HomeMy WebLinkAboutBoard of Commissioners - Minutes - 09/09/1997Q 0 Call to Order The Otter Tail County Human Services Board convened Tuesday, September 9, 1997 at 9:30 a.m. at the Otter Tail County Courthouse with Commissioners Syd Nelson, Vice-Chair; Andy Lindquist, Secretary; Malcolm Lee, and Virginia Portmann present. Human Services Chairman, Bill Stone, was absent. Approval of Minutes Motion by Lee, second by Portmann, and unanimously carried to approve the Human Services minutes of August 26, 1997 as presented. Approval of Agenda The Human Services Board approved the agenda of September 9, 1997 as presented with the following addition: Court Services Dog Bite Hearing Vice-Chair Nelson noted that additional information regarding the dog bite hearing held on August 26th was available. County Attorney, Wally Senyk, reviewed the facts heard at the August 26th hearing. Motion by Portmann, second by Lee, and unanimously carried to reopen this dog bite hearing for further testimony to hear additional and/or new evidence in this case. Hattie Shortsleeve ( owner of the dog named Sheeba), Harriet Stundahl, and Mr. & Mrs. Robert Carrison (parents of the injured child) were present. After being duly sworn in by the County Attorney, Robert Carrison, stated that on the day of the dog bite incident, his child had scooted out the door and into the neighbor's yard before he realized what had happened. He felt that the recent news article regarding this case was unfair. His children do not torment animals and he wouldn't allow that type of behavior. After being duly sworn in by the County Attorney, Mary Carrison stated her daughters have played and petted this dog (Sheba) in the past, however, have never tormented the animal or thrown anything at the animal. The County Attorney then, under oath, conveyed a conversation based on a telephone call he had received from a mail carrier regarding this dog. While Fergus Falls mail carrier, David Grimm, delivered mail to 328 East Vernon, this dog had charged to the end of its chain quite often to reach him. One day, the dog wasn't chained and charged him aggressively. He was fearful, utilized his mace spray to deter the dog, someone called the dog from the back yard and the dog went to the back yard. Ms. Shortsleeve stated that she has kept the dog chained on the opposite side of the house than previous to the dog bite incident on a fairly short leash. Testimony concluded at 10:04 a.m. Mr. Senyk noted that the Board must decide whether or not this dog is a danger to the public, then written findings must be prepared within 15 days from today's hearing. A copy of the findings will be sent to Ms. Shortsleeve and ·Mr. & Mrs. Carrison. Motion by Lee, second by Portmann, and unanimously carried to delay a decision in this case for one week until the next County Board meeting on September 16, 1997. West Central Regional Juvenile Center Court Services Director, Chuck Kitzman, provided WCRJC budget and program handouts. Otter Tail County Board of Commissioners September 9, I 997 Page 2 FY98 and FY99 Temporary Hold Contract Motion by Portmann, second by Lindquist, and unanimously carried to authorize the appropriate county officials' signatures to execute the FYl 998 -99 Temporary Hold Contract between Otter Tail County and the f'i·· State of Minnesota Department of Corrections, in the amount of $11,842, to fund the County's Temporary W Hold Program. FY98 CASELOAD/WORKLOAD REDUCTION GRANT FUNDS Mr. Kitzman presented a Caseload/Workload Reduction FY98 Activity Plan handout. He explained that additional caseload reduction funds are available to fund a new support staff position. The Department of Corrections has tentatively accepted the proposed plan for this new position. Additionally, Mr. Kitzman presented a proposed plan for temporary workspace for this additional staff position. Motion by Portmann, second by Lee, and carried, with Lindquist abstaining, to authorize the acceptance of the Court Services Director's proposal as submitted for an additional support staff position contingent upon funding from the MnDOC and acceptance of a temporary space plan by the County's Building Committee and Budget Committee. Bills & Claims Motion by Lindquist, second by Lee, and unanimously carried to approve the Human Services bills and claims as presented. Family Services Collaborative Frances Eggen, Family Services Collaborative Coordinator, briefed the board on the "Welfare to Work" project. The implementation grant for this project is the next step with October 15, 1997 as the deadline to submit the grant for startup in January, 1998. The idea for startup January 1, 1998 is that this would coincide r'\ with the effective date of the new welfare laws. Discussion followed regarding the welfare program and v,,,/ other youth programs. Long Term Care Rates Minnesota Social Services Association Dues Tom Fawcett, Social Services Director, provided a summary of monthly long term care rates effective July 1, 1997. Motion by Lindquist, second by Lee, and unanimously carried to authorize $955 for seven memberships to the Minnesota Social Services Association