HomeMy WebLinkAboutBoard of Commissioners - Minutes - 08/19/19970 Call to Order The Otter Tail County Board of Commissioners convened Tuesday, August 19, 1997 at 9:30 a.m. at the Otter Tail County Courthouse with Commissioners Andy Lindquist, Chair; Syd Nelson, Bill Stone, Malcolm Lee, and Virginia Portmann present. Approval of Agenda Motion by Lee, second by · Portmann, and unanimously carried to approve the agenda of August 19, 1997 as presented with the following changes: Auditor, Wayne Stein, (Tax Levy Discussion)-Canceled at 10:35 a.m. Solid Waste Director, Mike Hanan -Added at 10:35 a.m. Approval of Minutes Motion by Stone, second by Nelson, and unanimously carried to approve the County Board minutes of July 12, 1997 as presented. E-911/GIS Update GIS Coordinator, Bob Block, introduced discussion of the progress of the E-911/GIS project. A sample aerial photo was provided with an explanation of the process of verifying every locatable structure. These maps are reviewed and sent to townships and cities for road naming. The project is currently at this stage. When the maps are returned from the townships and cities after road naming is complete in their respective areas, the maps are sent to Pro-West for digitizing. -Brian Armstrong showed a map of the new emergency territories for E-911 services. Service contracts in some areas are complete. Several ambulance services are continuing discussion regarding the Ashby and Fergus Falls locations, however, rezoning is progressing and most people are in favor of the rezoning. Sherry Leabo is working with municipalities. She has requested that each city send a utility data base and/or an alphabetized list of residences. These lists are tied together with the county's data. Tag sheets are developed which correspond to the numbers on the map, then sent to Pro- West to digitize the data. Ms. Leabo stated that the Enhanced 911 notification will be sent with the Enhanced 911 address, however, the postal address will not change at that time. County residents may have an E-911 address and a postal address at the time of implementation. Eventually, the addresses will be the same. Additionally, Ms. Leabo noted efforts to keep data regarding new construction and individuals moving as current as possible. Mr. Armstrong briefed the board regarding options to purchase differential GPS. Discussion followed. Corporate Authorization Motion by Portmann, second by Lee, and unanimously carried to authorize the Chair's signature to execute the Corporate Authorization Resolution for the Battle Lake Solid Waste bank account. Otter Tail County Board of Commissioners August 19, 1997 Page 2 U.S. Fish & Wildlife -Wetland Easements Motion by Lee, second by Partmann, and unanimously carried to certify the acquisition of wetland easements by the U.S. Fish and Wildlife Service as follows: T.. 132 N .• R. 42 W .• 5th P.M. Section 16, that part of the SW¼ NW¼ described as follows: Commencing at the Northwest corner of said Section 16; thence South 01°44'58" West (Assumed Bearing) along the West line of said Section 16 a distance of 1923.71 feet to the point of beginning; thence South 88°45'54" East a distance of 780.60 feet; thence South 01°44'58" West a distance of 724.08 feet to the East-West Quarter Section Line of said Section 16; thence North 89°45'54" West along said East-West Quarter Section Line a distance of 780.87 feet to the West Quarter Section corner of said Section 16; thence North 01°44'58" East along the West Line of said Section 16 a distance of 744.72 feet to the point of beginning. Prepaid Yellow Bags Solid Waste Director, Mike Hanan. reported, as previously requested, on the statistics of the sales of prepaid yellow garbage bags. There are three garbage haulers using the prepaid garbage bag system. Primarily, the problems stem from the bags sold by Northern Waste. Northern Waste sells bags in 10 cities in 23 different stores. To date. in 1997. they have sold 7.995 bags. Mr. Hanan reported he receives approximately 20 complaints each summer, which is not a large percentage compared to total numbers of bags sold. Discussion followed regarding possible options to ensure that people that purchase these bags know where Northern Waste·s routes are and follow the proper procedures for the collection of this garbage. Chairman Lindquist directed that Commissioner Stone and the Solid. Waste Director present this problem to John Madison, President of the Coalition of Lakeshore Associations and request that the various Lakeshore Associations assist in a solution since many of the users of these bags are seasonal residents. Recess & Reconvene At 10:51 a.m., Chairman Lindquist declared the meeting of the Otter Tail County Board of Commissioners recessed until 1 :00 p.m. At 1 :01 p.m., Chair Lindquist declared the Otter Tail County Board of Commissioners' meeting reconvened. Appointment-HRA Board Q 0 Motion by Nelson, second by Stone, and unanimously carried to appoint Art Schwartz of New York Mills as first district representative to the Housing & Redevelopment Authority Board effective Q immediately to replace the term of Reba Lee. . ... 