Call to Order
The Otter Tail County Human Services Board convened Tuesday, October 14, 1997 at 9:31 a.m. at the
Otter Tail County Courthouse with Syd Nelson, Vice-Chair; Andy Lindquist, Secretary; Malcolm Lee,
and Virginia Portmann present. Commissioner Bill Stone was absent.
Approval of Agenda
Motion by Lindquist, second by Lee, and unanimously carried to approve the Human Services agenda of
October 14, 1997 as submitted.
Approval of Minutes
Motion by Lindquist, second by Lee, and unanimously carried to approve the Human Services minutes of
September 23, 1997 as presented.
Welfare to Work Planning Partnership
Frances Eggen, Family Services Collaborative Coordinator, provided copies of a "Welfare to Work".
proposal to the McKnight Foundation .for funding of a partnership project involving Wilkin, Otter Tail,
and Wadena counties. Captain Simmert, Salvation Army Director, Steve Nagle, Otter Tail Wadena
Community Action Council Director, and Ms. Eggen reviewed the proposed strategies to assist families in
the transition from welfare to work. This is an application for implementation funds from the McKnight
Foundation in the amount of $401,775. Discussion followed. Commissioner Lindquist questioned what
the guidelines are for the appropriate use of these grant funds. Ms. Eggen responded that ifthe McKnight
Foundation approves the concepts within this proposal, the proposal would be the guidelines for
appropriate expenditures. County Attorney, Wally Senyk, stated that the county is receiving funding from
the Department of Children, Family, and Learning for the Collaborative Coordinator's salary. Ms. Eggen
will contact the Department of Children, Family, and Learning to request verification that her salary is an
approved expenditure from the Family Services Collaborative grant and consistent with their vision of
family services.
Motion by Portmann, second by Lindquist, and unanimously carried to authorize the appropriate county
officials' signatures on the grant application for the Wilkin-Otter Tail-Wadena Welfare to Work Planning
Partnership proposal subject to the approval of the County Attorney.
Mental Health Screening Grant Application
Chuck Kitzman, Court Services Director, provided a bulletin from the DHS and explained that mental
health screening funds will be provided from the state through a grant process. The grant applications are
due October 31, 1997. Village Family Services has been the provider for this mental health screening
service for the past three years. Mr. Kitzman requested approval for the Court Services Department to act
as a fiscal agent for the grant.
Motion by Portmann, second by Lee, and unanimously carried to approve the process of applying for a
grant to provide mental health screening, assessment, and treatment for children involved in, or at risk of

involvement in the court system. Village Family Services will write the grant with Court Services acting
as fiscal agent.
Caseload/Workload Reduction Monies
Mr. Kitzman reported that the DOC has approved the caseload/workload reduction proposal and grant
award for FY98 of $98,SSS. Motion by Lee, second by Partmann, and unanimously carried to authorize
appropriate county officials' signatures to execute this grant agreement and approve expenditure of these
grant funds as detailed in Otter Tail County's caseload/workload reduction proposal.
Support Staff Position
Motion by Portmann, second by Lee, and unanimously carried to authorize the Court Services Director to
fill a new Support Staff Position with fund,ing for the position from the caseload/workload reduction
grant. The posting for this position should include a notice that this is a grant funded position.
Juvenile Restitution Program
Mr. Kitzman reported that the Juvenile Restitution Program funding will be a grant opportunity in the
future. The county will apply for the funding and there will be no guarantee of funds.
Secure Juvenile Detention Costs
Mr. Kitzman informed the board that the secure detention costs are over budget for 1997.
Breast & Cervical Cancer Screening Services

Motion by Partmann, second by Lee, and unanimously carried to authorize the Public Health Director's
signature on the Breast & Cervical Cancer Screening Services contract with the Minnesota Department of Q
Health in the amount of$8,338.
Health Assessments Contract
Motion by Lee, second by Portmann, and unanimously carried to authorize the appropriate county
officials' signatures on a Health Assessment contract for professional services by the Public Health
Department for Nations Care Link subject to the approval of the County Attorney .. · The health
assessments are for long-term care insurance.
Open House Authorized
Diane Thorson, Public Health Director, reported that 1997 is the 50th year of public health service in Otter
Tail County. County Board members authorized Ms. Thorson to schedule an open house at their new
location in honor of the department's 50th anniversary. ·
Tobacco Legislation
Ms. Thorson reported receipt of information from a training session regarding tobacco access legislation.
Discussion followed. Implementation of tobacco ordinance(s) will not begin until after January 1, 1998.
County-Based Purcl!asing
County Attorney, Wally Senyk, reviewed progress of the County-Based Purchasing committee. The CBP
preliminary plan has been sent to DHS. Health plans and medical service providers are interested in
participation with counties in the CBP model in.varying degrees. The committee is continuing to identify o
issues. The date for completion of a map of providers and a utilization survey for MA recipients may not ·· ·
be met until Otter Tail County identifies a provider to hire for CBP.

