HomeMy WebLinkAboutBoard of Commissioners - Minutes - 11/04/19970 Call to Order The Otter Tail County Board of Commissioners convened Tuesday, November 4, 1997 at 9:30 a.m. at the Otter Tail County Courthouse with Commissioners Andy Lindquist, Chair; Syd Nelson, Malcolm Lee, Bill Stone, and Virginia Portmann present. Approval of Agenda Motion by Stone, second by Lee, and unanimously carried to approve the County Board agenda of November 4, 1997 with the following addition: Land & Resource Director, Bill Kalar-10:15 a.m. Approv·al of Minutes Motion by Portmann, second by Lee, and unanimously carried to approve the County Board minutes of October 28, 1997 as presented. Premise Permit Otter Tail County Resolution No. 97-60 UPON a motion by Nelson, second by Stone, and unanimously carried, the Otter Tail County Board of Commissioners adopts the following resolution: WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of licenses and permits for the conduct of lawful gambling lies with the Minnesota Gambling Control Board; and WHEREAS, the Dent Lions Club, Dent, MN, has made an application to the Gambling Control Board for a premise permit to conduct lawful gambling at the Cozy Cove Resort in Dead Lake Township of Otter Tail County; and WHEREAS, Minnesota Statute 349.213 provides that the Gambling Control Board may not issue a permit unless they receive a resolution from the Otter Tail County Board of Commissioners approving the permit; and WHEREAS, the Otter Tail County Board of Commissioners is aware of no reason to oppose the conduct of lawful gambling by the Dent Lions Club, Dent, MN, at the Cozy Cove Resort in Dead Lake Township of Otter Tail County. NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners hereby approves the conduct of lawful gambling by the Dent Lions Club, Dent, MN, at the Cozy Cove Resort in · Dead Lake Township of Otter Tail County, provided the applicant meets all the necessary criteria for the '-.) licenses and permits as required by the Gambling Control Board. IT IS FURTHER RESOLVED, that notice of this application and approval shall be provided to the Township of Dead Lake by sending them a copy of this resolution. Dated: ~ J Id, I 9 '17 Canvassing Board Appointments Motion by Lee, second by Portmann, and unanimously carried to appoint Deputies Cora Nelson and Q Candy Bugbee to serve as members of the Canvassing Board for the Special State General Election held on Tuesday, November 4, 1997. The Canvassing Board will meet at 10:30 a.m. on Wednesday, November 5, 1997 in the Voter Registration office. () 0 0 Payment Approval Otter Tail County Board of Commissioners November 4, 1997 Page 3 Motion by Lee, second by Portmann, and unanimously carried to approve payment from the Tax Forfeiture Fund to the City of Pelican Rapids, in the amount of $510.00, for maintenance to tax forfeited properties located within the City of Pelican Rapids. _ Transfer of Liquor License Motion by Lee, second by,Portinann, and unanimously carried to approve transfer of On/Off Sale Non - Intoxicating Liquor License, Setup License, and On Sale Liquor License to Jennifer Burns for the Pantry N' Pub establishment. Request for Forgiveness of Penalty Motion by Stone, second by Portmann, and unanimously carried to deny a request• of George Jurgens for forgiveness of penalty because the postmark was October 17, 1997, which is after the tax deadline of October 15. Approval of Bills Motion by Lee, second by Portmann, and unanimously carried to approve the bills per Attachment A of these minutes which include lodging payments as follows: Best Western Americanna Inn Best Western Kelly Inn Grand View Lodge Holiday Inn Normandy Inn Ramada Hotel Ruttger's Bay Lake Lodge GIS, Robert Baker GIS employees, Sherran Leabo & Brian Armstrong Investigators, Mark Englund & Richard Tarnke Juvenile Temporary Hold, Phillip & Patricia Douglas Investigator, Michael McCormick Sergeant, Michael Boen Coordinator, Larry Krohn Payment Approval Motion by Portmann, second by Lee, and unanimously carried to approve payment, in the amount of $1,000, to Minnesota Counties Computer Cooperative for computer enhancements for 1997 tax law changes. Speed Zone Study Request -A Segment of CSAH No. 41 Otter Tail County Resolution No. 97-62 UPON a motion by Lee, second by Nelson, and unanimously carried, the Otter Tail County Board of Commissioners adopts the following resolution: WHEREAS, a group of residents has requested by petition that the County of Otter Tail take such action as may be necessary in order to pursue a reduced speed limit on the segment of County State Aid Highway No. 41 in the area of the Star Lake Bridge, approximately 1.5 miles South of TH No. 108 in Section 9 of Star Lake Township, AND WHEREAS, the County of Otter Tail believes that a speed zone reduction would be beneficial in this area. NOW, THEREFORE, BE IT RESOLVED, that Otter Tail County does hereby request that the area be studied by the Minnesota Department of Transportation to determine the need for a reduced speed zone, if any. BE IT ALSO RESOLVED, that Minnesota Department of Transportation proceed with establishing a legal speed zone if the findings of the traffic study are supportive. Motion by Stone, second by Nelson, and unanimously carried to authorize a survey to verify the present ditch elevation. If the current elevation is higher than the original ditch elevation, the Highway Engineer is authorized to approve cleanout to the original elevation. Approval of Final Plat -"Crystal Springs" Motion by Lee, second by Stone, and unanimously carried to approve the final plat of "Crystal Springs" (Sec. 3, Twp. 136N, R42W) as recommended by the Land & Resource Director. FMLA Policy Clarification Motion by Portmann, second by Lee, and unanimously carried to approve a clarification to Section 6 (A) of the current Family and Medical Leave Policy as follows: "Employees must use all accrued sick leave, if the reason for leave qualifies .for the use of sick leave under t~e appro~riate i::ersonnel policy or union contract, 0 and all accumulated vacation (except for one week ofvacat10n) durmg the1r FMLA leave." ~ Closed to the Public Adjournment At I 0:25 a.m., motion by Nelson, second by Stone, and unanimously carried to close the meeting of the Otter Tail County Board of Commissioners to the public. The purpose of the closed meeting is to discuss threatened litigation involving Girard Township in the resurfacing of township roads in cooperation with county engineering services. The closed session is authorized by attorney-client privilege pursuant to M.S. 471.705 Subd Id.
