Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, February 17, 1998 at 9:30 a.m.
at the Otter Tail County Courthouse with Commissioners Malcolm Lee, Chair; Syd Nelson,
Andy Lindquist, Bill Stone, and Virginia Partmann present.
Approval of Agenda
Motion by Lindquist, second by Partmann, and unanimously carried to approve the County Board
agenda of February 17, 1998 with the following addition:
Planning Commission Recommendations -1 :00 p.m.
Approval of Minutes
Motion by Nelson, second by Stone, and unanimously carried to approve the County Board
minutes of February 10, 1998 as presented.
Consulting Services Agreements
Highway Engineer, Rick West, presented an agreement for design services for replacement bridge
no. 3565. He noted that Pelican Township has expressed a desire to proceed with this project.
Motion by Stone, second by Nelson, and unanimously carried to authorize the Chair's signature to
execute a consulting agreement for design services for replacement bridge no. 3565, over the
Pelican River, between Interstate Engineering and the Otter Tail County Highway Department.
The agreement with Interstate Engineering to perform design services is for $7,100.
Motion by Lindquist, second by Partmann, and unanimously carried to authorize the Chair's
signature to execute a consulting agreement for design services for TH 59 South Turnback Project
between Widseth, Smith & Nolting and the Otter Tail County Highway Department. The estimate
for services performed by Widseth, Smith, & Nolting relative to this agreement is $37,317. The
Highway Engineer stated that a public information meeting would be schedule for this project
within the next two weeks.
Spring Road Restrictions
Mr. West notified the board that MnDOT road restrictions would be implemented next Monday,
February 23rd. He stated that county road restrictions might apply before that because of frost
depth test results.
Parents Forever Program
Extension Educator, Angela Berge, Court Administrator, Kathy Ouren, and Mary Matteson,
reported on the Parents Forever Program. Ms. Ouren explained that legislation passed last year
mandated a parent education program for people going through divorce. The program will be run
on a quarterly basis. Ms. Berge explained that the collaboration of several agencies administering
the program would keep the cost to participants at a minimum. Discussion followed.

Otter Tail Water Management District Board Appointments
Motion by Portmann, second by Lindquist, and unanimously carried to appoint the
individuals to the unexpired terms of Norm Neset and Warren Stavaas:
Allan Harder -Deer Lake
Don Thorson -Blanche Lake
The term of office for both of the above individuals will expire in June of 1999.
Temporary Liquor License Application Approval

Motion by Portmann, second by Lindquist, and unanimously carried to approve the following

The Spring Migration Chapter of the Ducks Unlimited has submitted an Application for
Authorization for an Exemption from Lawful Gambling Licenses for an event scheduled on
April 17, 1998 at the Pier. No action was taken to prohibit the activity.
Transfer of Liquor License Approval
Motion by Lindquist, second by Portmann, and unanimously carried to approve the following
application for license subject to the approval of the County Attorney:

The former owner authorized the transfer of the above licenses to David L. and

Premise Permit
Otter Tail County Resolution No. 98-06
Upon a motion by Nelson, second by Stone, and unanimously carried, the Otter Tail County Board
of Commissioners adopts the following resolution:
WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of licenses
and permits for the conduct of lawful gambling lies with the Minnesota Gambling Control Board;
and
WHEREAS, the Perham Lions Club, Perham, MN, has made an application to the Gambling
Control Board for a premise permit to conduct lawful gambling at Zorbaz of Little Pine Lake, Inc., in
Perham Township of Otter Tail County; and

WHEREAS, Minnesota Statute 349.213 provides that the Gambling Control Board may not issue a Q
permit unless they receive a resolution from the Otter Tail County Board of Commissioners
approving the permit, and

WHEREAS, the Otter Tail County Board of Commissioners is aware of no reason to oppose the
conduct of lawful gambling by the Perham Lions Club, Perham, MN at Zorbaz of Little Pine Lake, Q Inc., in Perham Township of Otter Tail County.

NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners
hereby approves the conduct of lawful gambling by the Perham Lions Club, Perham, MN at Zorbaz
of Little Pine Lake, Inc., in Perham Township of Otter Tail County, provided the applicant meets all
the necessary criteria for the licenses and permits as required by the Gambling Control Board.
IT IS FURTHER RESOLVED, that notice of this application and approval shall be provided to the
Township of Perham by sending them a copy of this resolution.

Mill Street Residence
Bill Adams, representing the Lake Region Healthcare Corporation Long Term Facilities, Inc.
explained to commissioners that the tax bill received by LRHC for the Mill Street Residence was
not budgeted. He noted that attorneys for the corporation stated that, around the country, most
facilities like the Mills Street Residence are tax exempt. He stated his belief that this facility meets
the historic definition for real estate tax exemption. Assessor, Bob Moe, had previously
researched this issue and received comment from the Department of Revenue that this property
would not be tax exempt. Discussion followed regarding confusion in the court system relative to
facilities that are taxable vs. those that are tax exempt. Commissioner Lindquist stated that
clarification by the legislation on this tax issue is needed.
Long Term Care Facilities
Otter Tail County Resolution No. 98-09
UPON a motion by Lindquist, second by Partmann, and unanimously carried, the Otter Tail County
Board of Commissioners adopts the following resolution:
WHEREAS, LRHC Long Term Care Facilities, Inc., dba The Mill Street Residence, is classified as
an elderly assisted living facility; and
WHEREAS, LRHC Long Term Care Facilities, Inc., is organized as a non-profit corporation;
WHEREAS, LRHC Long Term Care Facilities, Inc., has received 501 (c)(3) tax exempt status from
the Internal Revenue Service; and
WHEREAS, in 1997 the Minnesota State Legislature adopted Chapter 231 of the 1997 Session
Laws placing a moratorium on changes by local assessors to the property tax assessment of an
existing elderly assisted living facility; and
BE IT RESOLVED, that the Otter Tail County Commissioners support the efforts of LRHC Long
Term Care Facilities, Inc., to seek the enactment of appropriate legislation by the Minnesota State
Legislature to clarify the tax exempt status of elderly assisted living facilities, such as The Mill
Street Residence.

