Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, December 16, 1997 at 1 :00
p.m. at the Otter Tail County Courthouse with Commissioners Andy Lindquist, Chair; Syd Nelson,
Malcolm Lee, Bill Stone, and Virginia Partmann present.
Approval of Agenda
Motion by Lee, second by Stone, and unanimously carried to approve the County Board agenda of
December 16, 1997 with the following additions:

Motion by Portmann, second by Nelson, and unanimously carried to approve the County Board

Conditional Use Permit, Northern Star Camp Fire:
Motion by Lee, second by Partmann. and unanimously carried to approve a Conditional Use
Permit for Northern Star Camp Fire (Sec. 10 & 15, Twp. 137, R. 41, Lake Trowbridge & Lake Ida,
56-532 & 56-534) as recommended by the Planning Commission.
Final Plat "Hanson Haven"
Motion by Stone, second by Lee, and unanimously carried to approve the final plat of "Hanson
Haven" (Sec. 4, Twp. 133, R.39, Hanson Lake).
Approval of Otter Tail County Comprehensive Water Plan Update
Motion by Lee, second by Partmann, and unanimously carried to adopt the 1997 Otter Tail County
Comprehensive Water Plan Update as approved by the BWSR on June 25, 1997.
Approval to Apply for Base Grants
Motion by Lee, second by Partmann, and unanimously carried to authorize the Land & Resource
Director to apply for 1998 BWSR Natural Resources Block Grants for local water planning, wetland
conservation, and shoreland management. The application request is $77,001 with a county and
SWCD match of $67,623.
Resolution to Increase State Funding for
Comprehensive Local Water Planning
Otter Tail County Resolution No. 97-68
UPON a motion by Lee, second by Partmann, and unanimously carried, the Otter Tail County
Board of Commissioners adopts the following resolution:
WHEREAS, Otter Tail County has a state approved Comprehensive Local Water Plan, which has
been locally adopted pursuant to Minnesota Statutes Chapter 1038.311 or 1038.255 and covers
100 percent of the land area of the county; and
WHEREAS, each county in the state has added at least a one half time staff person to focus on
Water Planning; and
WHEREAS, Comprehensive Local Water Planning has dramatically increased the planning,
monitoring, and implementation of water resource management in Minnesota and prevented
further degradation of our surface and ground waters; and
WHEREAS, counties are asked to provide more resources in the environmental area related to
water planning, including an increased focus on watershed management; and

WHEREAS, to meet the goals of the state, we need resources at the local level to get the work
~one and these costs have increased since 1991 when Comprehensive Local Water Planning was Q
first funded; and · .,.
WHEREAS, the State of Minnesota, acting by and through its Board of Water and Soil Resources
(BWSR), has authority to award Natural Resources Block Grants for the purpose of implementing
Comprehensive Local Water Plans, the Wetland Conservation Act, the DNR Shoreland Program,

and the MPCA County Feedlot Program, to local government pursuant to Laws of Minnesota 1993,
Chapter 172, sec. 6, and Laws of Minnesota 1994, Chapter 632, sec. 3; and
WHEREAS, Otter Tail County may assess a levy under its general levy authority to match such
grants by BWSR pursuant to Minnesota Statutes 103B.335; and
WHEREAS, there has not been an increase in base funding since 1991 when the program was
started.
NOW, THEREFORE BE IT RESOLVED that Otter Tail County requests the State of Minnesota to
increase the base amount of dollars going to Comprehensive Local Water Planning through the
Natural Resources Block Grant Program, from $37,500 to $50,000 and include a three (3) percent
cost of living increase each year thereafter; and
BE IT FURTHER RESOLVED that Otter Tail County will support a proportionate local match
increase to support Otter Tail County's Comprehensive Local Water Planni g Program.

Feedlot Seminar Update
Land & Resource Director, Bill Kalar, briefed the board on a recent feedlot seminar held in
Mankato , MN.
Ditch No. 41
Ditch Inspector, Tiny Holm, attended a recent ditch seminar in Willmar, MN. Based on the
information from the seminar, Mr. Holm recommended two options regarding Ditch No. 41; 1)
redetermine the properties for the whole ditch system using today's standards, or 2) determine
properties to enter into the ditch system using 1908 standards and adding a 4-7% annual increase
on those properties only. Mr. Holm stated that the least costly process would be to use the 1908
figures and add for inflation.
Motion by Nelson, second by Lee, to authorize option #2 with a 400% inflation rate increase over
the 1908 figures. Discussion followed. Commissioner Lee and Partmann requested the actual
figures. Mr. Holm will calculate actual figures and return to the board. Commissioner Nelson
withdrew the motion.
Acknowledgment of Receipt of Proposed Property Tax Statements
Bob Moe, Assessor, reported receipt of proposed property tax statements from the Earth Bound
Trust. Mr. Moe stated that copies have been sent to the County Attorney and County Coordinator.
Approval to Pay Bill
Motion by Stone, second by Nelson, and unanimously carried to approve payment to the
Minnesota Rural Counties Caucus (MRCC) in the amount of $2,000 for 1998 annual dues.

