tail County Board of Commissioners March 10, 1998 Page 2 MH Local Advisory Council Annual Update Kay Johnson and LuAnn Hanson of the Otter Tail County Adult Local Mental Health Advisory Council updated the board regarding the council's recent activities. The council's purpose is to 0 advise the county regarding mental health issues and to promote mental health programs. A major accomplishment this past fall was the opening of a social club "A Place to Belong" to provide programming of a social nature. Lengthy discussion followed. Approval of Minutes Motion by Lindquist, second by Nelson, and unanimously carried to approve the County Board minutes of March 3, 1998 as presented. Boarding of Prisoners Sheriff, Gary Nelson, and Chief Deputy, Mark Morris, requested an increase for boarding prisoners from $50 per day to $55 per day. Motion by Lindquist, second by Partmann, and unanimously carried to approve an increase from $50 per day to $55 per day for boarding prisoners effective April 1, 1998. Sheriff Nelson reported that, this time of year, there is a trend over the summer of fewer prisoners held in the Otter Tail County detention facility. Sheriff Nelson reported that he previously spoke with Jail Administrator, John Halvorson and Assistant, Al Keller, regarding the possibility of accepting both the state and federal offer to board prisoners. Mr. Halvorson and Mr. Keller were in favor of both proposals. The state proposal would bring five (5) prisoners under the proposed ICWC Crew program. The U.S. Marshall proposal would bring eight (8) prisoners. The federal proposal would be effective two weeks after the county's acceptance of the agreement. Discussion continued regarding staffing levels as well as potential cost of remodeling to provide space for additional inmates. The Sheriff stated that the county could accept the federal contract before remodeling begins. Motion by Partmann, second by Lindquist, and unanimously carried to authorize the jail expansion project and the hiring of Yeater, Hennings, Ruff, Shultz, Rokke, Welch Architects & Planners of Moorhead, MN for architectural services for the project. 0 u Otter Tail County Board of Commissioners March 10, 1998 Page 3 Chief Deputy, Mark Morris, reported that the detention facility per M.S. 651 could now charge a booking fee. Motion by Stone, second by Portmann, and unanimously carried to approve collection of a $10.00 booking fee for inmates effective May 1, 1998. Children's' Mental Health Case Aid Position Motion by Portmann, second by Stone, and unanimously carried to authorize the appropriate Human Services authorities to proceed with advertising through the Coordinator's office to fill an additional Children's Mental Health Case Manager position. Payment Approval Motion by Portmann, second by Lindquist, and unanimously carried to approve $47,000 for IBM installation of the computer system upgrade as previously approved per contract and by the Capital Improvement Committee. The funds will be expended during 1998. Premise Permit Otter Tail County Resolution No. 98-13 UPON a motion by Nelson, second by Portmann and unanimously carried, the Otter Tail County Board of Commissioners adopts the following resolution: WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of licenses and permits for the conduct of lawful gambling lies with the Minnesota Gambling Control Board; and WHEREAS, the Vergas Fireman's Relief Association, Vergas, MN, has made an application to the Gambling Control Board for a premise permit to conduct lawful gambling at Heisler Country Store, Q in Candor Township of Otter Tail County; and 0 WHEREAS, Minnesota Statute 349.213 provides that the Gambling Control Board may not issue a permit unless they receive a resolution from the Otter Tail County Board of Commissioners approving the permit; and WHEREAS, the Otter Tail County Board of Commissioners is aware of no reason to oppose the conduct of lawful gambling by the Vergas Fireman's Relief Association, Vergas, MN, at Heisler Country Store, in·can~or Township of OtterTail County. _.. -. ) .. <·~_:, .;:-z_ NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners hereby approves the conduct of lawful gambling by the Vergas Fireman's Relief Association, Vergas, MN, at Heisler Country Store, in Candor Township of Otter Tail County, provided the applicant meets all the necessary criteria for the licenses and permits as required by the Gambling Control Board. Mr. West reported that he met with City Engineer, Dan Edwards and the County Highway Committee relative to the joint routes. Otter Tail County will establish CSAH as follows: Cascade Street from 0.09 miles South of St. Charles Avenue to Vernon Avenue (CSAH #25)-0.72 miles. This letter is on record with both the City of Fergus Falls and Otter Tail County. Additionally, CSAH No. 86 (roadway on the west side of the Fergus Falls Airport) will not be reconstructed for