0 MRCC DISCUSSION Otter Tail County Board of Commissioners August 19, 1997 Page 3 Commissioner Partmann and Commissioner Stone briefed board members on the recent report/update of the MRCC. Lengthy discussion followed. Minnesota Rural Counties Caucus Otter Tail County Resolution No. 97-42 Motion by Partmann, second by Stone, and unanimously carried to approve membership in the MRCC for 1997 at a membership fee of $500 and to adopt the following MRCC resolution with Commissioner Nelson appointed as the county's delegate: WHEREAS, the Minnesota Rural Counties Caucus (MRCC) is an organization dedicated to the enhancement and unification of rural counties and; WHEREAS, the MRCC will work within the caucus system established under Association of Minnesota County (AMC) caucus guidelines and; WHEREAS, it is good for Minnesota rural counties to have a forum within the AMC caucus system to discuss issues important to rural counties and; WHEREAS, rural Minnesota counties need to form a strong and cohesive network of communication singularly devoted to the issues important to rural counties and; WHEREAS, Minnesota rural counties need a strong and distinctive presence wherever policies Q affecting rural counties are being discussed. NOW, THEREFORE, BE IT RESOLVED that Otter Tail County, by means of this resolution, hereby supports the efforts of the MRCC, and joins its ranks as a member in good standing. Recess & Reconvene Chairman Lindquist declared the meeting of the Otter Tail County Board of Commissioners recessed at 1 :22 p.m. and reconvened the meeting at 1 :30 p.m. Approval to Pay Bills Motion by Stone, second by Lee, and unanimously carried to approve the bills and claims per Attachment A of these minutes. Otter Tail County Board of Commissioners August 19, 1997 Page4 Planning Commission Recommendations Conditional Use Permit -Walt Schmidt/Beatrice Richardson: • 1 Land & Resource Director, Bill Kalar, reported that this Conditional Use Permit request is an after-Q the-fact request for a tubing business. Mr. Kalar noted that the permit request was approved by the Planning Commission with the condition that private access to the river is obtained for the tubers. A letter received from Delores and Larry Johnson was presented. The letter stated concern about this business and concern regarding the fact that Johnson's CUP allows only one 4x4 sign while Mr. Schmidt has large signs all over his property. Motion by Portmann, second by Lee, and unanimously carried to approve the Conditional Use Permit for Walt Schmidt/Beatrice Richardson (Section 1, Twp. 133, R. 41, Otter Tail River) with conditions as recommended by the Planning Commission and subject to the same restrictions regarding signage that Mr. Larry Johnson's (neighboring tubing business) CUP allows. Conditional Use Permit -Eric Canfield: Motion by Nelson, second by Stone, and unanimously carried to approve the Conditional Use Permit of Eric Canfield (Section 29 & 30, Twp. 136, R. 40, McDonald Lake) with conditions as recommended by the Planning Commission. Preliminary Plat -"West Otter Shores": Mr. Kalar presented a preliminary plat of "West Otter Shores". Mr. Kalar recommended the following clarification: The Preliminary Plat indicates Lot 3, Block 1, is not intended for building purposes, however, this should read Lot 1, Block 1, since Lot 1, Block 1, does not have sufficient size for building purposes. Motion by Lee, second by Portmann, and unanimously carried to approve the Preliminary Plat of "West Otter Shores" (Section 31, of Candor Township, Otter Lake) as presented with the above clarification. Conditional Use Permit -Gloria Bates/Russell Thompson: Motion by Stone, second by Partmann, and unanimously carried to deny the Conditional Use Permit of Gloria Bates/Richard Thompson (Section 33, Twp. 133, R. 40, Unnamed Lake) as recommended by the Planning Commission. Motion by Lee, second by Partmann, and unanimously carried to authorize the Land & Resource Director to request that the DNR review this lake for possible reclassification of this body of water. Conditional Use Permit-Sharma Family Trust: Motion by Stone, second by Nelson, and unanimously carried to approve the Conditional Use Permit of Sharma Family Trust (Section 10, Twp. 134, R. 41, Pickerel Lake) with conditions as recommended by the Planning Commission. Conditional Use Permit -Earl Trosvik/Dean Bentz: Motion by Lee, second Partmann, and unanimously carried to approve the Conditional Use Permit of Earl Trosvik/Dean Bentz (Section 31, Twp. 137, R. 42, Lake Lizzie) as presented. 0 Conditional Use Permit -Robert Narveson/Woodlawn Resort: Q Motion by Partmann, second by Lee, and unanimously carried to approve the Conditional Use Permit of Robert Narveson/Woodlawn Resort (Section 6, Twp. 133, R. 39, Blanche Lake) as presented. 0 0 0 Sewage System Abatement List Otter Tail County Board of Commissioners August 19, 1997 Page 5 Mr. Kalar reported receipt of a letter from Dan Malmstrom, President of the West Battle Lake Association, requesting that West Battle Lake be placed on the county's sewage system survey list. Motion by Lee, second by Partmann, and unanimously carried to add West Battle Lake to the on-site sewage system abatement list and notify the association that the county will complete this as time permits. Local Water Plan The Land & Resource Director provided a handout from the BWSR showing the preliminary payable 1998 county levies for comprehensive local water implementation activities. Otter Tail County's is listed as $23,439 with a county match of $14,061.