Community Health Service Plan
Ms. Thorson reviewed the CHS plan summary in accordance with requirements for a Public Hearing.
Notice ofthis public hearing had been published. There were no citizens in attendance. Final approval
of the CHS plan by the Human Services Board will be Tuesday, October 28, 1997.
Bills & Claims
Motion by Lindquist, second by Lee, and unanimously carried to approve the Human Services bills and
claims as submitted.

Summary of monthly long term care rates
Rural Minnesota CEP letter regarding the new Welfare to Work program
New Dimensions Home Health Care Contract
Motion by Lindquist, second by Lee, and unanimously carried to authorize the appropriate county
officials' signatures to execute a contract between New Dimensions Home Health Care Agency and the
Department of Social Services for respite care at a cost of $6.50 per one-half hour.
TriMin, Inc. Contract
Motion by Lindquist, second by Lee, and unanimously carried to authorize the appropriate county
officials' signatures to execute a contract between TriMin, Inc. and Otter Tail County for the financial
account system.

Motion by Nelson, second by Partmann, and unanimously carried to approve the amended County Board

Ditch 41 _.
Ditch Inspector, Tiny Holm, presented a drawing of the Ditch 41 system. The engineering firm for the
project is proposing a replacement of a larger culvert than is currently W1der the city street. Discussion f'I
followed. CoW1ty Board members directed Mr. Holm to inquire as to the rationale for the larger culvert ""'11
and express his concerns.
Transfer of Funds -Ditch 63
Motion by Portmann, second by Lee, and W1animously carried to authorize the transfer of fW1ds, in the
amount of $12,600, from the general fund to the Ditch 63 fund. This cost will be assessed following
completion of the ditch redetermination.
Approval of Part-Time Clerk Position
Motion by Portmann, second by Lee, and W1animously carried to approve a half-time Clerk position in the
Treasurer's office as requested by the Treasurer.
Request for Forgiveness of Penalty
Motion by Lee, second by Portmann, and W1animously carried to uphold the Treasurer's decision to deny
a request for forgiveness of penalty, in the amount of $69.60, for Richard Rogers, Lake Lida (parcel No.
37-000-99-0960-000) as the penalty was not a result of a county error.
Blood Donations
Motion by Lee, second by Portmann, and W1animously carried to grant coW1ty employees time off for the
purpose of donating blood. This time off should be scheduled so as not to disrupt the operations of the
department.
Lake Planning Program
Motion by Stone, second by Lee, and W1animously carried to support Otter Tail CoW1ty lake associations
who have indicated an interest in participation in a pilot comprehensive lake planning program funded
through the Legislative Commission on Minnesota Resources. It is W1derstood that the plan will require
extensive participation of host lake associations. There will be no monetary commitment from Otter Tail
County for the participation of any of the lake associations requesting endorsement
Land Use Study Advisory Board
Commissioner Fortmann appointed Hal Leland of Fergus Falls to the Land Use Study Advisory Board.
Planning Commission Recommendations
Conditional Use Permit -Neal & Sheilagh Johnson:
Motion by Nelson, second by Lee, and W1animously carried to approve a Conditional Use Permit for Neal
& Sheilagh Johnson (Sec. 21, Twp 135, R. 38, Rush Lake) with conditions as recommended by the
Planning Commission.
Preliminary Plat -"Gustafson's Addition":
Land and Resource Director, Bill Kalar, noted the Planning Commission's condition of moving the pool
and pool house to meet setback requirements. Clem Hendrickson of Anderson Land Surveying, requested
for the applicant, a condition to write an easement aroW1d the pool so the pool could stay in its present
location.
Motion by Lee, second by Portmann, and unanimously carried to approve the Preliminary Plat of D.
Gustafson, "Gustafson's Addition" (Sec. 6, Pelican Lake, 56-786) with conditions as recommended by
the Planning Commission.