BCBSM Amendment Approval

Motion by Partmann, second by Lindquist, and unanimously carried to authorize the Chair's
signature to execute Amended Exhibit A which sets forth the financial terms and conditions for plan
year 1998 for the employee health benefit with BCBSM.
Communications Consulting Contract Approval
Motion by Lindquist, second by Partmann, and unanimously carried to authorize the Chair's
signature to execute a Communications Consulting Contract between the County of Otter Tail and
PSC Alliance for communications consultant work in countywide addressing and E-911.
Glendalough State Park
Otter Tail County Resolution No. 98-07
UPON a motion by Partmann, second by Lindquist, and unanimously carried, the Otter Tail County
Board of Commissioners adopts the following resolution:
WHEREAS, the Otter Tail County Board of Commissioners has previously expressed their support
for the establishment of Glendalough State Park; and
WHEREAS, the Otter Tail County Board of Commissioners have supported and participated in
Park Infrastructure; and
WHEREAS, the Otter Tail County Sentence-to-Service program has invested thousands of hours
of labor in Glendalough State Park; and
WHEREAS, the future development of the park will be an enhancement to the county.
NOW, THEREFORE, BE IT RESOLVED that the Otter Tail County Board of Commissioners
supports a grant proposal to the Legislative Commission on Minnesota Resources for the
renovation and restoration of three principal buildings in the original Glendalough Camp.

At 10:34 a.m., Chairman Lee declared the meeting of the Otter Tail County Board of
Commissioners closed to the public to discuss pending litigation as authorized by attorney-client
privilege, M.S. 471.705 Subd 1d. Present were Commissioners Partmann, Lee, Lindquist, Stone,
and Nelson, the County Attorney, County Coordinator, and Recording Secretary.
Recess & Reconvene
At 10:47 a.m., Chairman Lee declared the closed session concluded and the meeting of the Otter
Tail County Board of Commissioners recessed until 1 :00 p.m. this afternoon. Chairman Lee
reconvened the meeting at 1 :00 p.m.

Approval to Pay Bills
Motion by Stone, second by Lindquist, and unanimously carried to approve the bills per
Attachment A of these minutes. Bill No. 1877 to the National Pen Corporation, in the amount of Q
$89.31, was excluded for payment from the bills presented at the meeting.
Planning Commission Recommendations
Conditional Use Permits:
Motion by Lindquist, second by Partmann and unanimously carried to approve a Conditional Use
Permit for the Otter Tail County Highway Department, S.A.P. 56-674-01 (Section 13114 & 18/19,
Twp. T134N, R. 40W & R. 41W, Twin Lakes-56-382) as presented.
Motion by Partmann, second by Stone, and unanimously carried to approve a Conditional Use
Permit for YoungLife Campaign (Sec. 2 & 3, Twp. 137, R. 42 Pelican Lake-56-786) as presented.
Motion by Nelson, second by Stone, and unanimously carried to amend the Conditional Use
Permit (#5561) issued to Patrick Tower (Sec. 15, Twp. 136, R. 38, Big Pine Lake, 56-786) with
conditions as recommended by the Planning Commission.
Motion by Partmann, second by Lindquist, and unanimously carried to approve a Conditional Use
Permit for Dunn's 59 Limited (Sec. 20, Twp 137, R. 42, Lake Lizzie-56-760) with conditions as
recommended by the Planning Commission.
Mr. Landis Weaver and Bill Barber appeared to represent an application for parking lots near The Q
Pier. The Planning Commission had tabled this Conditional Use Application. Mr. Barber stated
that the Planning Commission had table the request because there was no one present opposing
the project. Re-applying would set the project back about a month. Mr. Kalar read, for the record,
the notice that had been previously published. The notice did mention a lodge as part of the total
project, although the lodge location is beyond the shoreland-regulated area. Discussion followed
regarding the location of parking lot(s) relative to Highway 78 and Highway 5.
Motion by Stone, second by Partmann, to approve a Conditional Use Permit for Landis Weaver
(Sec. 28, Twp 134, R. 39, Ottertail Lake-56-242) provided satisfactory documentation is submitted
to the Land & Resource office regarding the concerns expressed by the Planning Commission.

1998 Natural Resources Block Grant Agreement
Motion by Nelson, second by Stone, and unanimously carried to authorize the Chair's signature to Q
execute the 1998 Natural Resources Block Grant Agreement. The state block grant is $77,001
with a county and SWCD match of $67,623 to assist with costs of administering the water plan,
WCA, and Shoreland regulations.
