HomeMy WebLinkAboutBoard of Commissioners - Minutes - 08/26/1997' 0 a Call to Order The Otter Tail County Human Services Board convened Tuesday, August 26, 1997 at 9:30 a.m. at the Otter Tail County Courthouse with Commissioners Bill Stone, Chairman; Syd Nelson, Vice- Chair, Andy Lindquist, Secretary, Malcolm Lee, and Virginia Portmann present. Approval of Agenda Motion by Lee, second by Nelson, and unanimously carried to approve the Human Services agenda of August 26, 1997 as presented. Approval of Minutes Motion by Portmann, second by Nelson, and unanimously carried to approve the Human Services minutes of August 12, 1997 as presented. Family Services Collaborative Report Public Health Director, Diane Thorson, briefed board members regarding the McKnight Initiative Planning Group meeting. The group will be holding additional meetings in area communities and obtain information for submitting an application to the McKnight Foundation. Ms. Thorson reported a lack of understanding regarding welfare reform/changes. She noted that the commissioners would receive a summary report regarding the progress of this collaborative group. Dog Bite Hearing The County Attorney briefed the individuals present regarding the provisions of the Otter Tail CountyHealth and Animal Control ordinance relative to dog bite(s) which result in bodily injury. Notice of this hearing was previously provided. At 9:36 a.m., after being duly sworn in by the County Attorney, Public Health Nurse Phyllis Knutson, gave testimony regarding a dog bite incident on July 16,.1997 at 517 West Cavour in Fergus Falls. Ms. Knutson testified that she received a report from the ER before a three-year-old boy, Dale Carrison, had surgery as a result of this dog bite incident. Stitches were required on the boy's face. Pictures were submitted. After being duly sworn in by the County Attorney, Hattie Shortsleeve, owner of a German Shepherd (Sheba) that inflicted the injury gave testimony regarding the incident. After Hattie moved to 517 West Cavour, the children next door often came onto her property and threw things at the dog, steal the dog's toys, etc. She always keeps the dog chained and the chain does not extend past her property line(s). This is the first time Sheba has ever bitten anyone. "Beware of Dog" signs are posted on the front and the back of the house which are visible from the front street and the back alley. After being duly sworn in by the County Attorney, Harriet Stundahl, testified that Ms. Shortsleeve stayed with her at her home for two months and Sheba never displayed any type of aggressive behavior. At 10:06 a.m, upon conclusion of testimony, the County Attorney noted that a decision in this dog bite hearing will be made within two weeks and the findings will be issued in writing. Otter Tail County Board of Commissioners August 26, 1997 Page2 County Based Purchasing The Public Health Director provided board members with a draft copy of the County-Based - Purchasing Preliminary Proposal. Nancy O'Lou~hlin has been hired to pr~pare ~he preliminary Q plan and submit to the OHS along with a required resolution. Lengthy dIscussIon took place regarding total population of MA recipients, financial risk, claims processing, etc. County-Based Purchasing Preliminary Plan Otter Tail County Resolution No. 97-43 UPON a motion by Partmann, seconded by Lee, and carried on a roll call vote as follows, the Otter Tail County Board of Commissioners adopts the following resolution: Commissioner Partmann Lee Nelson Lindquist Stone Yea X X X X X WHEREAS, the following facts support this resolution to implement a county-based purchasing plan: 1. Minnesota Statutes 256B.692, Subd. 1, authorizes County Boards to purchase or provide health care services on behalf of persons eligible for medical assistance and general Q assistance medical care who would otherwise be required to or may elect to participate in the pre- paid medical assistance or pre-paid general assistance medical care programs. 2. Minnesota Statutes 256B.692, Subd. 5, requires that a County Board that wishes to purchase or provide such health care services must submit a preliminary proposal, on or before September 1, 1997, that substantially demonstrates the county's ability to meet all the identified requirements, and to submit a final proposal on or before July 1, 1998, that demonstrates an ability to begin enrollment ofrecipients on January 1, 1999. 3. The Otter Tail County Board of Commissioners has conducted meetings of health care providers in Otter Tail County and received input regarding county-based purchasing and the pre- paid medical assistance program. 4. There are a significant number of health care providers who have encouraged the County Board to pursue county-based purchasing in order to address issues of choice of provider and convenience of access to health care services for Otter Tail County residents under the pre- paid medical assistance program. 5. If the County Board does not submit a preliminary proposal by September 1, 1997, then it may require two years to switch from a pre-paid medical assistance program to county-based purchasing. NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners does hereby declare its intent to develop and implement a county-based purchasing plan and enroll eligible recipients not later than January 1, 1999. 