Preliminary Plat & Conditional Use Permit-"Bridgeview":
Motion-by Lee, second by Portmann, and unanimously carried to approve the Preliminary Plat and a
Conditional Use Permit for "Bridgeview", C. & D. Knutson and A. & J. Stricker (Sec. 27, Twp. 134, R.
42, West Red River) with conditions as recommended by the Planning Commission.
Applicant, Augie Stricker, questioned condition No. I of the Planning Commission minutes referring to
residential construction being completed without variances and whether future property owners can be
· preempted from requesting• a variance. The County Attorney stated that the Board of Adjustment is not
bound by this condition.
Conditional Use Permit-Elder Engebretson:
Motion by Lee, second by Nelson, and unanimously carried to approve a Conditional Use Permit for
. Elder Engebretson (Sec. 22, Twp. 133, R. 43, Unnamed Lake-56-862) with conditions as recommended by
the Planning Commission.
Conditional Use Permit-Thomas Thompson/Richard Deilke:
Motion. by Portmann, second by Lee, and unanimously carried to uphold the denial of the Planning
Commission for a Conditional Use Permit for Thomas Thompson and Richard Deilke (Sec. 16, Twp. 137,

Conditional Use Permit-Bruce M Hudalla:
Motion by Lee, second by Portmann, and unanimously carried to approve a Conditional Use Permit for

Conditional Use Permit -James and Brenna Lauerman:
Motion by Lee, second by Portmann, and unanimously carried to uphold the denial of the Planning

Final Plat -"Silent Pines":
Motion by Nelson, second by Lee, and unanimously carried to approve the final plat of "Silent Pines"
(Sec. 5, Twp. 133, R. 40W, Round Lake).
Proposed Amendments -Solid Waste Ordinance
Solid Waste Director, Mike Hanan, provided proposed changes to the Solid Waste Ordinance. Mr. Hanan
noted that Minnesota Statutes have changed and therefore, the SWO needs to reflect the changes which
will affect 1998 licensing requirements. Discussion followed. Motion by Portmann, second by Lee, and
unanimously carried to set the Public Hearing for enactment of proposed amendments to the SWO on
Wednesday, November 12, 1997.
Response to Local Assessor Comments
Assessor, Bob Moe, presented a response to an article recently published in the Daily Journal regarding
statements made by local assessors. Mr. Moe reported that.he will schedule two meetings for town boards
to discuss the true county assessor sytem; one meeting in Fergus Falls and one in -New York Mills. In
addition to the separate meetings, Mr. Moe will attend the East and West Annual Township meetings.

Otter Tail County Resolution No. 97-58
Upon a motion by Lee, second by Portmann, and unanimously carried, the Otter Tail County Board of
Commissioners adopts the following resolution:
WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of licenses and
permits for the conduct of lawful gambling lies with the Minnesota Gambling Control Board: and
WHEREAS, the American Legion Post 30, Fergus Falls, MN, has made an application to the Gambling
Control Board for a premise permit to conduct lawful gambling at the Wee Villa Lodge, in Elizabeth Q Township of Otter Tail County; and

WHEREAS, Minnesota Statute 349.213 provides that the Gambling Control Board may not issue a permit
unless they receive a resolution from the Otter Tail County Board of Commissioners approving the
permit, and
WHEREAS, the Otter Tail County Board of Commissioners is aware of no reason to oppose the conduct
of lawful gambling by the American Legion Post 30, Fergus Falls, MN, at the Wee Villa Lodge, in
Elizabeth Township of Otter Tail County.

Classification of Tax Forfeited Land and Request for DNR Approval
Otter Tail County Board Resolution No. 97-59
Upon a motion by Lee, second by Stone, and unanimously carried, the Otter Tail County Board of
. Commissioners adopts the following resolution:
WHEREAS, The County Board of Commissioners of the County of Otter Tail, State of Minnesota, desire
to offer for sale certain parcels of land that have forfeited to the State of Minnesota for non-payment of
taxes, and
WHEREAS, Said parcels of land have been view by the County Board of Commissioners and have been
classified as non-conservation lands as provided for in Minnesota Statutes 2.82.01

NOW, THEREFORE, BE IT RESOLVED That the Otter Tail County Board of Corrtmissioners hereby
certify that all parcels of land on the attached Exhibit A and Exhibit B have been viewed and comply with
the provisions of Minnesota Statutes 85.012, 92.461, 282.01, Subd. 8, 282.018 and the 1991 Laws of
Minnesota Ch. 354, Art. 10, Sec. 9, amending Minnesota Statute Section 282.018, Subd. 2 (1990). The
County Board of Commissioners hereby certifies that the Soil and Water Conservation Board of the
district in which the properties are located has reviewed attached Exhibit A and Exhibit B and has
identified any and all non-forested marginal lands and wetlands.
BE IT FURTHER RESOLVED That the Otter Tail County Board of Commissioners hereby requests
approval from the Minnesota Department of Natural Resources for the sale of said lands.