Committee Appointments
Commissioner Lee appointed Bob Westby of Erhard, MN to replace Howard Carlson on the Land
Use Study Advisory Committee.
Chairman Lindquist appointed Willis Roehl to replace Truman Eggum on the Land Use Study 0
Advisory Committee.
Motion by Lindquist, second by Stone, and unanimously carried to reappoint Willis Roehl to the
County Extension Committee effective January 1, 1998.
Motion by Nelson, second by Stone, and unanimously carried to reappoint Sandy Dombeck to the
County Extension Committee effective January 1, 1998.
Motion by Nelson, second by Stone, and unanimously carried to reappoint George Walters to the
Board of Adjustment effective January 1, 1998.
Motion by Lee, second by Portmann, and unanimously carried to reappoint the following members
to the Otter Tail County Community Health Service Committee effective January 1, 1998:

Court Services Advisory Board effective January 1, 1998.
Motion by Lee, second by Portmann, and unanimously carried to appoint Joe Maske to the
Planning Commission to replace Robert Ronningen. This is a three-year term effective January 1,
1998 .
Motion by Lindquist, second by Stone, and unanimously carried to reappoint Les Estes to the
Planning Commission effective January 1, 1998.
Motion by Partmann, second by Lee, and unanimously carried to reappoint Leona Zimmerman to
the Planning Commission effective January 1, 1998.
Motion by Lee, second by Stone, and unanimously carried to reappoint Cecil Femling, Bert Olson,
Howard Goese, and Hilbert Isaacson to the Solid Waste Advisory Board effective January 1, 1998.
Approval of Labor Agreements
Motion by Portmann, second by Lee, and unanimously carried to authorize the Chairman's
signature to execute a labor agreement between the County of Otter Tail and Minnesota
Teamsters Public and Law Enforcement Employees Union, Local No. 320. The contract is for the
essential supervisory employees unit in the Sheriffs department effective from January 1, 1997
through December 31, 1999.

Motion by Partmann, second by Lee, and unanimously carried to authorize the Chairman's Q
signature to execute a labor agreement between the County of Otter Tail and Minnesota
Teamsters Public and Law Enforcement Employees Union Local No. 320. The contract is for the
essential deputies unit in the Sheriffs department effective from January 1, 1997 through
December 31, 1999.

Motion by Lee, second by Nelson, and unanimously carried to authorize filling a vacated Assistant
County Attorney II position.
PAYABLE 1998 TAX LEVY AND BUDGET RESOLUTION
Otter Tail County Resolution No. 97-69
The following resolution was offered by Commissioner Partmann, who moved for the adoption of
the 1998 budget for the General Fund, for the budgeted Special Revenue Funds, for the Debt
Service Fund and for the adoption of the payable 1998 Gross and Net Tax Levy:
WHEREAS, The Otter Tail County Board of Commissioners held the required public hearing on
December 9, 1997, at 7:30 p.m., in the Otter Tail County Commissioners' Room for the purpose of
discussing and receiving public input regarding the 1998 budget proposed for the General Fund,
proposed for the budgeted Special Revenue Fund, proposed for the Debt Service Fund and for the
purpose of discussing and receiving public input regarding the proposed payable 1998 Gross and
Net Tax Levy.
WHEREAS, Public discussion and comment regarding the County Budget and Tax Levy was
requested on December 9, 1997, and all interested individuals in attendance were encouraged and
provided an opportunity to address the Otter Tail County Board of Commissioners with their
concerns.
WHEREAS, The Otter Tail County Board of Commissioners having received public discussion and
input from all interested individuals in attendance declared the public hearing adjourned and stated
that final action adopting the 1998 Budget and Tax Levy would take place on December 16, 1997
at 2:00 p.m. in the Otter Tail County Commissioners' Room.
WHEREAS, The Otter Tail County Budget Committee met on Thursday, December 11, 1997, to
consider the information presented at the public hearing with regard to and to consider various
(increases/decreases) adjustment to the 1998 budget.
Whereas, the Otter Tail County Budget Committee recognizes that the Minnesota Department of
Revenue has issued a Certification of Special Levies Approved for the Taxes Payable Year 1998,
and that adjustments to the 1998 budget cannot result in a net tax levy greater than either that
amount or that of the proposed net tax levy adopted on Tuesday, September 23, 1997.
NOW, THEREFORE, BE IT RESOLVED, That the Otter Tail County Board of Commissioners
adopts the amount of $39,034,341 as the County's 1998 budget for the General Fund, for the
budgeted Special Revenues Funds and for the Debt Service Fund, as detailed in the attached
documents.
BE IT FURTHER RESOLVED, That the Otter Tail County Board of Commissioners levies for the
payable year 1998, upon the net tax capacity of the property of Otter Tail County the following
amounts as detailed below:

submission to local legislators requesting that they introduce legislation in 1998 to grant special
levy status for Lake Improvement District Tax Levies and request that the tax levy of a Lake
Improvement District not be considered a part of the County Overall Levy Limitation.
Approval of Temporary Accounting Services
Motion by Lindquist, second by Partmann, and unanimously carried to authorize the Auditor to
adve,iise by way of a Request for Proposal for temporary, part-time accounting services.
