HomeMy WebLinkAboutBoard of Commissioners - Minutes - 12/03/19970 Call to Order The Otter Tail County Board of Commissioners convened Wednesday, December 3, 1997 at 1 :00 p.m. at the Otter Tail County Courthouse with Commissioners Andy Lindquist, Chair; Syd Nelson, Malcolm Lee, and Bill Stone present. Approval of Agenda Motion by Lee, second by Nelson, and unanimously carried to approve the County Board agenda of December 3, 1997 with the following addition: Chief Deputy, Mark Morris & Sheriff, Gary Nelson -1 :40 p.m. Approval of Minutes Motion by Lee, second by Stone, and unanimously carried to approve the amended County Board minutes of November 25, 1997 as presented. Commissioner Portmann present at 1 :03 p.m. 0 Approval to Pay Bills 0 Motion by Lee, second by Nelson, and unanimously carried to approve the bills per Attachment A of these minutes which include lodging payments as follows: Holiday Inn Arden Hills Sheraton Inn Midway Patrol Officer, Brian Fox & Investigator, Gary Waskosky Assistant County Attorney, Barbara Hanson Information Provided Chairman Lindquist provided a list of property tax revenues paid by electric power utilities on a county by county basis. Consideration of Enactment of an Amendment to 6.11 of the Solid Waste Ordinance Solid Waste Director, Mike Hanan, appeared to request reconsideration of the proposed amendment to the SWO to ban burning devices. Chairman Lindquist reviewed the action of the board last week. The motion regarding banning of burning devices failed on a split vote with Commissioner Stone absent. Commissioner Portmann explained that numbers of people are concerned about elimination of burning barrels because it is considered an infringement upon their rights. Some constituents would like to abolish burning barrels because of the pollution. Commissioner Lee, after speaking with many township citizens, reversed his position and does not agree with the proposed burning language of Chapter 6 Section 11. Commissioner Stone expressed a personal dislike of burning devices and a concern regarding enforcement relative to burning household garbage, however, because of many phone calls against the banning of burning devices, opposes the proposed language. Otter Tail County Board of Commissioners December 3, 1997 Page2 Motion by Nelson, second by Lee, and carried, with Partmann opposed, to deny the proposed amendment changes of Chapter 6.11 and 6.12 (proposed in November 26, 1997 letter) and leave Chapter 6.10 of the SWO as it originally read which reiterates state law. Q Chairman Lindquist requested that the Solid Waste Director contact John Matteson of the COLA to provide education to lake associations to discourage burning of household waste around the lake areas. Most of the complaints regarding household waste burning are from the lake areas. The year of 1998 will be used as an educational year for citizens to voluntarily dispose of burning barrels and ash. Truth In Taxation Statements Auditor, Wayne Stein, provided a copy of all tax capacity rates in Otter Tail County. Mr. Stein briefed the board on the process of completing the Truth In Taxation statements. He noted that due to some problems, the statements were sent out a few days late, however, at this point, everyone should have received their statements. He noted that legal descriptions were not included on the statements. The vendor responsible for printing the statements stated that the Department of Revenue had approved the form without legal descriptions. Discussion followed. The Chairman noted that the county Truth In Taxation hearing is scheduled for December 9, 1997 at 7:30 p.m. and requested Mr. Stein and Accountant, Mitzi Pederson to attend. Dedicated Phone Line for Weather Information Chief Deputy, Mark Morris, and Sheriff, Gary Nelson, requested an additional phone line for the Sheriffs Department for updated weather information. Mr. Morris reported receiving 150 -200 calls per day during inclement weather. Mr. Morris-noted that they would work with the Highway Department group leaders to report weather. This will be a separate, dedicated phone number. 0 Land Use Committee weather information could also be available via this phone number/recorder. · · Motion by Lee, second by Nelson, and unanimously carried to approve an additional, dedicated phone line for the Sheriffs Department at a cost of $50 for installation and $40 per month thereafter, for the above purposes. Coroner Appointment Chairman Lindquist read, for the record, a letter from Dr. Michael Koch, M.D. wherein Mr. Koch resigns his Deputy Coroner position with Otter Tail County effective December 31, 1997. Motion by Lee, second by Partmann, and unanimously carried to appoint Dr. Gregory Smith, M.D. as Otter Tail County Coroner effective January 1, 1998. Correspondence Acknowledged Chairman Lindquist acknowledged a letter from the DNR regarding STS work and correspondence regarding the Pelican Tax District. Cormorant Lake Issue Chairman Lindquist acknowledged correspondence from the Minnesota Department of Natural Resources and noted that a meeting regarding the proposed release of water from Cormorant Lake is scheduled for December 4, 1997 at 7:00 p.m. Motion by Nelson, second by Partmann, and unanimously carried to oppose release of water from Q Cormorant Lake which is the same position held by Otter Tail County in 1978. Commissioner Lee will attend the meeting on December 4 to convey the county's position. 0 0 AMC Annual Conference Otter Tail County Board of Commissioners December 3. 1997 Page 3 Commissioners Nelson and Stone reported on the recent Annual AMC meeting. MRCC The County Board named Commissioner Stone as the county's alternate delegate to the MRCC.
