HomeMy WebLinkAboutBoard of Commissioners - Minutes - 08/05/19970 0 Call to Order The Otter Tail County Board of Commissioners convened Tuesday, August 5, 1997 at 9:34 a.m. at the Otter Tail County Courthouse with Commissioners Andy Lindquist, Chair; Syd Nelson, Malcolm Lee, Bill Stone, and Virginia Portmann present. Approval of Agenda Motion by Lee, second by Portmann, and unanimously carried to approve the agenda of August 5, 1997 as presented with the following addition: Performance Evaluation Summary for Maintenance Supervisor, Rick Sytsma Approval of Minutes Motion by Lee, second by Nelson, and unanimously carried to approve the County Board minutes of July 22, 1997 as presented. U.S. Fish & Wildlife -Fee Purchase Request Don Kleven of the U. S. Fish and NYildlife Service presented a request for a proposed fee acquisition of land adjacent to the Prairie'Wellands Learning Center. Motion by Lindquist, second by Portmann, and unanimously carried to certify the acquisition of lands by the U.S. Fish and Wildlife Service as follows: Otter Tail County Agricultural Society and Fair Association, Inc. T. 132 N .• R. 43 W .• 5th P.M. Section 10, that part of E ½NE¼ described as follows: Beginning on the East line of said Section 1 O at a point located approximately 1,154.73 feet Southerly from the Northeast Section corner thereof and on the fenceline; thence westerly approximately 519 feet to a stake, thence northerly approximately 383 feet to a stake, thence southeasterly approximately 545 feet to a stake on the fenceline, thence southerly along said fenceline approximately 320 feet to the point of beginning. Section 11, that part of W ½ NW ¼ described as follows: Beginning on the West line of said Section 11 at a point located approximately 1,154.73 feet Southerly from the Northwest Section corner thereof and on the fenceline; thence Easterly approximately 420 feet to a stake on the fenceline, thence Northerly approximately 35 feet to a stake, thence Westerly approximately 450 feet to a stake on the fenceline, thence Southerly along said fenceline approximately 35 feet to the point of beginning. Correspondence Acknowledged Chairman Lindquist acknowledged the following correspondence: Otter Tail County Board of Commissioners August 5, 1997 Page 2 A letter sent to the cities within Otter Tail County regarding the countywide housing study. A meeting will be held August 18, 1997 at the Ottertail City Community Center at 7:00 p.m. regarding the housing study. 0 A letter from Representative Bud Nornes regarding the proposed turkey feedlot near Maplewood State Park. A letter from Phelps Mill Festival Manager, Teresa Brause, thanking the County Board for their continued support of the Phelps Mill Festival and a receipt, in the amount of $630, for tree planting in fulfillment of a contract between the County and Festival Committee. A letter from T. Patrick Clune in appreciation of the maintenance of the Phelps Mill Park. Snowmobile Trail Agreements Motion by Lee, second by Portmann, and unanimously carried to authorize the Chair's signature to execute the following Minnesota Trail Assistance Program Agreements for snowmobile trail maintenance subject to the approval of the County Attorney as follows: O.C.T.A. Lake Runners $20,500.00 $ 8,500.00 Final Plat-"Canterbury Sands" Motion by Lee, second by Partmann, and unanimously carried to approve the following final plat "Canterbury Sands", (Sec. 28, Twp.~, R. 40, Silver Lake) ,n, "'i ,,~11q1 Discussion of Daily Journal Article Chairman Lindquist requested information regarding the recent article that appeared in the Daily Journal regarding a possible manure spillage into Otter Tail Lake. Discussion followed. The Land & Resource Director reported that the MPCA has been notified. The Chairman directed Mr. Kalar to research the issue and report back to the board. Letter of Intent to File Mandamus Petition The County Attorney acknowledged receipt of a letter from several individuals regarding an Intent to file a Mandamus Petition. Mr. Senyk reported that a previous letter had been received from the same individuals as a result of the county's practice of approving septic sytems for installation closer to the lake than setback requirements of the Sanitation Code would otherwise require, absent a variance from the Board of Adjustment. With approval of the DNR, Otter Tail County had been varying .lake setback when there was no alternative. That practice was terminated and the County Board directed that the Board of Adjustment must deal with these situations. Concern was also expressed that the Board of Adjustment reviews applications for variance without complying 0 with the technical requirements of the ordinance for detailed drawings. Mr. Senyk met with the individuals and explained that the Board of Adjustment and/or the Planning Commission have the authority to waive the detailed surveys if the surveys are considered unnecessary. The County Board requested that the County Attorney respond in writing regarding these concerns to the - individuals who have signed the letter. The Chairman requested that the letter include the fact that 0 the County Commissioners are not members of the Board of Adjustment and further, the County Board does not issue variances. Commissioner Lee noted that the County Board's jurisdiction over the Board of Adjustment is limited to appointment only. The Chairman stated that this issue 0 0 Otter Tail County Board of Commissioners August 5, 1997 Page 3 is a result of a variance request on Dead Lake, whereby a property owner (Mr. Baribeau) applied for a variance to construct a dwelling unit in-line with the neighbors' dwellings. More recently, Mr. Baribeau has applied for a variance for septic system installation of an on-site sewage treatment system. His system would be setback approximately the same distance as his neighbors. Proposed Turkey Feedlot Buzz Lundeen, representing Otter Tail County Common Sense Land Use Coalition, presented a petition containing 250 signatures in opposition of the location of the proposed turkey feedlot. Mr. Lundeen