. Statutory Meeting -Call to Order
Pursuant to Minnesota Statute, the Otter Tail County Board of Commissioners convened Tuesday,
January 6, 1998 at 9:30 a.m. at the Otter Tail County Courthouse with Commissioners
Andy Lindquist, Chair; Syd Nelson, Malcolm Lee, Bill Stone, and Virginia Portmann present.
Otter Tail County Board Chair Selected
County Board Clerk, Larry Krohn, requested nominations for the· 1999 Otter Tail County Board
Chair. Motion by Portmann, second by Lindquist, and unanimously carried with Lee abstaining, to
elect Commissioner Malcolm Lee as the Otter Tail County Board Chairman for 1998.
Otter Tail County Board Vice-Chair Selected
1998 County Board Chairman, Mal.colm Lee, assumed the chair and requested nominations for the
1998 Otter Tail County Board Vice-Chair. Motion by Stone, second by Portmann, and
unanimously carried with Nelson abstaining, to elect Commissioner Sydney Nelson as the Otter
Tail County Board Vice-Chairman for 1998.
Approval of Agenda
Motion by Stone, second by Lindquist, and unanimously carried to approve the County Board.

Approval of Minutes
Motion by Lindquist, second by Portmann, and unanimously carried to approve the County Board
minutes of December 23, 1997 as presented.
Correspondence Acknowledged
Chairman Lee acknowledged the following correspondence:
Receipt of a letter from the Veterans Homes Board. He noted that Otter Tail County would receive
52.5% ($44,625) ofthe local share for the construction of the Fergus Falls Veterans Home that is
currently available.
A letter from the University of Minnesota regarding a proposed soybean crushing facility.
A letter that was referred to Commissioner Lindquist and Ditch Inspector, Tiny Holm:
Receipt of $12,263.61 from Lakeland Mental Health Center. This amount is final payment due to
the county for a previous loan.
1998 Solid Waste Haulers Renewal Licenses
Mike Hanan, Solid Waste Director, presented ten solid waste hauler
recommended approval for 1998 haulers licenses.

Chairman Lee requested an update on the Recycling Program.
Discussion ~ True County Assessor System
Assessor, Bob Moe, upon the request of Commissioner Stone, discussed the True County
Assessor System. Mr. Moe has informed the townships that it is their decision whether to maintain
their local boards of review or to turn the board of review over to the county.· Discussion continued
regarding CRP land and current market value of properties.
Request for Forgiveness of Penalty
Magnar Tenold requested forgiveness of penalty, in the amount of $2,804.08. He explained that
he had mailed his taxes on the 15th, however, the envelope was postmarked the 16th and resulted
in a late tax payment. Mr. Tenold explained his situation to the commissioners. After some
discussion, commissioners explained to Mr. Tenold that they empathized with. his situation,
however, could take no action to forgive the penalty because of the county's policy.
Commissioners referred Mr. Tenold to Auditor, Wayne Stein, to work out a payment plan.
1998 Printing and Publishing Bids
County Auditor Wayne Stein, having previously advertised for bids to be received for printing and
publishing of the county board minutes, legal notices, delinquent tax list and county's annual
financial statement, opened the following bids:

1998 Pocket Gopher Bounty
Otter Tail County Resolution No. 98-01
UPON a motion by Partmann, second by Lindquist, and unanimously carried, the Otter Tail County
Bo·ard of Commissioners adopts the following resolution:
RESOLVED by the Board of County Commissioners of Otter Tail County, Minnesota, that
The sum of thirty cents ($.30) be paid out of the General Revenue Fund of Otter Tail County fo'r
every pocket gopher killed in said County during the year 1998 in cases where the township in
which the pocket gophers were so killed shall provide for the payment of at least an additional
bounty of forty cents ($.40) for each pocket gopher so killed. ·
RESOLVED further that said payment of such County shall be made by the County Auditor upon
certificates executed by the Chairman and/or Clerk of the Town Board of said Township setting
forth that the township had issued and delivered to each claimant a payment for at least seventy
cents ($.70) for each pocket gopher so killed.