Adjournment
At 3:00 p.m., a motion was offered by Portmann, seconded by Lee, and unanimously carried, to declare
the meeting of the Otter Tail County Board of Commissioners closed to the public for purposes of
discussing matters of litigation as authorized by attorney-client privilege, M.S. 471.705 Subd. Id. The
litigation matters discussed were as follows: 1) settlement with Strom Construction, Inc. regarding final
payment and amendment to settlement agreement, and 2) Recycling Center construction dispute. All
Commissioners were present during the closed session. At 3:13 p.m., Chairman Lindquist declared the
meeting of the Otter Tail County Board of Commissioners adjourned until Tuesday, October 21, 1997 at
9:30 a.m.

EXHIBIT "A"
NOTICE OF PUBLIC SALE OF TAX FORFEITED LANDS
NOTICE IS HEREBY GIVEN That the parcels of land described in the List of Tax Forfeited Land for Private/ Public
Sale which is contained herein shall be sold to the highest bidder at public sale. The sale will be governed by the
provisions of Minnesota Statute 282 and by the resolution of the Otter Tail County Board of Commissioners
authorizing such sale. The resolution reads as follows:
BE IT RESOLVED,by the Board of County Commissioners of Otter Tail County, Minnesota,
that all parcels of tax-forfeited land included on the attached list have been classified as nonconservation
land; that the basic sale price of each parcel included on the attached list, which is on file with the County
Auditor, be approved and authorization for a public sale of this land be granted, pursuant to the Minnesota
Statute 282; that the sale will be held at (INSERT TIME) (INSERT DAY) (INSERT DATE) by the Otter
Tail County Auditor at the Otter Tail County Commissioners Room in the Otter Tail County Courthouse, for
not less than the basic sale price; and that all sales shall be for full cash payment per the tenns set forth in the
Notice of Public Sale of Tax Forfeited Lands.
TERMS FOR THE SALE OF TAX-FORFEITED LAND
Public Sales: Basic Sale Price
All parcels are offered at public auction and sold to the highest bidder on a cash basis. The minimum bid acceptable is
the basic sale price which is shown on the List of Tax-Forfeited Land for Public Sale. The basic sale price is equal to
the appraised value plus any extra charges for special assessments levied after forfeiture.
Extra Fees and Costs: In Addition to the Basic Sale Price
In addition to the purchase price of the land the following extra fees and costs are due at the time of sale:
l, A 3% surcharge for the state assurance account.
2. A state deed fee of$25.00.
3. A recording fee of$19.50.
4. A state deed tax of $1.65 per $500 of the sale prier.! or a fraction thereof.
Payment Terms: All parcels shall be paid on a cash basis and in full at the time of sale.
Special Assessments: Levied Before and After Forfeiture
The balance of any special assessments which were kvied before forfeiture and canceled at forfeiture and \Vhich
exceed the amount of the basic sale price may be reassessed by the municipality. These special assessments are shown
on the List of Tax Forfeited Land for Public Sale under the column entitled ·'Assessments Before Forfeiture".
Any special assessments which were levied after forfeiture and certified to the county auditor have been added to the
appraised value and must be paid by the purchaser as part of the basic sale price. These special assessments are shown
on the list of Tax-Forfeited Land for Public Sale with a special line entitled "Specials After Forfeiture".
Conditions: Restrictions on the Use of the Properties
Sales are subject to the following restrictions on the use of the properties:
I. existing leases,
2. easements obtained by a governmental subdivision or state agency for a public purpose,
3. building codes and zoning laws,
4. all sales are final with no refunds or exchanges allowed,
5. the appraised value does not represent a basis for future taxes,
6. all mineral rights are reserved by the State of Minnesota, and
7. parcels marked with an asterisk will include a restrictive covenant prohibiting enrollment of the parcel in a state
funded program providing compensation for conservation of marginal lands or wetlands and,
8. Parcels marked with ( +) have or are known to have had underground and/or above ground storage tanks and are
being offered subject to any existing access agreements or easements held by the MPCA and \Vith the understanding
that the successful buyer or any successors will grant access to the land to the MPCA and the buyer or any
successor will use the land in a way to protect the public health and environment, as well as, complying with all
federal and state laws.