0 0 0 Otter Tail County Board of Commissioners August 26, 1997 Page 3 BE IT FURTHER RESOLVED, that on or before September 1, 1997, Otter Tail County shall submit to the Commissioner of Human Services a preliminary proposal that substantially demonstrates the county's ability to meet all the requirements for county-based purchasing. Financial Statement The Social Services Director provided the July financial statement for Social Services funds. Children's MH Plan Certification and Agreement Motion by Lee, second by Portmann, and unanimously carried to authorize the Chair's signature to execute the Children's MH Plan Certificate and Agreement. Provider Agreement The County Attorney briefed the board regarding recommended contract language revisions for a provider agreement between Health Partners, Inc. and the Otter Tail County Public Health Department. This agreement includes home health care services, Child & Teen Checkups, and maternal child health counseling. Motion by Portmann, second by Lee, and unanimously carried to authorize appropriate county official's signatures to-execute a provider agreement between Health Partners, Inc. and the Otter Tail County Department of Public Health subject to final approval of the language revisions as described by the County Attorney. Approval of Peleske Group Home Agreement Motion by Nelson, second by Lee, and unanimously carried to authorize the Chair's signature to execute an agreement between the Peleske Group Home and Otter Tail County that reduces the licensing for the group home from eight to six clients. Support of Proposed DNR Facility Otter Tail County Resolution No. 97-46 Upon a motion by Nelson, seconded by Partmann, and carried, the Otter Tail County Board of Commissioners adopts the following resolution: WHEREAS, the Otter Tail County Board of Commissioners finds that the following facts support this resolution: 1. The proposed DNR Area Offices will be constructed with State of Minnesota funding, at no cost to the County of Otter Tail. NOW, THEREFORE, BE IT RESOLVED that the Otter Tail County Board of Commissioners hereby supports the capitol bonding request of the Minnesota Department of Natural Resources for the 2.7 million dollars necessary to design and construct a new Fergus Falls area DNR office and storage building. BE IT FURTHER RESOLVED that copies of this resolution shall be sent to all legislators representing residents of Otter Tail County, to the Commissioner of Natural Resources and to Governor Arne Carlson. Certificate of Correction to Plat Evanders Beach and First Addition to Augustana Beach Motion by Lee, second by Partmann, and unanimously carried to accept Attachment A as identified as a Land Surveyor's Certificate of Correction to the Plat of Resurvey and Addition to Evanders Beach as prepared by David A. Anderson, Registered Land Surveyor, pursuant to the provision of Minnesota Statute Chapter 505.175. Motion by Stone, second by Nelson, and unanimously carried to accept Attachment B as identified as a Land Surveyor's Certificate of Correction to the Plat of First Addition to Augustana Beach as prepared by Terry Lee Anderson, Registered Land Surveyor, pursuant to the provision of Minnesota Statute, Chapter 505.173 through 505.177. Property Tax Discussion · ·Auditor, Wayne Stein, reported that the State Department of Revenue does not have a separate levy available for separate improvement districts. Under the law, the county must approve the their budget under 4.6% levy increase. The Pelican Group of Lakes Improvement District is requesting a $20,000 budget increase. This increase cannot be a special levy. Chairman Lindquist directed the Auditor to set-up a meeting with the county Budget Committee and representatives of the Pelican Group of Lakes Improvement District. Highway Projects Update The Highway Engineer provided a highway construction and design project handout. Speed Zone Study Request Resolution -A Segment of CSAH No. 35 Otter Tail County Resolution No. 97-44 Upon a motion by Partmann, second by Lee, and unanimously carried, the Otter Tail County Board of Commissioners adopts the following resolution: WHEREAS, the County of Otter Tail has requested that action be taken as necessary in order to pursue a reduced speed limit from 35 mph to 30 mph on the segment of County State Aid Highway No. 35 from a point 500 feet West of the drainage structure between North and South Ten Mile Lakes, easterly to a point 2000 feet East of the drainage structure AND '-.) WHEREAS, the County of Otter Tail believes that a speed zone would be beneficial in this area. Otter Tail County Board of Commissioners August 26, 1997 Page6 NOW, THEREFORE, BE IT RESOLVED, that Otter Tail County does hereby request that the area be studied by the Minnesota Department of Transportation to determine the need for a reduced speed, if any. 0 BE IT ALSO RESOLVED, that Minnesota Department of Transportation proceed with establishing a legal speed zone if the findings of the traffic study are supportive. Girl< Sale of Used John Deere Tractor Q Highway Engineer, Rick West, reported that Mr. Jim Aakre had previously bid $2,179 for a 1964 John Deere Tractor with mower. The bid bond was returned to Mr. Aakre at the time of payment for the tractor, however, Mr. Aakre stopped payment on the check and did not pick up the tractor. General consensus of the County Board is to offer this 1964 John Deere 1010 Tractor and Mower (serial# 50520) for sale at the city/county auction in May, 1998. 1998 Trail Assistance Program for Snowmobile Trails Motion by Lee, second by Partmann, and unanimously carried to authorize the Chair's signature to execute the following 1998 Trail Assistance Program/Grant Agreements for snowmobile trails subject to the approval of the County Attorney: Lake Runners-ErhardNergas Trails -$6,300 Otter Trail Riders Trails -$23,500 O.C.T.A. -Central Lakes/Underwood Trails -$4,200 Recycling Canister Agreement Motion by Partmann, second by Lee, and unanimously carried to authorize the Chair's signature to execute an agreement between the County of Otter Tail and the Fergus Falls WalMart to provide a Recycling Canister in the WalMart parking lot. Parking Space Lease Agreement Motion by Lee, second by Partmann, and unanimously carried to authorize the Chair's signature to execute a five year Parking Space Lease Agreement between First Lutheran Church and the County of Otter Tail. The agreement provides 45 parking spaces for Otter Tail County at an annual rental cost of $10,480 per year. This figure includes all maintenance and snow removal costs. Senior Nutrition Program Report Commissioner Bill Stone reported that the bid from LSS for the seniors nutrition program was not accepted because bid specifications were not met. Additionally, the Evaluation Committee and Advisory Committee recommended the bid be turned down. Mr. Stone stressed that there will be a provider for this program and other bids will be requested. Bob Anderson, member of the Senior Nutrition Council with LSS, spoke briefly and requested that the WCAAA Board reverse its action and accept the LSS bid as LSS was the only bidder.