a period of five to seven years after the CSAH designation is approved by the Mn DOT Commission. RESOLUTION REVOKING COUNTY STATE AID HIGHWAYS Otter Tail County Resolution No. 98-15 UPON a motion by Lindquist, second by Partmann, and unanimously carried, the Otter County Board of Commissioners adopts the following resolution: WHEREAS, it appears to the County Board of Commissioners of the County of Otter Tail that the roads hereinafter described should be revoked as County State Aid Highways under the provisions of Minnesota Laws; NOW, THEREFORE, BE· IT RESOLVED'by'the County Board of Commissioners of the County of Otter Tail that the roads.described as•follows, to-wit: Fir Avenue from 0.13 miles West of Union Avenue to Friberg Avenue (CSAH 92) -1.10 miles Union Avenue from Alcott to Vernon Avenue (CSAH 1) -0.16 miles be, and hereby are, revoked as County State Aid Highways of said County subject to the approval of the Commissioner of Transportation of the State of Minnesota. This motion is contingent upon Otter Tail County being held harmless relative to liability and approval of the Sheriffs Department. Approval -Ditch #63 Order Redetermining Benefits County Attorney, David Hauser, requested approval ofthe Ditch #63 Order for Redetermination of Ditch Benefits and the Assessment Order. Motion by Partmann, second by Stone, and unanimously carried to approve the Otter Tail County Ditch #63 Order Redetermining Benefits and the corresponding Assessment Order per Attachment .A of the official minutes. The Order Redetermining Benefits and Assessment Order are on file in the County Auditor's office. Performance Evaluation Summary Motion by Lindquist, second by Partmann, and unanimously carried to approve the positive performance evaluation summary of Land & Resource Director, Bill Kalar, and place the summary in Mr. Kalar's personnel file. Lee, Chair 0 Q OTTER TAIL COUNTY BOARD OF COMMISSIONERS March 10, 1998 Page 1, Attachment A OTTER TAIL COUNTY DITCH #63 ORDER REDETERMINING BENEFITS The Otter Tail County Board of Commissioners, the drainage authority for Otter Tail County Ditch #63, held a public hearing on Tuesday, Februarv 24. 1998. which was continued to March 3. 1998. Notice of the hearing was given as required by Minnesota Statute § I 03E.325 and § I 03E.35 l, Subd. 2. The County Board determined that the original benefits or damages determined in the original drainage proceeding do not reflect reasonable present day land values. The viewers were present at the hearing and presented the Ditch Viewers Report dated January 27, 1998, at the hearing on February 24, and then re-examined the property benefited and damaged by the system and found that all but ten acres of land owned by Robert and James Rogholt, and Gary Rogholt, et al, identified in Tax Parcels 180162000 and 180163000 no longer drain into the system pursuant to a permanent easement granted to the U.S. Fish and Wildlife Service, a copy of which is on record with the Otter Tail County Recorder in Book 80, Page 759. The drainage into Ditch #63 from this acreage has been blocked off, and the area is maintained as a wetland for a waterfowl production area. The Viewers Report dated January 27, 1998, was amended to exclude the acreage no longer draining into the system. That a copy of the Ditch Viewers Report dated January 27, 1998, as amended on March 3, 1998, is attached, marked Exhibit A and incorporated by reference. (It includes a one-page explanation, Appendix A, Agricultural Production Values, and Assessment Worksheet showing the assessment to G) each individual property.) • 0 OTTER TAIL COUNTY BOARD OF COMMISSIONERS March 10, 1998 Page 2, Attachment A NOW, THEREFORE, IT IS HEREBY ORDERED that the benefits and damages are hereby redetermined and shall be as contained in the Ditch Viewers Report attached as Exhibit A. These redetermined benefits and darciages shall be used in place of the original benefits and damages in all subsequent proceedings relating to Ditch #63. ., Malcolm Lee, Chair / · Otter Tail County Board of Commissioners ASSESSMENT ORDER The Otter Tail County Board of Commissioners, the drainage authority for Otter Tail County Ditch #63 finds that the ditch is in need ofrepair, and that there is not enough money in the drainage system account to make the repairs. THEREFORE, IT IS HEREBY ORDERED that the property and entities that have been assessed benefits for Ditch #63 be assessed $16,000.00 for the drainage system repair fund. The assessment will be pro-rated among the property owners as outlined in Exhibit A, the Ditch Viewers Report dated January 27, 1998, a copy of which is attached hereto. IT IS FURTHER ORDERED that assessments up to an amount of $100.00 shall be paid in a single installment. That assessments between $100.00 and $500.00 may be paid in three annual installments; and assessments of $500.00 or more may be paid in five annual installments.