Title to the land to be offered for sale in not guaranteed, either by Otter Tail County or the State of Minnesota. The
buyer will receive a receipt at the time of the sale. Within a reasonable time after the sale the County Auditor's office
will request from the Department of Revenue a state deed to the property.
The Otter Tail County Board of Commissioners reserves the right to reject any or all bids and to restrict or withdraw
any parcel listed before or during the sale.

NOTICE OF PUBLIC SALE OFT AX FORFEITED LANDS
NOTICE IS HEREBY GIVEN That the parcels ofland described in the List ofTax Forfeited Land for Private/Public
Sale \vhich is contained herein shall be sold to the highest bidder at public sale. The sale will be governed by the
provisions of Minnesota Statute 282 and by the resolution of the Otter Tail County Board of Commissioners
authorizing such sale. The resolution reads as follows:
BE IT RESOLVED,by the Board of County Commissioners of Otter Tail County, Minnesota,
that all parcels of tax-forfeited land included on the attached list have been classified as nonconservation
land; that the basic sale price of each parcel included on the attached list, which is on file with the County
Auditor, be approved and authorization for a public sak of this land be granted, pursuant to the Minnesota
Statute 282; that the sale will be held at (Insert Time) (Insert Day) (Insert Date) by the Otter Tail County
Auditor at the Otter Tail County Commissioners Room in the Otter Tail County Courthouse, for not less than
the basic sale price; and that all sales shall be for full cash payment per the terms set forth in the Notice of
Public Sale of Tax Forfeited Lands.
TERMS FOR THE SALE OF TAX-FORFEITED LAND
Public Sales: Basic Sale Price
AH parcels are offered at public auction and sold to the highest bidder on a cash basis. The minimum bid acceptable is
the basic sale price which is shown on the List ofTasx•Forfeited Land for Public Sale. The basic sale price is equal to
the appraised value plus any extra charges for special assessments levied after forfeiture.
Extra Fees and Costs: In Addition to the Basic Sale Price
In addition to the purchase price of the land the following extra fees and costs are due at the time ofsaie:
1. A 3% surcharge for the state assurance account.
2. A state deed fee of$25.00.
3. A recording fee of$19.50.
4. A state deed tasx of$1.65 per $500 of the sale price or a fraction thereof.
Payment Terms: All parcels shall be paid on a cash basis and in ful I at the time of sale.
Special Assessments: Levied Before and After Forfeiture
The balance of any special assessments which were levied before forfeiture and canceled at forfeiture and which
exceed the amount of the basic sale price may be reassessed by the municipality. These special assessments are shown
on the List of Tax Forfeited Land for Public Sale under the column entitled ·'Assessments Before Forfeiture".
Any special assessments which were levied after forfeiture and certified to the county auditor have been added to the
appraised value and must be paid by the purchaser as part of the basic sale price. These special assessments are shown
on the list ofTax•Forfeited Land for Public Sale with a special line entitled "Specials After Forfeiture".
Conditions: Restrictions on the Use of the Properties
Sales are subject to the following restrictions on the use of the properties:
1. existing leases,
2. easements obtained by a governmental subdivision or state agency for a public purpose,
3. building codes and zoning laws,
4. all sales are final with no refunds or exchanges allowed,
5. the appraised value does not represent a basis for future taxes,
6. all mineral rights are reserved by the State of Minnesota, and
7. parcels marked with an asterisk will include a restrictive covenant prohibiting enrollment of the parcel in a state
funded program providing compensation for conservation of marginal lands or wetlands and
8. Parcels marked with(+) have or are known to have had underground and/or above ground storage tanks and are
being offered subject to any existing access agreements or easements held by the MPCA and \\/ith the understanding
that the successful buyer or any successors \Viii grant access to the land to the MPCA and the buyer or any
successor will use the land in a \Vay to protect the public health and environment, as well as, complying with all
federal and state laws.

Title to the land to be offered for sale in not guaranteed, either by Otter Tail County or the State of Minnesota. The
buyer will receive a receipt at the time of the sale. Within a reasonable time after the sale the County Auditor's office
will request from the Department of Revenue a state deed to the property.
The Otter Tail County Board of Commissioners reserves the right to reject any or all bids and to restrict or withdraw
any parcel listed before or during the sale.
