Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, September 16, 1997 at 9:30
a.m. at the Otter Tail County Courthouse with Commissioners Andy Lindquist, Chair; Syd Nelson,
Malcolm Lee, Bill Stone, and Virginia Partmann present.
Approval of Agenda
Motion by Lee, second by Partmann, and unanimously carried. to . approve the agenda of
September 16; 1997 as presented with the following changes:
Add at 10:30 a.m. -VSO, Chet Toso
Cancel -Public Health Director•Evaluation
Add at 1:15 p.m. -Ditch Inspector, Tiny Holm
Approval of Minutes
Motion by Nelson, second by Partmann, and unanimously carried to approve the County Board
minutes of September 9, 1997 as presented.
State Solid Waste Tax Information
Mike Hanan, Solid Waste Director,, introduced discussion regarding solid waste taxes. He
explained that the legislature implemented sales tax on municipal solid waste management
services in 1990. This past year, the Department of Revenue audited the county's solid waste tax
records and found the records to be in order. At a recent solid waste meeting with Department of
Revenue representatives, a difference of interpretation existed as. to what solid waste services are
taxable and what services are not taxable . This interpretation affects whether or not solid waste
service fees are 100% taxable. Discussion followed. Mr. Hanan requested direction relative to a
solid waste tax voluntary self-audit and how to respond to the Department of Revenue regarding
this issue. Chairman Lindquist directed Mr. Hanan to meet with the County Attorney and County
Coordinator to further research this issue and return to the board with a recommendation at the
September 23rd County Board meeting.
Findings of Dog Bite Hearing
Pursuant to the county's Animal Health and Control Ordinance, County Attorney Wally Senyk,
reviewed the facts of a recent dog bite hearing regarding a bite inflicted by a dog named Sheba
owned by Hattie Shortsleeve. Ms. Shortsleeve resides at 517 W. Cavour. Upon acceptance of
the facts of the case, a motion was offered by Partmann, seconded by Lee, and unanimously
carried to find the dog, Sheba, a danger to public safety.
Motion by Lee, second by Partmann, and unanimously carried to direct Ms. Shortsleeve to keep
the dog, Sheba, restrained by a chain when outside as is currently being done, and to further
suggest that a fence be built to ensure that the public does not unknowingly wander into the dog's
territory.

Planning Commission Recommendations
Preliminary Plat & Conditional Use Permit -Laurie Hanson "Hanson Haven":
Land and Resource Director, Bill Kalar, explained that this request is a preliminary plat for six
residential lots and a Conditional Use Permit to construct a road to service the lots. The Chairman Q
called for comments from the public. Allen Chase, Ethel Beach Resort, expressed a desire to
place covenants on new lakeshore property to safeguard lake property. The County Attorney
explained that the county does not regulate covenants. Covenants are sometimes placed on
property as an agreement between the developer(s) and purchaser(s).
Motion by Stone, second by Lee, and unanimously carried to approve the Preliminary Plat and
Conditional Use Permit requests of Laurie Hanson, "Hanson Haven" (Section 4, Twp. 133, R. 39,
Hanson Lake) with conditions as recommended by the Planning Commission.
Preliminary Plat and Conditional Use Permit -Robert & Susan Moore; "Rolling Hills":
Mr. Kalar reported that this preliminary plat proposal is 16 residential lots and a Conditional Use
Permit to construct a road to serve the development.
Motion by Lee, second by Portmann, and unanimously carried to approve the Preliminary Plat and
Conditional Use Permit requests of Robert & Susan Moore, "Rolling Hills" (Section 32, Twp. 133,
R. 40, Elbow Lake) with conditions as recommended by the Planning Commission and
additionally, that this development will not include lots 14, 15, and 16.
Conditional Use Permit -Virginia Adams.· Swan Lake Club:
Motion by Portmann, second by Lee, and unanimously carried to approve the Conditional Use
Permit request of Virginia Adams, Swan Lake Club (Section 19, Twp.132, R. 42, Swan Lake) with
conditions as recommended by the Planning Commission.
Conditional Use Permit -Tillman Opsal:
Bill Kalar explained that this CUP request is to gravel an existing easement driveway. The
Planning Commission recommended placement of gravel on existing tire tracks. Chairman
Lindquist called for comments from the public.
Applicant, Tillman Opsal, presented pictures of the present driveway.· He stated that the driveway
gets quite muddy and that he has been stuck. He stated that the former owner had graveled this
driveway in 1991. He was concerned about the Planning Commission's recommendation because
graveling just the tire tracks is not practical.
Sharon Gedde, property owner, spoke in opposition of the CUP approval. Mr. Kalar summarized
her reasons set forth in a letter previously presented to the Planning Commission as follows:
1) concern regarding improvement to the driveway
2) violations to the sanitation code
3) concern relative to the raising of the cabin from existing foundation
4) non-conforming sewage system
5) fill placed around cabin last year
6) application for variance for holding tank which was denied
7) 26' wide area included in the CUP request to be graveled is a play area for her children
Chairman Lindquist reiterated that the matter before the board is graveling the driveway not the
substandard (grandfathered) loUdwelling that the road services.

Kenn Rudd, relative of Mr. Opsal, stated that it is unusual to place 3" of gravel only on tire tracks
. and the applicant is seeking permission to gravel the driveway in the usual manner.