for 1998. The motion authorized the Social Services Director to select the 1998 delegates. Candlelight Vigil Motion by Partmann, second by Lee, and unanimously carried to approve the use of the courthouse for a Region IV Council on Domestic Violence Candlelight Vigil on Thursday, October 9, 1997 at 7:00 p.m. County-Based Purchasing Diane Thorson, Public Health Director, updated the board regarding county-based purchasing. The preliminary plan has been submitted to the DHS. Otter Tail County has mailed a Request for Proposal for quotes for two phases of the CBP: 1) quotation for completion of final plan from January, 1998 through June, 1998, and 2) quotation (if final plan is approved) to implement the plan through January, 1999. Commissioner Bill Stone was absent. Approval of Agenda Motion by Lee, second by Portmann, and unanimously carried to approve the County Board agenda of September 9, 1997 with the following additions: 2:30 p.m. -Land & Resource Director, Bill Kalar 2:40 p.m. -Ditch Inspector, Tiny Holm Motion by Lee, second by Nelson, September 2, 1997 as submitted. Approval of Minutes and unanimously carried to approve the County Board minutes of CSAHNo. 74 Amor Township Supervisor, Mike Holstrom, addressed the board with several concerns regarding the proposed highway plan for CSAH No. 74 which runs through the village of Amor; I) impact of the proposed curb and gutter, 2) impact of widening the road, 3) tree removal, and 4) possibility of bypassing the village. Highway Engineer, Rick West, responded that the proposed plan would minimize impact on the village and minimize the number of trees that will be removed. The county's plan is within the right-of-way and does not·propose purchasing additional land. These items were·discussed at the most recent public information meeting regarding this proposed road project. Commissioner Lindquist called for further comments from the public. Robert Kennard, owner of property adjacent to the cemetery, spoke in favor of the proposed construction plan of CSAH No. 74. Wendy Fogard spoke in opposition of the proposed project because of the impact of removing trees. She suggested that the township could take over the present road traveling through Amor and a bypass could be constructed west of the present location. Jay Johnson spoke in opposition of the proposed plan because of traffic concerns. 0 Robert Bjorgaard, spoke in favor of the proposed plan and referred to the new road that runs through Richville as an example. Otter Tail County Board of Commissioners September 9, 1997 Page 4 Dennis Hite spoke in favor of the plan and is strongly opposed to a bypass. The traffic is essential to his woodworking business. Chairman Lindquist stated that this is a 3.3 mile project with a proposed cost of $730,000. A petition had been presented in 1991 requesting improvements in the roadway, Two public information meetings have been held and the design work is 99% complete. The decision is to either go forward with the proposed project or put the project "on hold", Commissioner Lindquist requested a show of hands from the public in favor of moving forward with the proposed plan and also, a show of hands in favor of not going ahead with the plan. There were 6 in favor and O opposed. Upon a majority vote in favor of the proposed plan, a motion was offered by Partmann, seconded by Lee, and unanimously carried to approve the current proposed design and construction plan for CSAH No, 74, Adoption of Preliminary Budget and Levy Otter Tail County Resolution No. 97-49 Auditor, Wayne Stein, reviewed and discussed the preliminary budget process. WHEREAS, the Otter Tail County Budget Committee has held numerous committee meetings to consider and discuss the 1998 budget request and tax levy information. BE IT RESOLVED, by the Otter Tail County Board of Commissioners of Otter Tail County, Minnesota, that o-:: 0 The amount of 15,533,390 be adopted as the County's proposed gross tax capacity based levy for the payable Q year 1998 representing an 8, 75% increase over the gross property tax capacity based levy for the payable . , year 1997 and that the amount of 12,681,542 be adopted as the County's proposed net tax capacity based property tax levy for the payable year 1998 representing a 7.10% increase over the net tax capacity based property tax levy for the payable year I 997. Anderson, Registered Land Surveyor (Attachment C). Highway Maintenance Unit Contract Motion by Portmann, second by Lee, and unanimously carried to authorize the Chair's signature to execute a labor agreement between·Otter Tail County and the American .. Federation of State, County, and Municipal Employees, AFL-CIO, Local Union No. 1830 effective from January I, 1997 through December 31, 1999. Minnesota Work Plan -Department of Ag Motion by Lee, second by Portmann, and unanimously carried to approve the East and West Otter Tail County FY1998 Work Plan with the Minnesota Department of Agriculture as presented by the Land & Resource Director. Ditch Report Ditch Inspector, Tiny Holm, updated board members regarding Ditch Nos. 21, 63, 37, and 41. Discussion followed.