Tax Forfeited Land Sale Apportionment
Otter Tail County Resolution No. 98-02
· UPON a motion by Lindquist, second by Partmann, and unanimously carried, the Otter Tail County
Board of Commissioners adopts the following resolution:
RESOLVED by the Board of County Commissioners of Otter Tail County, Minnesota, that
· WHEREAS, it is provided in Minnesota Statute 282.05 for the apportionment of proceeds from the
sale of tax forfeited lands, and
WHEREAS, the County Auditor shall apportion the tax sale proceeds to the taxing district pursuant
to Minnesota Statute 282.08 and
WHEREAS, Minnesota Statute 282.08 (4) (b) provides that the County Board may set aside 20%
of the proceeds remaining after the value of public improvements, special assessments and bond
issues levied on the property have been paid, for acquisition and maintenance of county parks and
recreational areas, and
WHEREAS, Otter Tail County has a park and recreational area, which would benefit by such an
apportionment.
NOW, THEREFORE. BE IT RESOLVED, that the County Auditor retain 20% of the proceeds from
; the sale of tax forfeited lands for acquisition and maintenance of parks and recreational areas from
·· the proceeds to be disbursed according to law.

Delinquent Real Estate Parcels
· Motion by Nelson, second by Lindquist, and unanimously carried to set the cost assessed to
delinquent real estate parcels, that are published in the Delinquent Tax List at $19.00 per parcel.
In 1997 the cost to publish the Delinquent Tax List was $15,891.89. There were approximately
915 parcels published for a per parcel cost of $17.37. Based on the 1998 publication bid the cost
will be approximately $16,710.96 or a per parcel cost of $18.26 (assuming the same 1,176 inches
, of publication and assuming approximately 915 parcels). There is statutory authority for the
County Board to establish the fee at the greater of $10.00 or a reasonable fee to recover all the
cost incurred against each parcel included in the Delinquent Tax List (Minnesota Statute 279.092).

County Board of Equalization Dates
· Motion by Stone, second by Nelson, and unanimously carried to convene the County Board of
Equalization on Wednesday, June 17, 1998 at 9:00 a.m. and to reconvene the County Board of
Equalization for final action on Tuesday, June 30, 1998 (Minnesota Statute 274.14). ·

Budget Request
Commissioner Nelson requested $500 on behalf of the EQT Historical Society. No action taken::
Request from EOT Soil and Water Conservation District
Commissioner Stone acknowledged a request from the EQT Soil & Water Conservation District
employees to join the Otter Tail County group health plan.
Motion by Partmann, second by Lindquist, and unanimously carried to· direct the County··
Coordinator to send a letter to the EOTSWCD to explain that Otter Tail County's health plan
contract allows only employees to participate in the county health plan and the contract states that,
"There are no subsidiary or affiliated companies included for coverage". ·

Motion by Lindquist, second by Partmann, and unanimously carried to adopt the . following
resolution:
WHEREAS, Otter Tail County wishes to overlay County State Aid Highway No. 10 from CSAH No.
88, East 3.854 miles (6.202 kilometers) to T.H. 59, AND
WHEREAS, under state Aid Rules 8820.9925, the minimum.design speed required for·resurfacing
~(.)' would be 30 mph (50 km/hr) within an urban area; AND . . . . _ .
WHEREAS, there exists between Engineer's Station 375+03 within the City of Elizabeth a·25 mph
. (40 km/hr.) horizontal curve.

.NOW,.;THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners
hereby request a variance from State Aid Rule 8820.9925 in order to resurface this portion of
CSAH No. 10, AND
BE IT FURTHER RESOLVED, that Otter Tail County Board of Commissioners indemnifies, saves
and holds harmless the State and its agents and employees of and from claims, demands, actions,
or causes of action arising out of or by reason of the granting of said variance.

· Motion by Portmann, second by Lee, and unanimously carried to schedule a public meeting for the
Bridge Replacement Program on Wednesday, February 4, ___ 1~98 at 7:00 p.m. in the
Commissioners' Room at the Courthouse in Fergus Falls. The.Highway Engineer will advertise the
public hearing and notify affected townships.
Stipulation for Entry of Judgment
Motion by Portmann, second by Lindquist, and unanimously carried to authorize the Chair's
signature to execute a Stipulation for Entry of ,Judgment in a tax appeal matter between the County -Q
of Otter Tail and.the Best Western Hotel.