· Sharon Gedde presented pictures of the driveway from 1992 and 1994 to show that no gravel was
previously put on the driveway.
Mr. Opsal presented an affidavit stating that gravel was placed on the driveway in 1991 prior to
Gedde's ownership of their property.
Commissione~ Partmann questioned whether or not the turn-around area is an improvement.
Ms. Partmann stated that, per county ordinance, maintenance of substandard property is allowed,
not improvements. Mr.Kalar viewed the 26' turn-around area as an improvement. Mr. Opsal read
a letter, from the previous property owner, which stated that this turn-around area has been .used
in the past.
Dr. Kern, property owner on Elbow Lake, stated that the area the children currently use for
swimming (which is the same area now requested for the turn-around) is used because this area
has the best sandy beach on the lake.
Discussion and opinions of the commissioners followed.
Motion by Partmann, second by Lee, and unanimously carried to approve the CUP request of
Tillman Opsal (Section 32, Twp. 133, R. 40, Elbow Lake) with the following conditions: 1) allow the
applicant to maintain the driveway by placing gravel on the roadway 3 inches in · depth not to
exceed 10 feet in width, and. 2) graveling of the parking (turn around) area, cul-de-sac area, and
· other improvements are prohibited.
Conditional Use Permit -James P. Schneider:
Motion by Lee, second by Stone, and unanimously carried to approve the Conditional Use Permit
request of James P. Schneider (Section 2, Twp. 137, R. 42, Little Pelican Lake) with conditions as
recommended by the Planning Commission.
Memorandum of Agreement with the MN Veterans Home Board
Chet Toso, Veterans Service Officer, requested approval of a Memorandum of Agreement
between the Otter Tail County Veterans Service Office and the Minnesota Veterans Home Board
to allow the Veterans Service office to accept applications for the Veterans Home in Fergus Falls.
This service is needed until the Veterans Home has staff "on board".
Motion by Partmann, second by Nelson, and unanimously carried to approve the above described
Memorandum of Agreement as presented by the VSO.

At 11:10 a.m., Chair Lindquist declared the meeting of the Otter Tail County Board of
Commissioners closed to the public for the purpose of evaluating the performance of Chet Toso,
Veterans Service Officer, pursuant to M.S. 471.705 Subd. 1d (d).

A summary report of performance conclusions will be provided. The Chair declared the closed
session adjourned at 11 :30 a.m. and recessed the board meeting for lunch break.

Approval to Pay Bills
Chairman Lindquist reconvened the meeting of the Otter Tail County Board of Commissioners at
1 :00 p.m. Motion by Partmann, second by Nelson, and unanimously carried to approve the bills
per Attachment A of these minutes which include lodging payments as follows:
Best Western Arrowhead Lodge Patrol Officer, Matthew McGuire
Holiday Inn Assessor's Office, Barb Molter & Twyla Neuman
Radisson Hotel South & Plaza Sheriff, Gary Nelson
Sheraton Inn Midway, (reimbursable by MCCC) Treasurer, Steve Andrews & Sheriff, Gary Nelson
Bid Award -1-Ton Crew Cab Pickup
Bid Award -Three Road Maintenance Kettles
Motion by Lee, second by Portmann, and unanimously carried to award one 1-ton, 4-door, crew
cab pickup to the lowest bidder, Falls Automotive, Inc. in the amount of $21,343 as recommended
by the Highway Engineer.
Motion by Nelson, second by Stone, and unanimously carried to award three road maintenance
kettles to the lowest bidder, Stepp manufacturing Co. Inc. in the amount of $13,514.85 as
recommended by the Highway Engineer.
Ditch Cleanouts
Motion by Lee, second by Stone, and unanimously carried to approve ditch cleanout of sediment,
which washed into a portion of right-of-way on County Road 88 in Section 27, Twp. 134N, R. 44W,
Oscar Township. The approval was given to Ronnevik Farms as recommended by the Highway
Engineer.
Motion by Stone, second Partmann, and unanimously carried to approve ditch cleanout of 150' as
requested by Kurt Erlandson along County Road 112 in Section 17 and 8, Aastad Township as
recommended by the Highway Engineer.
Motion by Stone, second by Portmann, and unanimously carried to approve ditch cleanout as
requested by Frank Haataja along County Road 25 in Section 14, Twp. 131N, R. 43W, Aastad
Township as recommended by the Highway Engineer.
Ditch No. 63
Ditch Inspector, Tiny Holm, requested approval to hire an engineer for an opinion to lay new tile
next to the existing, old tile in Ditch No. 63. Motion by Nelson, second by Partmann, and
unanimously carried to authorize the Ditch Inspector to retain an engineer for an opinion regarding
the tile to be installed in Ditch No. 63.
Seniors Nutrition Program
Commissioner Stone briefed the board regarding a recent WCAAA meeting.

Lake Planning Program
Commissioner Lee reported that the Legislative Commission on Minnesota Resources is funding a
pilot Comprehensive Lake Planning program. Motion by Lee, second by Portmann, and
unanimously carried in support of Lake Lida being selected as a pilot lake for the western counties
as requested by the Lida Lake Property Owners Association conditioned upon no monetary
commitment from Otter Tail County.

At 1 :34 p.m., Chair Lindquist declared the meeting of the Otter Tail County Board of
Commissioners recessed until Tuesday, September 23, 1997 at 1 :00 p.m.