noted that the coalition has obtained a total of 1,400 signatures. Mr. Lundeen thanked the county for the 30-day delay and spoke of preventing future attempts to build feedlots near state parks in Minnesota. Discussion followed. The Chairman's opinion of how to handle the countywide land use issue is to develop a citizen's advisory group of 20-25 people to obtain broad citizen input. When the study is complete, public information meetings will be held with the best estimate of the cost associated with countywide zoning. After the information is given to the people, the voters would decide the issue during the '98 election. All commissioners agreed with this concept. Commissioner Lee. suggested that the · group include an individual from the EQT Township Association and the WOT Township Association and recommended that copies of good ordinances from other counties be read and shared. Performance Evaluation Summary Motion by Lee, second by Nelson, and unanimously carried to approve the favorable performance evaluation summary of Maintenance Supervisor, Rick Sytsma as presented and authorized placing the summary in his personnel records. Closed to the Public At 10:45 a.m., upon a motion by Portmann, seconded by Stone, and unanimously carried, the meeting of the Otter Tail County Board of Commissioners was closed to the public for the purpose of evaluating the performance of Social Services Director, Tom Fawcett; pursuant to M.S. 471.705 Subd. 1d (d). A summary report of performance conclusions will be provided at the next regular board meeting. At 11 :25 a.m., upon conclusion of the closed session, Chair Lindquist declared the meeting recessed for lunch break. Reconvene Approval to Pay Bills At 1 :00 p.m., · Chair Lindquist declared the meeting of the Otter Tail County Board of Commissioners reconvened. Motion by Stone, second by Nelson, and unanimously carried· to · approve the bills per Attachment A of these minutes which includes the following lodging payments: Best Western Thunderbird Hotel Canterbury Inn Days Inn · Holiday Inn, Wilmar Solid Waste Public Information Officer, Marie Tysdal GIS Employees, Sherry Leabo & Brian Armstrong Court Administrator, Kathy Ouren Juvenile Temporary Hold Attendants: Joe Cox, David Muchow, Vicki Hanson, Shirley Biederman, Patricia Douglas, Tracy Rendz, & Darlane Miller. Otter Tail County Board of Commissioners August 5, 1997 Page4 E-911 Wireless Regulations Chief Deputy, Mark Morris, reported that due to the death of Engineer, John DuBois, the outstanding obligations of the communications contract will be closed. Mr. Morris will offer a recommendation for a new engineer for the E-911 communication work at a later date. Q Discussion -Yellow Refuse Bags Commissioner Stone reported that he has received complaints from citizens living west of Vining regarding garbage put out in yellow bags that are not picked up. Mike Hanan, Solid Waste Director, reported that this is a problem at times because Northern Waste (sellers of the yellow bags) do not pick up in this area or north of Clitherall. Mr. Hanan reported that this is one method of collecting waste and works well in some areas if the bags are set out at the right time on the correct routes. Commissioner Partmann questioned how many yellow bags are sold and how many become a problem? The Solid Waste Director and Commissioner Stone will research this issue further and report back to the board in two weeks. Liquor License Applications Motion by Partmann, second by Lee, and unanimously carried to approve the following applications for license: Linden Park On/Off-Sale 3.2 Malt Liquor License Janet Judd Subject to the approval of the County Attorneys' office, the County Sheriffs office and to the submission of an application form. Pier Hospitality Corp. Landis Weaver PO Box 128 Ottertail, MN On-Sale Intoxicating Liquor License Tax Forfeited Land Wayne Stein, County Auditor, provided a packet of information to commissioners regarding tax- forfeited land in their respective district. 1998 Overall Levy Limit Mr. Stein provided levy limit information. The payable 1998 levy limitation for Otter Tail County is $11,560,480, Closure of CSAH No. 50 Motion by Stone, second by Nelson, and unanimously carried to approve the closure of one block of main street (CSAH No. 50) in the City of Deer Creek for the "Deer Trails Day Celebration" on August 16, 1997. This approval is subject to the approval of the Sheriffs office and that the county is held harmless relative to liability. Approval of CSAH No. 46 Contract-S.A.P. 56-646-05 0 Motion by Stone, second by Nelson, and unanimously carried to authorize the Chair's signature to execute a contract between the County of Otter Tail and Central Specialties, Inc. of Alexandria, Q MN, for Bituminous Overlay of CSAH No. 46, S.A.P. No. 56-646-05. .. 0 Speed Signs -Ten Mile Lake Otter Tail County Board of Commissioners August 5, 1997 Page 5 Commissioner Partmann questioned why speed zone signs on CSAH No. 35 by Ten Mile Lake are 30 mph and right behind these speed signs, others are posted 35 mph. The Highway Engineer explained that the 30 mph signs are advisory speed only, the State of Minnesota has authority over the actual speed limit. Motion by Partmann, second by Lee, to request the MnDOT to complete a speed zone study at the request of residents of Ten Mile Lake to reduce the speed limit from 35 mph to 30 mph on a portion of CSAH No. 35. The Chair called for a roll call vote as follows: Commissioner Yea Nay Nelson X Lee X Lindquist X Stone X Partmann X Motion carried. The Highway Engineer will report back to the board with the speed zone results. True County Assessor System Assessor, Bob Moe, presented a draft resolution implementing a true county assessor system. General consensus of the board is to request the County Assessor to send a letter to every city 0 and township explaining the system and report back to the board in one month. Adjournment At 1 :50 p.m., Chair Lindquist declared the meeting of the Otter Commissioners adjourned until 1 :00 p.m. on Tuesday, August 12, 1997.
